1313 2commissionshallconsistof[sixmembers] onememberfromeachcongressionaldistrict,
1414 3whoshallbeappointedbythegovernor[, byandwiththeadviceandconsentofthesenate,] as
1515 4providedundersubsection6ofthissection,withnotmorethan[three] halfthereoftobe
1616 5membersofthesamepoliticalparty.Intheeventamemberofthecommissionisfoundby
1717 6unanimousvoteoftheothercommissionerstohavemovedsuchcommissioner's
1818 7residencefromthecongressionaldistrictfromwhichsuchcommissionerwasappointed,

2020 9commissionershallbeataxpayerandresidentofstateforatleastfiveyearspriortohis
2121 10appointment.Anycommissionermayberemovedbythegovernoriffullysatisfiedofhis
2222 11inefficiency,neglectofduty,ormisconductinoffice.Anycommissionershallberemoved
2323 12bythegovernoruponanaffirmativevotebytwo-thirdsofthehouseofrepresentatives
2424 13andtwo-thirdsofthesenatetoremovesuchcommissioner.Commissionersappointed
2525 14pursuanttothissectionshallbeappointedfortermsofsixyears,exceptasotherwiseprovided
2626 15inthissubsection.Upontheexpirationofeachoftheforegoingtermsofthesecommissioners
2727 16asuccessorshallbeappointedforatermofsixyearsoruntilhissuccessorisappointedand

4646 34March1,2005.Thecommissionshallelectoneofthemembersaschairandtheotherasvice
4747 35chair.EffectiveMarch1,2005,thecommissionshallelectthetwomembersofthe
4848 36commission,onefromeachopposingpoliticalpartywhohasthemostseniorityin
4949 37commissionservice,whoshallserveascommissionleadershipwithonememberaschairand
5050 38theothermemberasvicechair,respectively,foroneyear.Attheendofsuchyear,the
5151 39memberscurrentlyservingaschairandvicechairshallhavetheoptiontorotatepositions,

5656 44leadershipofficesbecomesvacantduetodeath,resignation,removal,or[refuses] refusalto
5757 45servebeforetheone-yearleadershiptermexpires,thecommissionshallelectoneofits
5858 46membersthatisofthesamepoliticalpartyasthevacatingofficertoservetheremainderof
5959 47thevacatingofficer'sleadershipterm.Suchelectionshallnotprohibitthatmemberfromlater
6060 48servingaschairandvicechairwhensuchmember'sseniorityincommissionservicequalifies

6262 50 3.Nomorethanone-halfofthemembersofthecommissionshallbeofthesame
6363 51politicalparty.Theselectionandremovalofallemployeesofthedepartmentof
6464 52transportationshallbewithoutregardtopoliticalaffiliation.
6565 53 4.Thepresentmembersofthecommissionshallcontinuetoserveasmembersofthe
6666 54commissionfortheremainderofthetermsforwhichtheywereappointed,exceptasprovided
