Torepealsection226.030,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
highwaysandtransportationcommission.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section226.030,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection226.030,toreadasfollows:
226.030.1.BeginningJanuary1,2024,thehighwaysandtransportation
2commissionshallconsistof[sixmembers] onememberfromeachcongressionaldistrict,
3whoshallbeappointedbythegovernor[, byandwiththeadviceandconsentofthesenate,] as
4providedundersubsection6ofthissection,withnotmorethan[three] halfthereoftobe
5membersofthesamepoliticalparty.Intheeventamemberofthecommissionisfoundby
6unanimousvoteoftheothercommissionerstohavemovedsuchcommissioner's
7residencefromthecongressionaldistrictfromwhichsuchcommissionerwasappointed,
8theofficeofsuchcommissionershallbeforfeitedandconsideredvacant.Each
9commissionershallbeataxpayerandresidentofstateforatleastfiveyearspriortohis
10appointment.Anycommissionermayberemovedbythegovernoriffullysatisfiedofhis
11inefficiency,neglectofduty,ormisconductinoffice.Anycommissionershallberemoved
12bythegovernoruponanaffirmativevotebytwo-thirdsofthehouseofrepresentatives
13andtwo-thirdsofthesenatetoremovesuchcommissioner.Commissionersappointed
14pursuanttothissectionshallbeappointedfortermsofsixyears,exceptasotherwiseprovided
15inthissubsection.Upontheexpirationofeachoftheforegoingtermsofthesecommissioners
16asuccessorshallbeappointedforatermofsixyearsoruntilhissuccessorisappointedand
17qualifiedwhichtermofsixyearsshallthereafterbethelengthoftermofeachmemberofthe
18commissionunlessremovedasaboveprovided.Themembersofthecommissionshall

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19receiveascompensationfortheirservicestwenty-fivedollarsperdayforthetimespentinthe
20performanceoftheirofficialduties,andalsotheirnecessarytravelingandotherexpenses
21incurredwhileactuallyengagedinthedischargeoftheirofficialduties.Memberswhose
22termsotherwiseexpireDecember1,2003,shallservewithtermsexpiringMarch1,2004,and
23newmembersorthemembersreappointedshallbeappointedfortermsexpiringMarch1,
242005;amemberwhosetermotherwiseexpiresDecember1,2005,shallservewithaterm
25expiringMarch1,2007;amemberwhosetermotherwiseexpiresDecember1,2007,shall
26servewithatermexpiringMarch1,2009;andonememberwhosetermotherwiseexpires
27October13,2007,shallservewithatermexpiringMarch1,2007;andonememberwhose
28termotherwiseexpiresOctober13,2007,shallservewithatermexpiringMarch1,2009.Ifa
29vacancyoccursinanytermofacommissionerduetodeath,resignation,orremoval,a
30successorshallbeappointedforonlytheremainderoftheunexpiredterm.
31 2.Thetwomembersofthecommission,oneeachfromopposingpoliticalparties,
32whohavethemostseniorityincommissionserviceshallserveascommissionleadershipwith
33onememberaschairandtheothermemberasvicechair,respectively,fortermsending
34March1,2005.Thecommissionshallelectoneofthemembersaschairandtheotherasvice
35chair.EffectiveMarch1,2005,thecommissionshallelectthetwomembersofthe
36commission,onefromeachopposingpoliticalpartywhohasthemostseniorityin
37commissionservice,whoshallserveascommissionleadershipwithonememberaschairand
38theothermemberasvicechair,respectively,foroneyear.Attheendofsuchyear,the
39memberscurrentlyservingaschairandvicechairshallhavetheoptiontorotatepositions,
40andthemembercurrentlyservingasvicechairmayserveaschair,andviceversa.Thereafter,
41commissionleadershipshallcontinuetorotateaccordinglywiththetwomembersfrom
42opposingpoliticalpartieswhohavethemostseniorityintermsofcommissionservicebeing
43electedbythecommissiontoserveascommissionleadership.Ifoneofthecommission
44leadershipofficesbecomesvacantduetodeath,resignation,removal,or[refuses] refusalto
45servebeforetheone-yearleadershiptermexpires,thecommissionshallelectoneofits
46membersthatisofthesamepoliticalpartyasthevacatingofficertoservetheremainderof
47thevacatingofficer'sleadershipterm.Suchelectionshallnotprohibitthatmemberfromlater
48servingaschairandvicechairwhensuchmember'sseniorityincommissionservicequalifies
49himorherforthoseofficesasprovidedinthissubsection.
50 3.Nomorethanone-halfofthemembersofthecommissionshallbeofthesame
51politicalparty.Theselectionandremovalofallemployeesofthedepartmentof
52transportationshallbewithoutregardtopoliticalaffiliation.
53 4.Thepresentmembersofthecommissionshallcontinuetoserveasmembersofthe
54commissionfortheremainderofthetermsforwhichtheywereappointed,exceptasprovided
55insubsection1ofthissection.
HCSHB1302	2 56 5.Anymemberreappointedshallonlybeeligibletoserveaschairorvicechair
57duringthefinaltwoyearsofsuchmember'sreappointment.
58 6.(1)OnorafterJanuary1,2024,thegovernorshallappointtwoadditional
59memberstothehighwaysandtransportationcommissionfromalistofsixnominees
60submittedbythegeneralassemblypriortosuchdate.Thelistofnomineessubmittedto
61thegovernorshallbeselectedbythegeneralassemblyandapprovedpriortosuch
62submissionbyatwo-thirdsvoteofthehouseandatwo-thirdsvoteofthesenate.
63 (2)Additionalappointmentstothecommissionaftertheinitialappointments
64madeundersubdivision(1)ofthissubsectionshallbemadebythesamemethod;each
65timethereisavacancyonthecommission,thegeneralassemblyshallsubmittothe
66governorthenamesofthreenomineeswhomeettherequirementsofsubsection1ofthis
67sectionandwhosenominationhasbeenapprovedbyatwo-thirdsvoteofthehouseand
68atwo-thirdsvoteofthesenate.Thegovernorshallberequiredtomakeappointmentsto
69thecommissionfromthenominationlistsubmittedbythegeneralassembly.
70 7.Nomemberofthecommissionshallacceptdirectlyorindirectlyagiftofany
71tangibleorintangibleitem,service,orthingofvaluefromanypaidlobbyistorlobbyist
72principal.Nothinginthissubsectionshallpreventindividualsfromreceivinggifts,
73familysupport,oranythingofvaluefromthoserelatedtothemwithinthefourthdegree
74bybloodormarriage.
