12 | 12 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
---|
13 | 13 | | Section A. Chapter 67, RSMo, is amended by adding thereto 1 |
---|
14 | 14 | | one new section, to be known as section 67.288, to read as 2 |
---|
15 | 15 | | follows:3 |
---|
16 | 16 | | 67.288. 1. For purposes of this section, the 1 |
---|
17 | 17 | | following terms mean: 2 |
---|
18 | 18 | | (1) "Electric vehicle", any vehicle that operates, 3 |
---|
19 | 19 | | either partially or exclusively, on electrical energy from 4 |
---|
20 | 20 | | the grid or an off-board source that is stored onboard for a 5 |
---|
21 | 21 | | motive purpose; 6 |
---|
22 | 22 | | (2) "Electric vehicle charging station", a public or 7 |
---|
23 | 23 | | private parking space that is ser ved by battery charging 8 |
---|
24 | 24 | | station equipment that has as its primary purpose the 9 |
---|
25 | 25 | | transfer of electric energy by conductive or inductive means 10 |
---|
26 | 26 | | to a battery or other energy storage device in an electric 11 |
---|
27 | 27 | | vehicle. 12 |
---|
28 | 28 | | 2. Notwithstanding any other provision of law to the 13 |
---|
29 | 29 | | contrary, any political subdivision that adopts an 14 |
---|
30 | 30 | | ordinance, resolution, regulation, code, or policy that 15 |
---|
31 | 31 | | requires installation of electric vehicle charging stations 16 SCS HCS HB 184 2 |
---|
32 | 32 | | shall pay all costs associated with the installation, 17 |
---|
33 | 33 | | maintenance, and operation of the electric vehicle charging 18 |
---|
34 | 34 | | stations. No political subdivision shall adopt any 19 |
---|
35 | 35 | | ordinance, resolution, regulation, code, or policy that 20 |
---|
36 | 36 | | requires more than five electric vehicle charging stations 21 |
---|
37 | 37 | | per parking lot, or infrastructure for fu ture installation 22 |
---|
38 | 38 | | of more than five electric vehicle charging stations per 23 |
---|
39 | 39 | | parking lot. Such ordinances, resolutions, regulations, 24 |
---|
40 | 40 | | codes, or policies shall apply only to parking lots with 25 |
---|
41 | 41 | | more than thirty parking spaces designated for parking. 26 |
---|
42 | 42 | | 3. Notwithstanding any other provision of law to the 27 |
---|
43 | 43 | | contrary, no political subdivision shall adopt any 28 |
---|
44 | 44 | | ordinance, resolution, regulation, code, or policy that 29 |
---|
45 | 45 | | requires any school or any religious organization, as 30 |
---|
46 | 46 | | described in section 210.201, to instal l an electric vehicle 31 |
---|
47 | 47 | | charging station. 32 |
---|
48 | 48 | | 4. Nothing in this section shall prohibit a business 33 |
---|
49 | 49 | | owner or property owner from paying for the installation, 34 |
---|
50 | 50 | | maintenance, or operation of an electric vehicle charging 35 |
---|
51 | 51 | | station. 36 |
---|
52 | 52 | | 5. The provisions of this section shall only apply to 37 |
---|
53 | 53 | | any city not within a county and any county with more than 38 |
---|
54 | 54 | | one million inhabitants. 39 |
