99 To amend chapter 67, RSMo, by adding thereto one new section relating to electric vehicle

1212 Be it enacted by the General Assembly of the State of Missouri, as follows:
1313 Section A. Chapter 67, RSMo, is amended by adding thereto 1
1414 one new section, to be known as section 67.288, to read as 2
1515 follows:3
1616 67.288. 1. For purposes of this section, the 1
1717 following terms mean: 2
1818 (1) "Electric vehicle", any vehicle that operates, 3
1919 either partially or exclusively, on electrical energy from 4
2020 the grid or an off-board source that is stored onboard for a 5
2121 motive purpose; 6
2222 (2) "Electric vehicle charging station", a public or 7
2323 private parking space that is ser ved by battery charging 8
2424 station equipment that has as its primary purpose the 9
2525 transfer of electric energy by conductive or inductive means 10
2626 to a battery or other energy storage device in an electric 11
2727 vehicle. 12
2828 2. Notwithstanding any other provision of law to the 13
2929 contrary, any political subdivision that adopts an 14
3030 ordinance, resolution, regulation, code, or policy that 15
3131 requires installation of electric vehicle charging stations 16 SCS HCS HB 184 2
3232 shall pay all costs associated with the installation, 17
3333 maintenance, and operation of the electric vehicle charging 18
3434 stations. No political subdivision shall adopt any 19
3535 ordinance, resolution, regulation, code, or policy that 20
3636 requires more than five electric vehicle charging stations 21
3737 per parking lot, or infrastructure for fu ture installation 22
3838 of more than five electric vehicle charging stations per 23
3939 parking lot. Such ordinances, resolutions, regulations, 24
4040 codes, or policies shall apply only to parking lots with 25
4141 more than thirty parking spaces designated for parking. 26
4242 3. Notwithstanding any other provision of law to the 27
4343 contrary, no political subdivision shall adopt any 28
4444 ordinance, resolution, regulation, code, or policy that 29
4545 requires any school or any religious organization, as 30
4646 described in section 210.201, to instal l an electric vehicle 31
4747 charging station. 32
4848 4. Nothing in this section shall prohibit a business 33
4949 owner or property owner from paying for the installation, 34
5050 maintenance, or operation of an electric vehicle charging 35
5151 station. 36
5252 5. The provisions of this section shall only apply to 37
5353 any city not within a county and any county with more than 38
5454 one million inhabitants. 39
