1015 Be it enacted by the General Assembly of the State of Missouri, as follows:
11-SectionA.Section235.140,RSMo,isrepealedandonenewsectionenactedinlieu
12-2thereof,tobeknownassection235.140,toreadasfollows:
13-235.140.1.Atthegeneralmunicipalelectionintheyearafterthefirstfullcalendar
14-2yearaftertheorganizationofanydistrict, andbienniallyat[the]general[election] municipal
15-3electionsthereafter,thereshallbeelectedbythevotersofthedistrictonememberofthe
16-4boardtoserveforatermofsixyears.Nominations[may] shallbefiledwiththe[secretaryof
17-5theboard] electionauthorityforthejurisdictioninwhichthedistrictislocated.
18-6 2.Thecandidatesforboardmembershallbeelectedonaseparatenonpartisanballot.

16+ Section A. Sections 235.120 and 235.140, RSMo, are 1
17+repealed and three new sections enacted in lieu thereof, to be 2
18+known as sections 67.1849, 235.120, and 235.140, to read as 3
19+follows:4
20+ 67.1849. Notwithstanding any provision of law or 1
21+contract to the contrary, a political subdivision may, at 2
22+its own expense, repair any street light, or replace any 3
23+street light at least fifteen years old, located within a 4
24+public right-of-way, as such term is defined in section 5
25+67.1830, provided that the political subdivision shall give 6
26+the owner of the street light reasonable opportunity to 7
27+collect the street light or any parts rep laced. 8
28+ 235.120. Each member of the board shall receive an 1
29+attendance fee in an amount not to exceed fifty dollars per 2
30+diem for attending each regularly called board meeting, but 3
31+shall not be paid for attending more than one in any 4
32+calendar month; provided however, that such attendance fee 5
33+may be increased by ordinance up to a maximum of one hundred 6 SS SB 148 2
34+dollars per diem. An increase in such attendance fee above 7
35+one hundred dollars per diem may be authorized upon a vote 8
36+of the residents of the district. Each member of the board 9
37+shall be reimbursed for his actual expenditures in the 10
38+performance of his duties on behalf of the district. The 11
39+county commission shall have power to remove directors or 12
40+any of them for good cause shown up on a petition, notice and 13
41+hearing. 14
42+ 235.140. 1. At the general municipal election in the 1
43+year after the first full calendar year after the 2
44+organization of any district , and biennially at [the] 3
45+general [election] municipal elections thereafter, there 4
46+shall be elected by the voters of the district one member of 5
47+the board to serve for a term of six years. Nominations 6
48+[may] shall be filed with the [secretary of the board ] 7
49+election authority for the jurisdiction in which the 8
50+district is located. 9
51+ 2. The candidates for board member shall be elected on 10
52+a separate nonpartisan ballot. The candidate receiving the 11
53+most votes shall be elected. Any new member of the board 12
54+shall qualify in the same manner as members of the first 13
55+board qualify. 14
56+ 3. At the first general municipal election to occur 15
57+after August 28, 2023, the elections for the seats of any 16
58+board members elected to a six -year term in 2018 or who have 17
59+been appointed to unexpired terms of members elected to a 18
60+six-year term in 2018, shall be held. At the third general 19
61+municipal election to occur after August 28, 2023, the 20
62+elections for the seats of any board members elected to a 21
63+six-year term in 2020 or who have been appointed to 22
64+unexpired terms of members elec ted to a six-year term in 23
65+2020, shall be held. At the fifth general municipal 24 SS SB 148 3
66+election to occur after August 28, 2023, the elections for 25
67+the seats of any board members elected to a six -year term in 26
68+2022 or who have been appointed to unexpired terms of 27
69+members elected to a six -year term in 2022 shall be held. 28
