5anyreasonoutsidethebusinessorganization'scontrol. 6 3.Thegeneralassemblyherebyfindsanddeclaresthefollowing: 7 (1)Itisanessentialfunctionofstategovernmenttoprotectthepublichealth, 8welfare,peace,safety,andtheeconomicviabilityandwell-beingofMissourians; 9 (2)OnemethodofprotectingMissouriansistopreserveandpromotethe 10economicviability,well-being,anddevelopmentofbusinessesinthisstate; EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 11 (3)Thestateanditspoliticalsubdivisionsmayberequiredtotakenecessary 12emergencyactionsfortheprotectionofMissouriansthatmayadverselyaffectthe 13economicviabilityandwell-beingofMissouriansandbusinessesinthestate; 14 (4)Suchgovernmentalactionsshouldnotbeenteredintowithoutcareful 15considerationofandappropriateconcernforthelastingeffectsthatmaycause 16economiclosstoMissouriansandbusinessesinthestate; 17 (5)ItisthepublicpolicyofthestateofMissourithatapoliticalsubdivisionshall 18giveappropriateconsiderationtotheeffectsofitsactionsontheeconomicwell-beingof 19Missouriansandbusinessesinthestate;and 20 (6)Toensurethatapoliticalsubdivisiongivesappropriateconsiderationtosuch 21actions,apoliticalsubdivisionshallparticipateineconomiclossescausedbythepolitical 22subdivision'sactionsaffectingMissouriansandbusinessesinthestateasprovidedin 23thissection. 24 4.(1)Notwithstandinganyotherprovisionoflawtothecontrary,beginning 25January1,2024,ifanypoliticalsubdivisionwithjurisdictionoverabusiness 26implementsanyshutdownorderorordersandthebusinessclosessolelyduetosuch 27shutdownorderorordersforatleasttwenty-oneconsecutivedaysoratleastforty-five 28cumulativedays,thefollowingshallapply: 29 (a)Anyfeeforabusinesslicenseimposedbythepoliticalsubdivisionwith 30jurisdictionoverthebusinessshallbewaivedforthebusinessduringtheperiodofthe 31shutdownorderorordersorsixmonths,whicheverislonger.Feesforabusinesslicense 32maybeprorated;and 33 (b)Thepoliticalsubdivisionwithjurisdictionoverthebusinessshallreducethe 34realandpersonalpropertytaxliabilityofsuchbusinessbasedonthenumberofdaysthe 35businesswasshutdowninagivenyearasfollows: 36 a.IftheshutdownorderorordersendbeforeJunefirst,theappropriateofficials 37responsibleforassessingandlevyingrealandpersonalpropertytaxesandproviding 38statementsoftaxesdueinthepoliticalsubdivisionwithjurisdictionoverthebusiness 39shallcalculatethetaxliabilityofsuchbusinessasrequiredbylaw.Aftersuchtax 40liabilityiscalculated,suchofficialsshallreducesuchtaxliabilityasrequiredinthis 41section.Suchreductionshallbereflectedonthestatementoftaxesdueprovidedtothe 42taxpayerwhoisliableforthepropertytaxesofthebusiness.Suchappropriateofficials 43shallfollowallproceduresforcalculatingsuchtaxesandprovidingsuchstatements 44providedbylawaspracticable.Ataxpayerreceivingareducedstatementoftaxesdue 45shallmakefullpaymentofsuchreducedtaxesbeforethedelinquencydateasprovided 46bylaw;and HCSSSSB222 2 47 b.IftheshutdownorderorordersremainineffectonorafterJunefirst,the 48taxpayerwhoisliableforthepropertytaxesofthebusinessshallmakefullpaymentof 49taxesduebeforethedelinquencydateasprovidedbylaw.Theappropriateofficials 50responsibleforassessingandlevyingrealandpersonalpropertytaxesandproviding 51statementsoftaxesdueinthepoliticalsubdivisionwithjurisdictionoverthebusiness 52shall: 53 (i)Notifysuchtaxpayer,atthesametimethetaxpayer'sstatementoftaxesdueis 54providedtothetaxpayerasrequiredbylaw,thatthetaxpayermayapplyforarefundof 55aportionofthepropertytaxliabilityofsuchbusinessasprovidedinthissection; 56 (ii)Provideamethodofapplyingforarefundofsuchportionofsuchtax 57liability,bywhichthetaxpayershallprovideanyinformationrequiredbythe 58appropriateofficialstoassistinthecalculationofsuchportion.Arefundapplication 59madeasprovidedinthissubparagraphshallbesubmittedtotheappropriateofficialno 60laterthantheJanuaryfifteenthimmediatelyfollowingtherefundnotification; 61 (iii)Calculatetheamountofsuchallowableportiontoberefundedandnotify 62thetaxpayerofsuchamount.Allsuchcalculationsforallrefundapplicationsshallbe 63completednolaterthantheFebruaryfifteenthfollowingtherefundnotification;and 64 (iv)Makepaymentsofallrefundstoalltaxpayerseligiblefortherefund.All 65suchpaymentsofrefundsshallbecompletednolaterthantheMarchfifteenth 66immediatelyfollowingtherefundnotification. 67 (2)Notwithstandinganyotherprovisionofthissectiontothecontrary,a 68taxpayerwhosetaxliabilityisreducedasprovidedinthissubsectionandwholeasesor 69rentsalloraportionofthetaxpayer'saffectedrealpropertytooneormorerentersor 70lessorsshalldistributesuchamountbywhichthetaxliabilityisreducedonaprorata 71basistosuchrentersorlessorswhoarecurrentonallleaseorrentalpaymentsowedto 72thetaxpayerwhosetaxliabilityisreduced. 73 5.Thissectionshallnotbeconstruedtoapplytofeesrequiredforalicenseor 74certificationofanindividualtopracticeaprofession. 75 6.Thissectionshallnotbeconstruedasanexemptionofpropertyfromtaxation 76requiringthestatetoproviderestitutionorareplacementofrevenueslosttoapolitical 77subdivision.Anyactiontakenbyapoliticalsubdivisionthatresultsinarecalculationor 78refundoftaxesorrevenueslostbythepoliticalsubdivision,orboth,shallbeconstrued 79asanexerciseofthepoliticalsubdivision'sauthoritytolevyandcollectlocaltax 80revenuesasprovidedbystatelaw. 64.570.1.Fromandaftertheadoptionoftheofficialmasterplanorportionthereof 2anditspropercertificationandrecording,thereafternoimprovementofatypeembraced 3withintherecommendationsofsuchofficialmasterplanorpartthereofshallbeconstructed HCSSSSB222 3 4orauthorizedwithoutfirstsubmittingtheproposedplansthereoftothecountyplanning 5commissionandreceivingthewrittenapprovalorrecommendationsofsaidcommission. 6Thisrequirementshallbedeemedtobewaivedifthecountyplanningcommissionfailsto 7makeitsreportandrecommendationswithinforty-fivedaysafterreceiptoftheproposed 8plans. 9 2.(1)Inthecaseofanypublicimprovementsponsoredorproposedtobemadeby 10anymunicipalityorotherpoliticalorcivilsubdivisionofthestate,orpublicboard, 11commissionorotherpublicofficials,thedisapprovalorrecommendationsofthecounty 12planningcommissionmaybeoverruledbyatwo-thirdsvote,properlyenteredofrecordand 13certifiedtothecountyplanningcommission,ofthegoverningbodyofsuchmunicipality,or 14otherpoliticalorcivilsubdivision,orpublicboard,commissionorofficials,afterthereasons 15forsuchoverrulingarespreaduponitsminutes,whichreasonsshallalsobecertifiedtothe 16countyplanningcommission. 17 (2)Notwithstandingtheprovisionsofsubdivision(1)ofthissubsection,aboard 18governingalibraryestablishedunderchapter182shallnothavethepowertooverrule 19thedisapprovalorrecommendationsofthecountyplanningcommission. 64.820.1.Fromandaftertheadoptionoftheofficialmasterplanorportionthereof 2anditspropercertificationandrecording,thereafternoimprovementofatypeembraced 3withintherecommendationsoftheofficialmasterplan,orpartthereof,shallbeconstructedor 4authorizedwithoutfirstsubmittingtheproposedplansthereoftothecountyplanning 5commissionandreceivingthewrittenapprovalorrecommendationsofthecommission.This 6requirementshallbedeemedtobewaivedifthecountyplanningcommissionfailstomakeits 7reportandrecommendationswithinforty-fivedaysafterreceiptoftheproposedplans. 8 2.(1)Inthecaseofanypublicimprovementsponsoredorproposedtobemadeby 9anymunicipalityorotherpoliticalorcivilsubdivisionofthestate,orpublicboard, 10commissionorotherpublicofficials,thedisapprovalorrecommendationsofthecounty 11planningcommissionmaybeoverruledbyatwo-thirdsvote,properlyenteredofrecordand 3withintherecommendationsofsuchofficialmasterplanorpartthereofshallbeconstructed HCSSSSB222 4 4orauthorizedwithoutfirstsubmittingtheproposedplansthereoftothetownshipplanning 5commissionandreceivingthewrittenapprovalorrecommendationsofthetownshipplanning 6commission.Thisrequirementshallbedeemedtobewaivedifthetownshipplanning 7commissionfailstomakeitsreportandrecommendationswithinforty-fivedaysafterreceipt 8oftheproposedplans. 9 2.(1)Inthecaseofanypublicimprovementsponsoredorproposedtobemadeby HCSSSSB222 7 7 2.Incaseofdisapprovalthecommissionshallcommunicateitsreasonstothe 8council,andthecouncil,byvoteofnotlessthantwo-thirdsofitsentiremembership,may 9overrulethedisapprovaland,upontheoverruling,thecouncilortheappropriateboardor 10officermayproceed[, exceptthat]. 11 3.Notwithstandingtheprovisionsofsubsection2ofthissection,ifthepublic 12facilityorutilityisonetheauthorizationorfinancingofwhichdoesnotfallwithinthe 13provinceofthecouncil,[then] thefollowingprovisionsshallapply: 14 (1)Thesubmissiontotheplanningcommissionshallbebytheboardhaving 15jurisdiction[,]; and 16 (2)Theplanningcommission'sdisapprovalmaybeoverruledby[that] theboard 17describedinsubdivision(1)ofthissubsectionbyavoteofnotlessthantwo-thirdsofits 18entiremembership, exceptthataboardgoverningalibraryestablishedunderchapter 19182shallnothavethepowertooverruletheplanningcommission'sdisapproval. 20 4.Theacceptance,widening,removal,extension,relocation,narrowing,vacation, 21abandonment,changeofuse,acquisitionoflandfor,saleorleaseofanystreetorotherpublic 22facilityissubjecttosimilarsubmissionandapproval,andthefailuretoapprovemaybe 23similarlyoverruledtotheextentallowedundersubsection3ofthissection. 24 5.Thefailureofthecommissiontoactwithinsixtydaysafterthedateofofficial 25submissiontoitshallbedeemedapproval. 182.645.1.ThefiscalyearforeachconsolidatedpubliclibrarydistrictshallbeJuly 2firsttoJunethirtiethunlessotherwisesetbytheboardoftrustees, andeachyearthe 3librarianshallsubmittotheboardoftrusteesabudgetfortheforthcomingfiscalyear.The 4boardshallapprovethebudgetaftermakinganychangesthereinthatitdeemsnecessary.The 5budgetshallbeapprovedonorbefore[Junethirtieth] thelastdayofthefiscalyear 6precedingthefiscalyearforwhichthebudgetwasprepared.Theboardonitsownmotionor 7attherequestofthelibrarian,fromtimetotime,mayamendormodifytheapprovedbudget. 8Acopyoftheapprovedbudgetshallbefiledwitheachcountycommissionorcounty 9executiveofficeofthecountiescomprisingtheconsolidatedpubliclibrarydistrict,andwith 10thestateauditor. 11 2.Thetreasureroftheboardoftrusteesofaconsolidatedpubliclibrarydistrictshall 12receiveandbethecustodianofallmoneybelongingtothedistrictfromwhateversource 13derived.Allfundsoftheconsolidatedpubliclibrarydistrictderivedfromlocaltaxationtobe 14usedfornormaloperationsofthedistrictandreceivedfromthecountycollector,shallbekept 15inaconsolidatedlibraryoperatingfund.Allfundsbelongingtothedistrictwhicharetobe 16usedforbuildingpurposesshallbekeptinaconsolidatedlibrarybuildingfund;allfunds 17derivedfromstateaidorfederalgrants,otherthanland,buildingandfurnishinggrants,shall 18bekeptintheconsolidatedlibraryoperatingfund;andtheboardmayestablishanyother HCSSSSB222 8 19fundsthatitdeemsnecessary.Thetreasurershalldepositallmoneysbelongingtothe 20consolidatedpubliclibrarydistrictinthedepositariesthatareselectedbytheboardof 21trustees.Thetreasurershallalsobethecustodianofallbondsorothersecuritiesbelongingto 22theconsolidatedpubliclibrarydistrict. 23 3.Consolidatedpubliclibrarydistrictmoneysshallbedisbursedbythetreasurerby 24appropriateinstrumentofpaymentonlyupondueauthorizationoftheconsolidatedpublic 25librarydistrictboardoftrusteesanddulycertifiedforpaymentbythepresident.The 26certificationshallspecifytheamounttobepaid,towhompaymentistobemadeandthe 27purposeforwhichpaymentisbeingmade.Theboardbyresolutionmaydirectthatthe 28signatureofthepresidentortreasurerbeafacsimilesignatureinthemannerprovidedby 29sections105.273to105.278. 30 4.Noauthorizationorcertificationshallbemade,andnoinstrumentofpayment 31issuedforthepaymentofanyconsolidatedpubliclibrarydistrictindebtednessunlessthereis 32sufficientmoneyinthetreasuryandtheproperfundforthepaymentoftheindebtednessand 33beintheproperform. 34 5.Thetreasureroftheboardoftrusteesshallsubmittotheboardoftrustees,ateach 35regularlyscheduledmeetingoftheboard,anaccountingreflectingreceiptanddisbursement 36offundsbelongingtotheconsolidatedpubliclibrarydistrict. 182.819.Notwithstandinganyprovisionofthischapteroranyotherlaw,any 2realpropertyownedbyaboardgoverningalibraryestablishedunderthischaptershall 3notbeusedforanypurposethatviolatesanyzoningordinancesorregulationsadopted 4underchapter64,65,or89bythecounty,city,town,village,ortownshipinwhichthe 5realpropertyislocated.Anyboardgoverningalibraryestablishedunderthischapter 6shall: 7 (1)Besubjecttosuchzoningordinancesorregulationswithrespecttoitsreal 8propertywithoutregardtoanypowersoftheboardoutlinedinthischapter;and 9 (2)Nothavethepowertooverruleanydecisionrelatingtozoningadoptedunder 10chapter64,65,or89. 436.337.Notwithstandinganyotherprovisionoflaw,nopoliticalsubdivision 2shallrequireapropertyownertohaveahomeinspectionconductedofaresidential 3propertyregardingthesaleoftheproperty.Thisprovisionshallnotapplytoany 4inspectionrequirementofnewconstructionoroccupancypermits. 534.157.Alltransfersoftitleofrealpropertyforrentalpropertieswith 2outstandingcollectiblejudgmentsshallbefiledinthecircuitcourtwithinthirtydays 3aftertransferoftitle. ✔ HCSSSSB222 9
