19acompetitivebiddingprocess.Thecompetitivebiddingprocessshallgivepriorityto
20organizationsandentitiesthatareexemptfromtaxationunderSection501(c)(3),501(c)(6),or
21501(c)(4),exceptthosecivicorganizationsthatwouldbeconsideredactionorganizations
22under26C.F.R.Section1.501(c)(3)-1(c)(3),oftheInternalRevenueCodeof1986,as
23amended,withspecialconsiderationgiventothoseorganizationsandentitiesthatreinvesta
24minimumofseventy-fivepercentofthenetproceedstocharitableorganizationsinMissouri,

28mannerwithacurrentemployeeofthedepartmentofrevenueorwithaformer
29employeeofthedepartmentofrevenuefortheone-yearperiodfollowingtheformer
30employee'sterminationofemploymentwiththedepartment.Forpurposesofthis
31subsection,"affiliatedinanymanner"includesowningtheentitythatisapplyingfora
32feeofficecontract,orservingasanofficerorboardmemberofsuchentity.Thedirector
33ofthedepartmentofrevenuemaypromulgaterulesandregulationsnecessarytocarryoutthe
34provisionsofthissubsection.Anyruleorportionofarule,asthattermisdefinedinsection
35536.010,thatiscreatedundertheauthoritydelegatedinthissubsectionshallbecomeeffective
36onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
37section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
38vestedwiththegeneralassemblypursuanttochapter536toreview,todelaytheeffective
39date,ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrant

42 3.Exceptasotherwiseprovidedinsubsection9ofthissection,allfeesauthorized

52ofregistrations,licenses,andotherdocumentsrelatedtomotorvehiclesshallhavean
53insurableinterestinalllicenseplates,licenses,tabs,formsandotherdocumentsheldon
54behalfofthedepartment.

56actingasagentsofthedepartmentofrevenueundersection32.095orthosemotorvehicle

58 7.Notwithstandinganyotherprovisionoflawtothecontrary,thestateauditormay
59auditallrecordsmaintainedandestablishedbythefeeofficeinthesamemannerasthe
60auditormayauditanyagencyofthestate,andthedepartmentshallensurethatthisaudit
61requirementisanecessaryconditionfortheawardofallfeeofficecontracts.Noconfidential
62recordsshallbedivulgedinsuchawaytorevealpersonallyidentifiableinformation.
63 8.Thefeesdescribedinsubsection1ofthissectionshallnotbecollectedfrom

5Nofeeshallberequiredorcollectedforacertificationofbirth,death,ormarriageifthe
6requestforcertificationismadebythechildren'sdivision,thedivisionofyouthservices,a
7guardianadlitem,orajuvenileofficeronbehalfofachildorpersonundertwenty-oneyears
8ofagewhohascomeunderthejurisdictionofthejuvenilecourtundersection211.031.All
9feescollectedunderthissubsectionshallbedepositedtothestatedepartmentofrevenue.
10BeginningAugust28,2004,foreachvitalrecordsfeecollected,thedirectorofrevenueshall
11creditfourdollarstothegeneralrevenuefund,fivedollarstothechildren'strustfund,one
12dollarshallbecreditedtotheendowedcarecemeteryauditfund,onedollarforeach

17shallbeavailablebyappropriationtothedivisionofprofessionalregistrationtopayits

19depositedintheendowedcarecemeteryauditfundshallbecreditedtotheendowedcare
20cemeteryfund.Notwithstandingtheprovisionsofsection33.080tothecontrary,money

24precedingfiscalyear.Themoneydepositedinthepublichealthservicesfundunderthis
25sectionshallbedepositedinaseparateaccountinthefund,andmoneysinsuchaccount,upon
26appropriation,shallbeusedtoautomateandimprovethestatevitalrecordssystem,and
27developandmaintainanelectronicbirthanddeathregistrationsystem.Foranysearchofthe
28filesandrecords,whennorecordisfound,thestateshallbeentitledtoafeeequaltothe
29amountforacertificationofavitalrecordforafive-yearsearchtobepaidbytheapplicant.
30Fortheprocessingofeachlegitimation,adoption,courtorderorrecordingafterthe
31registrant'stwelfthbirthday,thestateshallbeentitledtoafeeequaltotheamountfora
32certificationofavitalrecord.Exceptwheneveracertifiedcopyorcopiesofavitalrecordis
33requiredtoperfectanyclaimofanypersononrelief,oranydependentofanypersonwhowas
34onreliefforanyclaimuponthegovernmentofthestateorUnitedStates,thestateregistrar
35shall,uponrequest,furnishacertifiedcopyorsomanycertifiedcopiesasarenecessary,
36withoutanyfeeorcompensationtherefor.
37 2.Fortheissuanceofacertificationofadeathrecordbythelocalregistrar,the
38applicantshallpayafeeoffourteendollarsforthefirstcertificationorcopyandafeeof
39elevendollarsforeachadditionalcopyorderedatthattime.Foreachfeecollectedunderthis
40subsection,onedollarshallbedepositedtothestatedepartmentofrevenueandtheremainder
41shallbedepositedtotheofficialcityorcountyhealthagency.Thedirectorofrevenueshall
42creditallfeesdepositedtothestatedepartmentofrevenueunderthissubsectiontothe
43Missouristatecoroners'trainingfundestablishedinsection58.208.
44 3.Fortheissuanceofacertificationorcopyofabirth,marriage,divorce,orfetal
45deathrecord,theapplicantshallpayafeeoffifteendollars;exceptthat,inanycountywitha
46charterformofgovernmentandwithmorethansixhundredthousandbutfewerthanseven
47hundredthousandinhabitants,adonationofonedollarmaybecollectedbythelocalregistrar
48overandaboveanyfeesrequiredbylawwhenacertificationorcopyofanymarriagelicense
49orbirthcertificateisprovided,withsuchdonationscollectedtobeforwardedmonthlybythe

51depositedbythecountytreasurerintothehousingresourcecommissionfundtoassist

53insuchcounty.Thelocalregistrarshallincludeacheck-offboxontheapplicationformfor
54suchcopies.Allfeescollectedunderthissubsection,otherthanthedonationscollectedin
55anycountywithacharterformofgovernmentandwithmorethansixhundredthousandbut
56fewerthansevenhundredthousandinhabitantsformarriagelicensesandbirthcertificates,
57shallbedepositedtotheofficialcityorcountyhealthagency.
58 4.Acertifiedcopyofadeathrecordbythelocalregistrarcanonlybeissuedwithin
59twenty-fourhoursofreceiptoftherecordbythelocalregistrar.Computer-generated
60certificationsofdeathrecordsmaybeissuedbythelocalregistraraftertwenty-fourhoursof
61receiptoftherecords.Thefeespaidtotheofficialcountyhealthagencyshallberetainedby
62thelocalagencyforlocalpublichealthpurposes.
63 5.Nofeeunderthissectionshallberequiredorcollectedfromaparentorguardianof
64ahomelesschildorhomelessyouth,asdefinedinsubsection1ofsection167.020,oran
65unaccompaniedyouth,asdefinedin42U.S.C.Section11434a(6),fortheissuanceofa
66certification,orcopyofsuchcertification,ofbirthofsuchchildoryouth.Anunaccompanied
67youthshallbeeligibletoreceiveacertificationorcopyofhisorherownbirthrecordwithout
68theconsentorsignatureofhisorherparentorguardian;provided,thatonlyonecertificate
69underthisprovisionshallbeprovidedwithoutcosttotheunaccompaniedorhomelessyouth.
70Fortheissuanceofanyadditionalcertificates,thestatutoryfeeshallbepaid.
71 6.(1)Notwithstandinganyprovisionoflawtothecontrary,nofeeshallbe
72requiredorcollectedforacertificationofbirthiftherequestismadebyavictimof
73domesticviolenceorabuse,asthosetermsaredefinedinsection455.010,andthevictim
74providesdocumentationsignedbyanemployee,agent,orvolunteerofavictimservice
75provider,anattorney,orahealthcareormentalhealthprofessional,fromwhomthe
76victimhassoughtassistancerelatingtothedomesticviolenceorabuse.Such
77documentationshallstatethat,underpenaltyofperjury,theemployee,agent,or
78volunteerofavictimserviceprovider,theattorney,orthehealthcareormentalhealth
79professionalbelievesthatthevictimhasbeeninvolvedinanincidentofdomestic
80violenceorabuse.
81 (2)Avictimmaybeeligibleonlyonetimeforafeewaiverunderthissubsection.
302.178.1.Anypersonbetweentheagesofsixteenandeighteenyearswhois
2qualifiedtoobtainalicensepursuanttosections302.010to302.340mayapplyfor,andthe
3directorshallissue,anintermediatedriver'slicenseentitlingtheapplicant,whilehavingsuch
4licenseinhisorherpossession,tooperateamotorvehicleoftheappropriateclassuponthe
5highwaysofthisstateinconjunctionwiththerequirementsofthissection.Anintermediate
HCSSB47	6 6driver'slicenseshallbereadilydistinguishablefromalicenseissuedtothoseovertheageof
7eighteen.Allapplicantsforanintermediatedriver'slicenseshall:
8 (1)Successfullycompletetheexaminationrequiredbysection302.173;
9 (2)Paythefeerequiredbysubsection4ofthissection;
10 (3)Havehadatemporaryinstructionpermitissuedpursuanttosubsection1of
11section302.130foratleastasix-monthperiodoravalidlicensefromanotherstate;and
12 (4)Haveaparent,grandparent,legalguardian,or,iftheapplicantisaparticipantina
13federalresidentialjobtrainingprogram,adrivinginstructoremployedbyafederalresidential
14jobtrainingprogram,signtheapplicationstatingthattheapplicanthascompletedatleast
15fortyhoursofsuperviseddrivingexperienceunderatemporaryinstructionpermitissued
16pursuanttosubsection1ofsection302.130,or,iftheapplicantisanemancipatedminor,the
17personovertwenty-oneyearsofagewhosupervisedsuchdriving.Forpurposesofthis
18section,theterm"emancipatedminor"meansapersonwhoisatleastsixteenyearsofage,but
19lessthaneighteenyearsofage,who:
20 (a)Marrieswiththeconsentofthelegalcustodialparentorlegalguardianpursuantto
21section451.080;
22 (b)Hasbeendeclaredemancipatedbyacourtofcompetentjurisdiction;
23 (c)EntersactivedutyintheArmedForces;
24 (d)Haswrittenconsenttotheemancipationfromthecustodialparentorlegal
25guardian;[or]
26 (e)Throughemploymentorothermeansprovidesforsuchperson'sownfood,shelter
27andothercost-of-livingexpenses;or
28 (f)Qualifiesasahomelesschildorhomelessyouth,asdefinedinsubsection1of
29section167.020,orasanunaccompaniedyouthasdefinedin42U.S.C.Section11434a
30(6),andwhosestatusassuchisverifiedasprovidedundersubsection10ofthissection;
31 (5)Havehadnoalcohol-relatedenforcementcontactsasdefinedinsection302.525
32duringtheprecedingtwelvemonths;and
33 (6)Havenononalcoholictrafficconvictionsforwhichpointsareassessedpursuantto

35 2.Anintermediatedriver'slicensegrantsthelicenseethesameprivilegestooperate

37nopersonshalloperateamotorvehicleonthehighwaysofthisstateundersuchan
38intermediatedriver'slicensebetweenthehoursof1:00a.m.and5:00a.m.unless
39accompaniedbyapersondescribedinsubsection1ofsection302.130;exceptthelicensee
40mayoperateamotorvehiclewithoutbeingaccompaniedifthetravelistoorfromaschoolor
41educationalprogramoractivity,aregularplaceofemploymentorinemergencysituationsas
42definedbythedirectorbyregulation.
HCSSB47	7 43 3.Eachintermediatedriver'slicenseshallberestrictedbyrequiringthatthedriver
44andallpassengersinthelicensee'svehiclewearsafetybeltsatalltimes.Thissafetybelt
45restrictionshallnotapplytoapersonoperatingamotorcycle.Forthefirstsixmonthsafter
46issuanceoftheintermediatedriver'slicense,theholderofthelicenseshallnotoperateamotor
47vehiclewithmorethanonepassengerwhoisundertheageofnineteenwhoisnotamember
48oftheholder'simmediatefamily.Asusedinthissubsection,anintermediatedriver'slicense
49holder'simmediatefamilyshallincludebrothers,sisters,stepbrothersorstepsistersofthe
50driver,includingadoptedorfosterchildrenresidinginthesamehouseholdoftheintermediate
51driver'slicenseholder.Aftertheexpirationofthefirstsixmonths,theholderofan
52intermediatedriver'slicenseshallnotoperateamotorvehiclewithmorethanthreepassengers
53whoareundernineteenyearsofageandwhoarenotmembersoftheholder'simmediate
54family.Thepassengerrestrictionsofthissubsectionshallnotbeapplicabletoany
55intermediatedriver'slicenseholderwhoisoperatingamotorvehiclebeingusedin
56agriculturalwork-relatedactivities.
57 4.Notwithstandingtheprovisionsofsection302.177tothecontrary,thefeeforan
58intermediatedriver'slicenseshallbefivedollarsandsuchlicenseshallbevalidforaperiodof
59twoyears.Suchfeeshallbewaivedforanypersonqualifyingasanemancipatedminor
60undersubdivision(4)ofsubsection1ofthissection.
61 5.Anyintermediatedriver'slicenseeaccumulatingsixormorepointsinatwelve-
62monthperiodmayberequiredtoparticipateinandsuccessfullycompleteadriver-
63improvementprogramapprovedbythestatehighwaysandtransportationcommission.The
64driver-improvementprogramorderedbythedirectorofrevenueshallnotbeusedinlieuof
65pointassessment.
66 6.(1)Anintermediatedriver'slicenseewhohas,fortheprecedingtwelve-month
67period,hadnoalcohol-relatedenforcementcontacts,asdefinedinsection302.525andno
68trafficconvictionsforwhichpointsareassessed,uponreachingtheageofeighteenyearsor
69withinthethirtydaysimmediatelyprecedingtheireighteenthbirthdaymayapplyforand
70receivewithoutfurtherexamination,otherthanavisiontestasprescribedbysection302.173,
71alicenseissuedpursuanttothischaptergrantingfulldrivingprivileges.Suchpersonshall
72paytherequiredfeeforsuchlicenseasprescribedinsection302.177.
73 (2)Ifanintermediatedriver'slicenseexpiresonaSaturday,Sunday,orlegalholiday,
74suchlicenseshallremainvalidforthefivebusinessdaysimmediatelyfollowingthe
75expirationdate.Innocaseshallalicenseewhoseintermediatedriver'slicenseexpiresona
76Saturday,Sunday,orlegalholidaybeguiltyofanoffenseofdrivingwithanexpiredorinvalid
77driver'slicenseifsuchoffenseoccurredwithinfivebusinessdaysimmediatelyfollowingan
78expirationdatethatoccursonaSaturday,Sunday,orlegalholiday.

80thepersonhashadnotrafficconvictionsforwhichpointsareassessedforaperiodoftwelve

88otherstateforanyreasonmayapplyforafulldriver'slicenseuntilsuchlicenseordriving
89privilegeisfullyreinstated.Anysuchpersonwhoseintermediatedriver'slicensehasbeen
90revokedpursuanttotheprovisionsofsections302.010to302.540shall,uponreceiptof
91reinstatementoftherevocationfromthedirector,passthecompletedriverexamination,apply
92foranewlicense,andpaytheproperfeebeforeagainoperatingamotorvehicleuponthe

94 8.Apersonshallbeexemptfromtheintermediatelicensingrequirementsifthe
95personhasreachedtheageofeighteenyearsandmeetsallotherlicensingrequirements.
96 9.Anypersonwhoviolatesanyoftheprovisionsofthissectionrelatingto
97intermediatedrivers'licensesortheprovisionsofsection302.130relatingtotemporary
98instructionpermitsisguiltyofaninfraction,andnopointsshallbeassessedtohisorher

100 10.Aperson'sstatusasahomelesschildoryouthorunaccompaniedyouth

2302.340shallbeinsuchformasthedirectorshallprescribe,butthelicenseshallbeacard
3madeofplasticorothercomparablematerial.Alllicensesshallbemanufacturedofmaterials
4andprocessesthatwillprohibit,asnearlyaspossible,theabilitytoreproduce,alter,
5counterfeit,forge,orduplicateanylicensewithoutreadydetection.Thelicenseshallalso
6beartheexpirationdateofthelicense,theclassificationofthelicense,thename,dateofbirth,
7residenceaddressincludingthecountyofresidenceoracodenumbercorrespondingtosuch

13licensee'sattorneyinfactforthepurposesofadurablepowerofattorneyforhealthcare
14decisions.Nolicenseshallbevaliduntilithasbeensosignedbythelicensee.Ifanyportion
15ofthelicenseispreparedbyaprivatefirm,anycontractwithsuchfirmshallbemadein
16accordancewiththecompetitivepurchasingproceduresasestablishedbythestatedirectorof
17thedivisionofpurchasing.
18 2.Alldigitalimagesproducedforlicensesshallbecomethepropertyofthe
19departmentofrevenue.
20 3.Thelicenseissuedshallbecarriedatalltimesbytheholderthereofwhiledrivinga
21motorvehicle,andshallbedisplayedupondemandofanyofficerofthehighwaypatrol,or
22anypoliceofficerorpeaceofficer,oranyotherdulyauthorizedperson,forinspectionwhen
23demandismadetherefor.Failureofanyoperatorofamotorvehicletoexhibithisorher
24licensetoanydulyauthorizedofficershallbepresumptiveevidencethatsuchpersonisnota
25dulylicensedoperator.
26 4.Thedirectorofrevenueshallnotissuealicensewithoutafacialdigitalimageof
27thelicenseapplicant,exceptasprovidedpursuanttosubsection7ofthissection.Adigital

47purposesonlyandshallnotbevalidasalicense.Nofeeshallberequiredorcollectedfrom
48ahomelesschildorhomelessyouth,asdefinedinsubsection1ofsection167.020,or
49unaccompaniedyouth,asdefinedin42U.S.C.Section11434a(6),forafirstnondriver's
50licensecardissuedunderthissubsection.Suchperson'sstatusasahomelesschildor
51youthorunaccompaniedyouthshallbeverifiedbyalettersignedbyoneofthe
52followingpersons:
53 (1)Adirectorordesigneeofagovernmentalornonprofitagencythatreceives
54publicorprivatefundingtoprovideservicestohomelesspersons;
55 (2)Alocaleducationagencyliaisonforhomelesschildrenandyouthdesignated

83 9.BeginningJuly1,2005,thedirectorshallnotissueadriver'slicenseora
84nondriver'slicenseforaperiodthatexceedsanapplicant'slawfulpresenceintheUnited
85States.Thedirectormay,byruleorregulation,establishprocedurestoverifythelawful
86presenceoftheapplicantandestablishthedurationofanydriver'slicenseornondriver's
87licenseissuedunderthissection.
