sectionsrelatingtolawenforcementpractices,withpenaltyprovisions.

SectionA.Sections300.100and304.022,RSMo,arerepealedandthreenewsections
2enactedinlieuthereof,tobeknownassections44.087,300.100,and304.022,toreadas
3follows:
44.087.1.Thechieflawenforcementexecutiveforanylawenforcementagency,
2orsuchexecutive'sdesignee,mayrequestassistancefromalawenforcementagencyof
3anotherjurisdiction,includingajurisdictionoutsidethestateofMissouributwithinthe
4UnitedStates.
5 2.Ifalawenforcementofficermakesanarrestorapprehensionoutsidesuch
6officer'sjurisdiction,theoffendershallbedeliveredtothefirstavailablelaw
7enforcementofficerwhoiscommissionedinthejurisdictioninwhichthearrestwas
8made.Theofficermakingtheinitialarrestorapprehensionshallassistinthe
9preparationofanyaffidavitsfiledwiththecomplaintorbasedonotherevidencethat
10thereisprobablecausetobelievethatbothacrimehasbeencommittedandthe
11defendanthascommittedsuchcrime.
12 3.Forthepurposeofliability,workers'compensation,andanyother
13employment-relatedmatter,lawenforcementofficersremainemployeesoftheir
14respectivelawenforcementagencythroughoutanyrequestforassistance.Qualified
15immunity,sovereignimmunity,officialimmunity,andthepublicdutyruleshallapplyto
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16theprovisionsofthissectionasinterpretedbythefederalandstatecourtsofthe
17respondingagency.
18 4.Nothinginthissectionshallbeconstruedtolimittheactionsoflaw
19enforcementofficersoragenciesconductedinaccordancewithsection44.095or44.098,
20oranyothermutualaidagreementmadeunderthischapter.
21 5.Theprovisionsofchapter544areapplicabletoanylawenforcementofficers
22fromjurisdictionslocatedoutsidethestateofMissouri,butwithintheUnitedStates,
23whoareactingpursuanttoarequestmadeunderthissection.
300.100.1.Thedriverofanauthorizedemergencyvehicle,whenrespondingtoan
2emergencycallorwheninthepursuitofanactualorsuspectedviolatorofthelaworwhen
3respondingtobutnotuponreturningfromafirealarm,mayexercisetheprivilegessetforthin
4thissection,butsubjecttotheconditionshereinstated.
5 2.Thedriverofanauthorizedemergencyvehiclemay:
6 (1)Parkorstand,irrespectiveoftheprovisionsofthisordinance;
7 (2)Proceedpastaredorstopsignalorstopsign,butonlyafterslowingdownasmay
8benecessaryforsafeoperation;
9 (3)Exceedthemaximumspeedlimitssolongashedoesnotendangerlifeor
10property;
11 (4)Disregardregulationsgoverningdirectionofmovementorturninginspecified
12directions.
13 3.Theexemptionshereingrantedtoanauthorizedemergencyvehicleshallapply
14onlywhenthedriverofanysaidvehiclewhileinmotionsoundsaudiblesignalbysirenor
15whilehavingatleastonelightedlampexhibitingaredlightvisibleundernormalatmospheric
16conditionsfromadistanceoffivehundredfeettothefrontofsuchvehicleoraflashingblue
17lightauthorizedbysection307.175, exceptthatanauthorizedemergencyvehicleoperated
18asapolicevehicleisnotrequiredtouseanaudiblesignalordisplayavisualsignalwhen
19thevehicleisbeingusedto:
20 (1)Obtainevidenceofaspeedingviolation;
21 (2)Respondtoasuspectedcrimeinprogresswhenuseofanaudibleorvisual
22signal,orboth,couldreasonablyresultinthedestructionofevidenceorescapeofa
23suspect;or
24 (3)Conductsurveillanceofavehicleorthepassengersofavehiclewhoare
25suspectedofinvolvementinacrime.
26 4.Theforegoingprovisionsshallnotrelievethedriverofanauthorizedemergency
27vehiclefromthedutytodrivewithdueregardforthesafetyofallpersons,norshallsuch
28provisionsprotectthedriverfromtheconsequencesofhisrecklessdisregardforthesafetyof
29others.
HB1707	2 304.022.1.Upontheimmediateapproachofanemergencyvehiclegivingaudible
2signalbysirenorwhilehavingatleastonelightedlampexhibitingredlightvisibleunder
3normalatmosphericconditionsfromadistanceoffivehundredfeettothefrontofsuch
4vehicleoraflashingbluelightauthorizedbysection307.175,thedriverofeveryother
5vehicleshallyieldtheright-of-wayandshallimmediatelydrivetoapositionparallelto,and
6asfaraspossibletotherightof,thetraveledportionofthehighwayandthereuponstopand
7remaininsuchpositionuntilsuchemergencyvehiclehaspassed,exceptwhenotherwise
8directedbyapoliceortrafficofficer.
9 2.Uponapproachingastationaryvehicledisplayinglightedredorredandbluelights,
10orastationaryvehicledisplayinglightedamberoramberandwhitelights,thedriverofevery
11motorvehicleshall:
12 (1)Proceedwithcautionandyieldtheright-of-way,ifpossiblewithdueregardto
13safetyandtrafficconditions,bymakingalanechangeintoalanenotadjacenttothatofthe
14stationaryvehicle,ifonaroadwayhavingatleastfourlaneswithnotlessthantwolanes
15proceedinginthesamedirectionastheapproachingvehicle;or
16 (2)Proceedwithduecautionandreducethespeedofthevehicle,maintainingasafe
17speedforroadconditions,ifchanginglaneswouldbeunsafeorimpossible.
18 3.Themotormanofeverystreetcarshallimmediatelystopsuchcarclearofany
19intersectionandkeepitinsuchpositionuntiltheemergencyvehiclehaspassed,exceptas
20otherwisedirectedbyapoliceortrafficofficer.
21 4.An"emergencyvehicle"isavehicleofanyofthefollowingtypes:
22 (1)Avehicleoperatedbythestatehighwaypatrol,thestatewaterpatrol,theMissouri
23capitolpolice,aconservationagent,orastateoracountyormunicipalparkranger,those
24vehiclesoperatedbyenforcementpersonnelofthestatehighwaysandtransportation
25commission,policeorfiredepartment,sheriff,constableordeputysheriff,federallaw
26enforcementofficerauthorizedtocarryfirearmsandtomakearrestsforviolationsofthelaws
27oftheUnitedStates,trafficofficer,coroner,medicalexaminer,orforensicinvestigatorofthe
28countymedicalexaminer'soffice,orbyaprivatelyownedemergencyvehiclecompany;
29 (2)Avehicleoperatedasanambulanceoroperatedcommerciallyforthepurposeof
30transportingemergencymedicalsuppliesororgans;
31 (3)Anyvehiclequalifyingasanemergencyvehiclepursuanttosection307.175;
32 (4)Anywrecker,ortowtruckoravehicleownedandoperatedbyapublicutilityor
33publicservicecorporationwhileperformingemergencyservice;
34 (5)Anyvehicletransportingequipmentdesignedtoextricatehumanbeingsfromthe
35wreckageofamotorvehicle;
36 (6)Anyvehicledesignatedtoperformemergencyfunctionsforacivildefenseor
37emergencymanagementagencyestablishedpursuanttotheprovisionsofchapter44;
HB1707	3 38 (7)Anyvehicleoperatedbyanauthorizedemployeeofthedepartmentofcorrections
39who,aspartoftheemployee'sofficialduties,isrespondingtoariot,disturbance,hostage
40incident,escapeorothercriticalsituationwherethereisthethreatofseriousphysicalinjury
41ordeath,respondingtomutualaidcallfromanothercriminaljusticeagency,orin
42accompanyinganambulancewhichistransportinganoffendertoamedicalfacility;
43 (8)Anyvehicledesignatedtoperformhazardoussubstanceemergencyfunctions
44establishedpursuanttotheprovisionsofsections260.500to260.550;
45 (9)Anyvehicleownedbythestatehighwaysandtransportationcommissionand
46operatedbyanauthorizedemployeeofthedepartmentoftransportationthatismarkedasa
47departmentoftransportationemergencyresponseormotoristassistancevehicle;or
48 (10)AnyvehicleownedandoperatedbythecivilsupportteamoftheMissouri
49NationalGuardwhileinresponsetoorduringoperationsinvolvingchemical,biological,or
50radioactivematerialsorinsupportofofficialrequestsfromthestateofMissouriinvolving
51unknownsubstances,hazardousmaterials,orasmayberequestedbytheappropriatestate
52agencyactingonbehalfofthegovernor.
53 5.(1)Thedriverofanyvehiclereferredtoinsubsection4ofthissectionshallnot
54soundthesirenthereonorhavethefrontredlightsorbluelightsonexceptwhensuchvehicle
55isrespondingtoanemergencycallorwheninpursuitofanactualorsuspectedlawviolator,
56orwhenrespondingto,butnotuponreturningfrom,afire.
57 (2)Thedriverofanemergencyvehiclemay:
58 (a)Parkorstandirrespectiveoftheprovisionsofsections304.014to304.025;
59 (b)Proceedpastaredorstopsignalorstopsign,butonlyafterslowingdownasmay
60benecessaryforsafeoperation;
61 (c)Exceedtheprimafaciespeedlimitsolongasthedriverdoesnotendangerlifeor
62property;
63 (d)Disregardregulationsgoverningdirectionofmovementorturninginspecified
64directions.
65 (3)Theexemptionsgrantedtoanemergencyvehiclepursuanttosubdivision(2)of
66thissubsectionshallapplyonlywhenthedriverofanysuchvehiclewhileinmotionsounds
67audiblesignalbybell,siren,orexhaustwhistleasmaybereasonablynecessary,andwhenthe
68vehicleisequippedwithatleastonelightedlampdisplayingaredlightorbluelightvisible
69undernormalatmosphericconditionsfromadistanceoffivehundredfeettothefrontofsuch
70vehicle, exceptthatanauthorizedemergencyvehicleoperatedasapolicevehicleisnot
71requiredtouseanaudiblesignalordisplayavisualsignalwhenthevehicleisbeingused
72to:
73 (a)Obtainevidenceofaspeedingviolation;
HB1707	4 74 (b)Respondtoasuspectedcrimeinprogresswhenuseofanaudibleorvisual
75signal,orboth,couldreasonablyresultinthedestructionofevidenceorescapeofa
76suspect;or
77 (c)Conductsurveillanceofavehicleorthepassengersofavehiclewhoare
78suspectedofinvolvementinacrime.
79 6.Nopersonshallpurchaseanemergencylightasdescribedinthissectionwithout
80furnishingthesellerofsuchlightanaffidavitstatingthatthelightwillbeusedexclusivelyfor
81emergencyvehiclepurposes.
82 7.ViolationofthissectionshallbedeemedaclassAmisdemeanor.
