Torepealsection260.205,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
solidwastedisposalareapermits.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section260.205,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection260.205,toreadasfollows:
260.205.1.Itshallbeunlawfulforanypersontooperateasolidwasteprocessing
2facilityorsolidwastedisposalareaofasolidwastemanagementsystemwithoutfirst
3obtaininganoperatingpermitfromthedepartment.Itshallbeunlawfulforanypersonto
4constructasolidwasteprocessingfacilityorsolidwastedisposalareawithoutfirstobtaining
5aconstructionpermitfromthedepartmentpursuanttothissection.Acurrentauthorizationto
6operateissuedbythedepartmentpursuanttosections260.200to260.345shallbeconsidered
7tobeapermittooperateforpurposesofthissectionforallsolidwastedisposalareasand
8processingfacilitiesexistingonAugust28,1995.Apermitshallnotbeissuedforasanitary
9landfilltobelocatedinafloodarea,asdeterminedbythedepartment,wherefloodwatersare
10likelytosignificantlyerodefinalcover.Apermitshallnotberequiredtooperateawaste
11stabilizationlagoon,settlingpondorotherwatertreatmentfacilitywhichhasavalidpermit
12fromtheMissouricleanwatercommissioneventhoughthefacilitymayreceivesolidor
13semisolidwastematerials.
14 2.Nopersonoroperatormayapplyfororobtainapermittoconstructasolidwaste
15disposalareaunlessthepersonhasrequestedthedepartmenttoconductapreliminarysite
16investigationandobtainedpreliminaryapprovalfromthedepartment.Thedepartmentshall,

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17withinsixtydaysofsuchrequest,conductapreliminaryinvestigationandapproveor
18disapprovethesite.
19 3.Allproposedsolidwastedisposalareasforwhichapreliminarysiteinvestigation
20requestpursuanttosubsection2ofthissectionisreceivedbythedepartmentonorafter
21August28,1999,shallbesubjecttoapublicinvolvementactivityaspartofthepermit
22applicationprocess.Theactivityshallconsistofthefollowing:
23 (1)Theapplicantshallnotifythepublicofthepreliminarysiteinvestigationapproval
24withinthirtydaysafterthereceiptofsuchapproval.Suchpublicnotificationshallbeby
25certifiedmailtothegoverningbodyofthecountyorcityinwhichtheproposeddisposalarea
26istobelocatedandbycertifiedmailtothesolidwastemanagementdistrictinwhichthe
27proposeddisposalareaistobelocated;
28 (2)Withinninetydaysafterthepreliminarysiteinvestigationapproval,the
29departmentshallconductapublicawarenesssessioninthecountyinwhichtheproposed
30disposalareaistobelocated.Thedepartmentshallprovidepublicnoticeofsuchsessionby
31bothprintedandbroadcastmediaatleastthirtydayspriortosuchsession.Printed
32notificationshallincludepublicationinatleastonenewspaperhavinggeneralcirculation
33withinthecountyinwhichtheproposeddisposalareaistobelocated.Broadcastnotification
34shallincludepublicserviceannouncementsonradiostationsthathavebroadcastcoverage
35withinthecountyinwhichtheproposeddisposalareaistobelocated.Theintentofsuch
36publicawarenesssessionshallbetoprovidegeneralinformationtointerestedcitizensonthe
37designandoperationofsolidwastedisposalareas;
38 (3)Atleastsixtydayspriortothesubmissiontothedepartmentofareportonthe
39resultsofadetailedsiteinvestigationpursuanttosubsection4ofthissection,theapplicant
40shallconductacommunityinvolvementsessioninthecountyinwhichtheproposeddisposal
41areaistobelocated.Departmentstaffshallattendanysuchsession.Theapplicantshall
42providepublicnoticeofsuchsessionbybothprintedandbroadcastmediaatleastthirtydays
43priortosuchsession.Printednotificationshallincludepublicationinatleastonenewspaper
44havinggeneralcirculationwithinthecountyinwhichtheproposeddisposalareaistobe
45located.Broadcastnotificationshallincludepublicserviceannouncementsonradiostations
46thathavebroadcastcoveragewithinthecountyinwhichtheproposeddisposalareaistobe
47located.Suchpublicnoticesshallincludetheaddressesoftheapplicantandthedepartment
48andinformationonapubliccommentperiod.Suchpubliccommentperiodshallbeginonthe
49dayofthecommunityinvolvementsessionandcontinueforatleastthirtydaysaftersuch
50session.Theapplicantshallrespondtoallpersonssubmittingcommentsduringthepublic
51commentperiodnomorethanthirtydaysafterthereceiptofsuchcomments;
SSHB1751	2 52 (4)Ifaproposedsolidwastedisposalareaistobelocatedinacountyorcitythathas
53localplanningandzoningrequirements,theapplicantshallnotberequiredtoconducta
54communityinvolvementsessionifthefollowingconditionsaremet:
55 (a)Thelocalplanningandzoningrequirementsincludeapublicmeeting;
56 (b)Theapplicantnotifiesthedepartmentofintenttoutilizesuchmeetinginlieuof
57thecommunityinvolvementsessionatleastthirtydayspriortosuchmeeting;
58 (c)Therequirementsofsuchmeetingincludeprovidingpublicnoticebyprintedor
59broadcastmediaatleastthirtydayspriortosuchmeeting;
60 (d)Suchmeetingisheldatleastthirtydayspriortothesubmissiontothedepartment
61ofareportontheresultsofadetailedsiteinvestigationpursuanttosubsection4ofthis
62section;
63 (e)Theapplicantsubmitstothedepartmentarecordofsuchmeeting;
64 (f)Apubliccommentperiodbeginsonthedayofsuchmeetingandcontinuesforat
65leastfourteendaysaftersuchmeeting,andtheapplicantrespondstoallpersonssubmitting
66commentsduringsuchpubliccommentperiodnomorethanfourteendaysafterthereceiptof
67suchcomments.
68 4.Nopersonmayapplyfororobtainapermittoconstructasolidwastedisposalarea
69unlessthepersonhassubmittedtothedepartmentaplanforconductingadetailedsurfaceand
70subsurfacegeologicandhydrologicinvestigationandhasobtainedgeologicandhydrologic
71siteapprovalfromthedepartment.Thedepartmentshallapproveordisapprovetheplan
72withinthirtydaysofreceipt.Theapplicantshallconducttheinvestigationpursuanttothe
73planandsubmittheresultstothedepartment.Thedepartmentshallprovideapprovalor
74disapprovalwithinsixtydaysofreceiptoftheinvestigationresults.
75 5.(1)Everypersondesiringtoconstructasolidwasteprocessingfacilityorsolid
76wastedisposalareashallmakeapplicationforapermitonformsprovidedforthispurposeby
77thedepartment.Everyapplicantshallsubmitevidenceoffinancialresponsibilitywiththe
78application.Anyapplicantwhoreliesinpartuponaparentcorporationforthisdemonstration
79shallalsosubmitevidenceoffinancialresponsibilityforthatcorporationandanyother
80subsidiarythereof.
81 (2)Everyapplicantshallprovideafinancialassuranceinstrumentorinstrumentsto
82thedepartmentpriortothegrantingofaconstructionpermitforasolidwastedisposalarea.
83Thefinancialassuranceinstrumentorinstrumentsshallbeirrevocable,meetallrequirements
84establishedbythedepartmentandshallnotbecancelled,revoked,disbursed,releasedor
85allowedtoterminatewithouttheapprovalofthedepartment.Afterthecessationofactive
86operationofasanitarylandfill,orothersolidwastedisposalareaasdesignedbythe
87department,neithertheguarantornortheoperatorshallcancel,revokeordisbursethe
SSHB1751	3 88financialassuranceinstrumentorallowtheinstrumenttoterminateuntiltheoperatoris
89releasedfrompostclosuremonitoringandcareresponsibilitiespursuanttosection260.227.
90 (3)Theapplicantforapermittoconstructasolidwastedisposalareashallprovide
91thedepartmentwithplans,specifications,andsuchotherdataasmaybenecessarytocomply
92withthepurposeofsections260.200to260.345.Theapplicationshalldemonstrate
93compliancewithallapplicablelocalplanningandzoningrequirements.Thedepartmentshall
94makeaninvestigationofthesolidwastedisposalareaanddeterminewhetheritcomplieswith
95theprovisionsofsections260.200to260.345andtherulesandregulationsadoptedpursuant
96tosections260.200to260.345.Withintwelveconsecutivemonthsofthereceiptofan
97applicationforaconstructionpermitthedepartmentshallapproveordenytheapplication.
98Thedepartmentshallissuerulesandregulationsestablishingtimelimitsforpermit
99modificationsandrenewalofapermitforasolidwastedisposalarea.Thetimelimitshallbe
100consistentwiththischapter.
101 (4)Theapplicantforapermittoconstructasolidwasteprocessingfacilityshall
102providethedepartmentwithplans,specificationsandsuchotherdataasmaybenecessaryto
103complywiththepurposeofsections260.200to260.345.Withinonehundredeightydaysof
104receiptoftheapplication,thedepartmentshalldeterminewhetheritcomplieswiththe
105provisionsofsections260.200to260.345.Withintwelveconsecutivemonthsofthereceipt
106ofanapplicationforapermittoconstructanincineratorasdescribedinthedefinitionofsolid
107wasteprocessingfacilityinsection260.200oramaterialrecoveryfacilityasdescribedinthe
108definitionofsolidwasteprocessingfacilityinsection260.200,andwithinsixmonthsfor
109permitmodifications,thedepartmentshallapproveordenytheapplication.Permitsissued
110forsolidwastefacilitiesshallbefortheanticipatedlifeofthefacility.
111 (5)Ifthedepartmentfailstoapproveordenyanapplicationforapermitorapermit
112modificationwithinthetimelimitsspecifiedinsubdivisions(3)and(4)ofthissubsection,the
113applicantmaymaintainanactioninthecircuitcourtofColeCountyorthatofthecountyin
114whichthefacilityislocatedoristobesited.Thecourtshallorderthedepartmenttoshow
115causewhyithasnotactedonthepermitandthecourtmay,uponthepresentationofevidence
116satisfactorytothecourt,orderthedepartmenttoissueordenysuchpermitorpermit
117modification.Permitsforsolidwastedisposalareas,whetherissuedbythedepartmentor
118orderedtobeissuedbyacourt,shallbefortheanticipatedlifeofthefacility.
119 (6)Theapplicantforapermittoconstructasolidwasteprocessingfacilityshallpay
120anapplicationfeeofonethousanddollars.Uponcompletionofthedepartment'sevaluation
121oftheapplication,butbeforereceivingapermit,theapplicantshallreimbursethedepartment
122forallreasonablecostsincurredbythedepartmentuptoamaximumoffourthousanddollars.
123Theapplicantforapermittoconstructasolidwastedisposalareashallpayanapplicationfee
124oftwothousanddollars.Uponcompletionofthedepartment'sevaluationsoftheapplication,
SSHB1751	4 125butbeforereceivingapermit,theapplicantshallreimbursethedepartmentforallreasonable
126costsincurredbythedepartmentuptoamaximumofeightthousanddollars.Applicantswho
127withdrawtheirapplicationbeforethedepartmentcompletesitsevaluationshallberequiredto
128reimbursethedepartmentforcostsincurredintheevaluation.Thedepartmentshallnot
129collectthefeesauthorizedinthissubdivisionunlessitcomplieswiththetimelimits
130establishedinthissection.
131 (7)Whenthereviewrevealsthatthefacilityorareadoesconformwiththeprovisions
132ofsections260.200to260.345andtherulesandregulationsadoptedpursuanttosections
133260.200to260.345,thedepartmentshallapprovetheapplicationandshallissueapermitfor
134theconstructionofeachsolidwasteprocessingfacilityorsolidwastedisposalareaasset
135forthintheapplicationandwithanypermittermsandconditionswhichthedepartmentdeems
136appropriate.Intheeventthatthefacilityorareafailstomeettherulesandregulations
137adoptedpursuanttosections260.200to260.345,thedepartmentshallissueareporttothe
138applicantstatingthereasonfordenialofapermit.
139 6.Plans,designs,andrelevantdatafortheconstructionofsolidwasteprocessing
140facilitiesandsolidwastedisposalareasshallbesubmittedtothedepartmentbyaregistered
141professionalengineerlicensedbythestateofMissouriforapprovalpriortotheconstruction,
142alterationoroperationofsuchafacilityorarea.
143 7.Anypersonoroperatorasdefinedinsection260.200whointendstoobtaina
144constructionpermitinasolidwastemanagementdistrictwithanapprovedsolidwaste
145managementplanshallrequestarecommendationinsupportoftheapplicationfromthe
146executiveboardcreatedinsection260.315.Theexecutiveboardshallconsidertheimpactof
147theproposalon,andtheextenttowhichtheproposalconformsto,theapproveddistrictsolid
148wastemanagementplanpreparedpursuanttosection260.325.Theexecutiveboardshallact
149upontherequestforarecommendationwithinsixtydaysofreceiptandshallsubmita
150resolutiontothedepartmentspecifyingitspositionanditsrecommendationregarding
151conformityoftheapplicationtothesolidwasteplan.Theboard'sfailuretosubmita
152resolutionconstitutesrecommendationoftheapplication.Thedepartmentmayconsiderthe
153application,regardlessoftheboard'sactionthereonandmaydenytheconstructionpermitif
154theapplicationfailstomeettherequirementsofsections260.200to260.345,orifthe
155applicationisinconsistentwiththedistrict'ssolidwastemanagementplan.
156 8.Ifthesiteproposedforasolidwastedisposalareaisnotownedbytheapplicant,
157theownerorownersofthesiteshallacknowledgethatanapplicationpursuanttosections
158260.200to260.345istobesubmittedbysignatureorsignaturesthereon.Thedepartment
159shallprovidetheownerwithcopiesofallcommunicationwiththeoperator,including
160inspectionreportsandordersissuedpursuanttosection260.230.
SSHB1751	5 161 9.Thedepartmentshallnotissueapermitfortheoperationofasolidwastedisposal
162area,solidwasteprocessingfacility,demolitionlandfill,orsanitarylandfilldesignedto
163serveacitywithapopulationofgreaterthanfourhundredthousandlocatedinmorethanone
164county,ifthesiteislocatedwithin[one-half] onemileofanadjoiningmunicipality,without
165theapprovalofthegoverningbodyof[such] theadjoiningmunicipality.Thegoverning
166bodyshallconductapublichearingwithinfifteendaysofnotice,shallpublicizethehearing
167inatleastonenewspaperhavinggeneralcirculationinthemunicipality,andshallvoteto
168approveordisapprovethelanddisposalfacilitywithinthirtydaysafterthecloseofthe
169hearing.
170 10.(1)Uponreceiptofanapplicationforapermittoconstructasolidwaste
171processingfacilityordisposalarea,thedepartmentshallnotifythepublicofsuchreceipt:
172 (a)Bylegalnoticepublishedinanewspaperofgeneralcirculationintheareaofthe
173proposeddisposalareaorprocessingfacility;
174 (b)Bycertifiedmailtothegoverningbodyofthecountyorcityinwhichthe
175proposeddisposalareaorprocessingfacilityistobelocated;and
176 (c)Bymailtothelastknownaddressofallrecordownersofcontiguousrealproperty
177orrealpropertylocatedwithinonethousandfeetoftheproposeddisposalareaand,fora
178proposedprocessingfacility,noticeasprovidedinsection64.875orsection89.060,
179whicheverisapplicable.
180 (2)Ifanapplicationforaconstructionpermitmeetsallstatutoryandregulatory
181requirementsforissuance,apublichearingonthedraftpermitshallbeheldbythedepartment
182inthecountyinwhichtheproposedsolidwastedisposalareaistobelocatedpriortothe
183issuanceofthepermit.Thedepartmentshallprovidepublicnoticeofsuchhearingbyboth
184printedandbroadcastmediaatleastthirtydayspriortosuchhearing.Printednotification
185shallincludepublicationinatleastonenewspaperhavinggeneralcirculationwithinthe
186countyinwhichtheproposeddisposalareaistobelocated.Broadcastnotificationshall
187includepublicserviceannouncementsonradiostationsthathavebroadcastcoveragewithin
188thecountyinwhichtheproposeddisposalareaistobelocated.
189 11.Aftertheissuanceofaconstructionpermitforasolidwastedisposalarea,but
190priortothebeginningofdisposaloperations,theownerandthedepartmentshallexecutean
191easementtoallowthedepartment,itsagentsoritscontractorstoenterthepremisesto
192completeworkspecifiedintheclosureplan,ortomonitorormaintainthesiteortotake
193remedialactionduringthepostclosureperiod.Afterissuanceofaconstructionpermitfora
194solidwastedisposalarea,butpriortothebeginningofdisposaloperations,theownershall
195submitevidencethatsuchownerhasrecorded,intheofficeoftherecorderofdeedsinthe
196countywherethedisposalareaislocated,anoticeandcovenantrunningwiththelandthatthe
197propertyhasbeenpermittedasasolidwastedisposalareaandprohibitsuseofthelandinany
SSHB1751	6 198mannerwhichinterfereswiththeclosureand,whereappropriate,postclosureplansfiledwith
199thedepartment.
200 12.Everypersondesiringtoobtainapermittooperateasolidwastedisposalareaor
201processingfacilityshallsubmitapplicableinformationandapplyforanoperatingpermitfrom
202thedepartment.Thedepartmentshallreviewtheinformationanddetermine,withinsixty
203daysofreceipt,whetheritcomplieswiththeprovisionsofsections260.200to260.345and
204therulesandregulationsadoptedpursuanttosections260.200to260.345.Whenthereview
205revealsthatthefacilityorareadoesconformwiththeprovisionsofsections260.200to
206260.345andtherulesandregulationsadoptedpursuanttosections260.200to260.345,the
207departmentshallissueapermitfortheoperationofeachsolidwasteprocessingfacilityor
208solidwastedisposalareaandwithanypermittermsandconditionswhichthedepartment
209deemsappropriate.Intheeventthatthefacilityorareafailstomeettherulesandregulations
210adoptedpursuanttosections260.200to260.345,thedepartmentshallissueareporttothe
211applicantstatingthereasonfordenialofapermit.
212 13.Eachsolidwastedisposalarea,exceptutilitywastelandfillsunlessotherwiseand
213totheextentrequiredbythedepartment,andthosesolidwasteprocessingfacilities
214designatedbyrule,shallbeoperatedunderthedirectionofacertifiedsolidwastetechnician
215inaccordancewithsections260.200to260.345andtherulesandregulationspromulgated
216pursuanttosections260.200to260.345.
217 14.Basedataforthequalityandquantityofgroundwaterinthesolidwastedisposal
218areashallbecollectedandsubmittedtothedepartmentpriortotheoperationofanewor
219expansionofanexistingsolidwastedisposalarea.Basedatashallincludeachemical
220analysisofgroundwaterdrawnfromtheproposedsolidwastedisposalarea.
221 15.Leachatecollectionandremovalsystemsshallbeincorporatedintonewor
222expandedsanitarylandfillswhicharepermittedafterAugust13,1986.Thedepartmentshall
223assesstheneedforaleachatecollectionsystemforalltypesofsolidwastedisposalareas,
224otherthansanitarylandfills,andtheneedformonitoringwellswhenitevaluatesthe
225applicationforallneworexpandedsolidwastedisposalareas.Thedepartmentmayrequire
226anoperatorofasolidwastedisposalareatoinstallaleachatecollectionsystembeforethe
227beginningofdisposaloperations,atanytimeduringdisposaloperationsforunfilledportions
228ofthearea,orforanyportionofthedisposalareaasapartofaremedialplan.The
229departmentmayrequiretheoperatortoinstallmonitoringwellsbeforethebeginningof
230disposaloperationsoratanytimeduringtheoperationallifeorpostclosurecareperiodifit
231concludesthatconditionsattheareawarrantsuchmonitoring.Theoperatorofademolition
232landfillorutilitywastelandfillshallnotberequiredtoinstallaleachatecollectionand
233removalsystemormonitoringwellsunlessotherwiseandtotheextentthedepartmentso
SSHB1751	7 234requiresbasedonhazardouswastecharacteristiccriteriaorsitespecificgeohydrological
235characteristicsorconditions.
236 16.Permitsgrantedbythedepartment,asprovidedinsections260.200to260.345,
237shallbesubjecttosuspensionforadesignatedperiodoftime,civilpenaltyorrevocation
238wheneverthedepartmentdeterminesthatthesolidwasteprocessingfacilityorsolidwaste
239disposalareais,orhasbeen,operatedinviolationofsections260.200to260.345ortherules
240orregulationsadoptedpursuanttosections260.200to260.345,orhasbeenoperatedin
241violationofanypermittermsandconditions,oriscreatingapublicnuisance,healthhazard,
242orenvironmentalpollution.Intheeventapermitissuspendedorrevoked,thepersonnamed
243inthepermitshallbefullyinformedastothereasonsforsuchaction.
244 17.Eachpermitforoperationofafacilityorareashallbeissuedonlytotheperson
245namedintheapplication.Permitsaretransferableasamodificationtothepermit.An
246applicationtotransferownershipshallidentifytheproposedpermittee.Adisclosure
247statementfortheproposedpermitteelistingviolationscontainedinthedefinitionof
248disclosurestatementfoundinsection260.200shallbesubmittedtothedepartment.The
249operationanddesignplansforthefacilityorareashallbeupdatedtoprovidecompliancewith
250thecurrentlyapplicablelawandrules.Afinancialassuranceinstrumentinsuchanamount
251andformasprescribedbythedepartmentshallbeprovidedforsolidwastedisposalareasby
252theproposedpermitteepriortotransferofthepermit.Thefinancialassuranceinstrumentof
253theoriginalpermitteeshallnotbereleaseduntilthenewpermittee'sfinancialassurance
254instrumenthasbeenapprovedbythedepartmentandthetransferofownershipiscomplete.
255 18.ThosesolidwastedisposalareaspermittedonJanuary1,1996,shall,upon
256submissionofarequestforpermitmodification,begrantedasolidwastemanagementarea
257operatingpermitiftherequestmeetsreasonablerequirementssetoutbythedepartment.
258 19.Incaseapermitrequiredpursuanttothissectionisdeniedorrevoked,theperson
259mayrequestahearinginaccordancewithsection260.235.
260 20.Everyapplicantforapermitshallfileadisclosurestatementwiththeinformation
261requiredbyandonaformdevelopedbythedepartmentofnaturalresourcesatthesametime
262theapplicationforapermitisfiledwiththedepartment.
263 21.Uponrequestofthedirectorofthedepartmentofnaturalresources,theapplicant
264forapermit,anypersonthatcouldreasonablybeexpectedtobeinvolvedinmanagement
265activitiesofthesolidwastedisposalareaorsolidwasteprocessingfacility,oranypersonwho
266hasacontrollinginterestinanypermitteeshallberequiredtosubmittoacriminal
267backgroundcheckundersection43.543.
268 22.Allpersonsrequiredtofileadisclosurestatementshallprovideanyassistanceor
269informationrequestedbythedirectororbytheMissouristatehighwaypatrolandshall
270cooperateinanyinquiryorinvestigationconductedbythedepartmentandanyinquiry,
SSHB1751	8 271investigationorhearingconductedbythedirector.If,uponissuanceofaformalrequestto
272answeranyinquiryorproduceinformation,evidenceortestimony,anypersonrequiredtofile
273adisclosurestatementrefusestocomply,theapplicationofanapplicantorthepermitofa
274permitteemaybedeniedorrevokedbythedirector.
275 23.Ifanyoftheinformationrequiredtobeincludedinthedisclosurestatement
276changes,orifanyadditionalinformationshouldbeaddedafterthefilingofthestatement,the
277personrequiredtofileitshallprovidethatinformationtothedirectorinwriting,withinthirty
278daysafterthechangeoraddition.Thefailuretoprovidesuchinformationwithinthirtydays
279mayconstitutethebasisfortherevocationofordenialofanapplicationforanypermitissued
280orappliedforinaccordancewiththissection,butonlyif,priortoanysuchdenialor
