2 (1)"Lawenforcementofficer",asherifforpeaceofficerofamunicipalitywiththe
3dutyandpowerofarrestforviolationofthegeneralcriminallawsofthestateorforviolation
4ofordinancesofmunicipalities;
5 (2)"Municipality",anycounty,city,town,orvillage;
6 (3)"Municipalityofficial",anyelectedorappointedofficialoranylawenforcement
7officerservingthemunicipality;
8 (4)"Sanctuarypolicy",anymunicipality'sorderorordinance,enactedorfollowed

15 2.Nomunicipalityshallenactoradoptanysanctuarypolicy.Anymunicipalitythat
16enactsoradoptsasanctuarypolicyshallbeineligibleforanymoneysprovidedthroughgrants

18longerineffect.Uponthecomplaintofanystateresidentregardingaspecificgovernment
19entity,agency,orpoliticalsubdivisionofthisstateorpriortotheprovisionoffundsor
20awardingofanygrantstoagovernmententity,agency,orpoliticalsubdivisionofthisstate,
21anymemberofthegeneralassemblymayrequestthattheattorneygeneralofthestateof
22Missouriissueanopinionstatingwhetherthegovernmententity,agency,orpolitical
23subdivisionhascurrentpoliciesincontraventionofthissection.
24 3.Thegoverningbody,sheriff,orchiefofpoliceofeachmunicipalityshallprovide
25eachlawenforcementofficerwithwrittennoticeoftheirdutytocooperatewithstateand
26federalagenciesandofficialsonmatterspertainingtoenforcementofstateandfederallaws
27governingimmigration.
28 4.ThissectionshallbecomeeffectiveonJanuary1,2009.
29 5.Theprovisionsofthissectionshallnotapplytoqualifiedimmigrantworkers
30registeredintheMissouridepartmentoflaborandindustrialrelationsdatabaseunder
31section285.545.
191.265.Anynoncompeteclauseofanemploymentcontractbetweenan
2employerandaphysicianlicensedunderchapter334thatrestrictstherightofthe
3physiciantopracticemedicineinanygeographicareaforanyperiodoftimeafterthe
4terminationofsuchemploymentrelationshipshallbevoidandunenforceable,provided
5thatnothinginthissectionshallrendervoidorunenforceabletheremainingprovisions
6ofanysuchemploymentcontract.
285.530.1.Nobusinessentityoremployershallknowinglyemploy,hirefor
2employment,orcontinuetoemployanunauthorizedalientoperformworkwithinthestateof
3Missouri.
4 2.Asaconditionfortheawardofanycontractorgrantinexcessoffivethousand
5dollarsbythestateorbyanypoliticalsubdivisionofthestatetoabusinessentity,orforany
6businessentityreceivingastate-administeredorsubsidizedtaxcredit,taxabatement,orloan
7fromthestate,thebusinessentityshall,byswornaffidavitandprovisionofdocumentation,
8affirmitsenrollmentandparticipationinafederalworkauthorizationprogramwithrespectto
9theemployeesworkinginconnectionwiththecontractedservices.Everysuchbusiness
10entityshallalsosignanaffidavitaffirmingthatitdoesnotknowinglyemployanypersonwho
11isanunauthorizedalieninconnectionwiththecontractedservices.Anyentitycontracting
12withthestateoranypoliticalsubdivisionofthestateshallonlyberequiredtoprovidethe
13affidavitsrequiredinthissubsectiontothestateandanypoliticalsubdivisionofthestatewith
14whichitcontracts,onanannualbasis.Duringorimmediatelyafteranemergency,the
15requirementsofthissubsectionthatabusinessentityenrollandparticipateinafederalwork
16authorizationprogramshallbesuspendedforfifteenworkingdays.Asusedinthis
HCSHB2489	2 17subsection,"emergency"includesthefollowingnaturalandmanmadedisasters:majorsnow
18andicestorms,floods,tornadoes,severeweather,earthquakes,hazardousmaterialincidents,
19nuclearpowerplantaccidents,otherradiologicalhazards,andmajormechanicalfailuresofa
20publicutilityfacility.
21 3.Allpublicemployers, privateemployers,andbusinessentitiesshallenrolland
22activelyparticipateinafederalworkauthorizationprogram.
23 4.(1)BeginningJanuary1,2025,anemployer[mayenrollandparticipateina
24federalworkauthorizationprogramand]orbusinessentityshallverifytheemployment
25eligibilityofeveryemployeeintheemployer'sorbusinessentity'shirewhoseemployment
26commencesaftertheemployerorbusinessentityenrollsinafederalworkauthorization
27program.Theemployerorbusinessentityshallretainacopyofthedatedverificationreport
28receivedfromthefederalgovernment.[Any] Anemployerorbusinessentity[that
29participates] enrolledandparticipatinginsuchprogramshallhaveanaffirmativedefense
30thatsuchbusinessentityhasnotviolatedsubsection1ofthissection.
31 (2)(a)Ifaprivateemployerorbusinessentityfailstocomplywiththis
32subsection,thedepartmentshallrequiretheprivateemployerorbusinessentityto
33provideanaffidavittothedepartmentstatingthattheprivateemployerorbusiness
34entity:
35 a.Willcomplywiththissubsection;
36 b.Hasterminatedtheemploymentofallunauthorizedaliensinthisstate;and
37 c.Willnotknowinglyemployanunauthorizedalieninthisstate.
38 (b)Iftheprivateemployerorbusinessentitydoesnotprovidetherequired
39affidavitandfailstocomplywiththissubsectionwithinfifteendaysofthedateofthe
40department'snotice,theattorneygeneralshalldirecttheappropriatelicensingagency
41orapplicablemunicipalorcountygoverningbodytosuspendallapplicablelicenses,
42permits,orexemptionsoftheprivateemployerorbusinessentityuntiltheprivate
43employerorbusinessentityprovidesthedepartmentwiththerequiredaffidavitthat
44demonstratescompliancewiththissubsection.
45 5.(1)Ageneralcontractororsubcontractorofanytiershallnotbeliableunder
46sections285.525to285.550whensuchgeneralcontractororsubcontractorcontractswithits
47directsubcontractorwhoviolatessubsection1ofthissection,ifthecontractbindingthe
48contractorandsubcontractoraffirmativelystatesthatthedirectsubcontractorisnot
49knowinglyinviolationofsubsection1ofthissectionandshallnothenceforthbeinsuch
50violationandthecontractororsubcontractorreceivesaswornaffidavitunderthepenaltyof
51perjuryattestingtothefactthatthedirectsubcontractor'semployeesarelawfullypresentin
52theUnitedStates.
HCSHB2489	3 53 (2)Ifageneralcontractororsubcontractorofanytierknowsordiscoversthat
54thedirectsubcontractorofsuchgeneralcontractororsubcontractorisinviolationof
55subsection1ofthissection,thegeneralcontractororsubcontractorshallreportsuch
56violationtothedepartment.Ifthegeneralcontractororsubcontractorfailstoreport
57suchviolationuponlearningoftheviolation,thegeneralcontractororsubcontractor
58shallbesubjecttothesamepenaltyfortheviolationasthedirectsubcontractor.
285.535.1.Theattorneygeneralshallenforcetherequirementsofsections285.525
2to285.550.
3 2.Anenforcementactionshallbeinitiatedbymeansofawritten,signedcomplaint
4underpenaltyofperjuryasdefinedinsection575.040totheattorneygeneralsubmittedby
5anystateofficial,businessentity,orstateresident.Avalidcomplaintshallincludean
6allegationwhichdescribestheallegedviolatoraswellastheactionsconstitutingthe
7violation,andthedateandlocationwheresuchactionsoccurred.Acomplaintwhichalleges
8aviolationsolelyorprimarilyonthebasisofnationalorigin,ethnicity,orraceshallbe
9deemedinvalidandshallnotbeenforced.
10 3.Uponreceiptofavalidcomplaint,theattorneygeneralshall,withinfifteen
11businessdays,requestidentityinformationfromthebusinessentityregardinganypersons
12allegedtobeunauthorizedaliens.Suchrequestshallbemadebycertifiedmail.Theattorney
13generalshalldirecttheapplicablemunicipalorcountygoverningbodytosuspendany
14applicablelicense,permit,orexemptionsofanybusinessentitywhichfails,withinfifteen
15businessdaysafterreceiptoftherequest,toprovidesuchinformation.
16 4.Theattorneygeneral,afterreceivingtherequestedidentityinformationfromthe
17businessentity,shallsubmitidentitydatarequiredbythefederalgovernmenttoverify,under
188U.S.C.1373,theimmigrationstatusofsuchpersons,andshallprovidethebusinessentity
19withwrittennoticeoftheresultsoftheverificationrequest:
20 (1)Ifthefederalgovernmentnotifiestheattorneygeneralthatanemployeeis
21authorizedtoworkintheUnitedStates,theattorneygeneralshalltakenofurtheractionon
22thecomplaint;
23 (2)Ifthefederalgovernmentnotifiestheattorneygeneralthatanemployeeisnot
24authorizedtoworkintheUnitedStates,theattorneygeneralshallproceedonthecomplaintas
25providedinsubsection5ofthissection;
26 (3)Ifthefederalgovernmentnotifiestheattorneygeneralthatitisunabletoverify
27whetheranemployeeisauthorizedtoworkintheUnitedStates,theattorneygeneralshall
28takenofurtheractiononthecomplaintuntilaverificationfromthefederalgovernment
29concerningthestatusoftheindividualisreceived.Atnopointshallanystateofficialattempt
30tomakeanindependentdeterminationofanyalien'slegalstatuswithoutverificationfromthe
31federalgovernment.

33authorizedtoworkintheUnitedStates,andtheemployeroftheunauthorizedalien
34participatesinafederalworkauthorizationprogram,thereshallbearebuttablepresumption
35thattheemployerhasmettherequirementsforanaffirmativedefenseundersubsection4of
36section285.530,andtheemployershallcomplywithsubsection6ofthissection.
37 (2)Ifthefederalgovernmentnotifiestheattorneygeneralthatanemployeeisnot
38authorizedtoworkintheUnitedStates,theattorneygeneralshallbringacivilactioninCole
39Countyiftheattorneygeneralreasonablybelievesthebusinessentityknowinglyviolated
40subsection1ofsection285.530:
41 (a)Ifthecourtfindsthatabusinessentitydidnotknowinglyviolatesubsection1of
42section285.530,theemployershallhavefifteenbusinessdaystocomplywithsubdivision(1)
43andparagraph(a)ofsubdivision(2)ofsubsection6ofthissection.Iftheentityfailstodoso,
44thecourtshalldirecttheapplicablemunicipalorcountygoverningbodytosuspendthe
45businesspermit,ifsuchexists,andanyapplicablelicensesorexemptionsoftheentityuntil
46theentitycomplieswithsubsection6ofthissection;
47 (b)Ifthecourtfindsthatabusinessentityknowinglyviolatedsubsection1ofsection
48285.530,thecourtshalldirecttheapplicablemunicipalorcountygoverningbodytosuspend
49thebusinesspermit,ifsuchexists,andanyapplicablelicensesorexemptionsofsuchbusiness
50entityfor[fourteen] onehundredtwentydays.Permits,licenses,andexemptionsshallbe
51reinstatedforentitieswhocomplywithsubsection6ofthissectionattheendofthe[fourteen-
52day]one-hundred-twenty-dayperiod.
53 6.Thecorrectionofaviolationwithrespecttotheemploymentofanunauthorized
54alienshallincludethefollowingactions:
55 (1)(a)Thebusinessentityterminatestheunauthorizedalien'semployment.Ifthe
56businessentityattemptstoterminatetheunauthorizedalien'semploymentandsuch
57terminationischallengedinacourtofthestateofMissouri,thefifteen-business-dayperiod
58forprovidinginformationtotheattorneygeneralreferencedinsubsection3ofthissection
59shallbetolledwhilethebusinessentitypursuestheterminationoftheunauthorizedalien's
60employmentinsuchforum;or
61 (b)Thebusinessentity,afteracquiringadditionalinformationfromtheemployee,
62requestsasecondaryoradditionalverificationbythefederalgovernmentoftheemployee's
63authorization,undertheproceduresofafederalworkauthorizationprogram.Whilethis
64verificationispending,thefifteen-business-dayperiodforprovidinginformationtothe
65attorneygeneralreferencedinsubsection3ofthissectionshallbetolled;and
66 (2)Alegalrepresentativeofthebusinessentitysubmits,atanofficedesignatedby
67theattorneygeneral,thefollowing:

69descriptionofthespecificmeasuresandactionstakenbythebusinessentitytoendthe
70violation,andthename,address,andotheradequateidentifyinginformationforany
71unauthorizedaliensrelatedtothecomplaint;and
72 (b)Documentationacceptabletotheattorneygeneralwhichconfirmsthatthe
73businessentityhasenrolledinandisparticipatinginafederalworkauthorizationprogram.
74 7.Thesuspensionofabusinesslicenseorlicensesundersubsection5ofthissection
75shallterminateonebusinessdayafteralegalrepresentativeofthebusinessentitysubmitsthe
76affidavitandotherdocumentationrequiredundersubsection6ofthissectionfollowingany
77periodofrestrictionrequiredundersubsection5ofthissection.
78 8.Foranentitythatviolatessubsection1ofsection285.530forasecondtime,the
79courtshalldirecttheapplicablemunicipalorcountygoverningbodytosuspend,foroneyear,
80thebusinesspermit,ifsuchexists,andanyapplicablelicenseorexemptionsofthebusiness
81entity.Forasubsequentviolation,thecourtshalldirecttheapplicablemunicipalorcounty
82governingbodytoforeversuspendthebusinesspermit,ifsuchexists,andanyapplicable
83licenseorexemptionsofthebusinessentity.Asecondorsubsequentviolationof
84subsection1ofsection285.530byanybusinessentityshallbedeemedaclassDfelony.
85 9.Inadditiontothepenaltiesinsubsections5and8ofthissection:
86 (1)Uponthefirstviolationofsubsection1ofsection285.530byanybusinessentity
87awardedastatecontractorgrantorreceivingastate-administeredtaxcredit,taxabatement,
88orloanfromthestate,thebusinessentityshallbedeemedinbreachofcontractandthestate
89mayterminatethecontractandsuspendordebarthebusinessentityfromdoingbusinesswith
90thestateforaperiodofthreeyears.Uponsuchtermination,thestatemaywithholdupto
91twenty-fivepercentofthetotalamountduetothebusinessentity;
92 (2)Uponasecondorsubsequentviolationofsubsection1ofsection285.530byany
93businessentityawardedastatecontractorgrantorreceivingastate-administeredtaxcredit,
94taxabatement,orloanfromthestate,thebusinessentityshallbedeemedinbreachofcontract
95andthestatemayterminatethecontractandpermanentlysuspendordebarthebusinessentity
96fromdoingbusinesswiththestate.Uponsuchtermination,thestatemaywithholdupto
97twenty-fivepercentofthetotalamountduetothebusinessentity.Asecondorsubsequent
98violationofsubsection1ofsection285.530byanybusinessentityshallbedeemedaclass
99Dfelony.
100 10.Sections285.525to285.550shallnotbeconstruedtodenyanyprocedural
101mechanismsorlegaldefensesincludedinafederalworkauthorizationprogram.
102 11.Anybusinessentitysubjecttoacomplaintandsubsequentenforcementunder
103sections285.525to285.540,oranyemployeeofsuchabusinessentity,maychallengethe

105Missouri.
106 12.Ifthecourtfindsthatanycomplaintisfrivolousinnatureorfindsnoprobable
107causetobelievethattherehasbeenaviolation,thecourtshalldismissthecase.Forpurposes
108ofthissubsection,"frivolous"shallmeanacomplaintnotshownbyclearandconvincing
109evidencetobevalid.Anypersonwhosubmitsafrivolouscomplaintshallbeliableforactual,
110compensatory,andpunitivedamagestotheallegedviolatorforholdingtheallegedviolator
111beforethepublicinafalselight.Ifthecourtfindsthatacomplaintisfrivolousorthatthereis
112notprobablecausetobelievetherehasbeenaviolation,theattorneygeneralshallissuea
113publicreporttothecomplainantandtheallegedviolatorstatingwithparticularityitsreasons
114fordismissalofthecomplaint.Uponsuchissuance,thecomplaintandallmaterialsrelating
115tothecomplaintshallbeapublicrecordasdefinedinchapter610.
116 13.Thedeterminationofwhetheraworkerisanunauthorizedalienshallbemadeby
117thefederalgovernment.Adeterminationofsuchstatusofanindividualbythefederal
118governmentshallcreatearebuttablepresumptionastothatindividual'sstatusinanyjudicial
119proceedingsbroughtunderthissectionorsection285.530.Thecourtmaytakejudicialnotice
120ofanyverificationofanindividual'sstatuspreviouslyprovidedbythefederalgovernment
121andmayrequestthefederalgovernmenttoprovideautomatedortestimonialverification.
122 14.Compensation,whetherinmoneyorinkindorinservices,knowinglyprovidedto
123anyunauthorizedalienshallnotbeallowedasabusinessexpensedeductionfromanyincome
124orbusinesstaxesofthisstate.
125 15.Anybusinessentitywhichterminatesanemployeeinaccordancewiththissection
126shallnotbeliableforanyclaimsmadeagainstthebusinessentityunderchapter213forthe
127termination.

24currentimmigrationstatusisinasuspendedquasi-legalstatus;and
25 (c)IsanewhireoremployedinthestateofMissouri;
26 (4)"Unauthorizedalien",thesamemeaningassuchtermisdefinedunder
27section285.525.
28 3.(1)TheMissouridepartmentoflaborandindustrialrelationsshallmaintain
29adatabaseorregistryofqualifiedimmigrantworkers.Thedepartmentshallestablish
30anyformsandproceduresnecessarytoprocessandmaintainsuchadatabaseor
31registry,mechanismsbywhichemployersshallverifyregistrationofanyqualified
32immigrantworkers,andanyothernecessaryinformationrequiredtoverifytheidentity
33andemploymentofqualifiedimmigrantworkers,butnotmoreordifferentdocuments
34thanarerequiredbyfederallawforthefederalgovernmenttoverifyemployment.
35 (2)Individualswhohavedocumentationincluding,butnotlimitedto,avalid
36immigrantvisa,PermanentResident(Green)Card,orEmploymentAuthorization
37Document,thatverifieshisorherlegalstatusasalawfulpermanentresident,asylee,
38refugee,nonimmigrantvisaholder,orotherverifiablelawfulimmigrationstatus,shall
39beexemptfromregisteringwiththedepartmentunderthissection.
40 4.Aqualifiedimmigrantworkershallberequiredtosignanaffidavitof
41understanding,onaformdevelopedbythedepartment,thatincludes,butisnotlimited
42to,thefollowing:
43 (1)Thattheregistrationqualifiesthequalifiedimmigrantworkerfor
44employmentonlyuntillegalimmigrationstatusisdeterminedbythecourts;
45 (2)Thatnothinginthissectionshallmakethequalifiedimmigrantworker
46eligibleforanyotherservicesprovidedbythestate;and
47 (3)Thatifatanytimethequalifiedimmigrantworkerisconvictedofafelony
48crimeinthefederalorstatecourtssystem,theworkprivilegeswillbeimmediately
49revoked.
HCSHB2489	8 50 5.Notwithstandinganyotherlawtothecontraryandsubjecttoallapplicable
51federallaws,aqualifiedimmigrantworker,asdefinedunderthissection,shallbe
52registeredbytheworker'semployerwiththedepartment,andsuchemployershall
53providethedepartmentwithallnecessarydocumentationincompliancewiththis
54section.
55 6.Thedepartmentshallprovideawrittenconfirmationtotheemployerupon
56theregistrationofthequalifiedimmigrantworkerincompliancewiththissection.
57 7.Theprovisionsrelatingtoverificationeligibilityofaqualifiedimmigrant
58workershallnotapplytoanemployerwhoreceivesandprovidesthenecessary
59documentationrelatingtothequalifiedimmigrantworkertothedepartmentin
60compliancewiththissection.Theverificationeligibilityofaqualifiedimmigrant
61workershallbeincludedinthedatabaseorregistrymaintainedbythedepartmentfor
62futureeligibilitydeterminations.
63 8.TheMissouriattorneygeneralshallbeauthorizedwiththeenforcementofthe
64provisionsofthissection,subjecttotheapplicablerequirementsofsections285.525to
65285.550.
66 9.Thedepartmentmayestablishmemorandumsofunderstandingbetweenthe
67attorneygeneral'sofficeandtheMissouristatehighwaypatroltosharesuch
68informationunderthissectioninfurtheranceofthepurposesofthissection.
69 10.Thedepartmentshallissueawrittennoncompliancenoticetoanyemployer
70whofailstoregisteraqualifiedimmigrantworkerwithinthirtydaysofhire.Ifthe
71employerfailstoregistertheworkerwithinthefifteendaysafterreceiptofsuchnotice,
72thedepartmentshallnotifytheattorneygeneraloftheemployer'snoncomplianceand
73theattorneygeneralshalldirecttheappropriatelicensingagencyorapplicable

76 11.(1)Aftertheemployernotifies,inwriting,thequalifiedimmigrantworker
77oranindividualseekingemploymentthatthefailuretosubmittherequested
78documentationisaviolationofthelawandsubjecttopunishment,anyqualified
79immigrantworkeroranindividualseekingemploymentwhofailstoprovidethe
80employer-requesteddocumentationthatisrequiredtoverifyworkauthorizationstatus
81withtheemployer,federalauthorities,andthedepartmentforthepurposesofthis
82registry,withinthirtydaysofthedateoftherequest,shallbeguiltyofaclassDfelony.
83 (2)Theattorneygeneralshallinvestigateallegedorsuspectedviolationsofthis
84subsectionandshallhavetheauthoritytoprosecuteallegedviolations.
85 (3)Anenforcementactionshallbeinitiatedbymeansofasigned,written
86complaint,underpenaltyofperjury,asdefinedinsection575.040,totheattorney
