18+221.407, and 221.410, RSMo, are repealed and eight new sections 2
19+enacted in lieu thereof, to be known as sections 217.451, 3
20+221.108, 221.400, 221.402, 221.405, 221.407, 221.410, and 4
21+550.320, to read as follows:5
22+ 217.451. 1. Correctional centers shall p rovide 1
23+offenders with reasonable access to phone services during an 2
24+offender's term of confinement; provided that, phone access 3
25+may be restricted as a disciplinary measure. 4
26+ 2. No correctional center or other party shall charge 5
27+an offender in a correctional center a total amount for a 6
28+domestic phone call, including fees and any per -minute rate, 7
29+that exceeds the equivalent of twelve cents per minute. 8
30+ 221.108. 1. Jails shall provide inmates with 1
31+reasonable access to phone serv ices during an inmate's term 2
32+of confinement; provided that, phone access may be 3
33+restricted as a disciplinary measure. 4 SS SB 900 2
34+ 2. No jail or other party shall charge an inmate in a 5
35+jail a total amount for a domestic phone call, including 6
36+fees and any per-minute rate, that exceeds the equivalent of 7
37+twelve cents per minute. 8
38+ 221.400. 1. Any two or more contiguous counties 1
39+within the state may form an agreement to establish a 2
40+regional jail district. The district shall have a boundary 3
41+which includes the areas within each member county, and it 4
42+shall be named the "______ Regional Jail District". Such 5
43+regional jail districts may contract to carry out the 6
44+mission of the commission and the regional jail district. 7
45+ 2. The county commission of each county desiring to 8
46+join the district shall approve an ordinance , order, or 9
47+resolution to join the district and shall approve the 10
48+agreement which specifies the duties of each county within 11
49+the district. 12
50+ 3. If any county wishes to jo in a district which has 13
51+already been established under this section, the agreement 14
52+shall be rewritten and reapproved by each member county. If 15
53+the district already levies a sales tax pursuant to section 16
54+221.407, the county desiring to join shall have approved the 17
55+levy of the district sales tax in the county pursuant to 18
56+subsection 3 of section 221.407, and the rewritten agreement 19
57+shall be provided. 20
58+ 4. The agreement which specifies the duties of each 21
59+county shall contain the following: 22
60+ (1) The name of the district; 23
61+ (2) The names of the counties within the district; 24
62+ (3) The formula for calculating each county's 25
63+contribution to the costs of the district; 26 SS SB 900 3
64+ (4) The types of prisoners which the regional jail may 27
65+house, limited to prisoners which may be transferred to 28
66+counties under state law; 29
67+ (5) The methods and powers which may be used for 30
68+constructing, leasing or financing a regional jail; 31
69+ (6) The duties of the director of the regional jail; 32
70+ (7) The timing and procedures for approval of the 33
71+regional jail district's annual budget by the regional jail 34
72+commission; and 35
73+ (8) The delegation, if any, by the member counties to 36
74+the regional jail district of the power of eminent domain. 37
75+ 5. Any county, city, town or village may contract with 38
76+a regional jail commission for the holding of its prisoners. 39
77+ 221.402. In addition to the powers granted to the 1
78+district by its member counties under the agreement, the 2
79+district has all the powe rs necessary or appropriate to 3
80+carry out its purposes, including, but not limited to, the 4
81+following: 5
82+ (1) To adopt bylaws and rules for the regulation of 6
83+its affairs and the conduct of its business; 7
84+ (2) To adopt an official seal; 8
85+ (3) To maintain an office at such place or places in 9
86+one or more of the member counties as the commission may 10
87+designate; 11
88+ (4) To sue and be sued; 12
89+ (5) To make and execute leases, contracts, releases, 13
90+compromises and other instruments necessary or co nvenient 14
91+for the exercise of its powers or to carry out its purposes; 15
92+ (6) To acquire, construct, reconstruct, repair, alter, 16
93+improve, [and] equip, extend, and maintain jail facilities; 17
94+ (7) To sell, lease, assign, mortgage, grant a security 18
95+interest in, exchange, donate and convey any or all of its 19 SS SB 900 4
96+properties whenever the commission finds such action to be 20
97+in furtherance of the district's purposes; 21
98+ (8) To collect rentals, fees and other charges in 22
99+connection with its services or for t he use of any 23
100+facilities; 24
101+ (9) To issue its bonds, notes or other obligations for 25
102+any of its corporate purposes and to refund the same. 26
103+ 221.405. 1. Any regional jail district created 1
104+pursuant to section 221.400 shall be governe d by a 2
105+commission. The commission shall be composed of the sheriff 3
106+and presiding commissioner from each county within the 4
107+district. 5
108+ 2. Each commissioner shall serve during his tenure as 6
109+sheriff or as presiding commissioner. 7
110+ 3. Commissioners shall serve until their successors in 8
111+their county offices have [been duly appointed] assumed 9
112+office. Vacancies on the commission shall be filled by the 10
113+succeeding sheriff or presiding commissioner for the 11
114+remainder of the term. 12
115+ 4. Commissioners shall serve without compensation, 13
116+except that they shall be reimbursed by the district for 14
117+their reasonable and necessary expenses in the performance 15
118+of their duties. 16
119+ 5. A jail commissioner from each county in the 17
120+district shall present a prop osed budget to the county 18
121+commission. 19
122+ 221.407. 1. The commission of any regional jail 1
123+district may impose, by order, a sales tax in the amount of 2
124+[one-eighth of] up to one percent[, one-fourth of one 3
125+percent, three-eighths of one percent, or one-half of one 4
126+percent] on all retail sales made in such region which are 5
127+subject to taxation pursuant to the provisions of sections 6 SS SB 900 5
128+144.010 to 144.525 for the purpose of providing jail 7
129+services [and court], facilities, and equipment for su ch 8
130+region. The tax authorized by this section shall be in 9
131+addition to any and all other sales taxes allowed by law, 10
132+except that no order imposing a sales tax pursuant to this 11
133+section shall be effective unless the commission submits to 12
134+the voters of the district, on any election date authorized 13
135+in chapter 115, a proposal to authorize the commission to 14
136+impose a tax. 15
137+ 2. The ballot of submission shall contain, but need 16
138+not be limited to, the following language: 17
139+If a majority of the votes cast on the proposal by the 28
140+qualified voters of the district voting thereon are in favor 29
141+of the proposal, then the order and any amendment to such 30
142+order shall be in effect on the first day of the second 31
143+quarter immediately following the election approving the 32
144+proposal. If the proposal receives less than the required 33
145+majority, the commission shall have no power to impose the 34
146+sales tax authorized pursuant to this section unless and 35
147+until the commission shall again have submitted another 36
148+proposal to authorize the commis sion to impose the sales tax 37

104-21thereonareinfavoroftheproposal,thentheorderandanyamendmenttosuchordershallbe
105-22ineffectonthefirstdayofthesecondquarterimmediatelyfollowingtheelectionapproving
106-23theproposal.Iftheproposalreceiveslessthantherequiredmajority,thecommissionshall
107-24havenopowertoimposethesalestaxauthorizedpursuanttothissectionunlessanduntilthe
108-25commissionshallagainhavesubmittedanotherproposaltoauthorizethecommissionto
109-26imposethesalestaxauthorizedbythissectionandsuchproposalisapprovedbythe
110-27[required] majorityofthequalifiedvotersofthedistrictvotingonsuchproposal[; however,in
111-28noeventshallaproposalpursuanttothissectionbesubmittedtothevoterssoonerthan
112-29twelvemonthsfromthedateofthelastsubmissionofaproposalpursuanttothissection].
113-30 3.Inthecaseofacountyattemptingtojoinanexistingdistrictthatleviesasales
114-31taxpursuanttosubsection1ofthissection,suchjoiningwiththedistrictshallnot
115-32becomeeffectiveuntiltheapprovalofthevoterstolevythedistrictsalestaxinthe
116-33countyattemptingtojointhedistricthasbeenobtained.Theelectionshallbecalledby
117-34thecountycommissionofthecountyattemptingtojointhedistrict,andthedistrictshall
118-35byordinanceororderprovidethatthesalestaxshallbeleviedinthejoiningcounty,
119-36subjecttoapprovalofthecountyvotersashereinprovided.Theballotofsubmission

237-33 5.Ifadoctor,nurse,orotherhealthcareprovidertreatingthepregnantoffender

239-35requeststhatrestraintsnotbeused,thesherifforjaileraccompanyingsuchoffender

241-37 6.Pregnantoffendersshallbetransportedinvehiclesequippedwithseatbelts.
242-38 7.Thecountyorcityjailshall:

236+ [4.] 5. Once the tax authorized by this section is 92
237+abolished or terminated by any means, all funds remaining in 93
238+the special trust fund shall be used solely for providing 94
239+jail services [and court], facilities and equipment for the 95
240+district. Any funds in such special trust fund which are 96
241+not needed for current expenditures may be invested by the 97
242+commission in accordance with applicable laws relating to 98
243+the investment of other county funds. 99
244+ [5.] 6. All sales taxes collected by the director of 100
245+revenue pursuant to this section on behalf of any district, 101 SS SB 900 8
246+less one percent for cost of collection which shall be 102
247+deposited in the state's general revenue fund after paym ent 103
248+of premiums for surety bonds as provided in section 32.087, 104
249+shall be deposited in a special trust fund, which is hereby 105
250+created, to be known as the "Regional Jail District Sales 106
251+Tax Trust Fund". The moneys in the regional jail district 107
252+sales tax trust fund shall not be deemed to be state funds 108
253+and shall not be commingled with any funds of the state. 109
254+The director of revenue shall keep accurate records of the 110
255+amount of money in the trust fund which was collected in 111
256+each district imposing a sale s tax pursuant to this section, 112
257+and the records shall be open to the inspection of officers 113
258+of each member county and the public. Not later than the 114
259+tenth day of each month the director of revenue shall 115
260+distribute all moneys deposited in the trust fun d during the 116
261+preceding month to the district which levied the tax. Such 117
262+funds shall be deposited with the treasurer of each such 118
263+district, and all expenditures of funds arising from the 119
264+regional jail district sales tax trust fund shall be paid 120
265+pursuant to an appropriation adopted by the commission and 121
266+shall be approved by the commission. Expenditures may be 122
267+made from the fund for any [function authorized in the order 123
268+adopted by the commission submitting the regional jail 124
269+district tax to the voter s] of the district's authorized 125
270+purposes. 126
271+ [6.] 7. The director of revenue may make refunds from 127
272+the amounts in the trust fund and credited to any district 128
273+for erroneous payments and overpayments made, and may redeem 129
274+dishonored checks and drafts d eposited to the credit of such 130
275+districts. If any district abolishes the tax, the 131
276+commission shall notify the director of revenue of the 132
277+action at least ninety days prior to the effective date of 133 SS SB 900 9
278+the repeal, and the director of revenue may order retent ion 134
279+in the trust fund, for a period of one year, of two percent 135
280+of the amount collected after receipt of such notice to 136
281+cover possible refunds or overpayment of the tax and to 137
282+redeem dishonored checks and drafts deposited to the credit 138
283+of such accounts. After one year has elapsed after the 139
284+effective date of abolition of the tax in such district, the 140
285+director of revenue shall remit the balance in the account 141
286+to the district and close the account of that district. The 142
287+director of revenue shall noti fy each district in each 143
288+instance of any amount refunded or any check redeemed from 144
289+receipts due the district. 145
290+ [7.] 8. Except as provided in this section, all 146
291+provisions of sections 32.085 and 32.087 shall apply to the 147
292+tax imposed pursuant to thi s section. 148
293+ [8. The provisions of this section shall expire 149
294+September 30, 2028.] 150
295+ 221.410. Except as provided in sections 221.400 to 1
296+221.420 the regional jail commission shall have the 2
297+following powers and duties: 3
298+ (1) It shall implement the agreement approved by the 4
299+counties within the district under section 221.400; 5
300+ (2) It shall determine the means to establish a 6
301+regional jail for the district; 7
302+ (3) It shall appoint a director for the regional jail; 8
303+ (4) It shall determine the initial budget for the 9
304+regional jail and shall approve, after a review and a 10
305+majority of the commissioners concurring therein, all 11
306+subsequent budgets, for which proposals may be submitted by 12
307+the director; 13
308+ (5) It may determine the policies for the housing of 14
309+prisoners within the regional jail; 15 SS SB 900 10
310+ (6) It may buy, lease or sell real or personal 16
311+property for the purpose of establishing and maintaining a 17
312+regional jail, and it may contract with public or private 18
313+entities [for the planning and acquisition of a ] to acquire, 19
314+construct, reconstruct, repair, alter, improve, equip, and 20
315+extend a regional jail; 21
316+ (7) It may contract with [the department of 22
317+corrections and with cities and other counties in this 23
318+state] governmental entities, including, without limitation, 24
319+agencies and instrumentalities thereof, or private entities 25
320+for the housing of prisoners; 26
321+ (8) It shall approve all positions to be created for 27
322+the purpose of administering the regional jail; and 28
323+ (9) It shall approve a location for the regional jail 29
324+which is [generally central to ] within the district. 30
325+ 550.320. 1. As used in this section, the following 1
326+terms shall mean: 2
327+ (1) "Department", the department of corrections o f the 3
328+state of Missouri; 4
329+ (2) "Jail reimbursement", a daily per diem paid by the 5
330+state for the reimbursement of time spent in custody. 6
331+ 2. Notwithstanding any other provision of law to the 7
332+contrary, whenever any person is sentenced to a term o f 8
333+imprisonment in a correctional center, the department shall 9
334+reimburse the county or city not within a county for the 10
335+days the person spent in custody at a per diem cost, subject 11
336+to appropriation, but not to exceed thirty -seven dollars and 12
337+fifty cents per day per offender. The jail reimbursement 13
338+shall be subject to review and approval of the department. 14
339+The state shall pay the costs when: 15
340+ (1) A person is sentenced to a term of imprisonment as 16
341+authorized by chapter 558; 17 SS SB 900 11
342+ (2) A person is sentenced pursuant to section 559.115; 18
343+ (3) A person has his or her probation or parole 19
344+revoked because the offender has, or allegedly has, violated 20
345+any condition of the offender's probation or parole, and 21
346+such probation or parole is a consequence of a violation of 22
347+the law, or the offender is a fugitive from the state or 23
348+otherwise held at the request of the department regardless 24
349+of whether or not a warrant has been issued; or 25
350+ (4) A person has a period of detention imposed 26
351+pursuant to section 559.026. 27
352+ 3. When the final determination of any criminal 28
353+prosecution shall be such as to render the state liable for 29
354+costs under existing laws, it shall be the duty of the 30
355+sheriff to certify to the clerk of the county or the chief 31
356+executive officer of the city not within a county the total 32
357+number of days any offender who was a party in such case 33
358+remained in the jail. It shall then be the duty of the 34
359+county clerk or the chief executive officer of the city not 35
360+within the county to submit th e total number of days spent 36
361+in custody to the department. The county clerk or chief 37
362+executive officer of the city not within the county may 38
363+submit claims to the department, no later than two years 39
364+from the date the claim became eligible for reimburse ment. 40
365+ 4. The department shall determine if the expenses are 41
366+eligible pursuant to the provisions of this chapter and 42
367+remit any payment to the county or city not within a county 43
368+when the expenses are determined to be eligible. The 44
369+department shall establish, by rule, the process for 45
370+submission of claims. Any rule or portion of a rule, as 46
371+that term is defined in section 536.010, that is created 47
372+under the authority delegated in this section shall become 48
373+effective only if it complies with and is subject to all of 49 SS SB 900 12
374+the provisions of chapter 536 and, if applicable, section 50
375+536.028. This section and chapter 536 are nonseverable and 51
376+if any of the powers vested with the general assembly 52
377+pursuant to chapter 536 to review, to delay the effective 53
378+date, or to disapprove and annul a rule are subsequently 54
379+held unconstitutional, then the grant of rulemaking 55
380+authority and any rule proposed or adopted after August 28, 56
381+2024, shall be invalid and void. 57
382+ [221.105. 1. The governing body o f any 1
383+county and of any city not within a county shall 2
384+fix the amount to be expended for the cost of 3
385+incarceration of prisoners confined in jails or 4
386+medium security institutions. The per diem cost 5
387+of incarceration of these prisoners chargeable 6
388+by the law to the state shall be determined, 7
389+subject to the review and approval of the 8
390+department of corrections. 9
391+ 2. When the final determination of any 10
392+criminal prosecution shall be such as to render 11
393+the state liable for costs under existing laws, 12
394+it shall be the duty of the sheriff to certify 13
395+to the clerk of the circuit court or court of 14
396+common pleas in which the case was determined 15
397+the total number of days any prisoner who was a 16
398+party in such case remained in the county jail. 17
399+It shall be the duty of the county commission to 18
400+supply the cost per diem for county prisons to 19
401+the clerk of the circuit court on the first day 20
402+of each year, and thereafter whenever the amount 21
403+may be changed. It shall then be the duty of 22
404+the clerk of the court in wh ich the case was 23
405+determined to include in the bill of cost 24
406+against the state all fees which are properly 25
407+chargeable to the state. In any city not within 26
408+a county it shall be the duty of the 27
409+superintendent of any facility boarding 28
410+prisoners to certify to the chief executive 29
411+officer of such city not within a county the 30
412+total number of days any prisoner who was a 31
413+party in such case remained in such facility. 32
414+It shall be the duty of the superintendents of 33 SS SB 900 13
415+such facilities to supply the cost per diem to 34
416+the chief executive officer on the first day of 35
417+each year, and thereafter whenever the amount 36
418+may be changed. It shall be the duty of the 37
419+chief executive officer to bill the state all 38
420+fees for boarding such prisoners which are 39
421+properly chargeable to the state. The chief 40
422+executive may by notification to the department 41
423+of corrections delegate such responsibility to 42
424+another duly sworn official of such city not 43
425+within a county. The clerk of the court of any 44
426+city not within a county shall not i nclude such 45
427+fees in the bill of costs chargeable to the 46
428+state. The department of corrections shall 47

431+ 3. Except as provided under subsection 6 50
432+of section 217.718, the actual costs chargeable 51
433+to the state, including those incurred for a 52
434+prisoner who is incarcerated in the county jail 53
435+because the prisoner's parole or probation has 54
436+been revoked or because the prisoner has, or 55
437+allegedly has, violated any condition of the 56
438+prisoner's parole or probation, and such parole 57
439+or probation is a consequence of a violation of 58
440+a state statute, or the prisoner is a fugitive 59
441+from the Missouri department of corrections or 60
442+otherwise held at the request of the Missouri 61
443+department of correction s regardless of whether 62
444+or not a warrant has been issued shall be the 63
445+actual cost of incarceration not to exceed: 64
446+ (1) Until July 1, 1996, seventeen dollars 65
447+per day per prisoner; 66
448+ (2) On and after July 1, 1996, twenty 67
449+dollars per day per pris oner; 68
450+ (3) On and after July 1, 1997, up to 69
451+thirty-seven dollars and fifty cents per day per 70
452+prisoner, subject to appropriations. 71
453+ 4. The presiding judge of a judicial 72
454+circuit may propose expenses to be reimbursable 73
455+by the state on behalf of one or more of the 74
456+counties in that circuit. Proposed reimbursable 75
457+expenses may include pretrial assessment and 76
458+supervision strategies for defendants who are 77 SS SB 900 14
459+ultimately eligible for state incarceration. A 78
460+county may not receive more than its share o f 79
461+the amount appropriated in the previous fiscal 80
462+year, inclusive of expenses proposed by the 81
463+presiding judge. Any county shall convey such 82
464+proposal to the department, and any such 83
465+proposal presented by a presiding judge shall 84
466+include the documented agreement with the 85
467+proposal by the county governing body, 86
468+prosecuting attorney, at least one associate 87
469+circuit judge, and the officer of the county 88
470+responsible for custody or incarceration of 89
471+prisoners of the county represented in the 90
472+proposal. Any county that declines to convey a 91
473+proposal to the department, pursuant to the 92
474+provisions of this subsection, shall receive its 93
475+per diem cost of incarceration for all prisoners 94
476+chargeable to the state in accordance with the 95
477+provisions of subsections 1, 2, and 3 of this 96
478+section.] 97
479+ Section B. Because of the immediate need for new and 1
480+enhanced jail facilities in the state of Missouri, the 2
481+repeal and reenactment of sections 221.400, 221.402, 3
482+221.405, 221.407, and 221.410 of this act is deemed 4
483+necessary for the immediate preservation of the public 5
484+health, welfare, peace, and safety, and is hereby declared 6
485+to be an emergency act within the meaning of the 7
486+constitution, and the repeal and reenactment of sections 8
487+221.400, 221.402, 221.4 05, 221.407, and 221.410 of this act 9
488+shall be in full force and effect upon its passage and 10
489+approval. 11
