Vacanciesonthecommissionshallbefilledbythe 8succeedingsherifforpresidingcommissionerfortheremainderoftheterm. 9 4.Commissionersshallservewithoutcompensation,exceptthattheyshallbe 10reimbursedbythedistrictfortheirreasonableandnecessaryexpensesintheperformanceof 11theirduties. 12 5.Ajailcommissionerfromeachcountyinthedistrictshallpresentaproposed 13budgettothecountycommission. 221.407.1.Thecommissionofanyregionaljaildistrictmayimpose,byorder,a 2salestaxintheamountof[one-eighthof]uptoonepercent[, one-fourthofonepercent,three- 3eighthsofonepercent,orone-halfofonepercent] onallretailsalesmadeinsuchregion 4whicharesubjecttotaxationpursuanttotheprovisionsofsections144.010to144.525forthe 5purposeofprovidingjailservices[andcourt],facilities, andequipmentforsuchregion.The 6taxauthorizedbythissectionshallbeinadditiontoanyandallothersalestaxesallowedby 7law,exceptthatnoorderimposingasalestaxpursuanttothissectionshallbeeffectiveunless 8thecommissionsubmitstothevotersofthedistrict,onanyelectiondateauthorizedinchapter 9115,aproposaltoauthorizethecommissiontoimposeatax. 10 [4.]5.Oncethetaxauthorizedbythissectionisabolishedorterminatedbyany 65means,allfundsremaininginthespecialtrustfundshallbeusedsolelyforprovidingjail 66services[andcourt],facilities, andequipmentforthedistrict.Anyfundsinsuchspecialtrust 67fundwhicharenotneededforcurrentexpendituresmaybeinvestedbythecommissionin 68accordancewithapplicablelawsrelatingtotheinvestmentofothercountyfunds. 69 [5.]6.Allsalestaxescollectedbythedirectorofrevenuepursuanttothissectionon 70behalfofanydistrict,lessonepercentforcostofcollectionwhichshallbedepositedinthe 71state'sgeneralrevenuefundafterpaymentofpremiumsforsuretybondsasprovidedin 72section32.087,shallbedepositedinaspecialtrustfund,whichisherebycreated,tobe 73knownasthe"RegionalJailDistrictSalesTaxTrustFund".Themoneysintheregionaljail 74districtsalestaxtrustfundshallnotbedeemedtobestatefundsandshallnotbecommingled 75withanyfundsofthestate.Thedirectorofrevenueshallkeepaccuraterecordsoftheamount 76ofmoneyinthetrustfundwhichwascollectedineachdistrictimposingasalestaxpursuant 77tothissection,andtherecordsshallbeopentotheinspectionofofficersofeachmember 78countyandthepublic.Notlaterthanthetenthdayofeachmonththedirectorofrevenueshall 79distributeallmoneysdepositedinthetrustfundduringtheprecedingmonthtothedistrict 80whichleviedthetax.Suchfundsshallbedepositedwiththetreasurerofeachsuchdistrict, 81andallexpendituresoffundsarisingfromtheregionaljaildistrictsalestaxtrustfundshallbe 89thetax,thecommissionshallnotifythedirectorofrevenueoftheactionatleastninetydays 90priortotheeffectivedateoftherepeal,andthedirectorofrevenuemayorderretentioninthe 221.410.Exceptasprovidedinsections221.400to221.420theregionaljail 2commissionshallhavethefollowingpowersandduties: 3 (1)Itshallimplementtheagreementapprovedbythecountieswithinthedistrict 4undersection221.400; 5 (2)Itshalldeterminethemeanstoestablisharegionaljailforthedistrict; 6 (3)Itshallappointadirectorfortheregionaljail; 7 (4)Itshalldeterminetheinitialbudgetfortheregionaljailandshallapprove,aftera 8reviewandamajorityofthecommissionersconcurringtherein,allsubsequentbudgets,for 9whichproposalsmaybesubmittedbythedirector; (1)"Extraordinarycircumstance",asubstantialflightriskorsomeother 3extraordinarymedicalorsecuritycircumstancethatdictatesrestraintsbeusedto 4ensurethesafetyandsecurityofapregnantoffenderinherthirdtrimesterora 5postpartumoffenderwithinforty-eighthourspostdelivery,thestaffofthecountyorcity 6jailormedicalfacility,otheroffenders,orthepublic; 7 (2)"Labor",theperiodoftimebeforeabirthduringwhichcontractionsare 8present; HCSSSSB900 6 9 (3)"Postpartum",theperiodofrecoveryimmediatelyfollowingchildbirth, 10whichissixweeksforavaginalbirthoreightweeksforacesareanbirth,orlongerifso 11determinedbyaphysicianornurse; 12 (4)"Restraints",anyphysicalrestraintorotherdeviceusedtocontrolthe 13movementofaperson'sbodyorlimbs. 14 2.Exceptinextraordinarycircumstances,acountyorcityjailshallnotuse 15restraintsonapregnantoffenderinherthirdtrimester,whetherduringtransportation 16toandfromvisitstohealthcareprovidersandcourtproceedingsormedical 17appointmentsandexaminations,orduringlabor,delivery,orforty-eighthours 18postdelivery. 19 3.Intheeventasherifforjailerdeterminesthatextraordinarycircumstances 20existandrestraintsarenecessary,thesherifforjailershallfullydocumentinwriting 21withinforty-eighthoursoftheincidentthereasonsheorshedeterminedsuch 22extraordinarycircumstancesexisted,thetypeofrestraintsused,andthereasonsthose 23restraintswereconsideredtheleastrestrictiveavailableandthemostreasonableunder 24thecircumstances.Suchdocumentsshallbekeptonfilebythecountyorcityjailforat 25leastfiveyearsfromthedatetherestraintswereused. 26 4.Anytimerestraintsareusedonapregnantoffenderinherthirdtrimesteror 27onapostpartumoffenderwithinforty-eighthourspostdelivery,therestraintsshallbe 28theleastrestrictiveavailableandthemostreasonableunderthecircumstances.Inno 29caseshallleg,ankle,orwaistrestraintsoranymechanicalrestraintsbeusedonany 30suchoffender,and,ifwristrestraintsareused,suchrestraintsshallbeplacedinthe 31frontofsuchoffender'sbodytoprotecttheoffenderandtheunbornchildinthecaseof 32aforwardfall. 33 5.Ifadoctor,nurse,orotherhealthcareprovidertreatingthepregnantoffender 34inherthirdtrimesterorthepostpartumoffenderwithinforty-eighthourspostdelivery 35requeststhatrestraintsnotbeused,thesherifforjaileraccompanyingsuchoffender 36shallimmediatelyremoveallrestraints. 37 6.Pregnantoffendersshallbetransportedinvehiclesequippedwithseatbelts. 38 7.Thecountyorcityjailshall: 39 (1)Ensurethatemployeesofthejailareprovidedwithtraining,whichmay 40includeonlinetraining,ontheprovisionsofthissection;and 41 (2)Informfemaleoffenders,inwritingandorally,ofanypoliciesandpractices 42developedinaccordancewiththissectionuponadmissiontothejail,andpostthe 43policiesandpracticesinlocationsinthejailwheresuchnoticesarecommonlyposted 44andwillbeseenbyfemaleoffenders. HCSSSSB900 7 221.523.1.ByJanuary1,2025,allcountyandcityjailsshalldevelopspecific 2proceduresfortheintakeandcareofoffenderswhoarepregnant,whichshallinclude 3proceduresregarding: 4 (1)Maternalhealthevaluations; 5 (2)Dietarysupplements,includingprenatalvitamins; 6 (3)Timelyandregularnutritiousmeals,whichshallinclude,atminimum,two 7thousandfivehundredcaloriestotalperday; 8 (4)Substanceabusetreatment; 9 (5)Treatmentforthehumanimmunodeficiencyvirusandwaystoavoidhuman 10immunodeficiencyvirustransmission; 11 (6)HepatitisC; 12 (7)Sleepingarrangementsforsuchoffenders,includingrequiringsuch 13offenderstosleeponthebottombunkbed; 14 (8)Accesstomentalhealthprofessionals; 15 (9)Sanitarymaterials;and 16 (10)Postpartumrecovery,includingthatnosuchoffendershallbeplacedin 17isolationduringsuchrecovery. 18 2.Asusedinthissection,"postpartumrecovery"means,asdeterminedbya 19physician,theperiodimmediatelyfollowingdelivery,includingtheentireperiodan 20offenderwhowaspregnantisinthehospitalorinfirmaryafterdelivery. 550.320.1.Asusedinthissection,thefollowingtermsshallmean: 2 (1)"Department",thedepartmentofcorrectionsofthestateofMissouri; 3 (2)"Jailreimbursement",adailyperdiempaidbythestateforthe 4reimbursementoftimespentincustody. 5 2.Notwithstandinganyotherprovisionoflawtothecontrary,wheneverany 6personissentencedtoatermofimprisonmentinacorrectionalcenter,thedepartment 7shallreimbursethecountyorcitynotwithinacountyforthedaysthepersonspentin 8custodyataperdiemcost,subjecttoappropriation,butnottoexceedthirty-seven 9dollarsandfiftycentsperdayperoffender.Thejailreimbursementshallbesubjectto 10reviewandapprovalofthedepartment.Thestateshallpaythecostswhen: 11 (1)Apersonissentencedtoatermofimprisonmentasauthorizedbychapter 12558; 13 (2)Apersonissentencedpursuanttosection559.115; 14 (3)Apersonhashisorherprobationorparolerevokedbecausetheoffender 15has,orallegedlyhas,violatedanyconditionoftheoffender'sprobationorparole,and 16suchprobationorparoleisaconsequenceofaviolationofthelaw,ortheoffenderisa HCSSSSB900 8 17fugitivefromthestateorotherwiseheldattherequestofthedepartmentregardlessof 18whetherornotawarranthasbeenissued;or 19 (4)Apersonhasaperiodofdetentionimposedpursuanttosection559.026. 20 3.Whenthefinaldeterminationofanycriminalprosecutionshallbesuchasto 21renderthestateliableforcostsunderexistinglaws,itshallbethedutyofthesheriffto 22certifytotheclerkofthecountyorthechiefexecutiveofficerofthecitynotwithina 23countythetotalnumberofdaysanyoffenderwhowasapartyinsuchcaseremainedin 24thejail.Itshallthenbethedutyofthecountyclerkorthechiefexecutiveofficerofthe 25citynotwithinthecountytosubmitthetotalnumberofdaysspentincustodytothe 26department.Thecountyclerkorchiefexecutiveofficerofthecitynotwithinthecounty 27maysubmitclaimstothedepartment,nolaterthantwoyearsfromthedatetheclaim 28becameeligibleforreimbursement. 29 4.Thedepartmentshalldetermineiftheexpensesareeligiblepursuanttothe 30provisionsofthischapterandremitanypaymenttothecountyorcitynotwithina 31countywhentheexpensesaredeterminedtobeeligible.Thedepartmentshallestablish, 32byrule,theprocessforsubmissionofclaims.Anyruleorportionofarule,asthatterm 33isdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection 34shallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof 35chapter536and,ifapplicable,section536.028.Thissectionandchapter536are 36nonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto 37chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare 38subsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandanyrule 39proposedoradoptedafterAugust28,2024,shallbeinvalidandvoid. [221.105.1.Thegoverningbodyofanycountyandofanycitynot 2 withinacountyshallfixtheamounttobeexpendedforthecostof 3 incarcerationofprisonersconfinedinjailsormediumsecurityinstitutions. 4 Theperdiemcostofincarcerationoftheseprisonerschargeablebythelawto 5 thestateshallbedetermined,subjecttothereviewandapprovalofthe 6 departmentofcorrections. 7 2.Whenthefinaldeterminationofanycriminalprosecutionshallbe 8 suchastorenderthestateliableforcostsunderexistinglaws,itshallbethe 9 dutyofthesherifftocertifytotheclerkofthecircuitcourtorcourtofcommon 10 pleasinwhichthecasewasdeterminedthetotalnumberofdaysanyprisoner 11 whowasapartyinsuchcaseremainedinthecountyjail.Itshallbetheduty 12 ofthecountycommissiontosupplythecostperdiemforcountyprisonstothe 13 clerkofthecircuitcourtonthefirstdayofeachyear,andthereafterwhenever 14 theamountmaybechanged.Itshallthenbethedutyoftheclerkofthecourt 15 inwhichthecasewasdeterminedtoincludeinthebillofcostagainstthestate 16 allfeeswhichareproperlychargeabletothestate.Inanycitynotwithina 17 countyitshallbethedutyofthesuperintendentofanyfacilityboarding HCSSSSB900 9 18 prisonerstocertifytothechiefexecutiveofficerofsuchcitynotwithina 19 countythetotalnumberofdaysanyprisonerwhowasapartyinsuchcase 20 remainedinsuchfacility.Itshallbethedutyofthesuperintendentsofsuch 21 facilitiestosupplythecostperdiemtothechiefexecutiveofficeronthefirst 22 dayofeachyear,andthereafterwhenevertheamountmaybechanged.Itshall 23 bethedutyofthechiefexecutiveofficertobillthestateallfeesforboarding 24 suchprisonerswhichareproperlychargeabletothestate.Thechiefexecutive 25 maybynotificationtothedepartmentofcorrectionsdelegatesuch 26 responsibilitytoanotherdulyswornofficialofsuchcitynotwithina 27 county.Theclerkofthecourtofanycitynotwithinacountyshallnotinclude 28 suchfeesinthebillofcostschargeabletothestate.Thedepartmentof 29 correctionsshallreviseitscriminalcostmanualinaccordancewiththis 30 provision. 31 3.Exceptasprovidedundersubsection6ofsection217.718,theactual 32 costschargeabletothestate,includingthoseincurredforaprisonerwhois 33 incarceratedinthecountyjailbecausetheprisoner'sparoleorprobationhas 34 beenrevokedorbecausetheprisonerhas,orallegedlyhas,violatedany 35 conditionoftheprisoner'sparoleorprobation,andsuchparoleorprobationis 36 aconsequenceofaviolationofastatestatute,ortheprisonerisafugitivefrom 37 theMissouridepartmentofcorrectionsorotherwiseheldattherequestofthe 38 Missouridepartmentofcorrectionsregardlessofwhetherornotawarranthas 39 beenissuedshallbetheactualcostofincarcerationnottoexceed: 40 (1)UntilJuly1,1996,seventeendollarsperdayperprisoner; 41 (2)OnandafterJuly1,1996,twentydollarsperdayperprisoner; 42 (3)OnandafterJuly1,1997,uptothirty-sevendollarsandfiftycents 43 perdayperprisoner,subjecttoappropriations. 44 4.Thepresidingjudgeofajudicialcircuitmayproposeexpensestobe 45 reimbursablebythestateonbehalfofoneormoreofthecountiesinthat 46 circuit.Proposedreimbursableexpensesmayincludepretrialassessmentand 47 supervisionstrategiesfordefendantswhoareultimatelyeligibleforstate 48 incarceration.Acountymaynotreceivemorethanitsshareoftheamount 49 appropriatedinthepreviousfiscalyear,inclusiveofexpensesproposedbythe 50 presidingjudge.Anycountyshallconveysuchproposaltothedepartment, 51 andanysuchproposalpresentedbyapresidingjudgeshallincludethe 52 documentedagreementwiththeproposalbythecountygoverningbody, 53 prosecutingattorney,atleastoneassociatecircuitjudge,andtheofficerofthe 54 countyresponsibleforcustodyorincarcerationofprisonersofthecounty 55 representedintheproposal.Anycountythatdeclinestoconveyaproposalto 56 thedepartment,pursuanttotheprovisionsofthissubsection,shallreceiveits 57 perdiemcostofincarcerationforallprisonerschargeabletothestatein 58 accordancewiththeprovisionsofsubsections1,2,and3ofthissection.] ✔ HCSSSSB900 10
