Torepealsection476.806,RSMo,andtoenactinlieuthereofonenewsectionrelatingtofees
andexpensesforaninterpreterortranslatorincertainproceedings.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section476.806,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection476.806,toreadasfollows:
476.806.1.Interpretersandtranslatorsincivil,juvenile,andcriminalproceedings
2shallbeallowedareasonablefeeapprovedbythecourtandnecessarytravelexpensesnotto
3exceedstaterates.Interpretersshallnotbecompensatedfortraveltime.
4 2.Ifthepersonrequiringaninterpreterortranslatorduringtheproceedingisaparty
5toorawitnessin[anycriminal] theproceeding,suchfeesandexpensesshallbepayableby
6thestatefromfundsappropriatedforsuchpurpose.
7 3.Inallcasesnotincludedinsubsection2ofthissection,suchfeesandexpensesmay
8betaxedascostsbythecourttotheparties.Priortoanyproceedingrequiringaninterpreter
9ortranslator,thecourtmayordereitherparty,orboth,todepositmoneywiththecourtinan
10amountreasonablynecessarytocoversuchfeesandexpenses.Upondispositionofthe
11proceedingthecourtmayordersuchcostspaidfromsuchdepositandshallreturnanyportion
12ofthedepositnotusedforsuchcourtcoststotheparties.
