13 (4)Requirementsthatcabinetsberemovedorrelocated[attheexpenseofthevideo 14serviceprovider] undertheprovisionsofsection67.1849or71.340,asapplicable,when 15necessarytoaccommodateconstruction,improvement,ormaintenanceofstreets[or],other 16publicworks,[excludingminor] orbeautificationprojects. 17 2.Apoliticalsubdivisionmaynotimposethefollowingregulationsonvideoservice 18providers: 19 (1)Requirementsthatparticularbusinessofficesorportionsofavideoservice 20networkbelocatedinthepoliticalsubdivision; 21 (2)Requirementsforpoliticalsubdivisionapprovaloftransfersofownershipor 22controlofthebusinessorassetsofavideoserviceprovider'sbusiness,exceptthatapolitical 23subdivisionmayrequirethatsuchentitymaintaincurrentpoint-of-contactinformationand 24providenoticeofatransferwithinareasonabletime;and 25 (3)Requirementsconcerningtheprovisioningoforqualityofcustomerservices, 26facilities,equipmentorgoodsin-kindforusebythepoliticalsubdivisionoranyothervideo 27serviceproviderorpublicutility. 71.340.1.Themayorandcitycouncilofanycityorthechairmanandboardof 2trusteesofanyincorporatedtownorvillageshallhavethepowertoannuallyappropriateand 3payoutofthetreasuryofsuchcityorincorporatedtownorvillageasumofmoney,notto 4exceedtenpercentoftheannualgeneralrevenuethereof,forthepurposeofconstructing, 5building,repairing,working,gradingormacadamizinganypublicroad,streetandhighway 6andanybridgethereonleadingtoandfromsuchcityorincorporatedtownorvillage;and 7suchappropriationshallbemadebyordinanceandthemoneysoappropriatedshallbe 8appliedunderthesupervisionanddirectionoftheengineersofsuchcityorincorporatedtown 9orvillage,andofthecountyhighwayengineerofthecountyinwhichsuchcity,townor 10villageislocated,orofsomecompetentpersonselectedbysuchcity,townorvillageand 11approvedbythecountyhighwayengineer,whoshallmakeareportthereof,inwriting,tothe 12mayorandcitycouncilofsuchcity,ortothechairmanandboardoftrusteesofsuch 13incorporatedtownorvillage;butthisprivilegeshallnotextendtoagreaterdistancethanfive 14milesfromthecorporatelimitsofsuchcity,townorvillage,andshallnotbeconstruedsoas 15toallowanyobstructiontoorinterferencewiththefreeuseofanysuchpublicroad,streetor 16highwaybythepublic,exceptsofarasmaybenecessarywhilesuchworkisbeingdone,and HCSHB661 2 17furthershallnotbeconstruedtoaffecttheliabilityofsuchcity,townorvillage,which 18liabilityshallbethesameasifsuchroads,streetsandhighwayswereinsidethecitylimits. 19 2.Notwithstandinganyrule,order,decision,permit,agreement,orother 20authorizationtothecontrary,acity,incorporatedtown,orvillageshallnotperformany 21roadmaintenanceorconstructionprojectunlessitreimbursesanynon-rate-regulated 22utilityproviderthatincurscostsforfacilityrelocationduetosuchmaintenanceor 23project.Acity,incorporatedtown,orvillageshallbeauthorizedtopaysuchfacility 24relocationcostsaspartofthecostoftheroadproject. 25 3.Forthepurposesofthissectionandsections226.220and226.224,"non-rate- 26regulatedutilityprovider"shallmean: 27 (1)Atelecommunicationscompanyasdefinedinsubdivision(52)ofsection 28386.020whosetelecommunicationsservicesarenotsubjecttorateofreturnregulation 29bythepublicservicecommissionpursuanttosubsection1ofsection392.240; 30 (2)Aproviderofbroadbandandotherinternetprotocol-enabledservicesas 31definedinsubsection2ofsection392.611; 32 (3)Avideoserviceproviderasdefinedinsubdivision(17)ofsubsection1of 33section67.2677;or 34 (4)Acableoperatorasdefinedinsubdivision(1)ofsubsection1ofsection 3567.2677. 226.220.1.Thereisherebycreatedandsetupthe"StateRoadFund"whichshall 2receiveallmoneysandcreditsfrom: 3 (1)Thesaleofstateroadbonds; 4 (2)TheUnitedStatesgovernmentandintendedforhighwaypurposes; 5 (3)Thestateroadbondandinterestsinkingfundasprovidedinsection226.210;and 6 (4)Anyothersourceiftheyareheldforexpenditurebyorunderthedepartmentof 7transportationorthestatehighwaysandtransportationcommissionandiftheyarenot 8requiredbysection226.200tobetransferredtothestatehighwaydepartmentfund. 9 2.Thecostsandexpenseswithdrawnfromthestatetreasury: 10 (1)Forlocating,relocating,establishing,acquiring,reimbursingfor,constructing, 11improvingandmaintainingstatehighwaysinthesystemsspecifiedinArticleIV,Section30 12(b),oftheConstitution; 13 (2)Forreimbursingnon-rate-regulatedutilityproviders,asdefinedin 14subsection3ofsection71.340,foranycostsincurredinfacilityrelocationthatis 15requiredduetoroadmaintenanceorconstruction; 16 (3)Foracquiringmaterials,equipmentandbuildings;and 17 [(3)](4)Forotherpurposesandcontingenciesrelatingandappertainingtothe 18constructionandmaintenanceofsaidhighwaysshallbepaidfromthestateroadfundupon HCSHB661 3 19warrantsdrawnbythestateauditor,baseduponbillsofparticularsandvoucherspreapproved 20andcertifiedforpaymentbythecommissionerofadministrationandbythestatehighways 21andtransportationcommissionactingthroughsuchoftheiremployeesasmaybedesignated 22bythem. 23 3.Nopaymentsortransfersshalleverbemadefromthestateroadfundexceptforan 24expendituremade: 25 (1)Underthesupervisionanddirectionofthestatehighwaysandtransportation 26commission;and 27 (2)ForapurposesetoutinSubparagraph(1),(2),(3),(4),or(5)ofSection30(b), 28ArticleIV,oftheConstitution. 226.224.Notwithstandinganyrule,order,decision,permit,agreement,orother 2authorizationtothecontrary,thedepartmentshallreimbursenon-rate-regulatedutility 3providers,asdefinedinsubsection3ofsection71.340,foranycostsincurredinfacility 4relocationthatisrequiredduetoroadmaintenance,construction,orotherright-of-way 5workactivity. 227.558.1.Iftheownerofautilityfacilityfailstoprovidetheresponsesor 2correctionstoprojectplansrequiredbysections227.553to227.556,thecommissionmay 3recoverfromtheownerdamagesintheamountofuptoonehundreddollarsperdayforeach 4daytherequiredactisnotcompleted. 5 2.Iftheownerfailstoprovidearelocationplanorfailstotimelyrelocateutility 6facilitiesinaccordancewiththerelocationplanasrequiredbysection227.555,the 7commissionmayrecoverfromtheownerdamagesintheamountofuptoonethousand 8dollarsperdayforeachdaytherequiredactisnotcompleted. 9 3.Thedamagesauthorizedbysubsections1and2ofthissectionmayberecovered 10throughactionsbroughtbythechiefcounseltothecommission,ormaybereferredtothe 11attorneygeneralforappropriateaction.Anactiontocollectthedamagesauthorizedbythis 12sectionshallbebroughtinacourtofappropriatejurisdiction.Alldamagescollectedunder 13thissectionshallbedepositedinthestateroadfund. 14 4.Nodamagesorfinesofanykindshallbeassessedfordelaysthatresult,inwholeor 15inpart,directlyorindirectly,fromanyofthefollowing: 16 (1)Customerdelays; 17 (2)Laborstrikesorshortages; 18 (3)Terroristattacks,riots,civilunrest,orcriminalsabotage; 19 (4)ActsofGod,orextremeweatherevents; 20 (5)Delayscausedbystaffingshortagesinthegeographicareanearthecommission's 21constructionprojectduetotheowner'sneedtoreassignanunusualnumberofworkerstoany 22otherareatorespondtoanactofGodorextremeweatherevent; HCSHB661 4 23 (6)Thefailureofanotherownertosufficientlycompleteitsrequiredrelocationof 24utilityfacilitiesthatinterferewithanowner'srelocationplan; 25 (7)Thefailureofanotherownerordelaybyanotherownerinsubmittingrelocation 26plansthatinterferewithanowner'srelocationplan; 27 (8)Delaysbythecommissioninacquiringnecessaryright-of-wayornecessary 28easements; 29 (9)Delayscausedbyfacilitydamagesorcablecutscausedbythecommission's 30contractor,otherowners,orthirdparties; 31 (10)Unusualmaterialshortages;and 32 (11)Anyothereventoractionbeyondthereasonablecontroloftheowner. 33 34Theoccurrenceofanyoftheunusualeventslistedinthissectionshallconstitutean 35affirmativedefensetotheassessmentofdamagesundertheprovisionsofthissection. 36 5.Exceptasprovidedinsection226.224,theremovalandrelocationofutility 37facilitiesasaresultofconstructionprojectsrequiredbythecommissionshallbemadeat 38theexpenseoftheownersunlessotherwiseprovidedbythecommission.Iftheownerfailsto 39relocatetheutilityfacilitiesinaccordancewiththerelocationplanasrequiredbysection 40227.555,theutilityfacilitiesmayberemovedandrelocatedbythestatehighwaysand 41transportationcommission,orunderitsdirection,andthecostofrelocatingtheutility 42facilitiesshallbe[collectedfromsuchowner] theresponsibilityofthecommission,as 43requiredbysection226.224,ortheowner. Ifthestatehighwaysandtransportation 44commissionoritsdesigneeremovesandrelocatestheutilityfacilities,theutilityownershall 45notbeliabletoanypartyforanydamagescausedbythecommission'sorthecommission's 46designee'sremovalandrelocationofsuchfacilities. 227.559.Anyhomerulecityhavingapopulationofsixtythousandinhabitantsor 2greateroranychartercountyofthefirstclassificationmayadoptordinances,policies, 3resolutions,orregulationsconsistentwithsections67.1849,71.340,and227.551to227.559 4regardingtherelocationofutilityfacilitieslocatedwithintheright-of-wayofstreets, 5highways,orroadsundertheirrespectivejurisdiction,whicharenotstatehighways.Any 6ordinance,policy,resolution,orregulationadoptedundertheauthorityofthissectionshall 7notinfringeupon,negateorotherwiseabrogateanowner'srighttoconstruct,own,operate, 8andmaintainutilityfacilitieswithintheright-of-waysofsuchpoliticalsubdivisionthatthe 9ownerotherwiseenjoyedpriortotheadoptionofsuchordinance,policy,resolution,or 10regulation. 229.360.Unlessotherwiserequiredbylaw,includingsection67.1849,itshallbe 2thedutyofanyperson,firmorcorporationowning,leasing,oroperatinganysuchconduits, 3poles,polelines,wires,mains,pipes,conductors,sewers,drains,tramwaysorotherobjects, HCSHB661 5 4afterserviceofthenoticerequiredinsection229.350tofurnishsuchcompetentworkmenand 5crewsasmaybenecessarytoeffectsuchremoval,changeoralteration,andtopayallactual 6expenseswhichareincurredbyanyperson,firm,corporationorpoliticalsubdivisioninso 7doing.Inmakingsuchnecessaryremoval,changeoralteration,nootherperson,firm, 8corporationorpoliticalsubdivisionshallinterferewithormakeanysuchchange,removalor 9alterationuntiltheowner,lesseeoroperatorsofsuchobjectshallhavebeennotifiedas 10providedinsection229.350,andshallhavefailedorrefusedtodosowithinareasonable 11time,andintheeventofsuchfailureorrefusalsuchworkshallbedoneonlybycompetent 12andexperiencedworkmenatthecostandexpense,however,oftheowner,lesseeoroperators 13ofsuchobject. ✔ HCSHB661 6
