5154 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5255 SECTION 1. NEW LAW A new section of law to be codified
5356 in the Oklahoma Statutes as Sect ion 5009.7 of Title 63, unless there
5457 is created a duplication in numbering, reads as follows:
55-A. It is the policy of this state that all state agencies with
56-an interest in public transit should ensure their programs are in
57-alignment with the Ok lahoma Public Transit Policy Plan as man dated
58-by Sections 322 through 324 of Title 69 of the Oklahoma Statutes and
59-that state policy and program direction related to public transit
60-and transportation should ensure a coordinated public transit
61-network that meets the mobility needs of all Oklahoma ns in a safe,
62-reliable, consistent and economical manner.
58+A. It is the policy of the State of Oklahoma that all state
59+agencies with an interest in public transit should ensure their
60+programs are in alignment with the Ok lahoma Public Transit Policy
61+Plan as mandated by Sections 322 through 324 of Title 69 of the
62+Oklahoma Statutes and that state policy and program direction

91+all Oklahomans in a safe, reliable, consistent, and economical
92+manner.
9093 B. The Oklahoma Health Care Authority, in contracting for
9194 nonemergency medical transportation for Medicaid or SoonerCare
9295 participants, shall not allow any e xisting contract to have or award
9396 any new contract that will have a negative impact on the financial
9497 stability of the state's public transit network as envisioned by the
9598 Oklahoma Public Transit Policy Plan.
9699 C. The Oklahoma Health Care Authority shall dire ct any entity
97100 contracted to broker or schedule nonemergency medical transportation
98101 for Medicaid or SoonerCare participants, whether such contract is
99102 between the entity and the Oklahoma Health Care Authority or is an
100103 entity subcontracted with an entity unde r contract with the Oklahoma
101104 Health Care Authority, to purchase participants' transportation
102105 through Oklahoma public transit systems, as defined by Sections
103106 5307, 5310 and 5311 of Title 49 of the United States Code, in all
104107 instances where public transit se rvices are available to meet the
105108 participants' needs in as cost -effective a manner as other
106109 transportation providers meeting the same state and federal
107110 regulations, safety and cleanliness standards, and education and
108111 training standards as prescribed in sub section E of this section.
109112 In purchasing such nonemergency medical transportation, the Oklahoma
110113 Health Care Authority and any contracted or subcontracted entity
111114 shall first respect the jurisdictional boundaries of such public
112-transit systems as defined by the Office of Mobility and Public
113-Transit at the Oklahoma Department of Transportation.

141+transit systems as defined by the Office of Mobility and Public
142+Transit at the Oklahoma Department of Transportation.
141143 D. Any entity contracted to broker or schedule nonemergency
142144 medical transportation for Medicaid or SoonerCare participants,
143145 whether such contract is between the entit y and the Oklahoma Health
144146 Care Authority or is an entity subcontracted with an entity under
145147 contract with the Oklahoma Health Care Authority, shall reasonably
146148 collaborate with the entity implementing a statewide mobility
147149 management program as envisioned by the Oklahoma Public Transit
148150 Policy Plan and recognized by the publi c transit agencies in the
149151 state to ensure such trips coordinate with public transit services
150152 and human services transportation through the recognized statewide
151153 mobility management program.
152154 E. In order for any public transit provider or transportation
153155 company to provide nonemergency medical transportation for Medicaid
154156 or SoonerCare participants, such provider or company shall have a
155157 valid certification from the Oklahoma Transit Association affirming
156158 that the provider or company has met certain education and training
157159 standards, adheres to all state and federal regulations, adheres to
158-industry safety and cleanliness standards and is based in this
159-state.
