58151 SECTION 1. AMENDATORY Section 1, Chapter 40, O.S.L.

73188 1. "Home food establishment" shall mean a business on the
74-premises of a residence in which prepared homemade food is products

128286 B. A home food establishment The production and sale of
129287 homemade food products that meet th e following conditions shall be
130288 exempt from the all licensing and other requirements of the State

137293 a. by the producer directly to the consumer, either in
138294 person or by remote means, including, but not limited
139295 to, the Internet or telephone, or

141296 b. by a producer's designated agent or a third -party
142297 vendor, such as a retail or grocery store, farm, farm
143298 stand, farmers market, membership -based buying club,
144299 craft fair or flea market, to the consumer; provided,
145300 the third-party vendor displays a placard where
146301 homemade food products are displayed for sale with the
147302 following disclosure: "This produc t was produced in a
148303 private residence that is exempt from government
149304 licensing and inspection. This product may contain
150305 allergens.";

167343 4. Time- or temperature-controlled-for-safety homemade food
168344 products shall be delivered by the producer directly to the
169345 consumer;

171346 5. Before a producer produces and sells time - or temperature-
172347 controlled-for-safety homemade food products, the producer shall
173348 complete and pass food safety training from a list of providers,
174349 including the ServSaf e Food Handler Training, approved by the
175350 Oklahoma Department of Agriculture, Food, and Forestry. The food
176351 safety training shall be available to complete online and shall not

352+exceed eight (8) hours in length. The Oklahoma Department of
178353 Agriculture, Food, and Forestry shall make the list of approved
179354 training available on its website by the effective date of this act;

193388 e. a statement indicating the presence of any of the
194389 eight most common allergens, including milk, eggs,
195390 peanuts, tree nuts, soy and wheat, and

197391 f. legible print stating, "This product was produced in a
198392 private residence that is exempt from government
199393 licensing and inspection.";

201394 7. If the homemade foo d product is packaged and distributed in
202395 interstate commerce, it shall also be sold and labeled in accordance
203396 with federal law; and

205397 8. Homemade food products shall not contain seafood or meat,
206-meat by-products or meat food products as defined by Section 301.2
207-of Title 9 of the Code of Federal Regulations or poultry, poultry
398+meat byproducts or meat food products as defined by Section 30 1.2 of
399+Title 9 of the Code of Federal Regulations or poultry, poultry
208400 products or poultry food products as defined for purposes of the
209401 federal Poultry Products Inspection Act.

211402 B. The information required by paragraph 6 of subsection A of
212403 this section shall be provided in a legible format of at least 10 -

223437 or other item that is made available to the consumer and is readily
224438 carriable if the homemade food product is not packaged; and

226439 4. Displayed on the webpage from which the homemade food
227440 product is offered for sale if it is sold on the Internet, provided
228441 that each item sold over the Internet shall be properly labeled or
229442 shall have a label included in the shipping container .

231443 C. The Oklahoma Department of Agriculture, Food, and Forestry
232444 may, upon a consumer complaint, request written documentation to
233445 verify the gross annual sales of a home food establishment.

235446 SECTION 4. AMENDATORY Section 4, Chapter 40, O.S.L.
236447 2013, as renumbered by Section 6, Chapter 85, O.S.L. 2017 (2 O.S.
237448 Supp. 2020, Section 5 -4.4), is amended to read as follows:

239449 Section 5-4.4 A home food establishment that sells prepared
240450 food shall affix a label that contains the following information:

242451 1. The name and addr ess of the home food establishment;

244452 2. The name of the prepared food; and

246453 3. The following statement printed in at least 10 -point type in
247454 a color that provides a clear contrast to the background of the
248455 label: "Made in a home food establishment that is n ot licensed by

250483 Freedom Act shall be construed to impede the State Department of
251484 Health in any investigation of a reported foodborne illness. Upon
252485 receipt of a consumer complaint, the Oklahoma Department of
253486 Agriculture, Food, and Forestry shall have the authority to request
254487 proof of completion of the food safety training, verify a producer's
255488 gross sales, and ensure a producer has complied with the act's
256489 labeling and delivery requirements. The Oklahoma Department of
257490 Agriculture, Food, and Forestry may fine a producer who violates
258491 this act in accordance with Section 5 -4.5 of this title.

260492 SECTION 5. AMENDATORY Section 5, Chapter 40, O.S.L.

281535 SECTION 7. AMENDATORY Section 2, Chapter 20, O.S.L. 2013
282536 (63 O.S. Supp. 2020, Section 1-1331), is amended to read as follows:

284537 Section 1-1331. A. Beekeepers with annual production of less
285538 than five hundred (500) gallons who do not qualify for the exemption
286539 provided in Section 5 -4.3 of Title 2 of the Oklahoma Statutes shall
287540 be exempt from regulation and inspection by the State Department of
288541 Health for the manufacture, sale, and distribution of honey and
289542 honeycomb products in Oklahoma if they meet the following
290543 requirements:

292544 1. The beekeeper shall only sell or distribute honey or
293545 honeycomb produced from hives located wholly within the State of
294546 Oklahoma this state which are owned and managed by the beekeeper;
295-
296547 2. The honey, honeycomb, or combination thereof is raw and not
297548 blended with other products or otherwise adulterated. The h oney may
298549 be in liquid or solid form or a combination of the two;

300550 3. The honey or honeycomb shall only be sold in-person or by a
301551 designated agent of the beekeeper to the end -use customer, or online
302552 by the beekeeper, or distributed in person to the end -use customer
303553 at the beekeeper's home, farmer's markets, roadside stands, county
304554 fairs, or similar events; by the beekeeper or members of the
305555 beekeeper's immediate family by an employee of the beekeeper, or
306556 distributed by a carrier, such as a parcel delivery se rvice, to the

311586 name, net weight of the honey, the beekeeper's name, current ten
312587 (10) digit phone number, an address wher e the honey or honeycomb was
313588 produced, and shall include the statement, "Bottled or packaged in a
314589 facility not inspected by the Oklahoma Department of Health." The
315590 statement shall be in 10 -point type or greater in a color that
316591 provides clear contrast to t he background label.

318592 B. No county, municipal corporation, consolidated government,
319593 or political subdivision of this state shall adopt or continue in
320594 effect any ordinance, rule, regulation, or resolution prohibiting,
321595 impeding, or restricting honey sales or distribution in compliance
322596 with this law.
597+SECTION 8. This act shall become effective November 1, 2021.
