3499 SECTION 1. AMENDATORY 52 O.S. 2021, Section 420.4, is

43107 this state any LPG intended for use in this state in any such
44108 system, container, appar atus or appliance, without having first
45109 applied for and obtained a registration permit to do so. A permi t

110+shall not be required by any person, firm or corporation engaged in
47111 the production or manufacture of LPG, or selling or reselling LPG to
48112 transporters, gas processors, distributors or retailers, no r by any
49113 person, firm or corporation selling or delivering motor vehicles or
50114 tractors which are factory equipped with an LPG syste m, container,
51115 apparatus or appliance for the utilization of LPG as motor fuel.
52116 The provisions of this section shall not preve nt an individual from
53117 installing in his or her own single -unit residence any system,
54118 container, apparatus or appliance which uses or will utilize LPG,
55119 provided that such individual has secured an inspection of the
56120 installation by the Administrator or someo ne designated by the
57121 Administrator or by a person duly lic ensed to make such an

59149 appliance. Applications for registration permits shall be in
60150 writing, on a form provided by the Board, and shall contain such
61151 pertinent information as is required b y the Board. Upon approval of
62152 each application and receipt of the certi ficates of insurance or
63153 securities required by the provisions of this section, the
64154 Administrator shall issue to the applicant a permit to engage in the
65155 phase of the LPG industry in thi s state to which such permit
66156 applies. No permit other than the Class I Dealer Permit shall be
67157 transferable. The Board is authorized to establish a fee fo r the
68158 transfer of a Class I Permit. Nothin g in Sections 420.1 through
69159 420.15 of this title shall be construed to regulate the
70160 manufacturing, fabrication, assembling, sellin g or installing of any
71161 system, container, apparatus or appliance having a fuel cont ainer
72162 with a maximum individual water capac ity of less than two and one-
73163 half (2 1/2) pounds.

75164 B. 1. The Board is authorized to establish an annual permit
76165 fee for the issuance of each class of permit listed in subsection C
77166 of this section.

79167 2. All such registration permits shall expire annually wit h no
80168 permit extending longer than one (1) calendar year. The expiration
81169 dates shall be set by the Board in the rules. The Admini strator may
82170 issue a semiannual permit to applicants engaging in the business

85199 date. The fee for a semiannual permit shall be one -half (1/2) that
86200 of the fee of the annual permit. All registration permits required
87201 pursuant to the provisions of this section shall be renewed upon
88202 payment of the annual fees on or be fore the expiration of the
89203 registration permit, and upon fulfilling all insurance requirements.

143266 2. The inspection fee shall increase to an amount established
144267 by the Board per vehicle if the inspection is not completed within
145268 sixty (60) days of the expiration date, or at a later date at the
146269 discretion of the Adminis trator.

153300 F. The fees provided for in this section shall be applicable to
154301 residents and nonresidents of Oklahoma.

156302 G. The Board is authorized to approve or disapprove
157303 applications for registratio n permits to distributors and retailers
158304 of LPG and managers of LPG e stablishments. The Admi nistrator is
159305 authorized to approve or disapprove all other applications for
160306 registration permits that may be issued pursuant to the provisions
161307 of this section.

163308 1. No application shall be approved by the Administrator unless
164309 the Administrator is satisfied that the applicant by written
165310 examination has shown a working knowledge of the safety requir ements
166311 provided by the rules of the Board.

168312 2. No application shall be a pproved by the Board unless the
169313 Board is satisfied by adequate writt en examination of the ap plicant,
170314 or the individual who is or shall be directly responsible for
171315 actively supervising the operations of such applicant which is a
172316 partnership, firm or corpora tion, that the applicant or such
173317 individual has a working knowledge of the safety requiremen ts
174318 provided by the rules of the Board. The Board shall cause to be
175319 held public hearings on the second Monday in the months of January,
176320 April, July and October of e ach year on all applications for new
177321 registration permits required b y the provisions of this section, or

178348 upon such other occasions as the Board may deem necessary. Notice
179349 of each hearing shall be mailed to each such applicant and shall be
180350 posted in a conspicuous place in the Office of the Administrator in
181-Oklahoma City, Oklahoma, at least thirty (30) days prior to the date ENR. H. B. NO. 1072 Page 5

182352 of the hearing. The notice shall include the name, address, pe rmit
183353 class and business location of each applicant whose application is
184354 to be considered at the hearing. The applicant, or the individual
185355 who is or shall be direct ly responsible for and actively supervising
186356 the operations of the applicant, may be present at the hearing. If,
187357 after the public hearing, an applicant is found by the Board to have
188358 a working knowledge of the safety requirements pro vided by the rules
189359 and regulations of the Board, the Board shall cause an order to that
190360 effect to be entered upon it s records and the application shall be
191361 approved. In the event an applic ant fails to qualify, the fact
192362 shall be entered upon the Board 's records.

194363 3. The Board shall charge a fee, in an amount established by
195364 the Board, for testing materials and the expense of holding the
196365 examinations provided for in this section. The fee shal l be paid
197366 upon filing an application for any permit.

199367 H. A registration permit shall not be issued to any applicant
200368 unless the Administrator has received certificates of insurance or
201369 security as required by this section.

205398 manufacturing, fabricating, assembling or installing any LPG system,
206399 container, apparatus or appliance in this state, and required to be
207400 registered pursuant to the provisions of Sections 420.1 through
208401 420.15 of this title, shall file with the Administrator a
209402 certificate indicating liability insurance coverage for the
210403 manufacturer and contractor. The Board is authorized to establish
211404 coverage amounts for each class of permit, pr ovided coverage shall
212405 be for an amount of not less than Twenty -five Thousand Dollars
213406 ($25,000.00) to Fifty Thousand Dollars ($50,000.00) for bodily
214407 injury and limits of not less than T wenty-five Thousand Dollars
215408 ($25,000.00) for property damage, and shall be in full force and
216409 effect, covering the plant, equipment and motor vehicles used in
217410 such business, and the operations of the business.

219411 J. Except as otherwise provided for in this se ction, all
220412 transporters, distributors, or retailers of LPG in this state ,
221413 required to be registered pursuant to Sections 420.1 through 420.1 5
222414 of this title, shall f ile with the Administrator a certificate
223415 indicating that public liability and property damag e insurance
224416 coverage has been issued. The Board is authorized to establ ish
225417 coverage amounts for each class of permit, provided coverage sha ll

230448 force and effect, cove ring the plant, equipment, and motor vehicles
231449 used in such business, and the operations of t he business.

233450 K. Insurance pursuant to the provisions of this section sh all
234451 be maintained in full force and effect during the operation of t he
235452 business for which th e coverage was issued. Except as otherwise
236453 provided for in this section, or in administrative rules promulgated
237454 by the Board, no registration permit shall be issue d until the
238455 certificate is filed with the Administrator. No insuran ce coverage
239456 shall be canceled or terminated without thirty (30) days prior
240457 written notice of cancellation or termina tion to the Administrator.

242458 L. The Board is authorized, upon proof of or a satisfactory
243459 showing that any person, firm or corporation is fina ncially able to
244460 pay or satisfy any judgment, claim or demand against the person,
245461 firm or corporation, to waive the i nsurance coverage required by
246462 this section. The Board, in lieu of the c ertificate, may require
247463 the deposit, with the Administrator, of secu rities, or satisfactory
248464 indemnity bond, in an amount and of a kind designated by the Board,
249465 to secure the liability of such person, firm or corporation to pay
250466 any judgment, claim or demand . The security shall not be in excess
251467 of the limits set forth in th is section. If the Boar d deems the
252468 financial status of such person, firm or corporation to be impaired
253469 so as to reduce the ability of such person, firm or corporation to
254470 make payment or to satisfy any judgment, claim or demand, the Board
255471 may revoke the waiver and require the per son, firm or corporation to

281520 authorized to refund or credit fees upon containers sold without
282521 outside of the state upon which the fees have previously bee n paid,

285550 refund. The Administrator is authorized to adopt a s ystem of
286551 identification of containers on which the fees herein levie d have

290554 state any container or cylinder up on which the applicable fee levied
291555 above applies and has not been paid. In case of failure to pay
292556 within the specified time, there shall be assessed a penalty of

322606 of the fee simple owner. The name of the fee simple owner, if other

325608 F. At least one attendant shall r emain close to the trans fer

327610 are finally disconnec ted, during the transfer of the product.
328611 During the actual transfer of liquids into containers at domestic

339646 dealers and employees in the State of Oklahoma, at such times and in
