26	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

28	54		SECTION 1. AMENDATORY 47 O.S. 2011, Sec tion 11-314, as
29	55		last amended by Section 26, Chapter 161, O.S.L. 2020 (47 O.S. Supp.
30	56		2020, Section 11-314), is amended to read as follows:

32	57		Section 11-314. A. This section shall be known and may be
33	58		cited as "Bernardo's Law".

35	59		B. The driver of a motor vehic le, upon approaching a stationary
36	60		authorized emergency vehicle, a Department of Transportation
37	61		maintenance vehicle, a Turnpike Authority maintenance vehicle, a
38	62		stationary vehicle that is displaying fla shing lights or a licensed
39	63		wrecker that is displaying a flashing amber light, a combination red

40	91		or blue light or any combination of amber, red or blue lights,
41	92		shall:

43	93		1. If traveling on a highway that consists of two or more lanes
44	94		that carry traffic in the same direction of travel as that of the
45	95		driver, the driver shall proceed with due caution and shall, if
46		-	possible and with due regard to the road, weather, and traffic ~~ENR. H. B. NO. 1584 Page 2~~
	96	+	possible and with due regard to the road, weather, and traffic
47	97		conditions, change lanes into a lane that is not adjacent to the
48	98		stationary authorized e mergency vehicle, a Department of
49	99		Transportation mainte nance vehicle, a Turnpike Authority maintenance
50	100		vehicle, or licensed wrecker; or if the driver is not able to change
51	101		lanes or if to do so would be unsafe, the driver shall proceed with
52	102		due caution and reduce the speed of the motor vehicle to a safe
53	103		speed for the existing road, weather, and traffic conditions; and

55	104		2. If traveling on a highway other than a highway described in
56	105		paragraph 1 of this subsection, the driver shall proceed with due
57	106		caution and reduce the speed of the motor vehicle to a safe speed
58	107		for the existing road, weather, and traffic conditions.

60	108		B. C. This section does not relieve the operator of a
61	109		stationary authorized emergency vehicle, a Department of
62	110		Transportation maintenance vehicle , a Turnpike Authority maintenance
63	111		vehicle, or licensed wrecker from the consequences of reckless
64	112		disregard for the safety of all persons and property upon the
65	113		highway.
