29156 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
30157 SECTION 1. NEW LAW A new section of law not to be
31158 codified in the Oklahoma Statutes reads as follows:

33159 The Legislature finds and declares the following:

35160 1. An efficient transportation system is critical for
36161 Oklahoma's economy and quality of life ;

38162 2. The revenues currently available for highways are
39163 unsustainable and inadequate to preserve and maintain existing
40164 infrastructure and provide funds for improvements that would reduce
41165 congestion and improve service;

43192 3. The gas tax is an ineffective mechani sm for meeting
44193 Oklahoma's long-term revenue needs because it will steadily generate

46195 sources of fuel are ut ilized. Currently, alternative -powered
47196 vehicles contribute less to road user reve nue used for building and
48197 maintaining Oklahoma 's highways, with some contributing none;

50198 4. Many other states have begun to explore the potential for a
51199 road usage charge to repla ce traditional motor fuel taxes;
52-
53200 5. Road usage charging is a policy whereby m otorists pay for
54201 the use of the roadway network ba sed on the distance they travel;
55-
56202 6. A road user charge program has the potential to distribute
57203 the gas tax burden across all vehicles regardless of the fuel source
58204 and to minimize the impact of the curre nt regressive gas tax
59205 structure;

61206 7. Experience to date in other states across the nation
62207 demonstrates that mileage -based charges can be implemented in a way
63208 that ensures data security and maximum privacy protection for
64209 drivers;

66210 8. According to the Departme nt of Transportation 's Long Range
67211 Transportation Plan, by 2045, the amount of fuel tax revenue
68212 generated per vehicle miles traveled is expected to decrease by
69213 forty-four and seven-tenths percent (44.7%); and

71240 9. It is therefore vital to begin the explorati on of
72241 alternative revenue sources that may be implemented in lieu of the
73242 antiquated gas tax structure now in place.

75243 SECTION 2. NEW LAW A new section of law to be codified
76244 in the Oklahoma Statutes as Section 1930 of Title 69, unless there
77245 is created a duplication in numbering, reads as follows:

79246 This act shall be known and may be cited as the "Oklahoma Road
80247 User Charge Program".

83249 in the Oklahoma Statutes as S ection 1931 of Title 69, unless there

122298 vehicle users, vehicle manufacturers and fuel
123299 distributors, to ensure fair and equitable
124300 distribution of the gas tax burden across all veh icles
125301 regardless of fuel source,

127302 b. study the availability, adaptability, reliability and
128303 security of methods that may be used in recording and
129304 reporting public road usage,

131305 c. study the ease and cost of administering the
132306 collection of taxes and fees as an alternative to the
133307 current system of taxing highway use t hrough motor
134308 vehicle fuel taxes,

136309 d. ensure that processes for collecting, managing,
137310 storing, transmitting and destroying data are in place
138311 to protect the integrity of the data and safeguard the

142340 interoperability opportunities to capture out -of-state
143341 drivers traveling through Oklahoma,

145342 f. develop and implement a voluntary pilot program to
146343 assess the potential for mileage -based revenue
147344 collection for Oklahoma 's roads and highways as an
148345 alternative to the gas tax system,

150346 g. through public outreach, se cure a sampling of
151347 individuals willing to participate in the pilot
152348 program for testing purposes in lieu of paying certain
153349 vehicle registration fees, and
154-
155350 h. seek available federal funds for studies,
156351 demonstration projects or pilots associated with the
157352 Oklahoma Road User Charge Program's implementation.

159353 B. A report of findings and rec ommendations determined by the
160354 task force on how best to implement the Oklahoma Road User Charge
161355 Program shall be submitted to the Legislature by December 31, 2023.

163356 SECTION 4. NEW LAW A new section of law to be codified
164357 in the Oklahoma Statutes as Section 193 2 of Title 69, unless there
165358 is created a duplication in numbering, reads as follows:

167359 The Oklahoma Tax Commission shall administer the collection of
168360 any charges or fees associated with the Oklahoma Road User Charge
169361 Program. Collections from the road usage charges imp osed under this
170362 act shall be specifically designated for the purpose of maintaining
