3897 SECTION 1. NEW LAW A new section of law to be codified
3998 in the Oklahoma Statutes as Section 1 -1432.1 of Title 63, unless
4099 there is created a d uplication in numbering, reads as follows:

42100 Sections 1 through 5 of this act shall be known and may be cited
43101 as the "Oklahoma Kratom Consumer Protection Act".

45102 SECTION 2. NEW LAW A new section of law to be codified
46103 in the Oklahoma Statutes as Section 1-1432.2 of Title 63, unless
47104 there is created a duplication in numbering, reads as follows:

49105 As used in this act:

51106 1. "Food" means a food, food product, food ingredient, dietary
52107 ingredient, dietary supplement or beverage for human consumpti on;
53-
54108 2. "Kratom product" means a food product or ingredient
55109 containing any part of the leaf of the plant Mitragyna speciosa; and
56-
57110 3. "Vendor" means a person that sells, prepares or maintains
58111 kratom products or that advertises, represents or holds itself ou t
59112 as selling, preparing or maintaining kratom products and includes a
60113 manufacturer, wholesaler, store, restaurant, hotel, catering
61114 facility, camp, bakery, delicatessen, supermarket, grocery store,
62115 convenience store, nursing home or food or drink company.

70147 is represented to be a kratom product shall disclose on the product
71148 label, website, or a quick response (QR) code on the product label
72149 linked to a website, the factual basis o n which that representation
73150 is made.

75151 B. A vendor shall not prepare, distribute, sell or expose for
76152 sale a food or ingredient that contains kratom as an ingredient or
77153 that is represented to be a kratom product that does not conform to
78154 the disclosure requir ed by this section.

80155 SECTION 4. NEW LAW A new section of law to be codified
81156 in the Oklahoma Statutes as Section 1 -1432.4 of Title 63, unless
82157 there is created a duplication in numbering, reads as follows:

84158 A. A vendor shall not prepar e, distribute, sell or expose for
85159 sale any of the following:

87160 1. A kratom product that is adulterated with a nonkratom
88161 substance. A kratom product is adulterated with a nonkratom
89-substance if the kratom product is mixed or packed with a nonkratom ENR. H. B. NO. 1784 Page 3
162+substance if the kratom product is mixed or packed with a nonkratom
90163 substance and that substance affects the quality or strength of the
91164 kratom product to such a degree as to render the kratom product
92165 injurious to a consumer;

94166 2. A kratom product that is contaminated with a dangerous
95167 nonkratom substance. A kratom product is contam inated with a
96168 dangerous nonkratom substance if the kratom product contains a
97169 substance that is not safe for human consumption;

99196 3. A kratom product containing a level of 7 -hydroxymitragynine
100197 in the alkaloid fraction that is greater than two percent (2%) of
101198 the alkaloid composition of the product;

103199 4. A kratom product containing any synthetic alkaloid including
104200 synthetic mitragynine, synthetic 7 -hydroxymitragynine or any other
105201 synthetically derived compounds of the kratom plant; or
106-
107202 5. A kratom product cont aining any controlled substance listed
108203 in the Uniform Controlled Dangerous Substances Act, unless the
109204 product is compounded by a licensed pharmacist with the controlled
110205 substance dispensed in accordance with a valid prescription.

112206 B. Kratom products shall be accompanied by a label, or a quick
113207 response (QR) code on the product label linked to a website, bearing
114208 the following information prior to its sale in this state:

116-1. A list of the ingredients , which shall include the common or
209+1. A list of the ingredients which shall include the common or
117210 usual name of each ingredi ent used in the manufacture of the
118211 product, listed in descending order of predominance;

120212 2. That the sale or transfer of kratom to a person under
121213 eighteen (18) years of age is prohibited;

123214 3. The amount of mitragynine and 7 -hydroxymitragynine contained
124215 in the product;

126216 4. The amount of mitragynine and 7 -hydroxymitragynine contained
127217 in packaging for the product;

129218 5. The name and the principal street address of the vendor or
130219 the person responsible for distributing the product;

132246 6. The suggested use of the pro duct; and

134247 7. Any precautionary statements as to the safety and
135248 effectiveness of the product.

137249 C. A vendor may not distribute, sell or expose for sale a
138250 kratom product to an individual under eighteen (18) years of age.

140251 D. Upon request by the State Departm ent of Health, the vendor
141252 shall provide test results from a United States -based testing
142253 facility to confirm the items listed on the product label.

144254 SECTION 5. NEW LAW A new section of law to be codified
145255 in the Oklahoma Statutes as Se ction 1-1432.5 of Title 63, unless
146256 there is created a duplication in numbering, reads as follows:

148257 A. The owner or manager of a vendor who violates any of the
149258 provisions of Section 3 or 4 of this act shall be punished by an
150259 administrative penalty of not mo re than Five Hundred Dollars
151260 ($500.00) for a first offense and not more than One Thousand Dollars
152261 ($1,000.00) for a second offense. Upon a third offense, the vendor
153262 shall be prohibited from selling kratom products for a period of
154263 three (3) years. If the State Department of Health receives a
155264 complaint that the owner or manager of a vendor is selling kratom
156265 products during the period of suspension, then the State Department
157266 of Health shall forward the information to the applicable district
158267 attorney's office. If the owner or manager of a vendor commits such
159268 violation during the three -year period, the person shall, upon
160269 conviction, be guilty of a misdemeanor punishable by imprisonment in

161296 a county jail for a term of not more than one (1) year, or by a fine
162297 of not more than Two Thousand Dollars ($2,000.00), or by both such
163298 fine and imprisonment.

165299 B. A person aggrieved by a violation of Section 3 or 4 of this
166300 act may bring a cause of action in a court of competent jurisdiction
167301 for damages resulting from that viol ation including, but not limited
168302 to, economic, noneconomic or consequential damages.

170303 C. A vendor does not violate the provisions of Section 3 or 4
171304 of this act if the court finds by a preponderance of the evidence
172305 that the vendor relied in good faith on th e representation of a
173306 manufacturer, processor, packager or distributor that the food
174307 product or dietary ingredient was a kratom product.

176308 SECTION 6. This act shall become effective November 1, 2021.
