38	97		SECTION 1. NEW LAW A new section of law to be codified
39	98		in the Oklahoma Statutes as Section 1 -1432.1 of Title 63, unless
40	99		there is created a d uplication in numbering, reads as follows:

42	100		Sections 1 through 5 of this act shall be known and may be cited
43	101		as the "Oklahoma Kratom Consumer Protection Act".

45	102		SECTION 2. NEW LAW A new section of law to be codified
46	103		in the Oklahoma Statutes as Section 1-1432.2 of Title 63, unless
47	104		there is created a duplication in numbering, reads as follows:

49	105		As used in this act:

51	106		1. "Food" means a food, food product, food ingredient, dietary
52	107		ingredient, dietary supplement or beverage for human consumpti on;
53		-
54	108		2. "Kratom product" means a food product or ingredient
55	109		containing any part of the leaf of the plant Mitragyna speciosa; and
56		-
57	110		3. "Vendor" means a person that sells, prepares or maintains
58	111		kratom products or that advertises, represents or holds itself ou t
59	112		as selling, preparing or maintaining kratom products and includes a
60	113		manufacturer, wholesaler, store, restaurant, hotel, catering
61	114		facility, camp, bakery, delicatessen, supermarket, grocery store,
62	115		convenience store, nursing home or food or drink company.

69	120		sale a food or product that contains kratom as an ingredient or that

75	151		B. A vendor shall not prepare, distribute, sell or expose for
76	152		sale a food or ingredient that contains kratom as an ingredient or
77	153		that is represented to be a kratom product that does not conform to
78	154		the disclosure requir ed by this section.

80	155		SECTION 4. NEW LAW A new section of law to be codified
81	156		in the Oklahoma Statutes as Section 1 -1432.4 of Title 63, unless
82	157		there is created a duplication in numbering, reads as follows:

84	158		A. A vendor shall not prepar e, distribute, sell or expose for
85	159		sale any of the following:
86		-
87	160		1. A kratom product that is adulterated with a nonkratom
88	161		substance. A kratom product is adulterated with a nonkratom

	162	+	substance if the kratom product is mixed or packed with a nonkratom
90	163		substance and that substance affects the quality or strength of the
91	164		kratom product to such a degree as to render the kratom product
92	165		injurious to a consumer;

94	166		2. A kratom product that is contaminated with a dangerous
95	167		nonkratom substance. A kratom product is contam inated with a
96	168		dangerous nonkratom substance if the kratom product contains a
97	169		substance that is not safe for human consumption;

99	196		3. A kratom product containing a level of 7 -hydroxymitragynine
100	197		in the alkaloid fraction that is greater than two percent (2%) of
101	198		the alkaloid composition of the product;

103	199		4. A kratom product containing any synthetic alkaloid including
104	200		synthetic mitragynine, synthetic 7 -hydroxymitragynine or any other
105	201		synthetically derived compounds of the kratom plant; or

107	202		5. A kratom product cont aining any controlled substance listed
108	203		in the Uniform Controlled Dangerous Substances Act, unless the
109	204		product is compounded by a licensed pharmacist with the controlled
110	205		substance dispensed in accordance with a valid prescription.

112	206		B. Kratom products shall be accompanied by a label, or a quick
113	207		response (QR) code on the product label linked to a website, bearing
114	208		the following information prior to its sale in this state:
115		-
116		-	1. A list of the ingredients , which shall include the common or
	209	+	1. A list of the ingredients which shall include the common or
117	210		usual name of each ingredi ent used in the manufacture of the
118	211		product, listed in descending order of predominance;

120	212		2. That the sale or transfer of kratom to a person under
121	213		eighteen (18) years of age is prohibited;

123	214		3. The amount of mitragynine and 7 -hydroxymitragynine contained
124	215		in the product;

126	216		4. The amount of mitragynine and 7 -hydroxymitragynine contained
127	217		in packaging for the product;

129	218		5. The name and the principal street address of the vendor or
130	219		the person responsible for distributing the product;

134	247		7. Any precautionary statements as to the safety and
135	248		effectiveness of the product.

137	249		C. A vendor may not distribute, sell or expose for sale a
138	250		kratom product to an individual under eighteen (18) years of age.

140	251		D. Upon request by the State Departm ent of Health, the vendor
141	252		shall provide test results from a United States -based testing
142	253		facility to confirm the items listed on the product label.

144	254		SECTION 5. NEW LAW A new section of law to be codified
145	255		in the Oklahoma Statutes as Se ction 1-1432.5 of Title 63, unless
146	256		there is created a duplication in numbering, reads as follows:
147		-
148	257		A. The owner or manager of a vendor who violates any of the
149	258		provisions of Section 3 or 4 of this act shall be punished by an
150	259		administrative penalty of not mo re than Five Hundred Dollars
151	260		($500.00) for a first offense and not more than One Thousand Dollars
152	261		($1,000.00) for a second offense. Upon a third offense, the vendor
153	262		shall be prohibited from selling kratom products for a period of
154	263		three (3) years. If the State Department of Health receives a
155	264		complaint that the owner or manager of a vendor is selling kratom
156	265		products during the period of suspension, then the State Department
157	266		of Health shall forward the information to the applicable district
158	267		attorney's office. If the owner or manager of a vendor commits such
159	268		violation during the three -year period, the person shall, upon
160	269		conviction, be guilty of a misdemeanor punishable by imprisonment in

161	296		a county jail for a term of not more than one (1) year, or by a fine
162	297		of not more than Two Thousand Dollars ($2,000.00), or by both such
163	298		fine and imprisonment.

165	299		B. A person aggrieved by a violation of Section 3 or 4 of this
166	300		act may bring a cause of action in a court of competent jurisdiction
167	301		for damages resulting from that viol ation including, but not limited
168	302		to, economic, noneconomic or consequential damages.

170	303		C. A vendor does not violate the provisions of Section 3 or 4
171	304		of this act if the court finds by a preponderance of the evidence
172	305		that the vendor relied in good faith on th e representation of a
173	306		manufacturer, processor, packager or distributor that the food
174	307		product or dietary ingredient was a kratom product.

176	308		SECTION 6. This act shall become effective November 1, 2021.
