NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 5061 of Title 63, unless there is created a duplication in numbering, reads as follows: There is hereby created in the State Treasury a revolving fund for the State Department of Health to be designated the "Oklahoma Critical Access Revolving Fund". The fund shall be a continuing fund, not subject to fiscal year limitations, and shall consist of all monies designated for deposit to the fund by law. All monies accruing to the credit of said fund are hereby appropriated and may be budgeted and expended by the State Department of Health for the purpose of improving rural access to health care as described in ENGR. Expenditures from said fund shall be made upon warrants issued by the State Treasurer against claims filed as prescribed by law with the Director of the Office of Management and Enterprise Services for approval and pay ment. SECTION 2. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 5062 of Title 63, unless there is created a duplication in numbering, reads as follows: A. Limited to the unencumbered balance of the Oklahoma Critical Access Revolving Fund, any rural hospital that would qualify as a Critical Access Hospital pursuant to Sections 485.601 through 485.647 of Title 42 of the Code of Federal Regulations but for its proximity to an out-of-state facility, shal l be eligible to receive up to One Million Dollars ($1,000,000.00) per fiscal year from the Oklahoma Critical Access Revolving Fund. B. The State Department of Health shall promulgate rules necessary to implement the provisions of this section. SECTION 3. This act shall become effective July 1, 2021. SECTION 4. It being immediately necessary for the preservation of the public peace, health or safety, an emergency is hereby declared to exist, by reason whereof this act sha ll take effect and be in full force from and after its passage and approval.
