26	58		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

28	59		SECTION 1. AMENDATORY 36 O.S. 2011, Section 6802, as
29	60		last amended by Section 1 of Enrolled Senate Bill No. 674 of the 1st
30	61		Session of the 58th Oklahoma Legislature, is amended to read as
31	62		follows:

33	63		Section 6802. As used in the Oklahoma Telemedicine Act:

35	64		1. "Distant site" means a site at which a health care
36	65		professional licensed to practice in this state is located while
37	66		providing health care services by means of telemedicine;

39	93		2. a. "Health benefit benefits plan" means any plan or
40	94		arrangement that:

42	95		(1) provides benefits for medical or surgical
43	96		expenses incurred as a result of a health
44	97		condition, accident or illness, and

46	98		(2) is offered by any insurance company, group
47	99		hospital service corporation or health
48	100		maintenance organization that delivers or issues
49	101		for delivery an individual, group, blanket or
50	102		franchise insurance policy or insurance
51	103		agreement, a group hospital service contract or
52	104		an evidence of coverage, or, to the extent
53	105		permitted by the Employee Retir ement Income
54	106		Security Act of 1974, 29 U.S.C., Section 1001 et
55	107		seq., by a multiple employer welfare arrangement
56	108		as defined in Section 3 of the Employee
57	109		Retirement Income Security Act of 1974, or any
58	110		other analogous benefit arrangement, whether the
59	111		payment is fixed or by indemnity,

61		-	b. Health benefit benefits plan shall not include:

86	153		(4) medical payment insurance issued as part of a
87	154		motor vehicle insurance policy,

89	155		(5) a long-term care policy including a nursing home

103	192		3. "Health care professional" means a physician or other health
104	193		care practitioner licen sed, accredited or certified to perform
105	194		specified health care services consistent with state law;

107	195		4. "Insurer" means any entity providing an accident and health
108	196		insurance policy in this state including, but not limited to, a
109	197		licensed insurance company, a not-for-profit hospital service and
110	198		medical indemnity corporation, a fraternal benefit society, a
111	199		multiple employer welfare arrangement or any other entity subject to
112	200		regulation by the Insurance Commissioner;

114	201		5. "mHealth", also referred to as "mobile heal th", means
115	202		patient medical and health information and includes the use of the
116	203		Internet and wireless devices by patients to obtain or create
117	204		specialized health information and online discussion groups to
118	205		provide peer-to-peer support;

120	206		6. "Originating site" means a site at which a patient is
121	207		located at the time health care services are provided to him or her
122	208		by means of telemedicine, which may include, but shall not be
123	209		restricted to, a patient's home, workplace or school;

125	210		7. 6. "Remote patient monitoring ser vices" means the delivery
126	211		of home health services using telecommunications technology to
127	212		enhance the delivery of home health care including monitoring of
128	213		clinical patient data such as weight, blood pressure, pulse, pulse
129	214		oximetry, blood glucose and other c ondition-specific data,

133	243		8. 7. "Store and forward transfer" means the transmission of a
134	244		patient's medical information either to or from an originating site

136	246		does not require the patient being present nor must it be in real

139	248		9. 8. "Telemedicine" or "telehealth" means technology -enabled
140	249		health and care management and delivery syst ems that extend capacity
141	250		and access, which includes:

143	251		a. synchronous mechanisms, which may include live
144	252		audiovisual interaction between a patient and a health
145	253		care professional or real -time provider-to-provider
146	254		consultation through live interactive audiovis ual
147	255		means,
148		-
149	256		b. asynchronous mechanisms, which include store and
150	257		forward transfers, online exchange of health
151	258		information between a patient and a health care
152	259		professional and online exchange of health information
153	260		between health care professionals, but shall not
154	261		include the use of automated text messages or
155	262		automated mobile applications that serve as the sole
156	263		interaction between a patient and a health care
