2859 SECTION 1. AMENDATORY 36 O.S. 2011, Section 6802, as
2960 last amended by Section 1 of Enrolled Senate Bill No. 674 of the 1st
3061 Session of the 58th Oklahoma Legislature, is amended to read as

3363 Section 6802. As used in the Oklahoma Telemedicine Act:

3564 1. "Distant site" means a site at which a health care
3665 professional licensed to practice in this state is located while

3993 2. a. "Health benefit benefits plan" means any plan or
4094 arrangement that:

4295 (1) provides benefits for medical or surgical
4396 expenses incurred as a result of a health
4497 condition, accident or illness, and

4698 (2) is offered by any insurance company, group
4799 hospital service corporation or health
48100 maintenance organization that delivers or issues
49101 for delivery an individual, group, blanket or
50102 franchise insurance policy or insurance
51103 agreement, a group hospital service contract or
52104 an evidence of coverage, or, to the extent
53105 permitted by the Employee Retir ement Income
54106 Security Act of 1974, 29 U.S.C., Section 1001 et
55107 seq., by a multiple employer welfare arrangement
56108 as defined in Section 3 of the Employee
57109 Retirement Income Security Act of 1974, or any
58110 other analogous benefit arrangement, whether the
59111 payment is fixed or by indemnity,

86153 (4) medical payment insurance issued as part of a
87154 motor vehicle insurance policy,

89155 (5) a long-term care policy including a nursing home

156+fixed indemnity policy, unless a determination is
91157 made that the policy provides benefit coverage so
92158 comprehensive that the policy meets the
93159 definition of a health benefit benefits plan,

95160 (6) short-term health insurance issued on a
96161 nonrenewable basis with a duration of six (6)
97162 months or less, or

99163 (7) a plan offered by the Employees Group Insurance

103192 3. "Health care professional" means a physician or other health
104193 care practitioner licen sed, accredited or certified to perform
105194 specified health care services consistent with state law;

107195 4. "Insurer" means any entity providing an accident and health
108196 insurance policy in this state including, but not limited to, a
109197 licensed insurance company, a not-for-profit hospital service and
110198 medical indemnity corporation, a fraternal benefit society, a
111199 multiple employer welfare arrangement or any other entity subject to
112200 regulation by the Insurance Commissioner;

114201 5. "mHealth", also referred to as "mobile heal th", means
115202 patient medical and health information and includes the use of the
116203 Internet and wireless devices by patients to obtain or create
117204 specialized health information and online discussion groups to
118205 provide peer-to-peer support;

120206 6. "Originating site" means a site at which a patient is
121207 located at the time health care services are provided to him or her
122208 by means of telemedicine, which may include, but shall not be
123209 restricted to, a patient's home, workplace or school;

125210 7. 6. "Remote patient monitoring ser vices" means the delivery
126211 of home health services using telecommunications technology to
127212 enhance the delivery of home health care including monitoring of
128213 clinical patient data such as weight, blood pressure, pulse, pulse
129214 oximetry, blood glucose and other c ondition-specific data,

133243 8. 7. "Store and forward transfer" means the transmission of a
134244 patient's medical information either to or from an originating site

136246 does not require the patient being present nor must it be in real
137247 time; and

139248 9. 8. "Telemedicine" or "telehealth" means technology -enabled
140249 health and care management and delivery syst ems that extend capacity
141250 and access, which includes:

143251 a. synchronous mechanisms, which may include live
144252 audiovisual interaction between a patient and a health
145253 care professional or real -time provider-to-provider
146254 consultation through live interactive audiovis ual
147255 means,

149256 b. asynchronous mechanisms, which include store and
150257 forward transfers, online exchange of health
151258 information between a patient and a health care
152259 professional and online exchange of health information
153260 between health care professionals, but shall not
154261 include the use of automated text messages or
155262 automated mobile applications that serve as the sole
156263 interaction between a patient and a health care
