2960 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3161 SECTION 1. AMENDATORY 29 O.S. 2011, Section 5 -301, is
3262 amended to read as follows:

3463 Section 5-301. A. No person may set or use at any time any
3564 poison, cyanide coyote getter, o r other similar device , using
3665 cyanide gas or other poisonous gas as the lethal agent, for the
3766 purpose of killing predators, except in accordance with the
3867 following conditions and procedures:

4094 1. Signs of a size and character and with wording to be
4195 determined by the State Oklahoma Department of Agriculture, Food,
4296 and Forestry indicating the presence of cyanide coyote getters or
4397 other similar device using cyanide gas or other poisonous gas as the
4498 lethal agent, shall be posted on all properties where said coyo te
45-getters are set to the right and left of all entrances from public ENR. H. B. NO. 2214 Page 2
99+getters are set to the right and left of all entrances from public
46100 roads and highways and from adjacent lands and at corners of
47101 perimeter fences.

49102 2. Such devices shall not be set from April 1 to September 30
50103 of each calendar year ; provided that, any de vices set or used within
51104 a commercial hunting area by a person holding a big game or big game
52105 and upland game combination license pursuant to Section 4 -106 of
53106 this title or a licensed farmed cervidae facility by a person
54107 holding a farmed cervidae facility license pursuant to the Oklahoma
55108 Farmed Cervidae Act may be set or used at any time of the year .

57109 3. All signs as required by this article shall be in place
58110 twenty-four (24) hours before said devices are set and shall be
59111 properly maintained in place during the permission period herein
60112 provided.

62113 4. A game warden may issue a permit for the setting of such
63114 devices and such permit must be obtained prior to the setting of
64115 such devices. Each permit shall be made in triplicate, the original
65116 to be retained by the landowner concerned, one copy retained by the

66143 game warden and the other copy mailed immediately to the Department
67144 for its permanent record.

69145 5. In applying for a permit, the landowner shall state the
70146 number of devices to be set and the approximate locatio n to the
71147 nearest forty (40) acres.

73148 6. Written permission permits required by this section shall
74149 cover a period not exceeding six (6) months; provided, however, that
75150 said permits shall be subject to renewal for a like period of time.

77151 7. All signs required by this section shall be removed at the
78152 end of the permission period, unless said permit is renewed prior to
79153 the expiration date thereof.

81154 8. No predator control devices shall be on any property without
82155 the written permission of the record owner or lessee thereof.

84156 B. Predatory control conducted by the State Oklahoma Department
85157 of Agriculture, Food, and Forestry or the Oklahoma Department of
86158 Wildlife Conservation shall be exempt from the provisions of
87159 paragraphs 4, 5 and 6 of subsection A of this section.

89160 C. The Director of the Department of Wildlife Conservation may
90161 issue depredation permits to landowners for control of any nuisance
91162 wildlife.

93163 D. Any person convicted of violating the provisions of this
94164 section shall be punished by a fine of not less than Fifty Dollars
95165 ($50.00), or by imprisonment in the county jail for not more than
