31 | 61 | SECTION 1. AMENDATORY 29 O.S. 2011, Section 5 -301, is | |
32 | 62 | amended to read as follows: | |

34 | 63 | Section 5-301. A. No person may set or use at any time any | |
35 | 64 | poison, cyanide coyote getter, o r other similar device , using | |
36 | 65 | cyanide gas or other poisonous gas as the lethal agent, for the | |
37 | 66 | purpose of killing predators, except in accordance with the | |
38 | 67 | following conditions and procedures: | |

52 | 105 | and upland game combination license pursuant to Section 4 -106 of | |
53 | 106 | this title or a licensed farmed cervidae facility by a person | |
54 | 107 | holding a farmed cervidae facility license pursuant to the Oklahoma | |
55 | 108 | Farmed Cervidae Act may be set or used at any time of the year . | |

57 | 109 | 3. All signs as required by this article shall be in place | |
58 | 110 | twenty-four (24) hours before said devices are set and shall be | |
59 | 111 | properly maintained in place during the permission period herein | |
60 | 112 | provided. | |

62 | 113 | 4. A game warden may issue a permit for the setting of such | |
63 | 114 | devices and such permit must be obtained prior to the setting of | |
64 | 115 | such devices. Each permit shall be made in triplicate, the original | |
65 | 116 | to be retained by the landowner concerned, one copy retained by the | |

74 | 149 | cover a period not exceeding six (6) months; provided, however, that | |
75 | 150 | said permits shall be subject to renewal for a like period of time. | |

77 | 151 | 7. All signs required by this section shall be removed at the | |
78 | 152 | end of the permission period, unless said permit is renewed prior to | |
79 | 153 | the expiration date thereof. | |

81 | 154 | 8. No predator control devices shall be on any property without | |
82 | 155 | the written permission of the record owner or lessee thereof. | |
83 | - | ||
84 | 156 | B. Predatory control conducted by the State Oklahoma Department | |
85 | 157 | of Agriculture, Food, and Forestry or the Oklahoma Department of | |
86 | 158 | Wildlife Conservation shall be exempt from the provisions of | |
87 | 159 | paragraphs 4, 5 and 6 of subsection A of this section. | |

89 | 160 | C. The Director of the Department of Wildlife Conservation may | |
90 | 161 | issue depredation permits to landowners for control of any nuisance | |

94 | 164 | section shall be punished by a fine of not less than Fifty Dollars | |
