65	64		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
66	65		SECTION 1. NEW LAW A new section of law to be codified
67	66		in the Oklahoma Statutes as Section 1-502.5 of Title 63, unless
68	67		there is created a duplication in num bering, reads as follows:
69	68		A. A state agency shall not enact by rule, order or other means
70	69		any vaccination requirement for any member of the general public or

98	96		discriminate against or civilly, criminally or administratively
99	97		penalize any member of the general public who declines to be
100	98		vaccinated or who declines to vaccinate his or her children, except
101	99		as provided by:
102	100		1. Section 411 of Title 10 of the Oklahoma Statutes ;
103	101		2. Rules promulgated by the State Commissioner of Health
104	102		governing hospital standards as authorized by Sections 1-705 and 1-
105	103		707 of Title 63 of the Oklahoma Statutes;
106	104		3. Sections 1210.191 through 1210.195 and Section s 3243 and
107	105		3244 of Title 70 of the Oklahoma Statutes ; or
108	106		4. Subsection B of this section.
109	107		B. For purposes of this section, “state agency” means any
110	108		office, department, board, commissi on or institution of the
111	109		executive branch of state government . State agency does not
112	110		include:
113		-	1. Any county, municipality or public trust;

114	112		2. Any hospital or health care facility owned by the state or
115	113		by a county, municipality or public trust including, but not limited
116	114		to, the University Hospitals Authority, the University Hospitals
117	115		Trust, the Oklahoma State University Medic al Authority, the Oklahoma
118	116		State University Medic al Trust or any entity under agreement or
119	117		contract to manage or operate any inpatient or outpatient hospital
120	118		or clinical facility, office or research building or other facility
121	119		or property of the University Hospitals Authority, the University

149	146		Hospitals Trust, the Oklahoma State U niversity Medical Authority or
150		-	the Oklahoma State Univer sity Medical Trust;
151		-	3. The Oklahoma Military Dep artment; or
152		-	4. The Oklahoma Department of Veterans Affairs or veterans
153		-	centers operated by the Oklahoma Department of Veterans Affairs.

154	148		C. A state agency, an entity excluded under subsection B of
155	149		this section or any person currently or formerly employed by or
156	150		working on behalf of such agency or entity shall not be liable for
157	151		any damages incurred by a person diagnosed with a communicable
158	152		disease when the person chose not to be vaccinated or for
159	153		vaccination side effects when the person received a vaccination.
160	154		SECTION 2. It being immediately necessar y for the preservation
161	155		of the public peace, health or saf ety, an emergency is hereby
162	156		declared to exist, by reason whereof this act shall take effect and
163	157		be in full force from and after its passage and approval.
