24	115		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
25	116		SECTION 1. AMENDATORY 2 O.S. 2011, Section 3 -82, as
26	117		amended by Section 1, Chapter 239, O.S.L. 2017 (2 O.S. Supp. 2020,
27	118		Section 3-82), is amended to read as follows:
28		-
29	119		Section 3-82. A. LICENSE REQUIRED - 1. It shall be unlawful
30	120		for any person to act, operate, or do business or advertise as a
31	121		commercial, noncommercial, certified applicator, temporary certified
32	122		applicator, service technician, or priva te applicator unless the
33	123		person has obtained a valid applicator's license issued by the State
34	124		Board of Agriculture for the category of pesticide application in
35	125		which the person is engaged.

37	126		2. A license may be issued by the Board in any category of
38	127		pesticide application if the applicant qualifies and the applicant

40	155		license. The Board may establish categories of pesticide
41	156		application as necessary. Licenses shall be issued upon application
42	157		to the Board on a form prescribed by the Board. The application
43	158		shall contain information regarding the applicant's qualifications,
44	159		proposed operations, and other information as specified by the
45	160		Board.

49	161		3. a. An aerial license shall not be issued or be valid
50	162		unless the applicant files with the Board a copy of a
51	163		valid document issued by the Federal Aviation
52	164		Administration showing that the person is qualified to
53	165		operate or supervise the operation of an aircraft
54	166		conducting agricultural operations. Applicants for an
55	167		aerial license and pilots working under a license may
56	168		be subject to a complete and thorough background
57	169		examination.

59	170		b. The Board shall promulgate rules regarding aerial
60	171		applicators and applications consistent with federal
61	172		law and shall solicit the assis tance of the Federal
62	173		Aviation Agency in the enforcement of this subsection.

64	174		4. Each business location shall require a separate license and
65	175		separate certified applicator except that a certified applicator for
66	176		a noncommercial business location may also serv e as the certified
67	177		applicator for one commercial business location.

69	204		5. A license shall not be issued for the category of pesticide
70	205		application of any applicant or representative who has a temporary
71	206		certification.

73	207		B. CERTIFICATION REQUIRED - 1. A license shall be issued only
74	208		after satisfactory completion of the certification standards by the
75	209		person who shall be the certified applicator under the license.
76	210		Temporary certified applicators do not qualify as the certified
77	211		applicator for a license, nor may the y act as a certified
78	212		applicator. The Board shall deny the application for certification,
79	213		recertification, issuance, or renewal of a certificate or license
80	214		for a failure to show proper qualification under the rules or for
81	215		violations of any provisions of th is section. A certificate in any
82	216		category shall be valid for five (5) years unless suspended,
83	217		canceled, or revoked by the Board or until recertification is
84	218		required for the category, and may be renewed after successful
85	219		completion of recertification requir ements. The Board may require
86	220		certified applicators to be recertified once in a five -year period.

88	221		2. A certified service technician identification shall be
89	222		issued upon application and completion of certification standards
90	223		determined by the Board. Tempor ary certified applicators may
91	224		qualify as a certified service technician. No person shall act, do
92	225		business as, or advertise as a service technician unless the person

95	226		has met all the qualifications and standards as required by the
96	227		Board. The service techni cians' identification shall be issued in

97	254		the name of the licensed entity. The licensee shall ensure that the
98	255		service technician identification is returned to the Board upon
99	256		termination of the employee. A service technician identification
100	257		shall be valid for a period of five (5) years unless suspended,
101	258		canceled, or revoked by the Board, until recertification is required
102	259		by the Board, or until the service technician leaves the employ of
103	260		the licensed entity. The Oklahoma Department of Agriculture, Food,
104	261		and Forestry may issue a service technician identification upon
105	262		completion of the following:
106		-
107	263		a. a determination is made by the Department that the
108	264		applicant has successfully completed the written
109	265		examination,
110		-
111	266		b. the licensed entity provides a completed service
112	267		technician identification application form at the time
113	268		of testing, and
114		-
115	269		c. all appropriate fees are paid at the time of testing.
116		-
117	270		3. Each license, except for private applicators, shall expire
118	271		on the 31st day of December following issuance or renewal, dates
119	272		established by the Department in administrative rules and may be
120	273		renewed for the ensuing calendar year, without penalty or
121	274		reexamination, if a properly completed application is filed with the
122	275		Board not later than the 1st day of January of each year on a date
123	276		established by the Department . If the application is not received
124	277		by January 1 the due date, a penalty of twice the amount of the

126	305		application is not received by February 1 within thirty (30) days
127	306		following the due date , an additional one-hundred-dollar penalty
128	307		shall be paid prior to license renewal.

130	308		All private applicator licenses are in effect for five (5) years
131	309		and may be renewed by application after completion of a continuing
132	310		education program or written exam approved by the Board.

134	311		C. The following fees shall be paid to the Board:
135		-
136	312		1. A fee of One Hundred Dollars ($100.00) for each category of
137	313		pesticide application shall be paid to the Board for the issuance or
138	314		renewal of a commercial applicator business license. Not more than

141	315		Five Hundred Dollars ($500.00) total category fees shall be charged
142	316		annually to any business location of an applicator;

144	317		2. A fee of Fifty Dollars ($50.00) shall be paid to the Board
145	318		for each written examination conducted by the Board;
146		-
147	319		3. A fee of Fifty Dollars ($50.00) shall be paid to the Board
148	320		for each practical examination conducted by the Board;
149		-
150	321		4. A fee of Twenty Dollars ($20.00) shall be paid to the Board
151	322		for the issuance or renewal of a private applicato r's license;
152		-
153	323		5. A fee of Fifty Dollars ($50.00) shall be paid to the Board
154	324		for the issuance or renewal of a noncommercial business license.
155	325		Not more than Two Hundred Fifty Dollars ($250.00) total category
156	326		fees shall be charged annually to any noncommerci al business
157	327		location of an applicator;

159	354		6. A fee of Twenty Dollars ($20.00) shall be paid to the Board
160	355		for the issuance or renewal of service technician identification;

162	356		7. A fee of Ten Dollars ($10.00) shall be paid to the Board for
163	357		the issuance of duplic ate licenses or certificates or transfer of
164	358		service technician identification;
165		-
166	359		8. A fee of Fifty Dollars ($50.00) shall be paid to the Board
167	360		for each recertification procedure; and
168		-
169	361		9. A fee of One Hundred Dollars ($100.00) shall be paid to the
170	362		Board for each reciprocal certification procedure for applicator
171	363		certifications.

173	364		D. All fees shall be deposited in the State Department of
174	365		Agriculture Revolving Fund.

176	366		E. Fees shall be paid to the Board prior to the processing of
177	367		any application.

179	368		F. Failure to pay any fee identified with licenses, permits,
180	369		pesticide registrations, or certification shall require the Board to
181	370		deny the application.

183	371		G. INSURANCE REQUIRED - 1. The Board shall not issue a
184	372		commercial applicator's license until the applicant has furnishe d
185	373		evidence of an insurance policy or certificate by an insurer or
186		-

188	374		broker authorized to do business in this state insuring the
189	375		commercial applicator and any agents against liability resulting
190	376		from the operations of the commercial applicator. The insurance

191	403		shall not be applied to damage or injury to agricultural crops,
192	404		plants, or land being worked upon by the commercial applicator.

194	405		2. The amount of liability shall not be less than that set by
195	406		the Board for each property damage arising out of actual use of a ny
196	407		pesticide. The liability shall be maintained at not less than that
197	408		sum at all times during the licensing period. The Board shall be
198	409		notified fifteen (15) days prior to any reduction in liability.

200	410		3. If the furnished liability becomes unsatisfactory, the
201	411		applicant shall immediately execute new liability upon notice from
202	412		the Board. If new liability is not immediately obtained, the Board
203	413		shall, upon notice, cancel the license. It shall be unlawful for
204	414		the person to engage in the business of applying pe sticides until
205	415		the liability is brought into compliance and the license reinstated.

207	416		H. DAMAGES - 1. Prior to filing an action against an
208	417		applicator for damages to growing crops or plants, any person
209	418		alleging damages to growing crops or plants shall:
210		-
211	419		a. within ninety (90) calendar days of the date that the
212	420		alleged damages occurred or prior to the time that
213	421		twenty-five percent (25%) of the allegedly damaged
214	422		crops or plants are harvested, whichever occurs first,
215	423		file a written complaint statement with the De partment
216	424		regarding the alleged damages, and
217		-
218	425		b. between the date of filing of the written complaint
219	426		pursuant to subparagraph a of this paragraph and the

220	453		date harvesting or destruction of the allegedly
221	454		damaged crops or plants occurs, allow the applicator
222	455		and the representatives of the applicator reasonable
223	456		access to the property to inspect and take samples of
224	457		the allegedly damaged crops or plants during
225	458		reasonable hours. The representatives of the
226	459		applicator may include, but not be limited to, crop
227	460		consultants, bondsmen, and insurers. Nothing in this
228	461		subparagraph shall limit in any way the harvesting or
229	462		destruction of the allegedly damaged crops or plants
230	463		in the ordinary course of business and practice.

234	464		2. Any person failing to comply with paragraph 1 of th is
235	465		subsection shall be barred from filing an action for damages against
236	466		the applicator.

238	467		I. PERMIT REQUIRED – 1. It shall be unlawful for any person to
239	468		sell, offer for sale, or distribute within this state any restricted
240	469		use pesticide without first obtain ing a restricted use pesticide
241	470		dealer's permit issued by the Board.
242		-
243	471		2. A permit may be issued by the Board in any category of
244	472		pesticide sales if the applicant qualifies under the provisions of
245	473		this section and the applicant is limited to the category of
246	474		pesticide sales named on the permit. The Board may establish
247	475		categories of pesticide sales as necessary.

254	506		4. Each business location engaged in the sale or distribution
255	507		of restricted use pesticides shall require a separate permit.

257	508		5. The annual permit fee for a restricted use pesticid e dealer
258	509		permit shall be Fifty Dollars ($50.00) for each location.

260	510		6. The Board may require a certified applicator to be present
261	511		at any location where designated restricted use pesticide sales
262	512		occur.

264	513		J. PESTICIDE REGISTRATION REQUIRED – 1. Every pesticide or
265	514		device distributed, sold, or offered for sale within this state or
266	515		delivered for transportation or transported in intrastate or
267	516		interstate commerce shall be registered with the Board.

269	517		2. The registrant shall file with the Board a statement
270	518		including, but not limited to:
271		-
272	519		a. the name and address of the registrant and the name
273	520		and address of the person whose name shall appear on
274	521		the label, if other than the registrant,
275		-
276	522		b. the name of the pesticide or device,
277		-

280	523		c. a complete copy of the labeling accompanyi ng the
281	524		pesticide or device and a statement of all claims to
282	525		be made for it, and directions for use, and

285	553		tests made and the results upon which the claims are
286	554		based. In renewing a registration, a state ment shall
287	555		be required only with respect to information which is
288	556		different from the information furnished when the
289	557		pesticide or device was last registered.

291	558		3. Each registrant shall pay to the Board an annual
292	559		registration fee of Two Hundred Ten Dollars ($2 10.00) for each
293	560		pesticide or device label registered. These fees shall be used by
294	561		the Oklahoma Department of Agriculture, Food, and Forestry for
295	562		purposes of administering pesticide management programs. A portion
296	563		of these fees, in the amount of Three Hund red Thousand Dollars
297	564		($300,000.00) annually, shall be dedicated for conducting programs
298	565		for unwanted pesticide disposal. This amount shall be deposited
299	566		into the State Department of Agriculture Unwanted Pesticide Disposal
300	567		Fund and shall be dedicated for th is use only.

302	568		4. The Board may require the submission of the complete formula
303	569		of any pesticide. Trade secrets and formulations submitted by the
304	570		registrant may be kept confidential. If it appears to the Board
305	571		that the composition of the pesticide is adequ ate to warrant the
306	572		proposed claims and if the pesticide, its labeling, and other
307	573		material required to be submitted comply with the requirements of
308	574		this section, then the pesticide shall be registered.

310	601		5. If it does not appear to the Board that the pestici de or
311	602		device is adequate to warrant the proposed claims for it or if the
312	603		pesticide or device, its labeling, and other material required to be
313	604		submitted do not comply with the provisions of this section, it
314	605		shall notify the applicant of the deficiencies in the pesticide,
315	606		device, labeling, or other material required and afford the
316	607		applicant an opportunity to make the necessary corrections. If the
317	608		applicant claims, in writing, that the corrections are not necessary
318	609		and requests in writing a hearing regarding the registration of the
319	610		pesticide or device, the Board shall provide an opportunity for a
320	611		hearing before refusing to issue the registration. In order to
321	612		protect the public, the Board may at any time cancel the
322	613		registration of a product or device. In no e vent, shall
323	614		registration of a pesticide or device be considered as a defense or

326	615		excuse for the commission of any offense prohibited under this
327	616		section.

329	617		6. The Board may require that pesticides be distinctively
330	618		colored or discolored to protect the public h ealth.

332	619		7. Registration shall not be required in the case of a
333	620		pesticide shipped from one plant or place within this state to
334	621		another plant or place within this state that is operated by the
335	622		same person.

337	649		K. CATEGORIES OF LICENSES AND PERMITS – The Board may establish
338	650		any category of license for pesticide application or any category of
339	651		permit for pesticide sales.

341	652		L. PERMIT AND PESTICIDE REGISTRATION EXPIRATION – 1. All
342	653		permits for pesticide sales shall be issued for a period of one (1)
343	654		year and the permits shall be renewed annually and shall expire on a
344	655		date determined by the Board. A permit may be renewed for the
345	656		ensuing year, without penalty, if a properly completed application
346	657		is filed with the Board not later than the fifteenth day of the
347	658		month first following the date of expiration. If the application is
348	659		not received by that date, a penalty of twice the amount of the
349	660		renewal fee shall be charged for renewal of the permit.

351	661		2. All pesticide registrations shall be issued for a period of
352	662		one (1) year. The registration shall be renewed annually and shall
353	663		expire on a date to be determined by the Board. Pesticide
354	664		registrations may be renewed for the ensuing year, without penalty,
355	665		if a properly completed application is filed with the Board not
356	666		later than the fifteenth day of the month first following the date
357	667		of expiration. If the application is not received by that date, a
358	668		penalty of twice the amount of the renewal fee shall be charged for
359	669		renewal of the pesticide registration.

361	670		M. PESTICIDE PRODUCING EST ABLISHMENTS – 1. Definitions as used
362	671		in this subsection:

375	705		c. "producer" means any person who produces,
376	706		manufactures, prepares, compounds, propagates or
377	707		processes any active ingredient, pesticide, o r device
378	708		as used in producing a pesticide.

380	709		2. It shall be unlawful for any person to produce within this
381	710		state any pesticide, active ingredient or device without first
382	711		obtaining a pesticide producer establishment permit issued by the
383	712		Board.

385	713		3. The permit shall be issued only upon application on a form
386	714		prescribed by the Board. The application shall contain information
387	715		regarding the proposed operation of the applicant and other
388	716		information as specified by the Board. If at any time there is a
389	717		change of the information provided in or on the application for a
390	718		pesticide producer establishment permit, the producer must notify
391	719		the Board in writing within thirty (30) calendar days of the change.

393	720		4. The producer shall file a statement with the Board including

408	756		5. All permits for pesticide producer establishments shall be
409	757		issued for a period of one (1) year and shall be renewed annually.
410	758		All permits shall expire on June 30 each year and m ay be renewed
411	759		without penalty if a properly completed application is filed with
412	760		the Board not later than the fifteenth day of the month first
413	761		following the date of expiration. If the application is not
414	762		received by that date, a penalty of twice the amount of the renewal
415	763		fee shall be charged for renewal of the permit.

419	764		6. Each pesticide producer establishment location engaged in
420	765		the production of pesticides, active ingredients or devices shall
421	766		require a separate permit.

423	767		7. The annual permit fee for a pestic ide producer establishment
424	768		shall be One Hundred Dollars ($100.00) for each location.

426	769		8. If requested by the Board, a complete copy of all labeling,
427	770		Material Safety Data Sheets, technical information associated with
428	771		the pesticide, active ingredient, or dev ice and a statement of all

432	800		9. In order to determine compliance with state and federal
433	801		laws, the Board may request a full disclosure of inventory records,
434	802		sales and distributio n records, and any other information deemed
435	803		necessary by the Board.

437	804		10. Every producer shall keep accurate records pertaining to
438	805		pesticide, active ingredient, or device production and distribution
439	806		as required by the Board. The records of the producer sha ll be kept
440	807		intact at the principal producing location in this state for at
441	808		least two (2) years after the date of production and distribution
442	809		and copies shall be furnished to any authorized agent of the Board,
443	810		immediately upon request in person, at any time during the regular
444	811		business hours of the producer. Copies of records shall be
445	812		furnished to any authorized agent of the Board within seven (7)
446	813		working days of a written request, in summary form, by mail, fax, e-
447	814		mail email, website, or any other electronic media customarily used.

449	815		N. COMPLAINT RESOLUTION - Upon receipt of a written complaint,
450	816		the Board shall notify the person filing the complaint in writing of
451	817		its receipt and status within two (2) working days. The person whom
452	818		the complaint is filed agains t shall also be notified within two (2)
453	819		working days. Notification that a complaint has been filed may also
454	820		be given to the landowner or operator when appropriate. The
455	821		resolution of a complaint is the completion of the appropriate
