24115 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
25116 SECTION 1. AMENDATORY 2 O.S. 2011, Section 3 -82, as
26117 amended by Section 1, Chapter 239, O.S.L. 2017 (2 O.S. Supp. 2020,
27118 Section 3-82), is amended to read as follows:

29119 Section 3-82. A. LICENSE REQUIRED - 1. It shall be unlawful
30120 for any person to act, operate, or do business or advertise as a
31121 commercial, noncommercial, certified applicator, temporary certified
32122 applicator, service technician, or priva te applicator unless the
33123 person has obtained a valid applicator's license issued by the State
34124 Board of Agriculture for the category of pesticide application in
35125 which the person is engaged.

37126 2. A license may be issued by the Board in any category of
38127 pesticide application if the applicant qualifies and the applicant

39154 is limited to the category of pesticide application named on the
40155 license. The Board may establish categories of pesticide
41156 application as necessary. Licenses shall be issued upon application
42157 to the Board on a form prescribed by the Board. The application
43158 shall contain information regarding the applicant's qualifications,
44159 proposed operations, and other information as specified by the
45160 Board.

49161 3. a. An aerial license shall not be issued or be valid
50162 unless the applicant files with the Board a copy of a
51163 valid document issued by the Federal Aviation
52164 Administration showing that the person is qualified to
53165 operate or supervise the operation of an aircraft
54166 conducting agricultural operations. Applicants for an
55167 aerial license and pilots working under a license may
56168 be subject to a complete and thorough background
57169 examination.

59170 b. The Board shall promulgate rules regarding aerial
60171 applicators and applications consistent with federal
61172 law and shall solicit the assis tance of the Federal
62173 Aviation Agency in the enforcement of this subsection.

64174 4. Each business location shall require a separate license and
65175 separate certified applicator except that a certified applicator for
66176 a noncommercial business location may also serv e as the certified
67177 applicator for one commercial business location.

69204 5. A license shall not be issued for the category of pesticide
70205 application of any applicant or representative who has a temporary
71206 certification.

73207 B. CERTIFICATION REQUIRED - 1. A license shall be issued only
74208 after satisfactory completion of the certification standards by the
75209 person who shall be the certified applicator under the license.
76210 Temporary certified applicators do not qualify as the certified
77211 applicator for a license, nor may the y act as a certified
78212 applicator. The Board shall deny the application for certification,
79213 recertification, issuance, or renewal of a certificate or license
80214 for a failure to show proper qualification under the rules or for
81215 violations of any provisions of th is section. A certificate in any
82216 category shall be valid for five (5) years unless suspended,
83217 canceled, or revoked by the Board or until recertification is
84218 required for the category, and may be renewed after successful
85219 completion of recertification requir ements. The Board may require
86220 certified applicators to be recertified once in a five -year period.

88221 2. A certified service technician identification shall be
89222 issued upon application and completion of certification standards
90223 determined by the Board. Tempor ary certified applicators may
91224 qualify as a certified service technician. No person shall act, do
92225 business as, or advertise as a service technician unless the person

95226 has met all the qualifications and standards as required by the
96227 Board. The service techni cians' identification shall be issued in

97254 the name of the licensed entity. The licensee shall ensure that the
98255 service technician identification is returned to the Board upon
99256 termination of the employee. A service technician identification
100257 shall be valid for a period of five (5) years unless suspended,
101258 canceled, or revoked by the Board, until recertification is required
102259 by the Board, or until the service technician leaves the employ of
103260 the licensed entity. The Oklahoma Department of Agriculture, Food,
104261 and Forestry may issue a service technician identification upon
105262 completion of the following:

107263 a. a determination is made by the Department that the
108264 applicant has successfully completed the written
109265 examination,
110-
111266 b. the licensed entity provides a completed service
112267 technician identification application form at the time
113268 of testing, and
114-
115269 c. all appropriate fees are paid at the time of testing.

117270 3. Each license, except for private applicators, shall expire
118271 on the 31st day of December following issuance or renewal, dates
119272 established by the Department in administrative rules and may be
120273 renewed for the ensuing calendar year, without penalty or
121274 reexamination, if a properly completed application is filed with the
122275 Board not later than the 1st day of January of each year on a date
123276 established by the Department . If the application is not received
124277 by January 1 the due date, a penalty of twice the amount of the

125304 renewal fee shall be charged for renewal of the license. If the
126305 application is not received by February 1 within thirty (30) days
127306 following the due date , an additional one-hundred-dollar penalty
128307 shall be paid prior to license renewal.

130308 All private applicator licenses are in effect for five (5) years
131309 and may be renewed by application after completion of a continuing
132310 education program or written exam approved by the Board.

134311 C. The following fees shall be paid to the Board:

136312 1. A fee of One Hundred Dollars ($100.00) for each category of
137313 pesticide application shall be paid to the Board for the issuance or
138314 renewal of a commercial applicator business license. Not more than

141315 Five Hundred Dollars ($500.00) total category fees shall be charged
142316 annually to any business location of an applicator;

144317 2. A fee of Fifty Dollars ($50.00) shall be paid to the Board
145318 for each written examination conducted by the Board;

147319 3. A fee of Fifty Dollars ($50.00) shall be paid to the Board
148320 for each practical examination conducted by the Board;

150321 4. A fee of Twenty Dollars ($20.00) shall be paid to the Board
151322 for the issuance or renewal of a private applicato r's license;

153323 5. A fee of Fifty Dollars ($50.00) shall be paid to the Board
154324 for the issuance or renewal of a noncommercial business license.
155325 Not more than Two Hundred Fifty Dollars ($250.00) total category
156326 fees shall be charged annually to any noncommerci al business

159354 6. A fee of Twenty Dollars ($20.00) shall be paid to the Board
160355 for the issuance or renewal of service technician identification;

162356 7. A fee of Ten Dollars ($10.00) shall be paid to the Board for
163357 the issuance of duplic ate licenses or certificates or transfer of
164358 service technician identification;

166359 8. A fee of Fifty Dollars ($50.00) shall be paid to the Board
167360 for each recertification procedure; and

169361 9. A fee of One Hundred Dollars ($100.00) shall be paid to the
170362 Board for each reciprocal certification procedure for applicator
171363 certifications.

173364 D. All fees shall be deposited in the State Department of
174365 Agriculture Revolving Fund.

176366 E. Fees shall be paid to the Board prior to the processing of
177367 any application.

179368 F. Failure to pay any fee identified with licenses, permits,
180369 pesticide registrations, or certification shall require the Board to
181370 deny the application.

183371 G. INSURANCE REQUIRED - 1. The Board shall not issue a
184372 commercial applicator's license until the applicant has furnishe d
185373 evidence of an insurance policy or certificate by an insurer or

188374 broker authorized to do business in this state insuring the
189375 commercial applicator and any agents against liability resulting
190376 from the operations of the commercial applicator. The insurance

191403 shall not be applied to damage or injury to agricultural crops,
192404 plants, or land being worked upon by the commercial applicator.

194405 2. The amount of liability shall not be less than that set by
195406 the Board for each property damage arising out of actual use of a ny
196407 pesticide. The liability shall be maintained at not less than that
197408 sum at all times during the licensing period. The Board shall be
198409 notified fifteen (15) days prior to any reduction in liability.

200410 3. If the furnished liability becomes unsatisfactory, the
201411 applicant shall immediately execute new liability upon notice from
202412 the Board. If new liability is not immediately obtained, the Board
203413 shall, upon notice, cancel the license. It shall be unlawful for
204414 the person to engage in the business of applying pe sticides until
205415 the liability is brought into compliance and the license reinstated.

207416 H. DAMAGES - 1. Prior to filing an action against an
208417 applicator for damages to growing crops or plants, any person
209418 alleging damages to growing crops or plants shall:
210-
211419 a. within ninety (90) calendar days of the date that the
212420 alleged damages occurred or prior to the time that
213421 twenty-five percent (25%) of the allegedly damaged
214422 crops or plants are harvested, whichever occurs first,
215423 file a written complaint statement with the De partment
216424 regarding the alleged damages, and
217-
218425 b. between the date of filing of the written complaint
219426 pursuant to subparagraph a of this paragraph and the

220453 date harvesting or destruction of the allegedly
221454 damaged crops or plants occurs, allow the applicator
222455 and the representatives of the applicator reasonable
223456 access to the property to inspect and take samples of
224457 the allegedly damaged crops or plants during
225458 reasonable hours. The representatives of the
226459 applicator may include, but not be limited to, crop
227460 consultants, bondsmen, and insurers. Nothing in this
228461 subparagraph shall limit in any way the harvesting or
229462 destruction of the allegedly damaged crops or plants
230463 in the ordinary course of business and practice.

234464 2. Any person failing to comply with paragraph 1 of th is
235465 subsection shall be barred from filing an action for damages against
236466 the applicator.

238467 I. PERMIT REQUIRED – 1. It shall be unlawful for any person to
239468 sell, offer for sale, or distribute within this state any restricted
240469 use pesticide without first obtain ing a restricted use pesticide
241470 dealer's permit issued by the Board.

243471 2. A permit may be issued by the Board in any category of
244472 pesticide sales if the applicant qualifies under the provisions of
245473 this section and the applicant is limited to the category of
246474 pesticide sales named on the permit. The Board may establish
247475 categories of pesticide sales as necessary.

249502 3. The permit shall be issued only upon application on a form
250503 prescribed by the Board and the application shall contain
251504 information regarding the appl icant's proposed operation and other
252505 information as specified by the Board.

254506 4. Each business location engaged in the sale or distribution
255507 of restricted use pesticides shall require a separate permit.

257508 5. The annual permit fee for a restricted use pesticid e dealer
258509 permit shall be Fifty Dollars ($50.00) for each location.

260510 6. The Board may require a certified applicator to be present
261511 at any location where designated restricted use pesticide sales
262512 occur.

264513 J. PESTICIDE REGISTRATION REQUIRED – 1. Every pesticide or
265514 device distributed, sold, or offered for sale within this state or
266515 delivered for transportation or transported in intrastate or
267516 interstate commerce shall be registered with the Board.

269517 2. The registrant shall file with the Board a statement
270518 including, but not limited to:

272519 a. the name and address of the registrant and the name
273520 and address of the person whose name shall appear on
274521 the label, if other than the registrant,

276522 b. the name of the pesticide or device,

280523 c. a complete copy of the labeling accompanyi ng the
281524 pesticide or device and a statement of all claims to
282525 be made for it, and directions for use, and

284552 d. if requested by the Board, a full description of the
285553 tests made and the results upon which the claims are
286554 based. In renewing a registration, a state ment shall
287555 be required only with respect to information which is
288556 different from the information furnished when the
289557 pesticide or device was last registered.

291558 3. Each registrant shall pay to the Board an annual
292559 registration fee of Two Hundred Ten Dollars ($2 10.00) for each
293560 pesticide or device label registered. These fees shall be used by
294561 the Oklahoma Department of Agriculture, Food, and Forestry for
295562 purposes of administering pesticide management programs. A portion
296563 of these fees, in the amount of Three Hund red Thousand Dollars
297564 ($300,000.00) annually, shall be dedicated for conducting programs
298565 for unwanted pesticide disposal. This amount shall be deposited
299566 into the State Department of Agriculture Unwanted Pesticide Disposal
300567 Fund and shall be dedicated for th is use only.

302568 4. The Board may require the submission of the complete formula
303569 of any pesticide. Trade secrets and formulations submitted by the
304570 registrant may be kept confidential. If it appears to the Board
305571 that the composition of the pesticide is adequ ate to warrant the
306572 proposed claims and if the pesticide, its labeling, and other
307573 material required to be submitted comply with the requirements of
308574 this section, then the pesticide shall be registered.

310601 5. If it does not appear to the Board that the pestici de or
311602 device is adequate to warrant the proposed claims for it or if the
312603 pesticide or device, its labeling, and other material required to be
313604 submitted do not comply with the provisions of this section, it
314605 shall notify the applicant of the deficiencies in the pesticide,
315606 device, labeling, or other material required and afford the
316607 applicant an opportunity to make the necessary corrections. If the
317608 applicant claims, in writing, that the corrections are not necessary
318609 and requests in writing a hearing regarding the registration of the
319610 pesticide or device, the Board shall provide an opportunity for a
320611 hearing before refusing to issue the registration. In order to
321612 protect the public, the Board may at any time cancel the
322613 registration of a product or device. In no e vent, shall
323614 registration of a pesticide or device be considered as a defense or

326615 excuse for the commission of any offense prohibited under this
327616 section.

329617 6. The Board may require that pesticides be distinctively
330618 colored or discolored to protect the public h ealth.

332619 7. Registration shall not be required in the case of a
333620 pesticide shipped from one plant or place within this state to
334621 another plant or place within this state that is operated by the
335622 same person.

337649 K. CATEGORIES OF LICENSES AND PERMITS – The Board may establish
338650 any category of license for pesticide application or any category of
339651 permit for pesticide sales.

341652 L. PERMIT AND PESTICIDE REGISTRATION EXPIRATION – 1. All
342653 permits for pesticide sales shall be issued for a period of one (1)
343654 year and the permits shall be renewed annually and shall expire on a
344655 date determined by the Board. A permit may be renewed for the
345656 ensuing year, without penalty, if a properly completed application
346657 is filed with the Board not later than the fifteenth day of the
347658 month first following the date of expiration. If the application is
348659 not received by that date, a penalty of twice the amount of the
349660 renewal fee shall be charged for renewal of the permit.

351661 2. All pesticide registrations shall be issued for a period of
352662 one (1) year. The registration shall be renewed annually and shall
353663 expire on a date to be determined by the Board. Pesticide
354664 registrations may be renewed for the ensuing year, without penalty,
355665 if a properly completed application is filed with the Board not
356666 later than the fifteenth day of the month first following the date
357667 of expiration. If the application is not received by that date, a
358668 penalty of twice the amount of the renewal fee shall be charged for
359669 renewal of the pesticide registration.

361670 M. PESTICIDE PRODUCING EST ABLISHMENTS – 1. Definitions as used
362671 in this subsection:

364698 a. "establishment" means any site where a pesticide
365699 product, active ingredient or device is produced
366700 within the state,

368701 b. "produce" means to manufacture, prepare, propagate,
369702 compound or process any pesticide or to package,

372703 repackage, label, relabel or otherwise change the
373704 container of any pesticide or device, and

375705 c. "producer" means any person who produces,
376706 manufactures, prepares, compounds, propagates or
377707 processes any active ingredient, pesticide, o r device
378708 as used in producing a pesticide.

380709 2. It shall be unlawful for any person to produce within this
381710 state any pesticide, active ingredient or device without first
382711 obtaining a pesticide producer establishment permit issued by the
383712 Board.

385713 3. The permit shall be issued only upon application on a form
386714 prescribed by the Board. The application shall contain information
387715 regarding the proposed operation of the applicant and other
388716 information as specified by the Board. If at any time there is a
389717 change of the information provided in or on the application for a
390718 pesticide producer establishment permit, the producer must notify
391719 the Board in writing within thirty (30) calendar days of the change.

393720 4. The producer shall file a statement with the Board including

399750 the physical location, if different than the mailing

402752 c. the name of any pesticide, active ingredient, or

405754 d. the name and address and other pertinent contact
406755 information for the responsible party.

408756 5. All permits for pesticide producer establishments shall be
409757 issued for a period of one (1) year and shall be renewed annually.
410758 All permits shall expire on June 30 each year and m ay be renewed
411759 without penalty if a properly completed application is filed with
412760 the Board not later than the fifteenth day of the month first
413761 following the date of expiration. If the application is not
414762 received by that date, a penalty of twice the amount of the renewal
415763 fee shall be charged for renewal of the permit.

419764 6. Each pesticide producer establishment location engaged in
420765 the production of pesticides, active ingredients or devices shall
421766 require a separate permit.

423767 7. The annual permit fee for a pestic ide producer establishment
424768 shall be One Hundred Dollars ($100.00) for each location.

426769 8. If requested by the Board, a complete copy of all labeling,
427770 Material Safety Data Sheets, technical information associated with
428771 the pesticide, active ingredient, or dev ice and a statement of all

429798 claims to be made as well as directions and use must be submitted to
430799 the Board.

432800 9. In order to determine compliance with state and federal
433801 laws, the Board may request a full disclosure of inventory records,
434802 sales and distributio n records, and any other information deemed
435803 necessary by the Board.

437804 10. Every producer shall keep accurate records pertaining to
438805 pesticide, active ingredient, or device production and distribution
439806 as required by the Board. The records of the producer sha ll be kept
440807 intact at the principal producing location in this state for at
441808 least two (2) years after the date of production and distribution
442809 and copies shall be furnished to any authorized agent of the Board,
443810 immediately upon request in person, at any time during the regular
444811 business hours of the producer. Copies of records shall be
445812 furnished to any authorized agent of the Board within seven (7)
446813 working days of a written request, in summary form, by mail, fax, e-
447814 mail email, website, or any other electronic media customarily used.

449815 N. COMPLAINT RESOLUTION - Upon receipt of a written complaint,
450816 the Board shall notify the person filing the complaint in writing of
451817 its receipt and status within two (2) working days. The person whom
452818 the complaint is filed agains t shall also be notified within two (2)
