1645 An Act relating to public health and safety; amending
1746 63 O.S. 2011, Section 2 -309, as last amended by
1847 Section 1, Chapter 255, O.S.L. 2018 (63 O.S. Supp.
1948 2020, Section 2-309), which relates to the Uniform
2049 Controlled Dangerous Substances Act; updating name of
2150 agency; exempting certain practitioners from
2251 electronic prescription requirements for controlled
2352 dangerous substances; allowing for the util ization of
2453 electronic prescriptions under certain circumstances;
2554 modifying internal statutory references; requiring
2655 practitioners to register with certain agency in
2756 order to purchase prescription forms; removing fee
2857 exemption and time period for valid regi strations;
2958 directing practitioners to purchase prescription

49100 Section 2-309. A. 1. Except for dosages medically required
50101 for a period not to excee d forty-eight (48) hours which are
51102 administered by or on direction of a practitioner, other than a
52103 pharmacist, or medication dispensed directly by a practitioner,
53104 other than a pharmacist, to an ultimate user, no controlled
54105 dangerous substance included in S chedule II, which is a prescription
55106 drug as determined under regulation promulgated by the State Board
56107 of Pharmacy, shall be dispensed without an electronic prescription
57108 of a practitioner; provided, that in emergency situations, as
58109 prescribed by the State Board of Pharmacy by regulation, such drug
59110 may be dispensed upon oral prescription reduced promptly to writing
60111 and filed by the pharmacist in a manner to be prescribed by rules
61112 and regulations of the Director of the Oklahoma State Bureau of
62113 Narcotics and Dangerous Drugs Control.

64114 2. Electronic prescribing shall be utilized for Schedules II,
65115 III, IV, and V, subject to the requirements set forth in 21 CFR,
66116 Section 1311 et seq.

68117 3. An electronic prescription with electronic signature may
69118 serve as an original p rescription, subject to the requirements set
70119 forth in 21 CFR, Section 1311 et seq.

76150 5. The electronic prescription requirem ent provided for in this
77151 section shall not apply to prescriptions for controlled dangerous
78152 substances issued by any of the following:

80153 a. a person licensed to practice veterinary medicine,

82154 b. a practitioner who experiences temporary technological
83155 or electrical failure or other extenuating
84156 circumstance that prevents the prescription from being
85157 transmitted electronically; provided, however, that

87159 exception in the medical record of the patient,

110201 (6) a penal institution listed in Section 509 of
111202 Title 57 of the Oklahoma Statutes,

113203 e. a practitioner who writes a prescription to be
114204 dispensed by a pharmacy located on federal property,
115205 provided the practitioner docu ments the reason for
116206 this exception in the medical record of the patient,
117207 or

119208 f. a practitioner that has received a waiver or extension
120209 from his or her licensing board ,

122210 g. a practitioner who prescribes a controlled dangerous
123211 substance for a supply that when taken as prescribed
124212 would be consumed within seve nty-two (72) hours, or

126213 h. a practitioner who determines that an electronic
127214 prescription cannot be issued in a timely manner and
128215 the condition of the patient is at risk .

130216 6. Electronic prescriptions shall not may be utilized under the
131217 following circumstance s:

144253 d. if the practitioner determines that an electronic
145254 prescription cannot be issued in a timely manner and
146255 the condition of the patient is at risk.

148256 7. A pharmacist who receives a written, oral or facsimile
149257 prescription shall not be required to verify that the prescription
150258 falls under one of the exceptions provided for in paragraph 6 of
151259 this subsection. Pharmacist s may continue to dispense medications
152260 from otherwise valid written, oral or facsimile prescriptions that
153261 are consistent with the provisions of this act.

155262 8. Practitioners shall indicate in the health record of a
156263 patient that an exception to the electronic prescription requirement
157264 was utilized.

159265 9. All prescriptions issued pursuant to paragraphs paragraph 5
160266 and subparagraph c of paragraph 6 of this subsection shall be issued
161267 on an official prescription form provided approved by the Oklahoma
162268 State Bureau of Narcotics and Dangerous Drugs Control.

164269 10. a. Effective January 1, 2020, practitioners Practitioners
165270 shall register be registered with the Oklahoma State
166271 Bureau of Narcotics and Dangerous Drugs Control in
167272 order to be issued purchase official prescription
168273 forms. Such registration shall include, but not be

170302 each place of business to be imprinted on official
171303 prescription forms. Any change to a registered
172304 practitioner's registered address shall be promptly
173305 reported to the practitioner's licensing board and th e
174306 Bureau by the practitioner in a manner approved by the
175307 Bureau.

177308 b. A practitioner's registration shall be without fee and
178309 subject to approval by the Bureau. Such registration
179310 shall be valid for a period o f two (2) years and may
180311 be denied, suspended or re voked by the Bureau upon a
181312 finding by the Bureau or licensing board that the
182313 registered practitioner has had any license to
183314 practice a medical profession revoked or suspended by
184315 any state or federal agency.

186316 c. Where the Bureau has revoked the registration of a
187317 registered practitioner, the Bureau may revoke or
188318 cancel any official prescription forms in the
189319 possession of the registered practitioner. Any
190320 revocation or any suspension shall require the
191321 registered practitioner to return all unused official
192322 prescription forms to the Bureau within fifteen (15)
193323 calendar days after the date of the written
194324 notification.

196352 d. c. A practitioner that has had any license to practice
197353 terminated, revoked or suspended by a state or federal
198354 agency may, upon restoration of such l icense or
199355 certificate, register to be issued official
200356 prescription forms with the Bureau.

202357 11. a. Except as provided in subparagraph f of this
203358 paragraph, the Bureau shall issue official Official
204359 prescription forms free of charge only to registered
205360 practitioners in this state. Such forms shall not be
206361 transferable. The number of official prescription
207362 forms issued to a registered shall be purchased at the
208363 expense of the practitioner at any time shall be at
209364 the discretion of or the employer of the practitioner
210365 from a list of vendors approved by the Bureau.

212366 b. Official prescription forms issued to a registered
213367 practitioner shall be imprinted only with the primary
214368 address and may include other addresses listed on the
215369 registration of the practitioner to identify the place
216370 of origin. Such prescriptions shall be sent only to
217371 the primary address of the registered practitioner.

219372 c. Official prescription forms issued to of a registered
220-practitioner shall be used only by the practitioner to ENR. H. B. NO. 2676 Page 6

224403 d. The Bureau may revoke or cancel official prescription
225404 forms in possession of registered practitioners when
226405 the license of such practitioner is suspended,
227406 terminated or revoked.

229407 e. Official prescription forms of regis tered
230408 practitioners who are deceased or who no longer
231409 prescribe shall be returned to the Bureau at a
232410 designated address. If the registered practitioner is
233411 deceased, it is the responsibility of the register ed
234412 practitioner's estate or lawful designee to ret urn
235413 such forms.

237414 f. The Bureau may issue official prescription forms to
238415 employees or agents of the Bureau and other government
239416 agencies for the purpose of preventing, identifying,
240417 investigating and prosecuti ng unacceptable or illegal
241418 practices by providers and other persons and assisting
242419 in the recovery of overpayments under any program
243420 operated by the state or paid for with state funds.
244421 Such prescription forms shall be issued for this
245422 purpose only to indivi duals who are authorized to
246423 conduct investigations on behalf of the Bureau or
247424 other government agencies as part of their official
248425 duties. Individuals and agencies receiving such
249426 prescription forms for this purpose shall provide

250454 appropriate assurances to t he Bureau that adequate
251455 safeguards and security me asures are in place to
252456 prevent the use of such prescription forms for
253457 anything other than official government purposes.

255458 12. a. Adequate safeguards and security measures shall be
256459 undertaken by registered pra ctitioners holding
257460 official prescription forms to assure against the
258461 loss, destruction, theft or unauthorized use of the
259462 forms. Registered practitioners shall maintain a
260463 sufficient but not excessive supply of such forms in
261464 reserve.

263465 b. Registered practitio ners shall immediately notify the
264466 Bureau, in a manner designated by the Bureau, upon
265-their knowledge of the loss, destruction, theft or ENR. H. B. NO. 2676 Page 7
467+their knowledge of the loss, destruction, theft or
266468 unauthorized use of any official prescription forms
267469 issued to them, as well as the failure to receive
268470 official prescription forms within a reasonable time
269471 after ordering them from the vendor approved by the
270472 Bureau.

272473 c. Registered practitioners shall immediately notify the
273474 Bureau upon their knowledge of any diversion or
274475 suspected diversion of drugs pursuant to the loss,
275476 theft or unauthorized use of prescriptions.

277504 B. 1. Except for dosages medically required for a period not

287513 2. Any prescription for a controlled dangerous substance in
288514 Schedule III, IV or V may not be filled or refilled more than six
289515 (6) months after the date thereof or be refilled more than five
290516 times after the date of the prescription, unless renewed by the
291517 practitioner.

293518 C. Whenever it appears to the Director of the Oklahoma State
294519 Bureau of Narcotics and Dangerous Drugs Control that a drug not
295520 considered to be a prescription drug under exi sting state law or
296521 regulation of the State Board of Pharmacy should be so considered
297522 because of its abuse potential, the Director shall so advise the
298523 State Board of Pharmacy and furnish to the Board all ava ilable data
299524 relevant thereto.

301525 D. 1. "Prescription", as used in this section, means a
302526 written, oral or electronic order by a practitioner to a pharmacist
303527 for a controlled dangerous substance for a particular patient, which

313563 2. "Registered practitioner ", as used in this section, means a
314564 licensed practitioner duly registered with the Oklahoma State Bureau
315565 of Narcotics and Dangerous Drugs Control authorized to be issued
316566 purchase official prescription forms.

318567 E. No person shall solicit, dispense, receive or deliver any
319568 controlled dangerous substance through the mail, unless the ultimate
320569 user is personally known to the practitioner and circumstances
321570 clearly indicate such method of delivery is in the best interest of
322571 the health and welfare of the ultimate user.

324572 SECTION 2. This act shall become effective November 1, 2021.
