50	106		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

52	107		SECTION 1. NEW LAW A new section of law not to be
53	108		codified in the Oklahoma Statutes reads as follows:
54		-
55	109		This act shall be known and may be cited as the " Health Care
56	110		Workforce Development and Finance Act of 2022 ".
57		-
58	111		SECTION 2. NEW LAW A new section of law to be codified
59	112		in the Oklahoma Statutes as Section 697.21b of Title 70, unless
60	113		there is created a duplication in numbering, reads as follows:
61		-
62	114		A. There is hereby created in the State Treasury until July 1,
63	115		2027, a revolving fund for the Health Care Workforce Training
64	116		Commission to be designated the "Health Care Workforce Development
65	117		Revolving Fund". The fund shall be a continuing fund , not subject
66	118		to fiscal year limitations, and shall consist of all available
67	119		monies:

69	120		1. Received by the state as Coronavirus State and Local Fiscal
70	121		Recovery Funds pursuant to Section 9901 of the American R escue Plan
71	122		Act of 2021, Pub. L. No. 117 -2;
72		-
73	123		2. Directed to the state by the federal government for the
74	124		purpose of recruiting, educating, and stabilizing Oklahoma's health
75	125		care workforce;

82	155		B. 1. All monies accruing to the credit of said fund are
83	156		hereby appropriated and may be budgeted and expended by the Health
84	157		Care Workforce Training Commission for authorized purpose s as
85	158		provided in paragraph 2 of this subsection . Expenditures from sai d
86	159		fund shall be made upon w arrants issued by the State Treasurer
87	160		against claims filed as prescribed by law with the Director o f the
88	161		Office of Management and Enterprise Serv ices for approval and
89	162		payment.

91	163		2. All monies accruing to the credit of said fund shall be
92	164		utilized for the purpose of recruiting, educating, and stabilizing
93	165		Oklahoma's health care workforce, including the cost s and expenses
94	166		of operating such programs.

96	167		3. All monies accruing to the credit of the fund shall be
97	168		budgeted or encumbered no later than December 31, 2024, and shall be
98	169		expended no later than December 31, 2026.

100	170		4. All monies accruing to the credit of th e fund shall be
101	171		budgeted, expended, and transferred in strict accordance with
102	172		applicable state and federal law and guidance providing for and
103	173		limiting the utilization of such funds.

105	174		SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -2721, is

108	202		Section 1-2721. A. 1. The Physician Manpower Health Care
109	203		Workforce Training Commission sha ll administer the Oklahoma Medical
110	204		Loan Repayment Program.

112	205		2. For the purposes of this section, "primary care physicians"
113	206		shall mean physicians practicing in family medicine, geriatrics,
114	207		general internal medicine, general pedia trics,
115	208		obstetrics/gynecology , or emergency medicine.

117	209		3. For the purposes of this section, "health center" shall mean
118	210		a federally qualified health center as defined by 42 U.S.C., Section
119	211		1905(1)(2)(B).

121	212		4. For the purposes of this se ction, "teaching health center"
122	213		shall mean a health center that supports the residencies of primary
123	214		care physicians within the operations of the health center.

125	215		5. The Program, depending upon and limited to available
126	216		funding, shall provide educational loan repayment assistance t o
127	217		Oklahoma licensed primary care physicians and physician assistants
128	218		who agree to establish a practice in a community located in Oklahoma
129	219		approved by the Commission.

131	220		6. Each award shall be for a contracted period and shall be
132	221		distributed to the participan t by drafts made payable to the
133	222		participant at the end of each contract year with disbursements not
134	223		to exceed an amount to be established annually by the Co mmission.

140	254		7. The Commission shall revi ew the performance in the Program
141	255		of the participating physician or physician assistant and determin e
142	256		whether an award may be gr anted for additional years pursuant to
143	257		rules promulgated by the Commission.

145	258		B. The physicians and physician assistants entering the Program
146	259		each year shall agree to provide medical care and services in ar eas
147	260		designated by the Commission to provide medical care and services to
148	261		Medicaid recipients as authorized by the Oklahoma Health Care
149	262		Authority.

151	263		C. A physician or physician assi stant shall be eligible to
152	264		participate in the loan repayment program if the i ndividual:
153		-
154	265		1. Is a physician that holds a current Oklahoma medical
155	266		license;
156		-
157	267		2. Is a new primary care graduate physician or physician
158	268		assistant. Preference will be given to grad uates of the primary
159	269		care residency programs affiliated with the Oklahoma Sta te
160	270		University College o f Osteopathic Medicine, the University of
161	271		Oklahoma College of Medicine and the teaching hospitals affiliated
162	272		with both schools of medicine and teaching heal th centers located in
163	273		this state; or

165	274		3. Is a current practicing physician or physician assistant an d
166	275		has met criteria establish ed by the Commission.

169	303		funds to assist in funding the Medical Loan R epayment Program. The
170	304		Commission may, at its discretion, contract with other public
171	305		entities and nonprofit corporations for the endowment, management
172	306		and administration of such funds.

174	307		E. The Commission shall present a report on the operation of
175	308		the Program to the Governor, the Speaker of the House of
176	309		Representatives, and the Pre sident Pro Tempore of t he Senate within
177	310		one (1) month of the beginning of each regular session of the
178	311		Legislature, including but not limited to the progress made in
179	312		accomplishing the goal of the Program.

181	313		SECTION 4. AMENDATORY 63 O.S. 2021, Section 1 -2722, is
182	314		amended to read as follows:

184	315		Section 1-2722. The amount of the award of educational loan
185	316		repayment assistance shall not exceed any maximum or minimum a mount
186	317		as promulgated by rules of the Physician Manpower Health Care
187	318		Workforce Training Commission pursuant to the Oklahoma Medical Loan
188	319		Repayment Program. The actual amount of the award shall be based
189	320		upon a determination of:

191	321		1. Actual funds available to the Program for expendit ure; and
192		-
193	322		2. The existing student loan indebtedness o f the participating
194	323		physician.

196	324		SECTION 5. AMENDATORY 63 O.S. 2021, Section 1 -2723, is

199	352		Section 1-2723. A. The Physician Manpower Health Care
200	353		Workforce Training Commission shall have the option of utilizing
201	354		available funding in excess of the amount nec essary to fund the
202	355		Oklahoma Medical Loan Repayment Progra m described in Section 1 -2721
203	356		of this title to fund new or expanded pri mary care residency
204	357		programs in rural and underserved areas of the state. Such new or
205	358		expanded primary care residency program f unding shall include but
206	359		not be limited to:

208	360		1. Payments to hospitals or teaching health centers desiring to
209	361		establish new primary care residency program s. Such payments shall
210	362		be made to cover the costs of salaries, benefits and educational
211	363		costs of residents in training at the facility; or
212		-
213	364		2. Payments to hosp itals or teaching health center s with
214	365		existing primary residency progra ms desiring to expand the number of
215	366		residents participating in those programs. Such payments shall be
216	367		made to cover the costs o f salaries, benefits and educational costs
217	368		of residents in training at the facility .

219	369		B. Provisions of this section shall be sub ject to the
220	370		promulgated rules of the Commission.

222	371		SECTION 6. AMENDATORY 70 O.S. 2021, Section 625.1, is
223	372		amended to read as follows:

231	404		SECTION 7. AMENDATORY 70 O.S. 2021, Section 625.2, is

234	406		Section 625.2 The Physician Manpower Health Care Workforce
235	407		Training Commission shall be authorized and empowered t o grant
236	408		scholarships to qualifi ed students who are bona fide residents of
237	409		the State of Oklahoma and who would not otherwise have funds
238	410		necessary to finance the cost of a program of study leading to the
239	411		Degree of Doctor of Medicine, or to the Degree of Doct or of
240	412		Osteopathic Medicine, to be granted by an accredited and recognized
241	413		college of medicine or college of osteopathic medicine .

243	414		SECTION 8. AMENDATORY 70 O.S. 2021, Section 625.3, is
244	415		amended to read as follows:

246	416		Section 625.3 A. The terms and conditions governing the
247	417		scholarships shall be as prescribed and formulated by the Physician
248	418		Manpower Health Care Workforce Training Commission, but shall
249	419		include the condition that each recipient, upon completion of his
250	420		the recipient's course of study, shall repay his such scholarship by
251	421		practicing his the recipient's profession in a rural community in
252	422		Oklahoma having a population of seven thousand five hundred (7,500)
253	423		persons or less according to the last preceding United States
254	424		Decennial Census and having a need therefor, as determined by the
255	425		Commission, for one (1) year for each one (1) year the scholarship

257	453		credit for payment and reduction of the obligation by serving in the
258	454		defined rural communities for a period less than two (2) years.

260	455		B. The maximum rural population criteria specified in
261	456		subsection A of this section ma y be waived by the Commission.
262		-
263	457		C. The terms of this subsection shall apply to recipients who
264	458		accept assistance on or after July 1, 1993. The contract shall
265	459		provide that in the event th e recipient breaches the terms of the
266	460		contract by not serving the desi gnated community for the specified
267	461		period of time, the Commission shall be entitled to recover an
268	462		amount equal to three times the principal disbursed, pursuant to the
269		-	contract, plus interest. Interest on all amounts paid to or on ~~ENR. H. B. NO. 2776 Page 7~~
	463	+	contract, plus interest. Interest on all amounts paid to or on
270	464		behalf of the participant shall be computed at the current prime
271	465		rate plus one percent (1%) with the interest to accrue from the d ate
272	466		each payment is made, pursuant to the contract. The amount the
273	467		Commission is entitled to recover shall be paid within nin ety (90)
274	468		days of the date the recipient becomes liable as determined by the
275	469		Commission.

277	470		SECTION 9. AMENDATORY 70 O.S. 2021, Section 6 25.4, is
278	471		amended to read as follows:

280	472		Section 625.4 The Commission shall promulgate and adopt suc h
281	473		rules and regulations as may be necessary to carry out the
282	474		provisions of this act. The Commission shall prescribe the fo rm and

285	503		eligibility of applicants; allow or disallow all applications for
286	504		scholarships or renewal of scholarships; contract, increase,
287	505		decrease, terminate and otherwise regulat e all grants for
288	506		scholarships and their repayment in cash or services; and manage,
289	507		operate and control all funds and property appropriated or otherwise
290	508		contributed for this purpose. The Commission may acquire prop erty
291	509		or money by the acceptance of gifts, grants, bequests or devise, and
292	510		may contract with the federal government in order to secure the
293	511		benefit of any federal program consistent with the provisions of
294	512		this act. Monies received by the Commission in repay ment of
295	513		scholarships granted from appropri ated funds shall be deposited with
296	514		the State Treasurer who shall place the same to the cred it of the
297	515		Commission in depository funds to be known as the "Rural Medical
298	516		Education Scholarship Fund" and the "Community P hysician Education
299	517		Scholarship Fund" depen ding on the program in which the recipient
300	518		participated, under and subject exclusively to t he control of the
301	519		Commission for the purpose of fulfilling and accomplishing the
302	520		conditions and purposes of the Physician Manpower Health Care
303	521		Workforce Training Commission. All monies so collecte d and
304	522		deposited in the State Treasury as aforesaid shall co nstitute a
305	523		continuing fund, shall not be subject to fiscal limitations, and the
306	524		unexpended balance shall at all times be ava ilable for expenditures
307	525		for the purposes and in the manner and form provi ded by this act.

320	562		Section 625.4a There is hereby created in the Stat e Treasury a
321	563		revolving fund for the Physician Manpower Health Care Workforce
322	564		Training Commission to be designated the " Physician Manpower Health
323	565		Care Workforce Training Commission Revolving Fund". The fund shall
324	566		be a continuing fund, not subject to fiscal year limitations and
325	567		shall consist of all payments received by the Commission pursuant to
326	568		Sections 625.3 and 625.10a of this title. All monies accrui ng to
327	569		the credit of the fund are hereby appro priated and may be budgeted
328	570		and expended by the Physician Manpower Health Care Workforce
329	571		Training Commission for any expenses incurred in the implementati on
330	572		of its duties. Expenditures from the fund shall be ma de upon
331	573		warrants issued by the State Treasurer against claims filed as
332	574		prescribed by law with the Directo r of the Office of Management and
333	575		Enterprise Services for approval and payment.

351	615		Section 625.10a The Physician Manpower Health Care Workforce
352	616		Training Commission is hereby authorized and empowered to establish
353	617		and administer cost-sharing scholarships a nd loan fund programs
354	618		which shall provide for state assistance to and participation with
355	619		community physician education an d scholarship trust funds which are
356	620		selected and approved by the Commission. Said state assistance and
357	621		participation shall be on a stat e and community matching formula

377	667		trust fund matching program. The Commission shall determine the

382	672		amount of the initial trust funds th e community has raised an d

423	761		3. The communities shall deposit with the Commission the
424	762		initial year scholarship funds provided by the community which funds
425	763		shall be a percentage of the total educational and associated cos ts
426	764		of the student in the course of study i n an accredited colle ge of
427	765		medicine or college of osteopathic medicine and which funds are to
428	766		be used in the education of the selected student.

430	767		4. The Commission shall review and approve the selection of a
431	768		given student and shall then match the initial co mmunity funds with
432	769		state funds from the Oklahoma Community Physician Education Loan and
433	770		Scholarship Program Fun d in the amount needed to meet the total cost
434	771		for educating the student for one (1) year as agreed by t he
435	772		Commission and the community in each pa rticular case.

458	816		Osteopathic Medicine as determined annually by the Commission at the
459	817		school of medicine or osteopathic medicine in which the selected

462	819		7. Each scholarship recipient, upon completion of his the
463	820		recipient's course of study, shal l repay his the recipient's loan

470	853		however, that the reci pient will be given no credit for payment,
471	854		repayment and reduction of said obligati on to the community and the
472	855		state by serving the given community for a period less than two (2)
473	856		years or, when approved by the Commis sion in agreement with the
474	857		community and terms of the contracts involved, repayment may be made
475	858		in cash with interest at th e rate of twelve percent (12%) per annum,
476	859		said interest to accrue from the date each payment of funds pursuant
477	860		to the loan and schola rship program is made. In addition, sho uld a
478	861		recipient who accepts financial assistance after July 1, 1977, elect
479	862		not to perform his obligated service in the sponsoring community,
480	863		the agreed upon sum denoted as liquidated da mages in the contract
481	864		shall be assessed the recipient. No interest shall accrue on the
482	865		principal during any one period of time that the recipient thereof
483	866		is required to serve in the Armed Forces of the United States, or
484	867		during his internship or residency, if in a primary care area and
485	868		the required service, internship or resid ency does not exceed four
486	869		(4) years. Provided that no interest shall accrue for s ix (6)
487	870		months following each of the above exceptions.

505	913		Community Matching Loan an d Scholarship Repayment Revolv ing Fund
506	914		hereby created in the State Trea sury. The community portion of any
507	915		repayment monies deposited in said fund shall be withdrawn from the
508	916		revolving fund and returned to the community on request or, if the
509	917		community so chooses, said repayment monies shall be held available
510	918		in said fund for reallocation by the community and the state to the
511	919		Community Physician Education L oan and Scholarship Program Fund to
512	920		educate another student selected by the community and approved by
513	921		the Commission. The form of th e contracts shall be prepared and

614	1113		family practice physicians for the rural and medically underserved
615	1114		areas of the state. Pr ovided that such subsidy may be used for the
616	1115		primary purpose of increasing the tot al number of residencies fun ded
617	1116		by this state, wherever located within the state, during that period
618	1117		in which residency programs are being established in rural areas;
619	1118		provided further, that as the residency programs are established and
620	1119		accredited in rural hospitals, residency positio ns in such programs
621	1120		shall be first provided for by the Commission . The Commission shall
622	1121		present a report to the Governor, the Speaker of the Hous e of

664	1210		workforce programs to service directly the rural and nonmetropolitan
