50106 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

52107 SECTION 1. NEW LAW A new section of law not to be
53108 codified in the Oklahoma Statutes reads as follows:

55109 This act shall be known and may be cited as the " Health Care
56110 Workforce Development and Finance Act of 2022 ".

58111 SECTION 2. NEW LAW A new section of law to be codified
59112 in the Oklahoma Statutes as Section 697.21b of Title 70, unless
60113 there is created a duplication in numbering, reads as follows:
61-
62114 A. There is hereby created in the State Treasury until July 1,
63115 2027, a revolving fund for the Health Care Workforce Training
64116 Commission to be designated the "Health Care Workforce Development
65117 Revolving Fund". The fund shall be a continuing fund , not subject
66118 to fiscal year limitations, and shall consist of all available
67119 monies:

69120 1. Received by the state as Coronavirus State and Local Fiscal
70121 Recovery Funds pursuant to Section 9901 of the American R escue Plan
71122 Act of 2021, Pub. L. No. 117 -2;
72-
73123 2. Directed to the state by the federal government for the
74124 purpose of recruiting, educating, and stabilizing Oklahoma's health
75125 care workforce;

82155 B. 1. All monies accruing to the credit of said fund are
83156 hereby appropriated and may be budgeted and expended by the Health
84157 Care Workforce Training Commission for authorized purpose s as
85158 provided in paragraph 2 of this subsection . Expenditures from sai d
86159 fund shall be made upon w arrants issued by the State Treasurer
87160 against claims filed as prescribed by law with the Director o f the
88161 Office of Management and Enterprise Serv ices for approval and
89162 payment.

91163 2. All monies accruing to the credit of said fund shall be
92164 utilized for the purpose of recruiting, educating, and stabilizing
93165 Oklahoma's health care workforce, including the cost s and expenses
94166 of operating such programs.

96167 3. All monies accruing to the credit of the fund shall be
97168 budgeted or encumbered no later than December 31, 2024, and shall be
98169 expended no later than December 31, 2026.

100170 4. All monies accruing to the credit of th e fund shall be
101171 budgeted, expended, and transferred in strict accordance with
102172 applicable state and federal law and guidance providing for and
103173 limiting the utilization of such funds.

105174 SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -2721, is

108202 Section 1-2721. A. 1. The Physician Manpower Health Care
109203 Workforce Training Commission sha ll administer the Oklahoma Medical
110204 Loan Repayment Program.

112205 2. For the purposes of this section, "primary care physicians"
113206 shall mean physicians practicing in family medicine, geriatrics,
114207 general internal medicine, general pedia trics,
115208 obstetrics/gynecology , or emergency medicine.

117209 3. For the purposes of this section, "health center" shall mean
118210 a federally qualified health center as defined by 42 U.S.C., Section
119211 1905(1)(2)(B).

121212 4. For the purposes of this se ction, "teaching health center"
122213 shall mean a health center that supports the residencies of primary
123214 care physicians within the operations of the health center.

125215 5. The Program, depending upon and limited to available
126216 funding, shall provide educational loan repayment assistance t o
127217 Oklahoma licensed primary care physicians and physician assistants
128218 who agree to establish a practice in a community located in Oklahoma
129219 approved by the Commission.

131220 6. Each award shall be for a contracted period and shall be
132221 distributed to the participan t by drafts made payable to the
133222 participant at the end of each contract year with disbursements not
134223 to exceed an amount to be established annually by the Co mmission.

137252 assistant detailing performance of activities in accordance with the
138253 Program.

140254 7. The Commission shall revi ew the performance in the Program
141255 of the participating physician or physician assistant and determin e
142256 whether an award may be gr anted for additional years pursuant to
143257 rules promulgated by the Commission.

145258 B. The physicians and physician assistants entering the Program
146259 each year shall agree to provide medical care and services in ar eas
147260 designated by the Commission to provide medical care and services to
148261 Medicaid recipients as authorized by the Oklahoma Health Care
149262 Authority.

151263 C. A physician or physician assi stant shall be eligible to
152264 participate in the loan repayment program if the i ndividual:

154265 1. Is a physician that holds a current Oklahoma medical
155266 license;

157267 2. Is a new primary care graduate physician or physician
158268 assistant. Preference will be given to grad uates of the primary
159269 care residency programs affiliated with the Oklahoma Sta te
160270 University College o f Osteopathic Medicine, the University of
161271 Oklahoma College of Medicine and the teaching hospitals affiliated
162272 with both schools of medicine and teaching heal th centers located in
163273 this state; or

165274 3. Is a current practicing physician or physician assistant an d
166275 has met criteria establish ed by the Commission.

168302 D. The Commission may accept donations of public or private
169303 funds to assist in funding the Medical Loan R epayment Program. The
170304 Commission may, at its discretion, contract with other public
171305 entities and nonprofit corporations for the endowment, management
172306 and administration of such funds.

174307 E. The Commission shall present a report on the operation of
175308 the Program to the Governor, the Speaker of the House of
176309 Representatives, and the Pre sident Pro Tempore of t he Senate within
177310 one (1) month of the beginning of each regular session of the
178311 Legislature, including but not limited to the progress made in
179312 accomplishing the goal of the Program.

181313 SECTION 4. AMENDATORY 63 O.S. 2021, Section 1 -2722, is
182314 amended to read as follows:

184315 Section 1-2722. The amount of the award of educational loan
185316 repayment assistance shall not exceed any maximum or minimum a mount
186317 as promulgated by rules of the Physician Manpower Health Care
187318 Workforce Training Commission pursuant to the Oklahoma Medical Loan
188319 Repayment Program. The actual amount of the award shall be based
189320 upon a determination of:

191321 1. Actual funds available to the Program for expendit ure; and

193322 2. The existing student loan indebtedness o f the participating

199352 Section 1-2723. A. The Physician Manpower Health Care
200353 Workforce Training Commission shall have the option of utilizing
201354 available funding in excess of the amount nec essary to fund the
202355 Oklahoma Medical Loan Repayment Progra m described in Section 1 -2721
203356 of this title to fund new or expanded pri mary care residency
204357 programs in rural and underserved areas of the state. Such new or
205358 expanded primary care residency program f unding shall include but
206359 not be limited to:

208360 1. Payments to hospitals or teaching health centers desiring to
209361 establish new primary care residency program s. Such payments shall
210362 be made to cover the costs of salaries, benefits and educational
211363 costs of residents in training at the facility; or
212-
213364 2. Payments to hosp itals or teaching health center s with
214365 existing primary residency progra ms desiring to expand the number of
215366 residents participating in those programs. Such payments shall be
216367 made to cover the costs o f salaries, benefits and educational costs
217368 of residents in training at the facility .

219369 B. Provisions of this section shall be sub ject to the
220370 promulgated rules of the Commission.

222371 SECTION 6. AMENDATORY 70 O.S. 2021, Section 625.1, is

231404 SECTION 7. AMENDATORY 70 O.S. 2021, Section 625.2, is
232405 amended to read as follows:

234406 Section 625.2 The Physician Manpower Health Care Workforce
235407 Training Commission shall be authorized and empowered t o grant
236408 scholarships to qualifi ed students who are bona fide residents of
237409 the State of Oklahoma and who would not otherwise have funds
238410 necessary to finance the cost of a program of study leading to the
239411 Degree of Doctor of Medicine, or to the Degree of Doct or of
240412 Osteopathic Medicine, to be granted by an accredited and recognized
241413 college of medicine or college of osteopathic medicine .

243414 SECTION 8. AMENDATORY 70 O.S. 2021, Section 625.3, is
244415 amended to read as follows:

246416 Section 625.3 A. The terms and conditions governing the
247417 scholarships shall be as prescribed and formulated by the Physician
248418 Manpower Health Care Workforce Training Commission, but shall
249419 include the condition that each recipient, upon completion of his
250420 the recipient's course of study, shall repay his such scholarship by
251421 practicing his the recipient's profession in a rural community in
252422 Oklahoma having a population of seven thousand five hundred (7,500)
253423 persons or less according to the last preceding United States
254424 Decennial Census and having a need therefor, as determined by the
255425 Commission, for one (1) year for each one (1) year the scholarship

256452 is financed; provided, however, that the recipient will be given no
257453 credit for payment and reduction of the obligation by serving in the
258454 defined rural communities for a period less than two (2) years.

260455 B. The maximum rural population criteria specified in
261456 subsection A of this section ma y be waived by the Commission.

263457 C. The terms of this subsection shall apply to recipients who
264458 accept assistance on or after July 1, 1993. The contract shall
265459 provide that in the event th e recipient breaches the terms of the
266460 contract by not serving the desi gnated community for the specified
267461 period of time, the Commission shall be entitled to recover an
268462 amount equal to three times the principal disbursed, pursuant to the
269-contract, plus interest. Interest on all amounts paid to or on ENR. H. B. NO. 2776 Page 7
463+contract, plus interest. Interest on all amounts paid to or on
270464 behalf of the participant shall be computed at the current prime
271465 rate plus one percent (1%) with the interest to accrue from the d ate
272466 each payment is made, pursuant to the contract. The amount the
273467 Commission is entitled to recover shall be paid within nin ety (90)
274468 days of the date the recipient becomes liable as determined by the
275469 Commission.

277470 SECTION 9. AMENDATORY 70 O.S. 2021, Section 6 25.4, is

280472 Section 625.4 The Commission shall promulgate and adopt suc h
281473 rules and regulations as may be necessary to carry out the
282474 provisions of this act. The Commission shall prescribe the fo rm and

284502 conferences and interviews with applicants; determine the
285503 eligibility of applicants; allow or disallow all applications for
286504 scholarships or renewal of scholarships; contract, increase,
287505 decrease, terminate and otherwise regulat e all grants for
288506 scholarships and their repayment in cash or services; and manage,
289507 operate and control all funds and property appropriated or otherwise
290508 contributed for this purpose. The Commission may acquire prop erty
291509 or money by the acceptance of gifts, grants, bequests or devise, and
292510 may contract with the federal government in order to secure the
293511 benefit of any federal program consistent with the provisions of
294512 this act. Monies received by the Commission in repay ment of
295513 scholarships granted from appropri ated funds shall be deposited with
296514 the State Treasurer who shall place the same to the cred it of the
297515 Commission in depository funds to be known as the "Rural Medical
298516 Education Scholarship Fund" and the "Community P hysician Education
299517 Scholarship Fund" depen ding on the program in which the recipient
300518 participated, under and subject exclusively to t he control of the
301519 Commission for the purpose of fulfilling and accomplishing the
302520 conditions and purposes of the Physician Manpower Health Care
303521 Workforce Training Commission. All monies so collecte d and
304522 deposited in the State Treasury as aforesaid shall co nstitute a
305523 continuing fund, shall not be subject to fiscal limitations, and the
306524 unexpended balance shall at all times be ava ilable for expenditures
307525 for the purposes and in the manner and form provi ded by this act.

352616 Training Commission is hereby authorized and empowered to establish
353617 and administer cost-sharing scholarships a nd loan fund programs
354618 which shall provide for state assistance to and participation with
355619 community physician education an d scholarship trust funds which are
356620 selected and approved by the Commission. Said state assistance and
357621 participation shall be on a stat e and community matching formula

362652 degree of Doctor of Medicine or to the degree of Doctor o f
363653 Osteopathic Medicine. Said student shall be a bona fide resident of
364654 the State of Oklahoma who desires and agrees to practice hi s
365655 profession on completion of t he course of study and training
366656 required for licensure and certification in the community provi ding
367657 the initial funds to be matched by the state funds. Communities
368658 shall deposit the initial trust funds with the Physician Manpower
369659 Health Care Workforce Training Commission to be administered and
370660 matched by the Commissio n for the education of selected and
371661 qualified students t o serve and to practice in the communities with
372662 trust funds so established for that purpose with the Comm ission.
373663 The Commission shall aid a nd advise communities in the selection of
374664 qualified students to participate in a given comm unity scholarship
375665 program and the Commission shall approve the selection of a given
376666 student for a particular community physician e ducation scholarship
377667 trust fund matching program. The Commission shall determine the
378668 percentage share for the state in the sc holarship matching progra m
379669 with a given community to educate a given and duly selected student
380670 on the basis of the extent of need of the community and its
381671 surrounding area for the services of a practicing physician, the
382672 amount of the initial trust funds th e community has raised an d
383673 deposited in the physician education scholarship trust fund that is
384674 duly established and the matching f unds schedule developed by the
385675 Commission and based upon both the population of the community

386702 determined by the latest Federal Decennial Census and the estimated
387703 median family annual income level as determined on the basis of the
388704 estimates of the Oklahoma Department of Commerce. The state
389705 matching assistance and participation in a given scholarship trust
390706 fund program shall not e xceed seventy-five percent (75%) of the
391707 total amount calculated to be necessary to fund the costs of a
392708 course of study for the deg ree of Doctor of Medicine or the de gree
393709 of Doctor of Osteopathic Medicine as determined annuall y by the
394710 Commission. Repayment of the total amount of t he scholarship by the
395711 student on completion of his the student's course of study and on
396712 the establishment of his the student's practice in the community
397713 shall be made to the state fund and to the community trust fund in
398714 accordance with the percentage and t otal amounts contributed by the
399715 state and by the community to th e matching scholarship trust fund
400716 program and in accordance with the provisions of Section 625.5 of
401717 this title and contract requirements of Section 625.6 of this tit le
402718 which shall apply in all cases to students participating in said

404720 administered by the Commission with the exception of the maximum
405721 amount allowable in payment to the student which shall be bas ed on
