5348 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5449 SECTION 1. AMENDATORY 38 O.S. 202 1, Section 28, is
5550 amended to read as follows:
5651 Section 28. A. It is the policy of this state that all
5752 citizens qualified for jury service pursuant to this section have an
5853 obligation to serve on petit juries w hen summoned by the courts of
5954 this state, unless excused.
6055 B. All citizens of the United States, residing in this state,
6156 having the qualifications of electors of this state, are competen t
6257 jurors to serve on all grand and petit juries within their counties;
6358 provided, that persons over seventy (70) years of age and persons
6459 who have served as a grand or petit juror during the last five (5)
60+immediately preceding calendar years shall not be co mpelled to serve

92-immediately preceding calendar years shall not be co mpelled to serve
9387 as jurors in this state and the court may excuse or d ischarge any
9488 juror drawn and summoned as a grand or petit juror if:
9589 1. The prospective juror has a mental or physical condition
9690 that causes him or her to be incapable of performing jury service.
9791 The juror, or the juror 's personal representative, shall pr ovide the
9892 court with documentation from a physician , physician assistant or
9993 advanced practice registered nurse licensed to practice medicine
10094 verifying that a mental or physical conditio n renders the person
10195 unfit for jury service for a period of up to twen ty-four (24)
10296 months; or
10397 2. Jury service would cause undue or extreme phy sical or
10498 financial hardship to the prospective juror or a person under his or
10599 her care or supervision. A judge o f the court for which the
106100 individual was called to jury service shall make undue or extreme
107101 physical or financial hardship determinations. The authority to
108102 make these determinations is delegable only to court officials or
109103 personnel who are authorized by t he laws of this state to function
110104 as members of the judiciary. A pers on requesting to be excused
111105 based on a finding of undue or extreme physic al or financial
112106 hardship shall take all actions necessary to have obtained a ruling
113107 on that request by no later t han the date on which the individual is
114108 scheduled to appear for jury d uty. For purposes of this section,
115109 "undue or extreme physical or financi al hardship" is limited to
110+circumstances in which an indi vidual would be required to abandon a

143-circumstances in which an indi vidual would be required to abandon a
144137 person under his or her personal care or supervision due to the
145138 impossibility of obtaini ng an appropriate substitute caregiver
146139 during the period of participation in the jury pool or on the jury,
147140 incur costs that would have a substantial adverse impact on the
148141 payment of the individual's necessary daily living expenses or on
149142 those for whom he or she provides the principal means of support, or
150143 suffer physical hardshi p that would result in illness or disease.
151144 Undue or extreme physical or financial hardship does not exist
152145 solely based on the fact that a prospective juror will be required
153146 to be absent from his or her place of employment. A person
154147 requesting a judge to grant an excuse based on undue or extreme
155148 physical or financial hardship shall be required to provide the
156149 judge with documentation, such as, but not limited to, federal and
157150 state income tax returns, medical statements from licensed
158151 physicians, proof of dep endency or guardianship, and similar
159152 documents, which the judge finds to clearly support the request to
160153 be excused. Failure to provide satisfactory documentation shall
161154 result in a denial of the request to be excused.
162155 After two (2) years, a person excused from jury service shall
163156 become eligible once again for qu alification as a juror unless the
164157 person was excused fro m service permanently. A person is excused
165158 from jury service permanen tly only when the deciding judge

160+permanent nature.

195187 C. Persons who are not qualified to serve as jurors are:
196188 1. Justices of the Supreme Court or the Court of Civil Appeals;
197189 2. Judges of the Court of Criminal Appeals or the district
198190 court;
199191 3. Sheriffs or deputy sheriffs;
200192 4. Municipal or state law enforcement officer s employed in any
201193 county with a population of two hundre d fifty-five thousand
202194 (255,000) or more;
203195 5. Federal law enforcement o fficers;
204196 6. Licensed attorneys engaged in the practice of law;
205197 7. Persons who have been convicted of any felony or who have
206198 served a term of imprisonment in any penitentiary, state or federal,
207199 for the commission of a felony; provided, any such citizen
208200 convicted, who has been fully restored to his or her civil rights,
209201 shall be eligible to serve as a juror; and
210202 8. Legislators during a session of the Legislature or when
211203 involved in state business.
212204 D. Jailers, or municipal or state law enforcement officers in a
213205 county with a population of less than two hundred fifty -five
214206 thousand (255,000), shall be eligible to serve on noncriminal
215207 actions only.
208+E. Upon his or her request, a person shall be exempt from

243-E. Upon his or her request, a person shall be exempt from
244-service as a juror if the person is:
245236 1. A member of the Armed Forces of the United States who is
246237 serving on active duty during a time of war or declared hostilities;
247238 or
248239 2. A mother who is breast-feeding a baby.
249240 F. The district court may provide electronic resources for
250241 persons summoned for jury duty to obtain information about their
251242 jury service and to submit information to the court, including but
252243 not limited to communications via te lephone, text messag e,
253244 electronic mail and website. The court may utilize an approved
254245 electronic jury management system to record, process, respond to,
255246 and maintain juror communications. The court clerk and the trial
256247 court administrator, under the superv ision and control of the
257248 presiding judge or chief judge, or any district judge acting as his
258249 or her designee, may be authorized to make determinations regarding
259250 juror excusals, exemptions, disqualifi cations, postponements and
260251 deferrals. However, determina tions regarding extr eme physical or
261252 financial hardship shall be made as provided in paragraph 2 of
262253 subsection B of this section.
263254 G. Information provided to the court pursuant to this section
264255 by persons summoned for jury service shall be used exclusively f or
265256 purposes of determining jury disqualifications or excusals. No
257+person shall disclose, copy or permit any person to copy this
258+information for purposes other than jury management.
259+SECTION 2. This act shall become effective November 1, 20 22.
