36	142		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

38	143		SECTION 1. AMENDATORY 2 O.S. 2021, Section 10 -9.7, is
39	144		amended to read as follows:
40		-
41	145		Section 10-9.7 A. All poultry feeding operat ions shall utilize
42	146		Best Management Practices and shall meet the cond itions and
43	147		requirements established by subsection B of this section and by
44	148		rules promulgated by the State Board of Agriculture pursuant to the
45	149		Oklahoma Registered Poultry Feeding Operation s Act.

47	176		B. The criteria for Best Management Practices shall be
48	177		promulgated by rules by t he Board and shall include, bu t not be
49	178		limited to, the following:

51	179		1. There shall be no discharge of poultry waste to waters of
52	180		the state;

54	181		2. Stored poultry waste shal l be isolated from outside surface
55	182		drainage by covers, ditches, dike s, berms, terraces o r other such
56	183		structures;
57		-
58	184		3. No waters of the state shall come into direct contact with
59	185		the poultry confined on the poultry feeding operation;
60		-
61	186		4. Poultry waste handlin g, treatment, management, and removal
62	187		shall:
63		-
64	188		a. not create an enviro nmental or a public health hazard,
65		-
66	189		b. not result in the contamination of waters of the
67	190		state, and
68		-
69	191		c. conform to such other handling, treatment and
70	192		management and removal requirements deeme d necessary
71	193		by the Oklahoma Department of Agriculture, Food, and
72	194		Forestry to implement t he Oklahoma Registered Poultry
73	195		Feeding Operations Act and rules promulgated pursuant
74	196		thereto.

76	197		The rules promulgated by the Board pursuant to this section
77	198		shall provide for exceptions to the storage requirements for poultry
78	199		waste in emergency situations. S uch exceptions shall include b ut

80	227		actions as are necessary to meet requirements imposed on a grower by
81	228		an integrator. In such situations growers shall be required to take
82	229		all actions feasible to prevent pollution from st ored poultry waste.

84	230		C. Every poultry feeding operation shall have a Nutrient
85	231		Management Plan which shall include at a minimum:
86		-
87	232		1. A description of poultry waste handling procedures and
88	233		availability of equipment and type of equipment to be used;
89		-
90	234		2. The calculations and assumptions used for determining land-
91		-	application rates if land application is applicable; ENR. H. B. NO. 2983 Page 3

	235	+	application rates if land application is applicable;
93	236		3. All nutrient analysis data for soil and poultry waste
94	237		testing;
95		-
96	238		4. Legal description and latitude and longitude of lands to be
97	239		used by an operation for land application;
98		-
99	240		5. Land-application rates of p oultry waste shall be based o n
100	241		the available nitrogen and phosphorous content of t he poultry waste
101	242		and shall provide controls for runoff and e rosion as appropriate for
102	243		site conditions;
103		-
104	244		6. The procedures documented in the Nutrient Management Plan
105	245		shall ensure that the handling and uti lization of poultry waste
106	246		complies with the following requirements:

108	247		a. adequate poultry waste storage shall be pr ovided
109	248		consistent with rules promulgated by th e Oklahoma

116	280		ground is frozen except in conformance with the
117	281		Nutrient Management Pl an,

119	282		c. poultry waste shall on ly be applied to suitable land
120	283		at appropriate times a nd rates. Discharge or runoff
121	284		of waste from the application site is prohibited.
122	285		Timing and rate of appli cations shall be based on
123	286		assimilation capacity of the soil profile, assuming
124	287		usual nutrient losses, expected precipitation, and
125	288		soil conditions, and
126		-
127	289		d. poultry waste application shall be prohibited on land
128	290		subject to excessive erosion;
129		-
130	291		7. Records shall be maintained of all poultry wastes applied on
131	292		land owned or controll ed by the operator, and sold or given to other
132	293		persons:

134	294		a. if the poultry waste is sold or given to other persons
135	295		for land application or othe r use, the poultry feeding

142	327		b. the poultry feeding operation shall make available to
143	328		the recipient any nutrient sa mple analysis from that
144	329		year;

146	330		8. Any analysis required by the provisions of the O klahoma
147	331		Registered Poultry Feeding Operations Act or rules p romulgated
148	332		thereto shall be performed by a qua lified environmental testing
149	333		laboratory certified by the Department of Environmental Quality and
150	334		approved by the Oklahoma Department of Agriculture, F ood, and
151	335		Forestry; and
152		-
153	336		9. Such other information deemed nec essary by the Oklahoma
154	337		Department of Agricultu re, Food, and Forestry to administer the
155	338		provisions of the Oklahoma Registered Poultry Feeding Op erations Act
156	339		and rules promulgated pursuant thereto.
157		-
158	340		D. 1. The Nutrient Management Plan for new or expanding
159	341		poultry feeding operations submitted after the effective date of
160	342		this act July 1, 1998, shall be prepared by the ope rator or designee
161	343		of the operator.
162		-
163	344		2. After the plan is submitted to the Oklahoma Department of
164	345		Agriculture, Food, and Forestry for review and approval i f the
165	346		Department determines that a submitted plan needs or requires any
166	347		corrections or modifications , the Department shall return the
167	348		Nutrient Management Plan to the operator for corrections.

169	375		3. For a renewal, if the Department determines the Nutrient
170	376		Management Plan needs or requires corrections or modifications, the
171	377		Department shall make any and all appropriate corrections, app rove
172	378		the plan and notify the poultry feeding operation of the
173	379		modifications.

175	380		E. 1. Except as otherwise provided in this subse ction, a
176	381		Nutrient Management Plan for every poultry feeding operation shall
177	382		be renewed and an update d plan shall be submitted to the Oklahoma
178	383		Department of Agriculture, Food, and Forestry every six (6) years
179	384		from the date the initial or previous plan was s ubmitted.

181	385		2. The operator shall have the op tion to submit the renewed or
182	386		updated plan through the D epartment's website or a prin table online
183	387		form designed by the Department.
184		-
185	388		3. A current operator may submit a one-page amendment to the
186	389		most recently submitted plan in lieu of a renewal plan through the
187	390		Department's website, if applicable. Poultry feedin g operations
188	391		submitting an amendment pursuant to this subsection shall still be
189	392		subject to the soil and poultry waste testing requirements under
190	393		subsections F and G of this section. The amendment sha ll contain
191	394		the following statements:

193	395		a. no changes in the waste utilization Department's
194	396		promulgated standards for land application of pou ltry
195	397		waste have occurred since the most recently submitted
196	398		Nutrient Management Plan,

206	431		d. the entirety of the poultry waste is:

208	432		(1) removed off-site as provided in the poultry
209	433		feeding operation's annual report, as required by
210	434		subsection J of this section, and will c ontinue
211	435		to be removed off-site for the next six (6)
212	436		years, or
213		-
214	437		(2) land-applied and will continue to be land -applied
215	438		for the next six (6) years.
216		-
217	439		F. Every poultry feeding operation located in a non-nutrient-
218	440		limited watershed and non-nutrient-vulnerable groundwaters shall
219	441		perform soil testing on each land-application area and poultry waste
220	442		testing at least once every three (3) years to determine:
221		-
222	443		1. Soil pH and plant-available nutrients including, at a
223	444		minimum, nitrogen, phosphorous and potassium;
224		-
225		-	2. Poultry waste nutrient concentrations and moisture; and ENR. H. B. NO. 2983 Page 6

227	446		3. Application rate based upon current United States Department
228	447		of Agriculture Natural Resources Conservation Service Waste

236	480		an annual soil test on each land-application area prior to the first
237	481		application of the calen dar year. Poultry waste testing shall be
238	482		performed annually prior to the first applica tion of the calendar
239	483		year. Soil and poultry waste testing shal l be performed to
240	484		determine:

242	485		1. Soil pH and plant-available nutrients including at least
243	486		nitrogen, phosphorous and potassium;

245	487		2. Poultry waste nutrient concentrations and moisture; and

254	494		H. 1. Soil and poultry waste analysis data shall be retained
255	495		by the poultry feeding operation for a minimum of six (6) years.

257	496		2. All soil and poultry waste analysis data shall be dated
258	497		prior to land application.

263	526		2. In the event there is an outbreak of a major disea se or
264	527		other emergency resulting in deaths significantly higher than normal
265	528		mortality rates, the Oklahoma Department of Agricul ture, Food, and
266	529		Forestry may approve, in writing, an alternate met hod of disposal of
267	530		carcasses or the storage of poultry waste dur ing the emergency
268	531		period.

270	532		J. Every poultry feeding operation shall file by September 1 of
271	533		each year an annual report with the Department regarding all poultry
272	534		waste removed from or land-applied by the facility for the period
273	535		from July 1 of the previous ye ar through June 30 of that year. The
274	536		report shall contain the following information:
275		-
276	537		1. The date and amount of poultry waste removed from or land-
277	538		applied at the facility;
278		-
279	539		2. The type of poultry waste removed or land -applied, whether a
280	540		cake out, full clean out, in-house windrow or compost, poultry waste
281	541		stack shed, or other type;
282		-
283	542		3. The county and, if applicable, the name of t he Nutrient
284	543		Limited Watershed where the poultry waste was produced ; and
	544	+	4. The location where the poultry waste is removed to:
	545	+	a. if land-applied on-site, provide the following:
	546	+	(1) the date of the land application,

320	592		SECTION 2. AMENDATORY 2 O.S. 2021, Section 10 -9.19, is
321	593		amended to read as follows:

323	594		Section 10-9.19 1. Prior to any land application of poultry
324	595		waste by a certified poultry waste applicator, the a pplicator shall

330	626		at any rate which exceeds the most recently published United States
331	627		Department of Agriculture Natural Resources Conservation Service
332	628		Waste Utilization Standards Department's promulgated standards for
333	629		land application of poultry waste.

335	630		3. The Oklahoma Department of Agriculture, Food, and Fo restry
336	631		may promulgate rules pursuant to the Administrative Pro cedures Act
337	632		which will prohibit the land application of poultry waste in
338	633		nutrient-limited watersheds and nutrien t-vulnerable groundwaters
339	634		based upon lower soil phosphorous levels than are allowe d in this
340	635		section for non-nutrient-limited watersheds and non -nutrient-
341	636		vulnerable groundwaters.

343	637		SECTION 3. NEW LAW A new section of law not to be
344	638		codified in the Oklahoma Statutes reads as follows:
345		-
346	639		The Oklahoma Department of Agricul ture, Food, and Forestry shall
347	640		promulgate emergency rules to implement the requirements and
348	641		standards required by the above sections.
349		-
350	642		SECTION 4. It being immediately necessary for the preservation
351	643		of the public peace, health or safety, an emergency is hereby
352	644		declared to exist, by reason whereof this act shall take effect and
353	645		be in full force from and af ter its passage and approv al.
