36142 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

38143 SECTION 1. AMENDATORY 2 O.S. 2021, Section 10 -9.7, is
39144 amended to read as follows:

41145 Section 10-9.7 A. All poultry feeding operat ions shall utilize
42146 Best Management Practices and shall meet the cond itions and
43147 requirements established by subsection B of this section and by
44148 rules promulgated by the State Board of Agriculture pursuant to the
45149 Oklahoma Registered Poultry Feeding Operation s Act.

47176 B. The criteria for Best Management Practices shall be
48177 promulgated by rules by t he Board and shall include, bu t not be
49178 limited to, the following:

51179 1. There shall be no discharge of poultry waste to waters of
52180 the state;

54181 2. Stored poultry waste shal l be isolated from outside surface
55182 drainage by covers, ditches, dike s, berms, terraces o r other such
56183 structures;

58184 3. No waters of the state shall come into direct contact with
59185 the poultry confined on the poultry feeding operation;
60-
61186 4. Poultry waste handlin g, treatment, management, and removal
62187 shall:
63-
64188 a. not create an enviro nmental or a public health hazard,
65-
66189 b. not result in the contamination of waters of the
67190 state, and
68-
69191 c. conform to such other handling, treatment and
70192 management and removal requirements deeme d necessary
71193 by the Oklahoma Department of Agriculture, Food, and
72194 Forestry to implement t he Oklahoma Registered Poultry
73195 Feeding Operations Act and rules promulgated pursuant
74196 thereto.

76197 The rules promulgated by the Board pursuant to this section
77198 shall provide for exceptions to the storage requirements for poultry
78199 waste in emergency situations. S uch exceptions shall include b ut

80227 actions as are necessary to meet requirements imposed on a grower by
81228 an integrator. In such situations growers shall be required to take
82229 all actions feasible to prevent pollution from st ored poultry waste.

84230 C. Every poultry feeding operation shall have a Nutrient
85231 Management Plan which shall include at a minimum:

87232 1. A description of poultry waste handling procedures and
88233 availability of equipment and type of equipment to be used;
89-
90234 2. The calculations and assumptions used for determining land-
91-application rates if land application is applicable; ENR. H. B. NO. 2983 Page 3

235+application rates if land application is applicable;
93236 3. All nutrient analysis data for soil and poultry waste
94237 testing;
95-
96238 4. Legal description and latitude and longitude of lands to be
97239 used by an operation for land application;

99240 5. Land-application rates of p oultry waste shall be based o n
100241 the available nitrogen and phosphorous content of t he poultry waste
101242 and shall provide controls for runoff and e rosion as appropriate for
102243 site conditions;

104244 6. The procedures documented in the Nutrient Management Plan
105245 shall ensure that the handling and uti lization of poultry waste
106246 complies with the following requirements:

108247 a. adequate poultry waste storage shall be pr ovided
109248 consistent with rules promulgated by th e Oklahoma

119282 c. poultry waste shall on ly be applied to suitable land
120283 at appropriate times a nd rates. Discharge or runoff
121284 of waste from the application site is prohibited.
122285 Timing and rate of appli cations shall be based on
123286 assimilation capacity of the soil profile, assuming
124287 usual nutrient losses, expected precipitation, and
125288 soil conditions, and

127289 d. poultry waste application shall be prohibited on land
128290 subject to excessive erosion;

130291 7. Records shall be maintained of all poultry wastes applied on
131292 land owned or controll ed by the operator, and sold or given to other
132293 persons:

134294 a. if the poultry waste is sold or given to other persons
135295 for land application or othe r use, the poultry feeding

142327 b. the poultry feeding operation shall make available to
143328 the recipient any nutrient sa mple analysis from that
144329 year;

146330 8. Any analysis required by the provisions of the O klahoma
147331 Registered Poultry Feeding Operations Act or rules p romulgated
148332 thereto shall be performed by a qua lified environmental testing
149333 laboratory certified by the Department of Environmental Quality and
150334 approved by the Oklahoma Department of Agriculture, F ood, and
151335 Forestry; and
152-
153336 9. Such other information deemed nec essary by the Oklahoma
154337 Department of Agricultu re, Food, and Forestry to administer the
155338 provisions of the Oklahoma Registered Poultry Feeding Op erations Act
156339 and rules promulgated pursuant thereto.

158340 D. 1. The Nutrient Management Plan for new or expanding
159341 poultry feeding operations submitted after the effective date of
160342 this act July 1, 1998, shall be prepared by the ope rator or designee
161343 of the operator.

163344 2. After the plan is submitted to the Oklahoma Department of
164345 Agriculture, Food, and Forestry for review and approval i f the
165346 Department determines that a submitted plan needs or requires any
166347 corrections or modifications , the Department shall return the
167348 Nutrient Management Plan to the operator for corrections.

169375 3. For a renewal, if the Department determines the Nutrient
170376 Management Plan needs or requires corrections or modifications, the
171377 Department shall make any and all appropriate corrections, app rove
172378 the plan and notify the poultry feeding operation of the
173379 modifications.

175380 E. 1. Except as otherwise provided in this subse ction, a
176381 Nutrient Management Plan for every poultry feeding operation shall
177382 be renewed and an update d plan shall be submitted to the Oklahoma
178383 Department of Agriculture, Food, and Forestry every six (6) years
179384 from the date the initial or previous plan was s ubmitted.

181385 2. The operator shall have the op tion to submit the renewed or
182386 updated plan through the D epartment's website or a prin table online
183387 form designed by the Department.

185388 3. A current operator may submit a one-page amendment to the
186389 most recently submitted plan in lieu of a renewal plan through the
187390 Department's website, if applicable. Poultry feedin g operations
188391 submitting an amendment pursuant to this subsection shall still be
189392 subject to the soil and poultry waste testing requirements under
190393 subsections F and G of this section. The amendment sha ll contain
191394 the following statements:

193395 a. no changes in the waste utilization Department's
194396 promulgated standards for land application of pou ltry
195397 waste have occurred since the most recently submitted
196398 Nutrient Management Plan,

202428 c. there has been no expansion in the poultry feedi ng
203429 operation since the most recently submitted Nutrient
204430 Management Plan, and

206431 d. the entirety of the poultry waste is:

208432 (1) removed off-site as provided in the poultry
209433 feeding operation's annual report, as required by
210434 subsection J of this section, and will c ontinue
211435 to be removed off-site for the next six (6)
212436 years, or
213-
214437 (2) land-applied and will continue to be land -applied
215438 for the next six (6) years.

217439 F. Every poultry feeding operation located in a non-nutrient-
218440 limited watershed and non-nutrient-vulnerable groundwaters shall
219441 perform soil testing on each land-application area and poultry waste
220442 testing at least once every three (3) years to determine:

222443 1. Soil pH and plant-available nutrients including, at a
223444 minimum, nitrogen, phosphorous and potassium;
224-

234478 G. Every poultry feeding operation located in a n utrient-
235479 limited watershed and nutrient-vulnerable groundwater s hall perform
236480 an annual soil test on each land-application area prior to the first
237481 application of the calen dar year. Poultry waste testing shall be
238482 performed annually prior to the first applica tion of the calendar
239483 year. Soil and poultry waste testing shal l be performed to
240484 determine:

242485 1. Soil pH and plant-available nutrients including at least
243486 nitrogen, phosphorous and potassium;
244-
245487 2. Poultry waste nutrient concentrations and moisture; and
246-
247488 3. Application rate based upon current United States Department

249490 Utilization Standards, unless the Oklahoma Department of

261525 disposal of carcasses associated with normal m ortality.

263526 2. In the event there is an outbreak of a major disea se or
264527 other emergency resulting in deaths significantly higher than normal
265528 mortality rates, the Oklahoma Department of Agricul ture, Food, and
266529 Forestry may approve, in writing, an alternate met hod of disposal of
267530 carcasses or the storage of poultry waste dur ing the emergency
268531 period.

270532 J. Every poultry feeding operation shall file by September 1 of
271533 each year an annual report with the Department regarding all poultry
272534 waste removed from or land-applied by the facility for the period
273535 from July 1 of the previous ye ar through June 30 of that year. The
274536 report shall contain the following information:

276537 1. The date and amount of poultry waste removed from or land-
277538 applied at the facility;
278-
279539 2. The type of poultry waste removed or land -applied, whether a
280540 cake out, full clean out, in-house windrow or compost, poultry waste
281541 stack shed, or other type;
282-
283542 3. The county and, if applicable, the name of t he Nutrient
284543 Limited Watershed where the poultry waste was produced ; and
544+4. The location where the poultry waste is removed to:
545+a. if land-applied on-site, provide the following:
546+(1) the date of the land application,

320592 SECTION 2. AMENDATORY 2 O.S. 2021, Section 10 -9.19, is

326623 the Oklahoma Poultry Was te Applicators Certification Act.

328624 2. Land application of poultr y waste in a non-nutrient-limited
329625 watershed and non-nutrient-vulnerable groundwaters shall not be made
330626 at any rate which exceeds the most recently published United States
331627 Department of Agriculture Natural Resources Conservation Service
332628 Waste Utilization Standards Department's promulgated standards for
333629 land application of poultry waste.

335630 3. The Oklahoma Department of Agriculture, Food, and Fo restry
336631 may promulgate rules pursuant to the Administrative Pro cedures Act
337632 which will prohibit the land application of poultry waste in
338633 nutrient-limited watersheds and nutrien t-vulnerable groundwaters
339634 based upon lower soil phosphorous levels than are allowe d in this
340635 section for non-nutrient-limited watersheds and non -nutrient-
341636 vulnerable groundwaters.

343637 SECTION 3. NEW LAW A new section of law not to be
344638 codified in the Oklahoma Statutes reads as follows:
345-
346639 The Oklahoma Department of Agricul ture, Food, and Forestry shall
347640 promulgate emergency rules to implement the requirements and
348641 standards required by the above sections.

350642 SECTION 4. It being immediately necessary for the preservation
351643 of the public peace, health or safety, an emergency is hereby
352644 declared to exist, by reason whereof this act shall take effect and
353645 be in full force from and af ter its passage and approv al.
