5956 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
6057 SECTION 1. AMENDATORY 7 0 O.S. 2021, Section 1 -111, is
6158 amended to read as follows:
6259 Section 1-111. A. Except as otherwise provided for by law, a
6360 school day shall consist of not less than s ix (6) hours devoted to
6461 school activities. A district board of education may elect to
6562 extend the length of one (1) or more school days to more than six
6663 (6) hours and reduce the number of school days as long as the total
6764 amount of classroom instruction tim e is not less than one thousand

9793 B. A school day for nursery, early childhood educati on,
9894 kindergarten, and alternative education pro grams shall be as
9995 otherwise defined by la w or as defined by the State Board of
10096 Education. Except as otherwise provided for in this subsection, not
10197 more than one (1) school day shall be counted for attendance
10298 purposes in any twenty-four-hour period. Two (2) school days, each
10399 consisting of not le ss than six (6) hours, may be counted for
104100 attendance purposes in any twenty-four-hour period only if one of
105101 the school days is for the purpose of parent -teacher conferences
106102 held as provided for in Section 1 -109 of this title.
107103 C. Students Except as provided in subsection D of thi s section,
108104 students absent from school in which they are regularly enrolled may
109105 be considered as being in attendance if the reason for such absence
110106 is to participate in scheduled school activ ities under the direction
111107 and supervision of a regular member o f the faculty or to participate
112108 in an online course approved by the district board of education.
113109 The State Board of Education shall adopt rules to provide for the
114110 implementation of supplementa l online courses which shall include,
115111 but not be limited to, pr ovisions addressing the following:
116112 1. Criteria for student admissions eligibility;

144139 2. A student admission process administered t hrough the
145140 district of residence, which provides the ability fo r the student to
146141 enroll in individual courses;
147142 3. A process by which students are not denied the oppo rtunity
148143 to enroll in educationally appropriate courses by school districts.
149144 For the purposes of this section, "educationally appropriate" means
150145 any instruction that is not substantially a repeat of a course or
151146 portion of a course that the student has succ essfully completed,
152147 regardless of the grade of the student, and regardless of whether a
153148 course is similar to or identical to the instruction that is
154149 currently offered in the school district;
155150 4. Creation of a system w hich provides ongoing enrollment
156151 access for students throughout the school year;
157152 5. A grace period of fifteen (15) calendar days from the first
158153 day of an online course for student withdrawal f rom an online course
159154 without academic penalty;
160155 6. Mastery of competencies for course completion rathe r than
161156 Carnegie units;
162157 7. Student participation in extracurricular activities in
163158 accordance with school district eligibility rules and policies and
164159 any rules and policies of a private organization or association
165160 which provides the coordination, supervisio n, and regulation of the

249240 disciplined, suspended, or expelled, if the terms of
250241 punishment would preclude the student from
251242 participating in an educational field trip or
252243 extracurricular activity.
253244 E. Each district board of education shall adopt policies and
254245 procedures that conform to rules for online courses as adopted by
255246 the State Board. Such policies shall include criteria for approval
256247 of the course, the approp riateness of the course for a particular
257248 student, authorization for full-time students to enroll in online
258249 courses, and establishing fees or charges. No district shall be
259250 liable for payment o f any fees or charges for any online course for
260251 a student who has not complied with the district's policies and
261252 procedures. School districts shall not deny students the
262253 opportunity to enroll in educationally appropriate courses and sha ll
263254 provide an admissions process which includes input from the student,
264255 the parent or guardian of the student, and school faculty.
265256 E. F. Districts shall require students enrolled in online
266257 courses to participate in the Oklahoma School Testing Program Act.
267258 Students participating in online courses from a remote site will be
268259 responsible for providing their own equipment and Internet acce ss,

297287 not be granted for such courses except upon approval of the State
298288 Board of Education and the district board of education.
299289 F. G. Districts may provide students with opportunities for
300290 blended instruction. "Blended instruction" shall mean a combination
301291 of brick-and-mortar learning and virtual learning environments that
302292 includes elements of a student's control over place, pace and path
303293 of learning. A student in blended instruction may work on virtual
304294 courses at home or at school in a blended flex lab but shall
305295 participate in at least one unit or set of competencies as defined
306296 by Section 11-103.6 of this title at a physical school building in a
307297 traditional classroom setting which is the academi c equivalent of
308298 one (1) hour per day for each instructional day in the school year
309299 as defined by Section 1-109 of this title.
310300 G. H. The school day for kindergarten may consist of six (6)
311301 hours devoted to schoo l activities.
312302 SECTION 2. This act shall become effective November 1, 2022.
