6156 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6257 SECTION 1. AMENDATORY 59 O.S. 2021, Section 1800.2, is
6358 amended to read as follows:
6459 Section 1800.2 As used in the Alarm, Locksmith and Fire
6560 Sprinkler Industry Act:
6661 1. "Alarm industry" means the sale, except as provided in
6762 Section 1800.3 of this title, insta llation, alteration, repair,
6863 replacement, service, inspection, or main tenance of alarm systems or
64+service involving receipt of alarm signals for the purpose of
65+employee response and investigation of such signals or any

96-service involving receipt of alarm signals for the purpose of
97-employee response and investigation of such signals or any
9892 combination of the foregoing activiti es except inspections on one-
9993 and two-family dwellings are exempt;
10094 2. "Alarm system" means one or more de vices designed either to
10195 detect and signal an unauthorized intrusion or entry or to signal a
10296 fire or other emergency condition, which signals are resp onded to by
10397 public law enforcement off icers, fire department personnel , private
10498 guards or security officer s;
10599 3. "Battery-charged security fence " means an alarm system and
106100 ancillary components or equipment attached to such a system
107101 including, but not limited to, a fence, a battery-operated
108102 energizer, which is intended to periodically deliver voltage
109103 impulses to the fence connected to it, and a battery-charging device
110104 used exclusively to charge the battery;
111105 4. "Committee" means the Alarm, and Locksmith and Fire
112106 Sprinkler Industry Committee;
113107 4. 5. "Commissioner" means the Commissioner of Labor;
114108 5. 6. "Integrated security system " means a mechanical and/or
115109 electronic security device that includes, but is not limited to,
116110 multiple integrated locks, burglar alar m systems, access control
117111 systems, fiber-optic security systems, video surveillance systems,
118112 and nurse call systems, but does not include a stand-alone-, single-
119113 element of an integrated security system;
114+6. 7. "Licensee" means any person licensed pursuant to the

147-6. 7. "Licensee" means any person licensed pursuant to the
148-Alarm, Locksmith and Fire Sprinkl er Industry Act;
149142 7. 8. "Lock" means mechanical or electronic devices consisting
150143 entirely of Class 2 or Class 3 circuits and power source
151144 requirements as established by the National Electrical Co de and
152145 designed to control use of a device or control ingress or egress of
153146 a structure or automobile , including, but not limited to, peripheral
154147 devices to alarm systems, safes, vaults, safe deposit boxes,
155148 biometric/retina readers and mechanical or electron ic key systems;
156149 8. 9. "Locksmith industry" means the sale, servicing or
157150 installing, repairing, rebuilding, readying, rekeying, repinning,
158151 adjusting or installing locks, mechanical or e lectronic security
159152 devices, annunciation devices not designed to requir e a response by
160153 law enforcement or opening or bypassing a loc k by a means other than
161154 those intended by the manufacturer of such devices. For the
162155 purposes of the Alarm, Locksmith and Fi re Sprinkler Industry Act,
163156 "mechanical or electronic security devices " includes, but is not
164157 limited to, access control systems inclu ding peripheral devices to
165158 alarm systems, fiber -optic security systems, fire sprinklers, closed
166159 circuit television, video su rveillance and nurse call systems;
167160 9. 10. "Person" means an individual, sole proprietorship , firm,
168161 partnership, association, limite d liability company, corporation, or
169162 other similar entity; and
163+10. 11. "Residential alarm monitoring or service contract "
164+means a contract with end users for alarm monitoring and/or services
165+for individual residenti al premises for their own use.

197-10. 11. "Residential alarm monitoring or service contract "
198-means a contract with end users for alarm monitoring and/or services

200192 SECTION 2. AMENDATORY 59 O.S. 2021, Section 1800.12, is
201193 amended to read as follows:
202194 Section 1800.12 A. Any municipality or county may levy and
203195 collect reasonable charges for alarm installation conn ections
204196 located in or at a police or fire department which is owned,
205197 operated or monitored by the municipality or county. Any
206198 municipality or county may require di scontinuance of service of any
207199 alarm signal device which, due to mech anical malfunction or f aulty
208200 equipment, causes excessive false alarms and, in the opinion of the
209201 appropriate county or municipal official, becomes a detriment to the
210202 functions of the depa rtment involved. The municipality or county
211203 may cause the disconnect ion of the device until the same is repaired
212204 to the satisfaction of the appropriate official; however , the
213205 municipality or county shall advise the owner or user of the device
214206 of the disconnection in advance or as soon as reasonably
215207 practicable. The municip ality or county may le vy and collect
216208 reasonable reconnection fees. Mechanical malfunction and faulty
217209 equipment shall not include, for the purpose of the Alarm, Locksmith
218210 and Fire Sprinkler Industry Act, false alarms caused by human error
219211 or an act of God.

214+business or individual which is or may be licensed pursuant to th e

247-B. No municipality m ay adopt any ordinance concerning the
248-licensing of any alarm, locksmith or fire sprinkler industry
249-business or individual which is or may be licensed pursuant to th e
250-Alarm, Locksmith and Fire Sprinkler Industry Act.
251242 C. No municipality or county may adopt any ordinance, order, or
252243 regulation concerning the installation, operat ion, or usage of a
253244 battery-charged security fence as long as the installation ,
254245 operation, and usage of the battery-charged security fence follows
255246 the requirements and standards prescrib ed in Section 3 of this act.
256247 SECTION 3. NEW LAW A new section of law to be codified
257248 in the Oklahoma Statutes as Section 1800.19 of Title 59, unless
258249 there is created a duplication in numbering, reads as follows:
259250 A battery-charged security fence shall meet the following
260251 requirements:
261252 1. Interfaces with a monitored alarm device in a man ner that
262253 enables the alarm system to transmit a signal intended to summon the
263254 business or law enforcement in response to an intrusion or burglary;
264255 2. Is located on a property that is not designated by a
265256 municipality or county exclusively for residential u se;
266257 3. Has an energizer that is powered by a commercial storage
267258 battery that is not more than twelve (12) volts of direct current ;
268259 4. Has an energizer that meets the standards set forth by the
269260 International Electrotechnical Commission Standard 60335-2-76,
270261 current edition;
262+5. Is completely surrounded by a non electric perimeter fence or
263+wall that is not less than five (5) feet in height;

298-5. Is completely surrounded by a non electric perimeter fence or
299-wall that is not less than five (5) feet in height;
300290 6. Does not exceed ten (10) feet in height or two (2) feet
301291 higher than the nonelectric perimeter fence or wall described in
302292 paragraph 5 of this section, whichever is higher; and
303293 7. Is marked with conspicuous warning signs that are located on
304294 the battery-charged security fence at not more than thirty-foot
305295 intervals and display: "WARNING – ELECTRIC FENCE".
306296 SECTION 4. It being immediately necessary for the pr eservation
307297 of the public peace, health or safety, an emergency is hereby
308298 declared to exist, by reas on whereof this act shall take effect an d
309299 be in full force from and after its passage and approval.
