1448 An Act relating to cities and towns; amending 11 O.S.
1549 2021, Section 56-103, which relates to municipalities
1650 subject to the Municipal Campaign Finance and
1751 Financial Disclosure Act; providing for
1852 municipalities to contract with an Interlocal Entity;
1953 authorizing municipalities not subject to the
2054 Municipal Campaign Fin ance and Financial Disclosure
2155 Act to enact a comprehensive code; clarifying that
2256 the Ethics Commission shall have no enforcement
2357 responsibilities; enabling municipal government s to
2458 provide for hearings, enforcement, and civil fines;
2559 granting for appeals of municipal court orders to

2761 adopt necessary ordinances; authorizing municipal

4199 SECTION 1. AMENDATORY 11 O.S. 2021, Section 56-103, is
42100 amended to read as follows:

44101 Section 56-103. A. The Municipal Campaign Finance and
45102 Financial Disclosure Act shall apply only to municipalities with a
46-population of more than ten thousand (10,000) according to the most ENR. H. B. NO. 3056 Page 2
103+population of more than ten thousand (10,000) according to the most
47104 recent Federal Decenni al Census and a general fund expenditure
48105 budget in excess of Ten Million Dollars ($10,000,000.00) in the
49106 fiscal year in which the municipal elections are held.

51107 B. A municipality described in subsection A of this section may
52108 enact a comprehensive code of c ampaign finance and pers onal
53109 financial disclosure ordinances, including provisions for
54110 enforcement thereof, in which case the Muni cipal Campaign Finance
55111 and Financial Disclosure Act shall not apply to the municipality. A
56112 municipality described in subsecti on A of this section may contract
57113 with an Interlocal Entity operating under the Municipal Campaign
58114 Finance Disclosure for Exempted Municipalities Act and the
59115 municipality may alternatively follow the provisions of the
60116 Municipal Campaign Financ e Disclosure for Exempted Municipalities
61117 Act when they have adopted their own comprehensive code of campaign
62118 finance and personal disclosure or dinances as authorized under this
63119 act. Any municipality enacting such a code shall file a notice of
64120 its action with the Ethics Commission, which shall have no
65121 enforcement responsibilities under the code.

67148 SECTION 2. NEW LAW A new se ction of law to be codified
68149 in the Oklahoma Statutes as Section 56-103a of Title 11, unless
69150 there is created a duplication in numbering, reads as foll ows:

71151 1. Any municipality not subject to the Municipal Campaign
72152 Finance and Financial Disclosure Act, or a ny entity authorized under
73153 subsection B of Section 56 -103 of Title 11 of the Oklahoma Statutes ,
74154 may enact a comprehensive code of campaign finance and personal
75155 financial disclosure ordinances including policies and provisions
76156 for the administration and enforcement thereof. The Ethics
77157 Commission shall have no enforcement responsibilities under the
78158 Municipal Campaign Finance Disclosure for Exempted Municipalities
79159 Act. Municipal governments may provide for hearings, enforcement,
80160 and civil fines not to exceed Five Hundred Dollars ($500.00).
81161 Hearings shall be conducted through the municipal court to
82162 adjudicate violations of the comprehensive code of campaign finance
83163 and personal financial disclosure ordinances as authorized in this
84164 act. Any judicial order from a municipal court under this section
85165 may be appealed to the district court having jurisdiction over the
86166 alleged or adjudicated violator. All appeals shall be de novo. Any
87167 civil fine issued under the provisions of the act may be converted
88168 to a civil judgment by the municipal government in the appropriate
89169 district court. Municipal governments have the authority to adopt
90170 ordinances necessary and proper for the administration and

93198 2. Municipal governments enacting a comprehensive code of
94199 campaign finance and personal financial disclosure ordinances may
95200 contract with an interlocal entity created in accordance with the
96201 Interlocal Cooperation Act for the administration an d enforcement of
97202 this act. The interlocal entity may assign adjudication of any
98203 potential violations of a municipality's campaign finance and
99204 personal financial disclosure ordinances to any municipal court that
100205 has joined the interlocal entity in accordance with policies adopted
101206 by the interlocal entity. The assigned municipal court shall have
102207 jurisdiction to conduct the hearing , issue subpoenas, adjudicate the
103208 matter and issue judgment for civil fines for violations of
104209 municipal campaign finance and personal financial disclosure
105210 ordinances of any member of the interlocal entity. Any civil fine
106211 issued under the provisions of t his act may be converted to a civil
107212 judgment by the interlocal ent ity in the appropriate district court.
108213 The interlocal entity shall hav e the authority to adopt policies and
109214 procedures necessary and proper for the administration and
110215 enforcement of this act .
