53224 Solicitation Act of 2022".

55225 SECTION 2. NEW LAW A new section of law to be codified
56226 in the Oklahoma Statutes as Secti on 775C.2 of Title 15, unless there

59228 As used in the Telephone Solic itation Act of 2022:

61229 1. "Called party" means a person who is the regular user of the
62-telephone number that receives a commercial telephonic sales call;

64231 2. "Caller identification service " means a service that allows
65232 a telephone subscriber to have the telephone number and, where
66233 available, the name of the ca lling party transmitted
67234 contemporaneously with the telephone call and displayed on a device
68235 in or connected to the subscriber 's telephone;

70236 3. "Prior express written consent" means a written agreement

323+A. A person may not make or knowingly allow a telephonic sales
324+call to be made if s uch call involves an automated system for the
325+selection or dialing of telephone numbers or the playing of a
326+recorded message when a connection is completed to a number called
327+without the prior express written consent of the called party.
328+B. It shall be unlawful for any perso n who makes a telephonic
329+sales call or causes a t elephonic sales call to be made to fail to
330+transmit or cause not to be transmitted the originating telephone
331+number and, when made av ailable by the telephone solicitor's
332+carrier, the name of the telephone solicitor to any caller
333+identification service in u se by a recipient of a telephonic sales
334+call. However, it is not a violation to substitute, for the name
335+and telephone number used in or billed for making the call, the name
336+of the seller on behalf of which a telephonic sales call is placed
337+and the seller's customer service telephone number, which i s
338+answered during regular business hours. If a telephone number is
339+made available through a caller identification service as a result
340+of a telephonic sales call, the solicitor must ensure that telephone
341+number is capable of receiving telephone calls and must connect the
342+original call recipient, upon calling such number, to the telephone

123-B. It shall be unlawful for any perso n who makes a commercial
124-telephonic sales call or causes a commercial telephonic sales call
125-to be made to fail to transmit or cause not to be transmitted the
126-originating telephone number and, when made av ailable by the
127-telephone solicitor's carrier, the name of the telephone solicitor
128-to any caller identification service in u se by a recipient of a
129-commercial telephonic sales call . However, it is not a violation to
130-substitute, for the name and telephone number used in or billed for
131-making the call, the name of the seller on behalf of which a
132-commercial telephonic sales call is placed and the seller's customer

143-telephonic sales call or causes a commercial telephonic sales call
144-to be made to intentionally alter the voice of th e caller in an
145-attempt to disguise or conceal the identity of the caller in order
146-to defraud, confuse, or financially or otherwise injure the
147-recipient of a commercial telephonic sales call or in orde r to
148-obtain personal information from the recipient of a commercial
149-telephonic sales call, which may be used in a fraudulent or unlawful
150-manner.

152-D. There is a rebuttable presumption that a commercial
153-telephonic sales call made to any area code in this state is made to
154-an Oklahoma resident or to a person in this state a t the time of the
155-call.

162386 any of the following types of phone calls, including calls made
163387 through automated di aling or recorded messages:

165388 1. A commercial telephone solicitation phone call before 8 a.m.
166389 or after 8 p.m. local time in the called person 's time zone; and

168390 2. More than three comm ercial telephone solicitation phone
169391 calls from any number to a person over a twenty-four-hour period on

173420 B. A commercial telephone seller or salesperson making a
174421 commercial telephone solicitation call may not:

176422 1. Intentionally act to prevent transmission of the telephone
177423 solicitor's name or telephone number to the party called when the
178424 equipment or service used by the telephone solicitor is capable of
179425 creating and transmitting the telephone solicitor's name or
180426 telephone number; or

182427 2. Use technology that deliberately displays a different caller
183428 identification number than the number from where the call is
184429 originating to conceal the true identity of the caller.

186430 SECTION 5. NEW LAW A new section of law t o be codified
187431 in the Oklahoma Statutes as Section 775C.5 of Title 15, unless there
188432 is created a duplication in numbering, reads as follows :

190433 Exempt from this act are the following:

192434 1. A person engaging in commercial telephone solicitation where
193435 the solicitation is an isolated transaction and not conducted in the
194436 course of a pattern of r epeated transactions of like nature;

196437 2. A person soliciting for religious, charitable, political, or
197438 educational purposes. A person soliciting for other noncommercial
198439 purposes is exempt only if tha t person is soliciting for a nonprofit
199440 organization and if that organization is properly registered as such

201468 Section 501(c)(3) or (6) of the Internal Revenue Code ;

203469 3. A person who does not make the major sales presentation
204470 during the telephone sol icitation and who does not intend to, and
205471 does not actually, compl ete or obtain provisional acceptance of a
206472 sale during the telephone solicitation, but who makes the major
207473 sales presentation and co mpletes the sale at a later face-to-face
208474 meeting between the sell er and the prospective purchaser . However,
209475 if a seller, directly following a telephone solicitation, causes an
210476 individual whose primary purpose is to go to the prospective
211477 purchaser to collect the payment or deliver any item purchased, this
212478 exemption does not apply;

214479 4. A licensed securities, commodities, or in vestment broker,
215480 dealer, or investment adviser when soliciting within the scope of
216481 his or her license, or a l icensed associated person of a securities,
217482 commodities, or investment broker, dealer, or investment adviser
218483 when soliciting within the scope of h is or her license. As used in
219484 this section, "licensed securities, commodities, or investment
220485 broker, dealer, or investment adviser" means a person subject to
221486 license or registration by the Securities and Exchange Commission,
222487 by the Financial Industry Regulatory Authority or other self -
223488 regulatory organization as defi ned by the Securities Exchange Act of
224489 1934, 15 U.S.C., Section 78l, or by an official or agency of this
225490 state or of any state of the United States. As used in this

234524 5. A person primarily soliciting the sale of a newspaper of
235525 general circulation;

237526 6. A book, video, or record club or contractual plan or
238527 arrangement:

240528 a. under which the seller provides the co nsumer with a
241529 form which the consumer may use to instruct the seller
242530 not to ship the offered merchandise,
243-
244531 b. which is regulated by the Trade Regulation Rule
245532 regarding the Use of Negative Option Plans by Sellers
246533 in Commerce, and
247-
248534 c. which provides for the s ale of books, records, or
249535 videos which are not co vered under subparagraph a or b
250536 of this paragraph, including continuity plans,
251537 subscription arrangements, standing-order
252538 arrangements, supplements, and series arrangements

259570 As used in this section, "supervised financial institution " means a
260571 commercial bank, trust company, savings and loan associ ation, mutual
261572 savings bank, credit union, industrial loan company, consumer
262573 finance lender, commercial finance lender, or insurer ; provided that
263574 the institution is subject to supervision by an official or agency
264575 of this state, of any state, or of the Unite d States. For the
265576 purposes of this exemption, "affiliate" means a person who direct ly,
266577 or indirectly through one or more intermediaries, contro ls or is
267578 controlled by, or is under common contro l with, a supervised
268579 financial institution;

270580 8. Any licensed insurance broker, agent, customer
271-representative, or solicitor when soliciting within the scope of his ENR. H. B. NO. 3168 Page 7

272582 or her license. As used in this section, "licensed insurance

274584 insurance broker, agent, c ustomer representative, or solicitor

290622 b. the purchaser business intends to resell or offer for
291623 purposes of advertisement or as a promotional item the
292624 property or goods purchased, or
293-
294625 c. the purchaser business intends to use the pro perty or
295626 goods purchased in a recyclin g, reuse,
296627 remanufacturing, or manufacturing process ;

298628 11. A person who solicits sales by periodicall y publishing and
299629 delivering a catalog of the seller's merchandise to prospective
300630 purchasers, if the catalog:

302631 a. contains a written description or illustrati on of each

322671 Statutes, or affiliate thereof or its agents, or a
323672 telecommunications business that is regulated by the Oklahoma
324673 Corporation Commission, or a cellular telephone company licensed by
325674 the Federal Communications Commission or any of their authorized
326675 vendors or independent contractors or other bona fide radio
327676 telecommunication services provider. For the purposes of this
328677 exemption, "affiliate" means a person who directly, or indirectly
329678 through one or more intermediaries, controls or is controlled by, or
330679 is under common control with, a telepho ne company subject to Title
331680 17 of the Oklahoma Statutes;

333681 15. A person who is licensed pursuant to the Funeral Services
334682 Licensing Act in Title 59 of the Oklahoma Statutes and who is
335683 soliciting within the scope of the licen se;

337684 16. An issuer or a subsidiary of an issuer that has a class of
338685 securities which is subject to Section 12 of the Securities Exchange
339686 Act of 1934, 15 U.S.C., Section 78l, and which is either registered
340687 or exempt from registration under subparagraph (a), subparagraph

374767 services are offered for sale and provided at the

377769 b. a majority of the seller 's business involves the buyer
378770 obtaining such products or services at the seller 's
379771 location;

381772 22. Any person who has been lawfully providing telemarketing
382773 sales services continuously for at least five (5) years under the
383774 same ownership and control and who derives seventy-five percent
384775 (75%) of its gross telemarketing sales revenues from contracts with
385776 persons exempted in this section;

387777 23. A person licensed pursuant to The Oklahoma Real Estate
388778 License Code in Title 59 of the Oklahoma Statutes, soliciting within
389779 the scope of the license;

391780 24. A publisher, or an agent of a publisher by written
392781 agreement, who solicits the sale of his or her periodical or
393782 magazine of general, paid circulation. The term "paid circulation"
394783 shall not include magazines that are only circulated as part of a
395784 membership package or that are given as a free gift or prize from
396785 the publisher or agent of the publisher by written agreement ;
