105101 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
106102 SECTION 1. NEW LAW A new section of law to be codified
107103 in the Oklahoma Statutes as Section 1703 of Title 47, unless there
108104 is created a duplication in numbering, reads as follows:
109105 A. A person, as defined in Section 1701 of Title 47 of the
110106 Oklahoma Statutes, may operate a fully autonomous vehicle on the
111107 public roads of this state without a hum an driver provided that the
112108 automated driving system is engaged and the ve hicle meets the
113109 following conditions:
114110 1. If a failure of the automated driving system occurs that
115111 renders that system unable to perform the entire dynamic driving
116112 task relevant to its intended operational design domain, the fully
117113 autonomous vehicle will achieve a minimal risk condition;
118114 2. The fully autonomous vehicle is capable of operating in
119115 compliance with the applicable traffic and motor vehicle safety laws
120116 and regulations of this state, unless an exemption has been granted
121117 by the Department of Public Safety or its designee; and
122118 3. When required by federal law, the vehicle bears the required
123119 manufacturer's certification label indicating that at the t ime of
124120 its manufacture it has been certified to be in comp liance with all
125121 applicable Federal Motor Vehicle Safety Standards, including
126122 reference to any exemption granted by the National Highway Traffic
127123 Safety Administration.

155150 B. Prior to operating a fully autonomous vehicle on the public
156151 roads of this state witho ut a human driver, a person shall submit to
157152 the Department of Public Safety a law enforcement interacti on plan
158153 that contains, but shall not be li mited to, information that
159154 describes:
160155 1. How to communicate with a fleet support specialist who is
161156 available during the times the vehicle is in operation;
162157 2. How to safely remove the fully a utonomous vehicle from the
163158 roadway;
164159 3. How to recognize whether the fully autonomous vehicle is in
165160 autonomous mode and steps to safely tow the vehicle; and
166161 4. Any additional information the manufacturer or owner deems
167162 necessary regarding the hazardous co nditions or public saf ety risks
168163 associated with the operation of the fully autonomous vehicle.
169164 C. The Department is authorized to promulgate rules regarding
170165 the contents of the law enforcement interaction plan described in
171166 subsection B of this section.
172167 SECTION 2. NEW LAW A new section of law to be codified
173168 in the Oklahoma Statutes as Sectio n 1704 of Title 47, unless there
174169 is created a duplication in num bering, reads as follows:
175170 Before operating a fully auton omous vehicle on public r oads in
176171 this state without a human driver, a person shall submit proof of
177172 financial responsibility satisfactory to the Department of Public
178173 Safety that the fully autonomous ve hicle is covered by insurance or

210204 SECTION 3. NEW LAW A new section of law to be codified
211205 in the Oklahoma Statutes as Section 1705 of Title 47, unless there
212206 is created a duplication in numbering, reads as follows:
213207 In the event of an accident:
214208 1. The fully autonomous vehicle shall remain on the scene of
215209 the accident when required by Section 10-107 or 10-108 of Title 47
216210 of the Oklahoma Statutes, consistent with its capab ility under
217211 Section 1 of this act; and
218212 2. The owner of the fully autonomous vehicle, or a person on
219213 behalf of the vehicle owner, shall report any acc idents or
220214 collisions consistent with Section 10-107 or 10-108 of Title 47 of
221215 the Oklahoma Statutes.
222216 SECTION 4. NEW LAW A new section of law to be codified
223217 in the Oklahoma Statutes as Section 1706 of Title 47, unless there
224218 is created a duplication in numbering, reads as follows:
225219 An on-demand autonomous vehicle network shall be permitted to
226220 operate pursuant to state laws governing the operation of
227221 transportation networ k companies, taxis, or any oth er ground
228222 transportation for hire of passengers, with th e exception that any
229223 provision of the Oklahoma Transportation Network Company Services

262255 SECTION 5. NEW LAW A ne w section of law to be codified
263256 in the Oklahoma Stat utes as Section 1707 of Title 47, unless there
264257 is created a duplication in n umbering, reads as follows:
265258 A. A fully autonomous vehicle shall be properly registered in
266259 accordance with the Oklahoma Vehicle L icense and Registration Act
267260 pursuant to Section 1 101 et seq. of Title 47 of the Oklahoma
268261 Statutes. If a fully autonomous vehicle is registered in this
269262 state, the vehicle shall be identified on t he registration as a
270263 fully autonomous vehicle.
271264 B. A fully autonomous vehicle shall be properly titled in
272265 accordance with Oklahoma Vehicle License and Registration Act. If a
273266 fully autonomous vehicle is titled in th is state, the vehicle shall
274267 be identified on the title as a fully autonomous vehicle.
275268 SECTION 6. NEW LAW A new section of law to be codified
276269 in the Oklahoma Statutes as Section 1708 of Title 47, unless there
277270 is created a duplication in numbering, reads as follows:
278271 A. A person may operate a motor vehicle equipped with an
279272 automated driving system capable of performing the entire dynamic
280273 driving task if:

308300 1. Such automated driving system w ill issue a request to
309301 intervene whenever the a utomated driving system is not capable of
310302 performing the entire dynamic driving task with the e xpectation that
311303 the person will respond appropriately to such a request; and
312304 2. The automated driving system is c apable of being oper ated in
313305 compliance with Sections 11-101 through 11-1404 of Title 47 of the
314306 Oklahoma Statutes unless an exemption has be en granted by the
315307 Department of Public Safety.
316308 B. Nothing in this act prohibits or restricts a human driver
317309 from operating a fully autonomous vehicle equipped with controls
318310 that allow for the human driver to control all or part of the
319311 dynamic driving task .
320312 SECTION 7. NEW LAW A new section of law to be codified
321313 in the Oklahoma Statutes as Sec tion 1709 of Title 47, unless there
322314 is created a duplication in numbering, reads as follows:
323315 A fully autonomous vehicle that is also a commerci al motor
324316 vehicle pursuant to Sections 161A through 230.34b of Title 47 of the
325317 Oklahoma Statutes may operate pursuant to state laws governing th e
326318 operation of commerc ial motor vehicles, except that any provision
327319 that by its nature reasonably applies only to a human driver does
328320 not apply to such a vehicle operating with the automated driving
329321 system engaged.

358349 in the Oklahoma Statutes as Section 1710 of Title 47, unless there

360351 A fully autonomous vehicle that is designed to be operated
361352 exclusively by the automated drivin g system for all trips is not
362353 subject to motor vehicle equipment laws or regulations of this stat e
363354 that:
364355 1. Relate to or support motor vehicle operation by a human
365356 driver seated in the vehicle; and
366357 2. Are not relevant for an automated driving system.
367358 SECTION 9. NEW LAW A new section of law to be codified
368359 in the Oklahoma Statutes as Section 1711 of Title 47, unless there
369360 is created a duplication in numbering, reads as follows:
370361 Unless otherwise provided in this title and notwithstanding any
371362 other provision of law, fully autonomous vehicles and automated
372363 driving systems are governed exclusively by this act. The
373364 Department of Public Safety and the Oklahoma Department of
374365 Transportation are authorized to promulgate administrative rule s to
375366 implement the provis ions of this act.
376367 SECTION 10. AMENDATORY 47 O.S. 2021, Section 6-102, is
377368 amended to read as follows:
378369 Section 6-102. A. A nonresident who is sixteen (16) years of
379370 age or older may operate a motor vehicle in t his state as authorize d

407397 by the class, restrictions, and endorsements specified on the
408398 license, if the nonresident is:
409399 1. Properly licensed in the home state or country to ope rate a
410400 commercial or noncommercial motor vehicle an d who has immediate
411401 possession of a valid driver lic ense issued by the home state or
412402 country; or
413403 2. A member of the Armed Forces of the United States or the
414404 spouse or dependent of such member who has been issued and is in
415405 possession of a valid driver license issued by an overseas comp onent
416406 of the Armed Forces of the United States.
417407 B. A resident who is at least fifteen (15) years of age may
418408 operate a vehicle in this state without a driver license, if the
419409 resident is:
420410 1. Operating a vehicle pursuant to sub section B of Section 6 -
421411 105 of this title; or
422412 2. Taking the driving skills examination as required by Section
423413 6-110 of this title, when accompanied by a D river License Examiner
424414 of the Department of Public Safety or by a design ated examiner
425415 approved and certified by the Department.
426416 C. Any person, while in t he performance of official duties, may
427417 operate any class of motor vehicle if the person possesses any class
428418 of valid Oklahoma driver license or a valid d river license issued by
429419 another state, if the person is:

457446 1. A member of the Arme d Forces of the United States who is on
458447 active duty;
459448 2. A member of the military reser ves, not including United
460449 States reserve technician;
461450 3. A member of the National Guard who is on active duty ,
462451 including National Guard mil itary technicians;
463452 4. A member of the National Guar d who is on part-time National
464453 Guard training, including National Guard military technicians; or
465454 5. A member of the United States Coast Guard who is on active
466455 duty.
467456 D. The Commissioner of Public Safety is hereby authorized to
468457 adopt rules as may be necess ary to enter into reciprocity agreements
469458 with foreign countries. The rules shall specify that the dri ver
470459 license standards of the foreign country shall be comparable to
471460 those of this state. The rules sh all also require foreign drive rs,
472461 who are operating a motor vehicle in Oklahoma under such a
473462 reciprocity agreement, t o comply with the compulsory motor vehicle
474463 liability insurance and financial responsibil ity laws of this stat e.
475464 E. When an automated drivi ng system, as defined by Section 1701
476465 of this title, installed on a motor vehicle i s engaged, the
477466 following shall apply:
478467 1. The automated driving syst em is considered the driver or
479468 operator, for the purpo se of assessing compliance with applicable
480469 traffic or motor vehicle laws, and shall be deemed to satisf y

509497 the vehicle; and
510498 2. The automated driving system is consider ed to be licensed to
511499 operate the vehicle.
512500 SECTION 11. AMENDATORY 47 O.S. 2021 , Section 1701, is
513501 amended to read as follows:
514502 Section 1701. As used in this act:
515503 A. "Driving automation system" "Automated driving system or
516504 ADS" means hardware and softwar e that are collectively capable of
517505 performing part or the entire dynamic task on a sustained basis,
518506 regardless of whether it is limite d to a specific operational design
519507 domain. The term driving automation system is used generally to
520508 describe any system ca pable of level 1-5 driving automation, as
521509 specified in SAE International Recommen ded Practice J3016 inc luding,
522510 but not limited to, cor e vehicle functions as listed in this
523511 section.
524512 B. "Dynamic driving task" or "DDT" means all of the real -time
525513 operational and tactical functions required to operate a vehicle in
526514 on-road traffic, excludin g the strategic functi ons such as trip
527515 scheduling and selection of destinations and waypoints and inclu ding
528516 without limitation:
529517 1. Lateral vehicle motion co ntrol via steering;
530518 2. Longitudinal vehicle motion control via accel eration and
531519 deceleration;

559546 3. Monitoring the driving environment via object and event
560547 detection, recognition, classification and resp onse preparation;
561548 4. Object and event response execut ion;
562549 5. Maneuver planning; and
563550 6. Enhancing conspicuity via lightin g, signaling and gesturing.
564551 C. "DDT fallback" means the response by the person or hum an
565552 driver to either perform the DDT or achieve a minimal risk condition
566553 after occurrence of a DDT performance -relevant system failure(s) or
567554 upon operation design domain e xit, or the response by an aut omated
568555 driving system to achieve minimal risk condition, given the same
569556 circumstances.
570557 D. "Fully autonomous vehicle" means a motor vehicle equipped
571558 with an automated driving system designed to function wit hout a
572559 human driver as a level 4 or 5 system under SAE J3016B.
573560 E. "Human driver" means a natural person in the vehicle with a
574561 valid license to operate a motor vehicle who controls all or part of
575562 the dynamic driving task.
576563 F. "Minimal risk condition" means a condition to which a
577564 person, human driver, or a n ADS may bring a vehi cle after performing
578565 the DDT fallback in order to reduce the risk of a crash when a given
579566 trip cannot or should not be completed.
580567 G. "On-demand autonomous vehicle network" means a
581568 transportation service network that uses a software a pplication or
582569 other digital means to dispatch or otherwi se enable the

610596 prearrangement of transportation with fully autonomous vehicles for
611597 purposes of transporting passengers o r goods, including for-hire
612598 transportation and tran sportation of passengers or go ods for
613599 compensation.
614600 H. "Operational design domain " or "ODD" means operating
615601 conditions under which a gi ven automated driving system is
616602 specifically designed to function, in cluding, but not limited to,
617603 environmental, geographic al, and time-of-day restrictions, and the
618604 requisite presence or absence of certain tra ffic or roadway
619605 characteristics.
620606 I. "Person" means a natural person, corporation, business
621607 trust, estate, trust, pa rtnership, limited liability company,
622608 association, joint venture, governmental agency, public corporati on,
623609 or any other legal or commercial entity.
624610 J. "Request to intervene " means notification by an automated
625611 driving system to a human driver that the human driver should
626612 promptly begin or resume performance o f part or all of the dynamic
627613 driving task.
628614 K. "SAE J3016B" means the Taxonomy and Definitions for Terms
629615 Related to Driving Automatio n Systems for On-Road Motor Vehicles
630616 published by SAE International i n June 2018.
631617 SECTION 12. AMENDATORY 47 O.S. 2021, Section 1702, is
632618 amended to read as follows:

660645 Section 1702. A. Only the State of Oklahoma may enact a law or
661646 take any other action to regulate the operation of motor vehicles
662647 equipped with driving automation automated driving systems in
663648 Oklahoma.
664649 B. Pursuant to subsection A of this section, the State of
665650 Oklahoma:
666651 1. Preempts the authority of a county or municipal ity to
667652 prohibit, restrict or regulate the operation of motor vehicles
668653 equipped with driving automation automated driving systems on the
669654 basis of those vehicles being equipp ed with driving automation
670655 automated driving systems; and
671656 2. Supersedes any existin g law or ordinance of a county or
672657 municipality that prohibits, restri cts or regulates the testing or
673658 operation of motor vehicles equipped with driving automation
674659 automated driving systems.
675660 SECTION 13. This act shall become effective November 1, 2022.
