105	101		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
106	102		SECTION 1. NEW LAW A new section of law to be codified
107	103		in the Oklahoma Statutes as Section 1703 of Title 47, unless there
108	104		is created a duplication in numbering, reads as follows:
109	105		A. A person, as defined in Section 1701 of Title 47 of the
110	106		Oklahoma Statutes, may operate a fully autonomous vehicle on the
111	107		public roads of this state without a hum an driver provided that the
112	108		automated driving system is engaged and the ve hicle meets the
113	109		following conditions:
114	110		1. If a failure of the automated driving system occurs that
115	111		renders that system unable to perform the entire dynamic driving
116	112		task relevant to its intended operational design domain, the fully
117	113		autonomous vehicle will achieve a minimal risk condition;
118	114		2. The fully autonomous vehicle is capable of operating in
119	115		compliance with the applicable traffic and motor vehicle safety laws
120	116		and regulations of this state, unless an exemption has been granted
121	117		by the Department of Public Safety or its designee; and
122	118		3. When required by federal law, the vehicle bears the required
123	119		manufacturer's certification label indicating that at the t ime of
124	120		its manufacture it has been certified to be in comp liance with all
125	121		applicable Federal Motor Vehicle Safety Standards, including
126	122		reference to any exemption granted by the National Highway Traffic
127	123		Safety Administration.

155	150		B. Prior to operating a fully autonomous vehicle on the public
156	151		roads of this state witho ut a human driver, a person shall submit to
157	152		the Department of Public Safety a law enforcement interacti on plan
158	153		that contains, but shall not be li mited to, information that
159	154		describes:
160	155		1. How to communicate with a fleet support specialist who is
161	156		available during the times the vehicle is in operation;
162	157		2. How to safely remove the fully a utonomous vehicle from the
163	158		roadway;
164	159		3. How to recognize whether the fully autonomous vehicle is in
165	160		autonomous mode and steps to safely tow the vehicle; and
166	161		4. Any additional information the manufacturer or owner deems
167	162		necessary regarding the hazardous co nditions or public saf ety risks
168	163		associated with the operation of the fully autonomous vehicle.
169	164		C. The Department is authorized to promulgate rules regarding
170	165		the contents of the law enforcement interaction plan described in
171	166		subsection B of this section.
172	167		SECTION 2. NEW LAW A new section of law to be codified
173	168		in the Oklahoma Statutes as Sectio n 1704 of Title 47, unless there
174	169		is created a duplication in num bering, reads as follows:
175	170		Before operating a fully auton omous vehicle on public r oads in
176	171		this state without a human driver, a person shall submit proof of
177	172		financial responsibility satisfactory to the Department of Public
178	173		Safety that the fully autonomous ve hicle is covered by insurance or

207	201		($1,000,000.00) which shall satisfy the requirements of t he
208	202		Compulsory Insurance Law pursuant to Section 7-600 et seq. of Title
209	203		47 of the Oklahoma Statutes.
210	204		SECTION 3. NEW LAW A new section of law to be codified
211	205		in the Oklahoma Statutes as Section 1705 of Title 47, unless there
212	206		is created a duplication in numbering, reads as follows:
213	207		In the event of an accident:
214	208		1. The fully autonomous vehicle shall remain on the scene of
215	209		the accident when required by Section 10-107 or 10-108 of Title 47
216	210		of the Oklahoma Statutes, consistent with its capab ility under
217	211		Section 1 of this act; and
218	212		2. The owner of the fully autonomous vehicle, or a person on
219	213		behalf of the vehicle owner, shall report any acc idents or
220	214		collisions consistent with Section 10-107 or 10-108 of Title 47 of
221	215		the Oklahoma Statutes.
222	216		SECTION 4. NEW LAW A new section of law to be codified
223	217		in the Oklahoma Statutes as Section 1706 of Title 47, unless there
224	218		is created a duplication in numbering, reads as follows:
225	219		An on-demand autonomous vehicle network shall be permitted to
226	220		operate pursuant to state laws governing the operation of
227	221		transportation networ k companies, taxis, or any oth er ground
228	222		transportation for hire of passengers, with th e exception that any
229	223		provision of the Oklahoma Transportation Network Company Services

258	251		Statutes that reasonably applies only to a human driver would not
259	252		apply to the operation of a fully autonomous vehicle with the
260	253		automated driving syste m engaged on an on-demand autonomous vehicle
261	254		network.
262	255		SECTION 5. NEW LAW A ne w section of law to be codified
263	256		in the Oklahoma Stat utes as Section 1707 of Title 47, unless there
264	257		is created a duplication in n umbering, reads as follows:
265	258		A. A fully autonomous vehicle shall be properly registered in
266	259		accordance with the Oklahoma Vehicle L icense and Registration Act
267	260		pursuant to Section 1 101 et seq. of Title 47 of the Oklahoma
268	261		Statutes. If a fully autonomous vehicle is registered in this
269	262		state, the vehicle shall be identified on t he registration as a
270	263		fully autonomous vehicle.
271	264		B. A fully autonomous vehicle shall be properly titled in
272	265		accordance with Oklahoma Vehicle License and Registration Act. If a
273	266		fully autonomous vehicle is titled in th is state, the vehicle shall
274	267		be identified on the title as a fully autonomous vehicle.
275	268		SECTION 6. NEW LAW A new section of law to be codified
276	269		in the Oklahoma Statutes as Section 1708 of Title 47, unless there
277	270		is created a duplication in numbering, reads as follows:
278	271		A. A person may operate a motor vehicle equipped with an
279	272		automated driving system capable of performing the entire dynamic
280	273		driving task if:

308	300		1. Such automated driving system w ill issue a request to
309	301		intervene whenever the a utomated driving system is not capable of
310	302		performing the entire dynamic driving task with the e xpectation that
311	303		the person will respond appropriately to such a request; and
312	304		2. The automated driving system is c apable of being oper ated in
313	305		compliance with Sections 11-101 through 11-1404 of Title 47 of the
314	306		Oklahoma Statutes unless an exemption has be en granted by the
315	307		Department of Public Safety.
316	308		B. Nothing in this act prohibits or restricts a human driver
317	309		from operating a fully autonomous vehicle equipped with controls
318	310		that allow for the human driver to control all or part of the
319	311		dynamic driving task .
320	312		SECTION 7. NEW LAW A new section of law to be codified
321	313		in the Oklahoma Statutes as Sec tion 1709 of Title 47, unless there
322	314		is created a duplication in numbering, reads as follows:
323	315		A fully autonomous vehicle that is also a commerci al motor
324	316		vehicle pursuant to Sections 161A through 230.34b of Title 47 of the
325	317		Oklahoma Statutes may operate pursuant to state laws governing th e
326	318		operation of commerc ial motor vehicles, except that any provision
327	319		that by its nature reasonably applies only to a human driver does
328	320		not apply to such a vehicle operating with the automated driving
329	321		system engaged.

358	349		in the Oklahoma Statutes as Section 1710 of Title 47, unless there
359	350		is created a duplication in nu mbering, reads as follows:
360	351		A fully autonomous vehicle that is designed to be operated
361	352		exclusively by the automated drivin g system for all trips is not
362	353		subject to motor vehicle equipment laws or regulations of this stat e
363	354		that:
364	355		1. Relate to or support motor vehicle operation by a human
365	356		driver seated in the vehicle; and
366	357		2. Are not relevant for an automated driving system.
367	358		SECTION 9. NEW LAW A new section of law to be codified
368	359		in the Oklahoma Statutes as Section 1711 of Title 47, unless there
369	360		is created a duplication in numbering, reads as follows:
370	361		Unless otherwise provided in this title and notwithstanding any
371	362		other provision of law, fully autonomous vehicles and automated
372	363		driving systems are governed exclusively by this act. The
373	364		Department of Public Safety and the Oklahoma Department of
374	365		Transportation are authorized to promulgate administrative rule s to
375	366		implement the provis ions of this act.
376	367		SECTION 10. AMENDATORY 47 O.S. 2021, Section 6-102, is
377	368		amended to read as follows:
378	369		Section 6-102. A. A nonresident who is sixteen (16) years of
379	370		age or older may operate a motor vehicle in t his state as authorize d

407	397		by the class, restrictions, and endorsements specified on the
408	398		license, if the nonresident is:
409	399		1. Properly licensed in the home state or country to ope rate a
410	400		commercial or noncommercial motor vehicle an d who has immediate
411	401		possession of a valid driver lic ense issued by the home state or
412	402		country; or
413	403		2. A member of the Armed Forces of the United States or the
414	404		spouse or dependent of such member who has been issued and is in
415	405		possession of a valid driver license issued by an overseas comp onent
416	406		of the Armed Forces of the United States.
417	407		B. A resident who is at least fifteen (15) years of age may
418	408		operate a vehicle in this state without a driver license, if the
419	409		resident is:
420	410		1. Operating a vehicle pursuant to sub section B of Section 6 -
421	411		105 of this title; or
422	412		2. Taking the driving skills examination as required by Section
423	413		6-110 of this title, when accompanied by a D river License Examiner
424	414		of the Department of Public Safety or by a design ated examiner
425	415		approved and certified by the Department.
426	416		C. Any person, while in t he performance of official duties, may
427	417		operate any class of motor vehicle if the person possesses any class
428	418		of valid Oklahoma driver license or a valid d river license issued by
429	419		another state, if the person is:

457	446		1. A member of the Arme d Forces of the United States who is on
458	447		active duty;
459	448		2. A member of the military reser ves, not including United
460	449		States reserve technician;
461	450		3. A member of the National Guard who is on active duty ,
462	451		including National Guard mil itary technicians;
463	452		4. A member of the National Guar d who is on part-time National
464	453		Guard training, including National Guard military technicians; or
465	454		5. A member of the United States Coast Guard who is on active
466	455		duty.
467	456		D. The Commissioner of Public Safety is hereby authorized to
468	457		adopt rules as may be necess ary to enter into reciprocity agreements
469	458		with foreign countries. The rules shall specify that the dri ver
470	459		license standards of the foreign country shall be comparable to
471	460		those of this state. The rules sh all also require foreign drive rs,
472	461		who are operating a motor vehicle in Oklahoma under such a
473	462		reciprocity agreement, t o comply with the compulsory motor vehicle
474	463		liability insurance and financial responsibil ity laws of this stat e.
475	464		E. When an automated drivi ng system, as defined by Section 1701
476	465		of this title, installed on a motor vehicle i s engaged, the
477	466		following shall apply:
478	467		1. The automated driving syst em is considered the driver or
479	468		operator, for the purpo se of assessing compliance with applicable
480	469		traffic or motor vehicle laws, and shall be deemed to satisf y

510	498		2. The automated driving system is consider ed to be licensed to
511	499		operate the vehicle.
512	500		SECTION 11. AMENDATORY 47 O.S. 2021 , Section 1701, is
513	501		amended to read as follows:
514	502		Section 1701. As used in this act:
515	503		A. "Driving automation system" "Automated driving system or
516	504		ADS" means hardware and softwar e that are collectively capable of
517	505		performing part or the entire dynamic task on a sustained basis,
518	506		regardless of whether it is limite d to a specific operational design
519	507		domain. The term driving automation system is used generally to
520	508		describe any system ca pable of level 1-5 driving automation, as
521	509		specified in SAE International Recommen ded Practice J3016 inc luding,
522	510		but not limited to, cor e vehicle functions as listed in this
523	511		section.
524	512		B. "Dynamic driving task" or "DDT" means all of the real -time
525	513		operational and tactical functions required to operate a vehicle in
526	514		on-road traffic, excludin g the strategic functi ons such as trip
527	515		scheduling and selection of destinations and waypoints and inclu ding
528	516		without limitation:
529	517		1. Lateral vehicle motion co ntrol via steering;
530	518		2. Longitudinal vehicle motion control via accel eration and
531	519		deceleration;

559	546		3. Monitoring the driving environment via object and event
560	547		detection, recognition, classification and resp onse preparation;
561	548		4. Object and event response execut ion;
562	549		5. Maneuver planning; and
563	550		6. Enhancing conspicuity via lightin g, signaling and gesturing.
564	551		C. "DDT fallback" means the response by the person or hum an
565	552		driver to either perform the DDT or achieve a minimal risk condition
566	553		after occurrence of a DDT performance -relevant system failure(s) or
567	554		upon operation design domain e xit, or the response by an aut omated
568	555		driving system to achieve minimal risk condition, given the same
569	556		circumstances.
570	557		D. "Fully autonomous vehicle" means a motor vehicle equipped
571	558		with an automated driving system designed to function wit hout a
572	559		human driver as a level 4 or 5 system under SAE J3016B.
573	560		E. "Human driver" means a natural person in the vehicle with a
574	561		valid license to operate a motor vehicle who controls all or part of
575	562		the dynamic driving task.
576	563		F. "Minimal risk condition" means a condition to which a
577	564		person, human driver, or a n ADS may bring a vehi cle after performing
578	565		the DDT fallback in order to reduce the risk of a crash when a given
579	566		trip cannot or should not be completed.
580	567		G. "On-demand autonomous vehicle network" means a
581	568		transportation service network that uses a software a pplication or
582	569		other digital means to dispatch or otherwi se enable the

610	596		prearrangement of transportation with fully autonomous vehicles for
611	597		purposes of transporting passengers o r goods, including for-hire
612	598		transportation and tran sportation of passengers or go ods for
613	599		compensation.
614	600		H. "Operational design domain " or "ODD" means operating
615	601		conditions under which a gi ven automated driving system is
616	602		specifically designed to function, in cluding, but not limited to,
617	603		environmental, geographic al, and time-of-day restrictions, and the
618	604		requisite presence or absence of certain tra ffic or roadway
619	605		characteristics.
620	606		I. "Person" means a natural person, corporation, business
621	607		trust, estate, trust, pa rtnership, limited liability company,
622	608		association, joint venture, governmental agency, public corporati on,
623	609		or any other legal or commercial entity.
624	610		J. "Request to intervene " means notification by an automated
625	611		driving system to a human driver that the human driver should
626	612		promptly begin or resume performance o f part or all of the dynamic
627	613		driving task.
628	614		K. "SAE J3016B" means the Taxonomy and Definitions for Terms
629	615		Related to Driving Automatio n Systems for On-Road Motor Vehicles
630	616		published by SAE International i n June 2018.
631	617		SECTION 12. AMENDATORY 47 O.S. 2021, Section 1702, is
632	618		amended to read as follows:

660	645		Section 1702. A. Only the State of Oklahoma may enact a law or
661	646		take any other action to regulate the operation of motor vehicles
662	647		equipped with driving automation automated driving systems in
663	648		Oklahoma.
664	649		B. Pursuant to subsection A of this section, the State of
665	650		Oklahoma:
666	651		1. Preempts the authority of a county or municipal ity to
667	652		prohibit, restrict or regulate the operation of motor vehicles
668	653		equipped with driving automation automated driving systems on the
669	654		basis of those vehicles being equipp ed with driving automation
670	655		automated driving systems; and
671	656		2. Supersedes any existin g law or ordinance of a county or
672	657		municipality that prohibits, restri cts or regulates the testing or
673	658		operation of motor vehicles equipped with driving automation
