33101 BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:

35102 SECTION 1. NEW LAW A new section of law to be codifi ed
36103 in the Oklahoma Statutes as Sect ion 427.3A of Title 63, unless there
37104 is created a duplication in numbering, read s as follows:

39105 There is hereby created in the State Treasury a revolving fund
40106 for the Oklahoma Medical Marijuana Authority to be designated the
41107 "County Sheriff Public Safety Grant Revolving Fund". The fund shall
42108 be a continuing fund, not subject to fiscal year limitations, and
43109 shall consist of all monies received by the Oklahoma Medical
44110 Marijuana Authority that are appropriated or apportioned to this
45111 fund, and any federal funds, grants, and donat ions from any public

47113 All monies accruing to th e credit of the fund are hereby
48114 appropriated and may be budgeted and expended by the Oklahoma

52118 medical marijuana or other related business activity for wh ich a

233+BE IT ENACTED BY THE PEOPLE OF THE S TATE OF OKLAHOMA:
234+SECTION 4. AMENDATORY 63 O.S. 2021, Section 426 , is
235+amended to read as follows:
236+Section 426. A. The tax on retail medical marijuana sales will
237+be established at seven percent (7%) of the gross amount received b y
238+the seller.

265+B. This tax will be collected at the point of sale. Except as
266+provided for in subsection D of this section, tax proceeds will be
267+applied primarily to finance the regulatory office.
268+C. Except as provided for in subsection D of this section, if
269+proceeds from the levy authorized by subsection A of this section
270+exceed the budgeted amount for runn ing the regulatory office, any
271+surplus shall be apportioned with seventy-five percent (75%) going
272+to the General Revenue Fund and may only be expended for common
273+education including funding redbud school grants pursuant to Section
274+3-104 of Title 70 of the Oklahoma Statutes. Twenty-five percent
275+(25%) shall be apportioned to the Oklahoma State Department of
276+Health and earmarked for drug and alcohol rehabilitation.
277+D. For fiscal year 2022 2023 and for each fiscal year
278+thereafter, proceeds from the levy autho rized by subsection A of
279+this section shall be apportioned as follows:
280+1. The first Sixty-five Million Dollars ($65,000,000.00) Five
281+Million Dollars ($5,000,000.00), allocated in equal mon thly amounts
282+of one-twelfth (1/12) during each fiscal year, shall be apportioned
283+as follows:
284+a. fifty-nine and twenty-three hundredths percent
285+(59.23%) to the State Public Common School Bui lding
286+Equalization Fund,
287+b. thirty-four and sixty-two hundredths percent (34.62%)
288+to the Oklahoma Medical Mari juana Authority, a

316+Health, and
317+c. six and fifteen hund redths percent (6.15%) to the
318+Oklahoma State Department of Health and earmarked for
319+drug and alcohol rehabilitation to the County Sheriff

321+Section 2 of this act; and
322+2. Any surplus collections , in excess of the monthly allocation
323+required by paragraph 1 of this subsection, shall be apportioned to
324+the General Revenue Fund of the State Treasury .

365+Oklahoma Statutes. Expenditures from said fund shall be mad e upon

367+prescribed by law with the Director of t he Office of Management and
368+Enterprise Services for approval and payment.
369+SECTION 6. AMENDATORY 63 O.S. 2021, Section 427.3 , is
370+amended to read as follows:
371+Section 427.3 A. There is hereby creat ed the Oklahoma Medical
372+Marijuana Authority within the State Department of Heal th which
373+shall address issues related to the medical marijuana program i n
374+Oklahoma including, but not limited to, the issuance of patient
375+licenses and medical marijuana business licenses, and the
376+dispensing, cultivating, processing, testing, transporting, storage,
377+research, and the use of and sale of medical marijuana pursuant to
378+the Oklahoma Medical Marijuana and Patient Protection Act .
379+B. The Department shall provide support s taff to perform
380+designated duties of the Authority. The Department shall also
381+provide office space for meetings of the Authority.
382+C. The Department shall implement the provisions o f the
383+Oklahoma Medical Marijuana and Patient Protection Act consistently
384+with the voter-approved State Quest ion No. 788, Initiative Petition
385+No. 412, subject to the provisions of the Oklahoma Medical Marijuana
386+and Patient Protection Act.
387+D. The Department shall exercise its respective p owers and
388+perform its respective duties an d functions as specified i n the

415+Oklahoma Medical Marijuana and Patient Protecti on Act and this title
416+including, but not limited to, the following:
417+1. Determine steps the state shall take, whether administrative
418+or legislative in nature, to ensure that res earch on marijuana and
419+marijuana products is being conducted for public purpose s, including
420+the advancement of:
421+a. public health policy and public safe ty policy,
422+b. agronomic and horticultural best practices, an d
423+c. medical and pharmacopoeia best practices ;
424+2. Contract with third-party vendors and other governmental
425+entities in order to carry out the respective duties and functions
426+as specified in the Oklahoma Medical Marijuana and Patient
427+Protection Act;
428+3. Upon complaint or upon its own motion and upon a completed
429+investigation, levy fi nes as prescribed in applicable laws, rules
430+and regulations and suspend, revoke or not renew licenses pursuant
431+to applicable laws, rules and regulations ;
432+4. Issue subpoenas for the appearance or production of persons,
433+records and things in connection with disciplinary or contested
434+cases considered by the Department;
435+5. Apply for injunctive or declaratory relief to enfo rce the
436+provisions of applicable laws, rules and regulations;
437+6. Inspect and examine all licensed premis es of medical
438+marijuana businesses , research facilities, education facilities and
439+

465+waste disposal facilities in which medical marijuana is cultivated,
466+manufactured, sold, stored, transported, tested , distributed or
467+disposed of;
468+7. Upon action by the federa l government by which the
469+production, sale and use of marijuana in Oklahoma doe s not violate
470+federal law, work with the Oklahoma State Banking Departme nt and the
471+State Treasurer to develop good practice s and standards for banking
472+and finance for medical ma rijuana businesses;
473+8. Establish internal control procedures for licenses incl uding
474+accounting procedures, reporting procedures and personnel policies ;
475+9. Establish a fee schedule and collect fees f or performing
476+background checks as the Commissioner deem s appropriate. The fees
477+charged pursuant to this paragraph shall not exceed th e actual cost
478+incurred for each background check;
479+10. Establish a fee schedule and collect fees for material
480+changes requested by the licensee; and
481+11. Establish regulations , which require a medical marijuana
482+business to submit information to the Oklahom a Medical Marijuana
483+Authority, deemed reasonably necessary to assist the Authority in
484+the prevention of diversion of m edical marijuana by a licensed
485+medical marijuana business . Such information required by the
486+Authority may include, but shall not be limit ed to:
487+a. the square footage of the licensed premise s,
488+b. a diagram of the licensed premises,

515+c. the number and type of lights at the li censed medical
516+marijuana commercial growe r business,
517+d. the number, type and production capacity of equipment
518+located at the medical marijuana processing facility,
519+e. the names, addresses and telephone numbers of
520+employees or agents of a medical marijuana business,
521+f. employment manuals and stand ard operating procedures
522+for the medical marijuana business, and
523+g. any other information as the Authority reasonably
524+deems necessary; and
525+12. Establish programs and provide funding, from the revenues
526+apportioned pursuant to paragraph 1 of subsection D o f Section 426
527+of this title, to support county sheriffs to enforce the
528+requirements of state law with respect to the commercial growth of
529+medical marijuana or other related business activity for which a
530+license is required pursuant to the provisions of law governing the
531+production, cultivation, transportation, distribution, sale, or
532+other actions related to medical marijuana.
533+SECTION 7. This act shall become effective July 1, 2022.
