51	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
52	51		SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.2, is
53	52		amended to read as follows:
54	53		Section 427.2 As used in the Oklahoma Medic al Marijuana and
55	54		Patient Protection Act:
56	55		1. "Advertising" means the act of providing consideration for
57	56		the publication, dissemination, solicitation, or circulation, of
58	57		visual, oral, or written communication to induce dire ctly or
59	58		indirectly any person to p atronize a particular medical marijuana
60	59		business, or to purchase particular medical marijuana or a m edical
61		-	marijuana product. Advertising includes ma rketing, but does not
62		-	include packaging and la beling;
63		-	2. "Authority" means the Oklahoma Medical Marijuana Authority;

	88	+	2. "Authority" means the Oklahoma Medical Marijuana Authority;
91	89		3. "Batch number" means a unique numeric or alphanumeric
92	90		identifier assigned prior to t esting to allow for inventory tracking
93	91		and traceability;
94	92		4. "Cannabinoid" means any of the chemical compounds that are
95	93		active principles of marijuana;
96	94		5. "Caregiver" means a family member or assistant who regularly
97	95		looks after a medical marijuana license holder whom a physician
98	96		attests needs assistance;
99	97		6. "Child-resistant" means special packaging that is:
100	98		a. designed or constructed to be significantly dif ficult
101	99		for children under five (5) years of age to open and
102	100		not difficult for normal adults to use p roperly as
103	101		defined by 16 C.F.R. 1700.15 (1995) and 16 C.F.R.
104	102		1700.20 (1995),
105	103		b. opaque so that the outermost packaging doe s not allow
106	104		the product to be seen without opening the packaging
107	105		material, and
108	106		c. resealable to maintain its child -resistant
109	107		effectiveness for multiple openings for any product
110	108		intended for more than a single use or containing
111	109		multiple servings;
112		-	7. "Clone" means a nonflowering plant cut f rom a mother plant
113		-	that is capable of developing into a new plant and has shown no
114		-	signs of flowering;

	136	+	7. "Clone" means a nonflowering plant cut f rom a mother plant
	137	+	that is capable of developing into a new plant and has shown no
	138	+	signs of flowering;
142	139		8. "Commissioner" means the State Commissioner of Health;
143	140		9. "Complete application" means a document prepared in
144	141		accordance with the provisions set for th in the Oklahoma Medical
145	142		Marijuana and Patient Protection Act, rules promulgated pursuant
146	143		thereto, and the forms and instructions provided by the De partment,
147	144		including any supporting documentation required and the applic able
148	145		license application fee;
149	146		10. "Department" means the State Department of Health;
150	147		11. "Director" means the Executive Director of the Oklahoma
151	148		Medical Marijuana Authority;
152	149		12. "Dispense" means the selling of medical marijuana or a
153	150		medical marijuana pr oduct to a qualified patient or th e designated
154	151		caregiver of the patient that is packaged in a suitable container
155	152		appropriately labeled for subsequent administration to or use by a
156	153		qualifying patient;
157	154		13. "Dispensary" means a medical marijuana dispensary, an
158	155		entity that has been licensed b y the Department pursuant to the
159	156		Oklahoma Medical Marijuana and Pati ent Protection Act to purchase
160	157		medical marijuana or medical marijuana products fro m a licensed
161	158		medical marijuana commercial grower or licensed medical mar ijuana
162	159		processor, to prepare and p ackage noninfused pre -rolled medical
163		-	marijuana, and to sell medical marijuana or medical marijuana
164		-	products to licensed patients and caregivers as def ined in this

192	188		section, or sell or transfer products to another licensed

194	190		14. "Edible medical ma rijuana product" means any medical -
195	191		marijuana-infused product for whi ch the intended use is oral
196	192		consumption including, but not limited to, any type of food, drink
197	193		or pill;
198	194		15. "Entity" means an individual, general partner ship, limited
199	195		partnership, limited liability company, trust, estate, association,
200	196		corporation, coopera tive or any other legal or comme rcial entity;
201	197		16. "Flower" means the reproductive organs of the marijuana or
202	198		cannabis plant referred to as the bud or par ts of the plant that are
203	199		harvested and used for consumption in a variety of medical marijuana
204	200		products;
205	201		17. "Flowering" means the rep roductive state of the marijuana
206	202		or cannabis plant in which there are physical signs of flower or
207	203		budding out of the nodes of the stem;
208	204		18. "Food-based medical marijuana concentrate" means a medical
209	205		marijuana concentrate th at was produced by extracting ca nnabinoids
210	206		from medical marijuana through the use of propylene glycol,
211	207		glycerin, butter, olive oil, coconut oil or other t ypical food-safe
212	208		cooking fats;
213		-	19. "Harvest batch" means a specifically identified quantity of
214		-	medical marijuana that is uniform in s train, cultivated utilizing

	235	+	19. "Harvest batch" means a specifically identified quantity of
	236	+	medical marijuana that is uniform in s train, cultivated utilizing
242	237		the same cultivation p ractices, harvested at the same time from the
243	238		same location and cured un der uniform conditions;
244	239		20. "Harvested marijuana" means postflowering medical marijuana
245	240		not including trim, concentrate or waste;
246	241		21. "Heat- or pressure-based medical marijuana conce ntrate"
247	242		means a medical marijuana concentrate that was produced by
248	243		extracting cannabinoids from medical ma rijuana through the use of
249	244		heat or pressure;
250	245		22. "Immature plant" m eans a nonflowering marijuana pl ant that
251	246		has not demonstrated signs of flowering;
252	247		23. "Inventory tracking system" means the required tracking
253	248		system that accounts for the entire life span of medical marijuana
254	249		and medical marijuana products, including any testing samples
255	250		thereof and medical marijuana waste;
256	251		24. "Licensed patient" or "p atient" means a person who has been
257	252		issued a medical marijuana patient l icense by the State Department
258	253		of Health or Oklahoma Medical Marijuana Authority;
259	254		25. "Licensed premi ses" means the premises specifie d in an
260	255		application for a medical marijuana busine ss license, medical
261	256		marijuana research facility license or medical marij uana education
262	257		facility license pursuant to the Oklahoma Medical Marijuana and
263	258		Patient Protection Act that are owned or in possession of the
264		-	licensee and within which the licensee is a uthorized to cultivate,
265		-	manufacture, distribut e, sell, store, transport, test or research

	285	+	licensee and within which the licensee is a uthorized to cultivate,
	286	+	manufacture, distribute, sell, store, transport, test or research
293	287		medical marijuana or medical marijuana products in accordance with
294	288		the provisions of the Oklahoma Medical Marijuana and Patient
295	289		Protection Act and rules promulgated p ursuant thereto;
296	290		26. "Manufacture" means the production, propagation,
297	291		compounding or processing of a medi cal marijuana product, excluding
298	292		marijuana plants, either directly o r indirectly by extraction from
299	293		substances of natural or synthetic origin, or inde pendently by means
300	294		of chemical synthesis, or by a combination of extract ion and
301	295		chemical synthesis;
302	296		27. "Marijuana" shall have the same meaning as such term is
303	297		defined in Section 2-101 of this title;
304	298		28. "Material change" means any change that would affe ct the
305	299		qualifications for licensure of an applicant or licensee;
306	300		29. "Mature plant" means a harvestable f emale marijuana plant
307	301		that is flowering;
308	302		30. "Medical marijuana bus iness (MMB)" means a licensed me dical
309	303		marijuana dispensary, medical marijuana proc essor, medical marijuana
310	304		commercial grower, medical marijuana laboratory , medical marijuana
311	305		business operator or a, medical marijuana transporter , or a medical
312	306		marijuana wholesaler ;
313	307		31. "Medical marijuana concentrate" or "concentrate" means a
314	308		specific subset of medical marijuana that was produced by extracting
315		-	cannabinoids from medical marijuana. Categories of medical
316		-	marijuana concentrate include water-based medical marijuana

	336	+	marijuana concentrate include water-based medical marijuana
344	337		concentrate, food-based medical marijuana concentrate, solvent-based
345	338		medical marijuana concentrate, and heat - or pressure-based medical
346	339		marijuana concentrate;
347	340		32. "Medical marijuana co mmercial grower" or "commercial
348	341		grower" means an entity licensed to cultivate, prepare and package
349	342		medical marijuana or package medical marijuana as p re-rolls, and
350	343		transfer or contract for transfer medical marijuana and me dical
351	344		marijuana pre-rolls to a medical marijuana dispensary, medical
352	345		marijuana processor, any other medical marijuana commercial growe r,
353	346		medical marijuana research facility or medical marijuana education
354	347		facility. A commercial grower may sell seeds, flowe r or clones to
355	348		commercial growers pursuant to the Oklahoma Medical Marijuan a and
356	349		Patient Protection Act;
357	350		33. "Medical marijuana educa tion facility" or "education
358	351		facility" means a per son or entity approved pursuant to the Oklahoma
359	352		Medical Marijuana and Pa tient Protection Act to operate a facility
360	353		providing training and education to individuals involving the
361	354		cultivation, growing, harvest ing, curing, preparing, packaging or
362	355		testing of medical marijuana, or the production, manufacture,
363	356		extraction, processing, packaging or creation of medical -marijuana-
364	357		infused products or medical mar ijuana products as described in the
365	358		Oklahoma Medical Mariju ana and Patient Protection Act;

393	385		34. "Medical-marijuana-infused product" means a product infused
394	386		with medical marijuana in cluding, but not limited to, edibl e
395	387		products, ointments and tinctures;
396	388		35. "Medical marijuana product" or "product" means a product
397	389		that contains cannabinoids that have been extracted from plant
398	390		material or the resin therefrom by physical or chemical mean s and is
399	391		intended for administrati on to a qualified patient including, but
400	392		not limited to, oils, tinctures, edibles, pills, topical fo rms,
401	393		gels, creams, vapors, patches, liquids, and f orms administered by a
402	394		nebulizer, excluding live plant forms which are c onsidered medical
403	395		marijuana;
404	396		36. "Medical marijuana processor" means a per son or entity
405	397		licensed pursuant to the Oklahoma Medical Mar ijuana and Patient
406	398		Protection Act to operate a bus iness including the production,
407	399		manufacture, extraction, processing, pac kaging or creation of
408	400		concentrate, medical-marijuana-infused products or me dical marijuana
409	401		products as described in the Oklahoma Medic al Marijuana and Patient
410	402		Protection Act;
411	403		37. "Medical marijuana research facility" or "research
412	404		facility" means a person or entity approved pursuant to the Oklahoma
413	405		Medical Marijuana and Patient P rotection Act to conduct medical
414	406		marijuana research. A med ical marijuana research facility is not a
415	407		medical marijuana business;

443	434		38. "Medical marijuana testing laboratory" or "labo ratory"
444	435		means a public or private laboratory licensed pursuant to the
445	436		Oklahoma Medical Marijuana and Patient Protection Act to conduct
446	437		testing and research on medical marijuana and med ical marijuana
447	438		products;
448	439		39. "Medical marijuana transporter" or "transp orter" means a
449	440		person or entity that is licensed pursuant to the Oklahoma Medical
450	441		Marijuana and Patient Protection Act. A medical mar ijuana
451	442		transporter does not include a medical mari juana business that
452	443		transports its own medical marijuana, medical mariju ana concentrate
453	444		or medical marijuana products to a property or facility adjacent to
454	445		or connected to the licensed premises if the prope rty is another
455	446		licensed premises of the same medic al marijuana business;
456	447		40. "Medical marijuana waste" or "waste" means u nused, surplus,
457	448		returned or out-of-date marijuana, plant debris of the plant of the
458	449		genus Cannabis including dead plants and all unuse d plant parts and
459	450		roots, except the term shall not include roots, stems, stalks and
460	451		fan leaves;
461	452		41. "Medical marijuana wh olesaler" or "wholesaler" means an
462	453		entity licensed by the Oklahoma Medical Marijuana Authority to
463	454		acquire, possess, sell , or distribute medical marijuana or medical
464	455		marijuana products on behalf of another licensed medical marijuana
465	456		business in the State of Oklahoma. A medical marijuana wh olesaler
466	457		does not include a medical marijuana business which grows, produces

495	485		or medical marijuana products;
496	486		42. "Medical use" means the acquisition, pos session, use,
497	487		delivery, transfer o r transportation of medical marijuana, medical
498	488		marijuana products, medical marijuana devices or par aphernalia
499	489		relating to the administration of medica l marijuana to treat a
500	490		licensed patient;
501	491		42. 43. "Mother plant" means a marijuana plant that is grown or
502	492		maintained for the purpose of generating clones, and that will not
503	493		be used to produce plant materia l for sale to a medical marijuana
504	494		processor or medical marijuana dispensary;
505	495		43. 44. "Oklahoma physician" or "physician" m eans a physician
506	496		licensed by and in good standing with the State Board of Medical
507	497		Licensure and Supervision, the State Board of Osteo pathic Examiners
508	498		or the Board of Podiatric Medical Examiners;
509	499		44. 45. "Oklahoma resident" means an individual who can prov ide
510	500		proof of residency as required by the Oklahoma Medical Marijuana and
511	501		Patient Protection Act;
512	502		45. 46. "Owner" means, except where the context otherwise
513	503		requires, a direct beneficia l owner including, but not limited to,
514	504		all persons or entities as follow s:
515	505		a. all shareholders owning an i nterest of a corporate
516	506		entity and all officers of a corporate entity,
517	507		b. all partners of a general partnership,

558	547		licensed facility;
559	548		46. 47. "Package" or "packaging" means any container or wrapper
560	549		that may be used by a medical marijuana business to enclose or
561	550		contain medical marijuana;
562	551		47. 48. "Person" means a natura l person, partnership,
563	552		association, business trust, company, corporation, estate, limited
564	553		liability company, trust or any o ther legal entity or organization ,
565	554		or a manager, agent, owner, director, servant, officer or employee
566	555		thereof, except that "person" d oes not include any governmental
567	556		organization;

595	583		48. 49. "Pesticide" means any substance or mixture of
596	584		substances intended f or preventing, destroying, repell ing or
597	585		mitigating any pest or any substance or mixture of substances
598	586		intended for use as a plant reg ulator, defoliant or desiccant,
599	587		except that the term "pesticide" shall not include any article that
600	588		is a "new animal drug" as designated by the United State s Food and
601	589		Drug Administration;
602	590		49. 50. "Production batch" means:
603	591		a. any amount of medical marijuan a concentrate of the
604	592		same category and produced usi ng the same extraction
605	593		methods, standard operating procedures and an
606	594		identical group of harvest batch of medical marijuana,
607	595		or
608	596		b. any amount of medical marijuana product of the same
609	597		exact type, produced us ing the same ingredients,
610	598		standard operating proced ures and the same production
611	599		batch of medical marijuana concentrate;
612	600		50. 51. "Public institution" means any entity established or
613	601		controlled by the federal government, state government, or a local
614	602		government or municipality including, but not limited to,
615	603		institutions of higher education or related research institutions;
616	604		51. 52. "Public money" means any fund s or money obtained by the
617	605		holder from any governmental entity including, but not limited to,
618	606		research grants;

646	633		52. 53. "Recommendation" means a docume nt that is signed or
647	634		electronically submitted by a physician on behalf o f a patient for
648	635		the use of medical marijuana pursuant to the Oklahoma Medical
649	636		Marijuana and Patient Protection Act;
650	637		53. 54. "Registered to conduct business" means a person that
651	638		has provided proof that the business applicant or licensee is in
652	639		good standing with the Oklahoma Secretary of S tate;
653	640		54. 55. "Remediation" means the process by which a harvest
654	641		batch or production batch that fai ls testing undergoes a procedure
655	642		to remedy the harvest batch or production batch and is retested in
656	643		accordance with Oklahom a laws, rules and regulations;
657	644		55. 56. "Research project" means a discrete scientific endeavor
658	645		to answer a research question or a se t of research questions related

660	647		research license. A research project shall include a descripti on of
661	648		a defined protocol, clearly articulated goals, defined methods and
662	649		outputs, and a defined star t and end date. The description shall
663	650		demonstrate that the research project will comply with all
664	651		requirements in the Oklah oma Medical Marijuana and Patient
665	652		Protection Act and rules promulgated pursuant thereto. All research
666	653		and development conducted by a medical marijuana research facility
667	654		shall be conducted in furtherance of an approved research project;
668	655		56. 57. "Revocation" means the final decision by th e Department
669	656		that any license issued pursuant to the Oklahoma Medical Marijuana

701	687		57. 58. "School" means a public or private elementary, middle
702	688		or high school used for school c lasses and instruction. A
703	689		homeschool, daycare or child -care facility shall not be considered a
704	690		"school" as used in the Oklahoma Medical Marijuana and Patient
705	691		Protection Act;
706	692		58. 59. "Shipping container" means a hard-sided container with
707	693		a lid or other enclosure that can be secured in place. A shipping
708	694		container is used sole ly for the transport of medical m arijuana,
709	695		medical marijuana concentrate, or medical marijuana products between
710	696		medical marijuana bus inesses, a medical marijuana research facility,
711	697		or a medical marijuana education facility;
712	698		59. 60. "Solvent-based medical marijuana concentrate" means a
713	699		medical marijuana concentrate that was produced by extracting
714	700		cannabinoids from medical marijuana thro ugh the use of a solvent
715	701		approved by the Department ;
716	702		60. 61. "State Question" means Oklahoma State Question No. 788,
717	703		Initiative Petition No. 412, approved by a majority vote of the
718	704		citizens of Oklahoma on June 26, 2018;
719	705		61. 62. "Strain" means the name gi ven to a particular variety
720	706		of medical marijuana th at is based on a combination of factors which

753	738		naturally tetrahydrocannabinolic acid, which generally occurs by
754	739		exposure to heat;
755	740		63. 64. "Transporter agent" means a person who transports
756	741		medical marijuana or medical marijuana products as an employee of a
757	742		licensed medical marijuana business and holds a tra nsporter agent
758	743		license specific to that business pursuant to the Oklahoma Medical
759	744		Marijuana and Patient Protection Act;
760	745		64. 65. "Universal symbol" mea ns the image established by the
761	746		State Department of Health or Oklahoma M edical Marijuana Authority
762	747		and made available to licensees through its website indicating that
763	748		the medical marijuana or the medical m arijuana product contains THC;
764	749		65. 66. "Usable marijuana" means the dried leaves, flowers,
765	750		oils, vapors, waxes and other p ortions of the marijuana plant an d
766	751		any mixture or preparation thereof, excluding seeds, roots, stems,
767	752		stalks and fan leaves; and
768	753		66. 67. "Water-based medical marijuana concentrate" me ans a
769	754		concentrate that was produced by extracting cannabinoids from
770	755		medical marijuana through the use of only water, ice or dry ice.

813	797		easy-to-find location, applic ations for a medical marijuana
814	798		business.
815	799		D. The annual, nonrefundable application fee for a medical
816	800		marijuana business license shall be Two Thousand Five Hundred
817	801		Dollars ($2,500.00).
818	802		E. All applicants seeking licensure or licensure renewal as a
819	803		medical marijuana business shall comply with the following general

916	898		incarcerated in a jail or corrections facility;
917	899		8. There shall be no limit to the number of medical marijuana
918	900		business licenses or categories that an individual or entity can
919	901		apply for or receive, although each application and each category
920	902		shall require a separate application and application fee. A
921	903		commercial grower, processor and dispensary , or any combination
922	904		thereof, are authorized to share the same address or physical

960	941		b. individuals applying on behalf of an entity,
961	942		c. all principal officers of an entity, and
962	943		d. all owners of an entity as defined b y the Oklahoma
963	944		Medical Marijuana and Patient Protection Act;
964	945		10. All applicable fees charged by the OSBI are the
965	946		responsibility of the applicant and shall not be higher than fee s
966	947		charged to any other person or industry f or such background checks;
967	948		11. In order to be considered an Oklahoma resident for purposes
968	949		of a medical marijuana business application, all applicants sha ll
969	950		provide proof of Oklah oma residency for at least two (2 ) years
970	951		immediately preceding the date of a pplication or five (5) years of
971	952		continuous Oklahoma resid ency during the preceding twenty-five (25)

1012	992		prior to August 30, 2019, are hereby exempt from the two-year or
1013	993		five-year Oklahoma residence requirement mentioned above;
1014	994		12. All license applicants shall be required to submit a
1015	995		registration with the Oklahoma State Bureau of Na rcotics and
1016	996		Dangerous Drugs Cont rol as provided in Sections 2 -302 through 2-304
1017	997		of this title;
1018	998		13. All applicants shall establish their identity through
1019	999		submission of a color copy or digital image of one of the foll owing
1020	1000		unexpired documents:
1021	1001		a. front of an Oklahoma driver license,
1022	1002		b. front of an Oklahoma identification card,

1058	1037		approval, rejection, denial or status-update letter to the applica nt
1059	1038		within ninety (90) business da ys of receipt of the application.
1060	1039		G. 1. The Authority shall review the medical marijuan a
1061	1040		business applications and conduct all investigations, inspec tions
1062	1041		and interviews before approving the application.
1063	1042		2. Approved applicants shall be issued a medical marijuana
1064	1043		business license for the specific category applied under , which
1065	1044		shall act as proof of their approved status. Rejection and denial
1066	1045		letters shall provide a reason for the rejection or denial.
1067	1046		Applications may only be rejected or denied based on the applicant
1068	1047		not meeting the standards set forth in the provisions o f the
1069	1048		Oklahoma Medical Marijuana and Patient Protection Act and Sections
1070	1049		420 through 426.1 of this title, improper completion of the
1071	1050		application, or for a reason provided for in the Oklahoma Medical
1072	1051		Marijuana and Patient Protection Act and Sections 420 through 426.1
1073	1052		of this title. If an application is rejected for failure to provide

1107	1085		3. Status-update letters shall provide a reason for delay in
1108	1086		either approval, rejection or denial should a situation arise in
1109	1087		which an application was submitted properly but a delay in
1110	1088		processing the application occurred.
1111	1089		4. Approval, rejection, denial or status-update letters shall
1112	1090		be sent to the applicant in the sa me method the application was
1113	1091		submitted to the Department.
1114	1092		H. A license for a medical marijuana business, medical
1115	1093		marijuana research facility, medical marijuana educa tion facility or
1116	1094		medical marijuana waste disposal facility shall not be issued to or
1117	1095		held by:
1118	1096		1. A person until all required fees have been paid;
1119	1097		2. A person who has been convicted of a nonviolent felony
1120	1098		within two (2) years of the date of application, o r within five (5)
1121	1099		years for any other felony;
1122	1100		3. A corporation, if the criminal history of any of its
1123	1101		officers, directors or stockholders indicates th at the officer,
1124	1102		director or stockholder has been convicted of a nonviole nt felony

1162	1139		6. A sheriff, deputy sheriff, police officer or prosecut ing
1163	1140		officer, or an officer or emp loyee of the Authority or municipality;
1164	1141		7. A person whose authority to be a caregiver , as defined in
1165	1142		Section 427.2 of this title, has been revoked by the Department; or
1166	1143		8. A person who was involved in the management or op erations of
1167	1144		any medical marijuana business, medical marijuana research facility,
1168	1145		medical marijuana education facility or m edical marijuana waste
1169	1146		disposal facility that, after the initi ation of a disciplinary
1170	1147		action, has had a medical marijuana license revo ked, not renewed, or
1171	1148		surrendered during the five (5) years preceding submission of the
1172	1149		application and for the following v iolations:
1173	1150		a. unlawful sales or purchases,
1174	1151		b. any fraudulent acts, falsification of records or
1175	1152		misrepresentation to the Authority, med ical marijuana

1209	1185		e. knowingly or intenti onally refusing to permit the
1210	1186		Department access to premises or records,
1211	1187		f. using a prohibited, hazardous substance for processing
1212	1188		in a residential area ,
1213	1189		g. criminal acts relating to the operation of a medical
1214	1190		marijuana business, or
1215	1191		h. any violations that e ndanger public health and safety
1216	1192		or product safety.
1217	1193		I. In investigating the qualificatio ns of an applicant or a
1218	1194		licensee, the Department, Authority an d municipalities may have
1219	1195		access to criminal history record information furnished by a
1220	1196		criminal justice agency subject to any restrictions imposed by such
1221	1197		an agency.
1222	1198		J. The failure of an applic ant or licensee to provide the
1223	1199		requested information by the Au thority deadline may be grounds for
1224	1200		denial of the application.
1225	1201		K. All applicants and licensees shall submit information to the
1226	1202		Department and Authority in a full, faithful, truthful and fair

1259	1234		applicant or licensee. Typos and scrivener errors shall n ot be
1260	1235		grounds for denial.
1261	1236		L. A licensed medical marijuana business premises shall be
1262	1237		subject to and responsible for compl iance with applicable provisions
1263	1238		consistent with the zoning wh ere such business is located as
1264	1239		described in the most recent versions of the Oklahoma Uniform
1265	1240		Building Code, the International Building Code and the International
1266	1241		Fire Code, unless granted an ex emption by a municipality or
1267	1242		appropriate code enforcement enti ty.
1268	1243		M. All medical marijuana business , medical marijuana research
1269	1244		facility, medical marijuana education facility and medical marijuana
1270	1245		waste disposal facility licensees shall pay the relevant l icensure
1271	1246		fees prior to receiving licensure to operate.
1272	1247		N. A medical marijuana business, medical marijuana research
1273	1248		facility, medical marijuana education facility or m edical marijuana
1274	1249		waste disposal facility that attempts to renew its license after the
1275	1250		expiration date of the license shall pay a late renewal fee in an
1276	1251		amount to be determined by the Department to reinstate the license .

1313	1287		Section 427.16 A. There is hereby created a medical marijuana
1314	1288		transporter license as a category of the medical marijua na business
1315	1289		license.
1316	1290		B. Pursuant to Section 424 o f this title, the Oklahoma Medical
1317	1291		Marijuana Authority shall issue a medical marijuana transporter
1318	1292		license to licensed medical marijuana commercial growers, processors
1319	1293		and dispensaries upon issuance of such licenses and upon each
1320	1294		renewal. Medical marijuana transporter licenses shall als o be
1321	1295		issued to licensed med ical marijuana research facilities, medical
1322	1296		marijuana education facilities and medical marijuana testing
1323	1297		laboratories upon issuance of such license s and upon each renewal.
1324	1298		C. A Aside from a medical marijuana transporter license issued
1325	1299		to a licensed medica l marijuana dispensary, medical marijuana
1326	1300		commercial grower, medical marijuana processor, medical marijuana
1327	1301		research facility, or medical marijuana education facility in

1356	1329		transporter license may also be issued to qualifying applicants who
1357	1330		are registered with the Oklahoma Secretary of State and otherwise
1358	1331		meet the requirements for a medical mari juana business license set
1359	1332		forth in the Oklahoma Medical Marijuana and Patient Prote ction Act
1360	1333		and the requirements set forth in this section to provide logist ics,
1361	1334		distribution and storage of medical marijuana, medical marijuana
1362	1335		concentrate and medical mari juana products. The license, when not
1363	1336		issued in conjunction with a medical marijuan a dispensary, medical
1364	1337		marijuana commercial grower, medical marijuana processor, medical
1365	1338		marijuana research facility , or medical marijuana education facility
1366	1339		license, shall be known as a "medical marijuana wholesaler license"
1367	1340		or "wholesaler license".
1368	1341		D. A medical marijuana transporter license or wholesaler
1369	1342		license shall be valid for one (1) year and shall not be transf erred
1370	1343		with a change of ownership . A licensed medical mar ijuana
1371	1344		transporter or wholesaler shall be responsible for all medical
1372	1345		marijuana, medical marijuana concentrate and medical marijuana
1373	1346		products once the transpo rter or wholesaler takes control of the
1374	1347		product.
1375	1348		E. A transporter license or wholesaler license shall be
1376	1349		required for any person or entity to transpor t or transfer medical
1377	1350		marijuana, medical marijuana concentrate or medical marijuana
1378	1351		products from a licensed medical marijuana business to another

1407	1379		a medical marijuana research facility or medical marijuana education
1408	1380		facility.
1409	1381		F. A medical marijuana transporter or wholesaler licensee may
1410	1382		contract with multiple lic ensed medical marijuana businesses to
1411	1383		package, store, and transport medical marijuana, medical marijuana
1412	1384		concentrate, and medical marijuana products on its beh alf in the
1413	1385		State of Oklahoma.
1414	1386		G. A medical marijuana transporter or wholesaler may maintain a
1415	1387		licensed premises to temporarily store medical marijuana, medical
1416	1388		marijuana concentrate and medical marijuana products and to use as a
1417	1389		centralized packaging and distribution point. A medical marijuana
1418	1390		transporter or wholesaler and its employees may broker, package,
1419	1391		store and, market, or distribute medical marijuana, medical
1420	1392		marijuana concentrate and medical marijuana products from the
1421	1393		licensed premises in the State of Oklahoma on behalf of another
1422	1394		medical marijuana business li censee. The licensed premises of the
1423	1395		wholesaler shall meet all security requirements applicable to a
1424	1396		medical marijuana business.
1425	1397		H. A medical marijuana transporter or wholesaler licensee shall
1426	1398		use the seed-to-sale tracking system developed pursuant t o the
1427	1399		Oklahoma Medical Marijuana and Pa tient Protection Act to track all
1428	1400		medical marijuana, medical ma rijuana concentrate, and medical
1429	1401		marijuana products received, packaged, stored, or distributed by a
1430	1402

1458	1429		documenting the transport of medical marijuana, medical marijuana
1459	1430		concentrate and medical marijuana products throughout the state.
1460	1431		I. A licensed medical marijuana transporter or wholesaler may
1461	1432		maintain and operate one or more warehouses in the state to handle
1462	1433		medical marijuana, medical marijuana concentrate and medical
1463	1434		marijuana products. Each location shall be registered and inspected
1464	1435		by the Authority prior to its use.
1465	1436		J. With the exception of a lawful transfer between medical
1466	1437		marijuana businesses who are licens ed to operate at the same
1467	1438		physical address, all medical marijuana, medical marijuana
1468	1439		concentrate and medical marijuana products shall be transported:
1469	1440		1. In vehicles equipped with Global Positioning System (GPS)
1470	1441		trackers;
1471	1442		2. In a locked container and clea rly labeled "Medical Marijuana
1472	1443		or Derivative"; and
1473	1444		3. In a secured area of the vehicle that is not accessible by
1474	1445		the driver during transit.
1475	1446		K. A transporter agent may possess marijuana at any location
1476	1447		while the transporter agent is transferring marijuana to or from a
1477	1448		licensed medical marijuana business, licensed medical marijuana
1478	1449		research facility or licensed medical marijuana ed ucation facility.
1479	1450		The Department shall administer and enforce the provisions of this
1480	1451		section concerning transportation.

1508	1478		L. The Authority shall issue a tra nsporter agent license to
1509	1479		individual agents, employees, officers or owners of a transporter or
1510	1480		wholesaler license in order for the individual employees, officers,
1511	1481		or owners to qualify to transport medical marijuana , medical
1512	1482		marijuana concentrate or medical marijuana products.
1513	1483		M. The annual fee for a transporter a gent license shall b e
1514	1484		Twenty-five Dollars ($25.00) and shall be paid by the transporter
1515	1485		license holder or wholesaler licensee or the individual applicant .
1516	1486		Transporter license reprints shall be Twe nty Dollars ($20.00).
1517	1487		N. The Authority shall issue each transporter agent a regi stry
1518	1488		identification card within thirty (30) days of receipt of:
1519	1489		1. The name, address and date of birth of the person;
1520	1490		2. Proof of current Oklahoma residency;
1521	1491		3. Proof of identity as required for a medical marijuana
1522	1492		business license;
1523	1493		4. Possession of a valid Oklahoma driv er license;
1524	1494		5. Verification of employment with a licensed transporter;
1525	1495		6. The application and affiliated fee; and
1526	1496		7. A copy of the criminal background ch eck conducted by the
1527	1497		Oklahoma State Bureau of Investigation, paid for by t he applicant.
1528	1498		O. If the transporter agent application is denied, the
1529	1499		Department shall notify the tra nsporter or wholesaler in writing of
1530	1500		the reason for denying the registry identifi cation card.

1559	1528		expire one (1) year after the date of issuance or upon notification
1560	1529		from the holder of the transporter or wholesaler license that the
1561	1530		transporter agent ceas es to work as a transporter.
1562	1531		Q. The Department may revoke the registry identification card
1563	1532		of a transporter agent who knowingl y violates any provision of this
1564	1533		section, and the transporter or wholesaler is subject to any other
1565	1534		penalties established by law for the violation.
1566	1535		R. The Department may revoke or suspend the transporter license
1567	1536		of a transporter or wholesaler that the Department determines
1568	1537		knowingly aided or facilitated a violation of any provision of this
1569	1538		section, and the license holder is subject to any other penalties
1570	1539		established in law for the violation.
1571	1540		S. Vehicles used in the transport of medical marijuana or
1572	1541		medical marijuana product shall be:
1573	1542		1. Insured at or above the legal requirements in Oklahoma;
1574	1543		2. Capable of securing medical marijua na during transport; and
1575	1544		3. In possession of a shipping container as defined in Section
1576	1545		427.2 of this title capable of securing all transported products.
1577	1546		T. Prior to the transport of any medical marijuana , medical
1578	1547		marijuana concentrate or medical marijuana products, an inventory
1579	1548		manifest shall be prepared at the origination point of the medical
1580	1549		marijuana. The inventory manifest shall include the following
1581	1550		information:

1627	1595		5. The arrival date and estimate d time of arrival;
1628	1596		6. Printed names and signatures of the personnel accompanying
1629	1597		the transport; and
1630	1598		7. Notation of the transpo rting licensee.
1631	1599		U. 1. A separate inventory manifest shall be prepared for each
1632	1600		licensee receiving the medical marijuana.

1665	1632		marijuana, medical marijuana concentrate or medical marijuana
1666	1633		products that are not accompanied by an inventory manife st.
1667	1634		4. Originating and receiving licensees shall maintain copies of
1668	1635		inventory manifests and logs of quantities of medical marijuana
1669	1636		received for seven (7) years from date of receipt.
