1544 Section 1210.284, which relates to vision screening;
1645 specifying that optometrists and ophthalmologists may

2551 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2752 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210 .284, is
2853 amended to read as follows:

3054 Section 1210.284 A. 1. The parent or guardian of each student
3155 enrolled in kindergarten at a public school in this state shall
3256 provide certification to school person nel that the student passed a
3357 vision screening withi n the previous twelve (12) months or during
3458 the school year. Such screening shall be conducte d by personnel
3559 listed on the statewide registry as maintained by the State
3660 Department of Health , which may include, but not be limited to,
3761 Oklahoma licensed optom etrists and ophthalmologists.

3962 2. The parent or guardian of each student enrolled in first or
4063 third grade at a publ ic school in this state shall provide within

4191 thirty (30) days of the beginning of the sch ool year certification
4292 to school personnel that the student passed a vision screening
4393 within the previous twelve (12) months. Such screening shall be
4494 conducted by personnel listed on the statewide registry as

4696 licensed optometrists and ophthalmologists shall be exempt from such

4998 3. The parent or guardian of each student who receives a vision
5099 screening as required by this section shall receive notification
51100 that a vision screening is not the equivalent of a comprehensive eye
52101 exam.

54102 B. 1. The Infant and Children's Health Advisory Cou ncil
55103 created in Section 44 of this act 1-103a.1 of Title 63 of the
56104 Oklahoma Statutes shall make recommendations to the State Board of
57105 Health on:

59106 a. standards for vision screening and referral ; provided,
60107 Oklahoma licensed optometrists and ophthalmologists
61108 shall be exempt from such standards ,

63109 b. qualifications for initial reco gnition and renewal of
64110 recognition of vision screeners,

66111 c. qualifications for initial recognition and renewal of
67112 recognition of vision sc reener trainers,

69113 d. qualifications for initial re cognition and renewal of
70114 recognition of trainers of vision screener tr ainers;

71142 provided, Oklahoma licensed optometrists and
72143 ophthalmologists shall be exempt from any training
73144 requirements, and

75145 e. grounds for denial, refusal, suspension or revocation
76146 of recognition of vision screeners, vision screener
77147 trainers and trainers of vision screener trainers.

79148 2. The Department shall:

81149 a. establish and thereafter maint ain a statewide
82150 registry, available via the Internet , which shall
83151 contain a list of approved vision s creeners,

85152 b. maintain a list of approved vision screener trainers
86153 and trainers of vision screener trainers, and

88154 c. maintain the standards for vision screen ing and
89155 referral.

91156 3. After notice and hearing, the Department may deny, refuse,
92157 suspend or revoke ap proval to an applicant which who has a history
93158 of:

95159 a. noncompliance or inc omplete or partial compliance with
96160 the provisions of this section or the rules ad opted by
97161 the Board to implement the provisions of th is section,

99162 b. referring persons to a business in which the applicant
100163 has a financial interest or a business which is owned
101164 or operated by someone within the third degree of
102165 consanguinity or affinity of t he applicant, or

104193 c. conduct which demonstrates that the applicant is
105194 providing services in a manner w hich does not warrant
106195 public trust.

108196 4. The Board, giving consideration to the recommendations of
109197 the Infant and Children's Health Advisory Council created in Section
110198 44 of this act, shall promulgate rules t o implement the provisions
111199 of this section.

113200 C. 1. The parent or guardian of each student who fails the
114201 vision screening required in subsection A of this section shall
115202 receive a recommendation to undergo a comprehensive eye examination
116203 performed by an ophthalmologist or optometrist.

118204 2. The ophthalmolog ist or optometrist shall for ward a written
119205 report of the results of the comprehensive eye examination to the
120206 student's school, parent or guardian, and prim ary health care
121207 provider designated by the parent or guardian. The report shall
122208 include, but not be limited to:

124209 a. date of report,

126210 b. name, address and date of birth of the student,

128211 c. name of the student's school,

130212 d. type of examination,

132213 e. a summary of significant findings, including
133214 diagnoses, medicatio n used, duration of action of
134215 medication, treatment, prognosis, whether or no t a

137244 f. recommended educational adjustments for the child, if
138245 any, which may includ e: preferential seating in the
139246 classroom, eyeglasses for full-time use in school,
140247 eyeglasses for part-time use in school, sight -saving
141248 eyeglasses, and any other recommendations, and

143249 g. name, address and signature of the examiner.

145250 D. No student shall be pr ohibited from attending school for a
146251 parent's or guardian's failure to furnish a report of the studen t's
147252 vision screening or an e xaminer's failure to furnish the results of
148253 a student's comprehensive eye examination required by this section.

150254 E. School districts shall notify parents or guardians of
151255 students who enroll in kindergarten, first, or third grade for the
152256 2007-08 school year and each year thereafter of the requirements of
153257 this section.

155258 F. The State Board of Education shall adopt rules for the
156259 implementation of this section except as provided in subs ection B of
157260 this section. The State Department o f Education shall issue a
158261 report annually on the impact and effectiveness of this section.

160262 SECTION 2. This act shall become effective November 1, 2022.
