32109 SECTION 1. AMENDATORY 28 O.S. 2021, Section 152, is

36112 the court clerk shall collect, at the t ime of filing, the following
37113 flat fees, none of which shall ever be refundable, and which shall
38114 be the only charge for court costs, except as is otherwise

107214 Court for expenses lawfully incurred for providing qualified
108215 courtroom interpreter services in the district courts, for
109216 credentialing and training Oklahoma courtroom interpreters, an d for
110217 any other expenditures determined by the Supreme Court to be
111218 necessary to provide language access in the district courts as

116248 F. In addition to the amounts collected pursuant to paragraphs
117249 1, 3, 8, 9, 10 and 14 of subsect ion A of this section, each county
118250 may assess, upon approval by the board of county commissioners, a
119251 sum not to exceed Ten Dollars ($10.00) per case to be credited to
120252 the Sheriff's Service Fee Account in the county in which t he action
121253 arose for the purpose of enhancing existing or providing additional
122254 courthouse security.

124255 G. Until November 1, 2027, in addition to the amounts collected
125256 pursuant to subsection A of this sectio n, the sum of Ten Dollars
126257 ($10.00) shall be assessed and credited to the Court Clerk 's Records
127258 Management and Preservation Fund created in Section 31.3 of this

130260 H. In any case in which a litigant claims to have a just cause
131261 of action and that, by re ason of poverty, the litigant is unable to
132262 pay the fees and costs provided for in th is section and is
133263 financially unable to employ counsel, upon the filing of an
134264 affidavit in forma pauperis executed before any officer authorized

141297 contradicting the allegation of poverty. In all such cases, the
142298 court shall promptly set for hearing the determination of
143299 eligibility to litigate without payment of fees or costs. Until a
144300 final order is entered de termining that the affiant is i neligible,
145301 the clerk shall permit the affiant to litigate without payment of
146302 fees or costs. Any litigant executing a false affidavit or counter
147303 affidavit pursuant to the p rovisions of this section shall be guilty
148304 of perjury.

150305 I. Payments to the court cler k for fees and costs assessed
151306 pursuant to this section may be made by a nationally r ecognized
152307 credit or debit card or other electronic payment method as provided
153308 in paragraph 1 of subsection B of Section 151 of this title.

291552 language interpreter or for the issuance or service of process to
292553 obtain compulsory attendance of witnesses.

294554 J. The amounts to be assessed as court costs upon filing of a
295555 case shall be those amounts above-stated in paragraph 3 or 4 of
296556 subsection A and subsection s B, C, D and E of this section.

298557 K. The fees collected pursuant to this section shall b e
299558 deposited into the court fund, except the following :

301559 1. A court clerk issuing a m isdemeanor warrant is entitled to
302560 ten percent (10%) of the sheriff 's service fee, provided for in
303561 paragraph 9 of subsection A of this section, collected on a warrant
304562 referred to the contractor for the misdemeanor warrant noti fication
305563 program governed by Se ctions 514.4 and 514.5 of Title 19 of the
306564 Oklahoma Statutes. This ten -percent sum shall be deposited into the
307565 issuing Court Clerk's Revolving Fund, created pursuant to Sec tion
308566 220 of Title 19 of the Oklahoma Statutes, of the court clerk issuing
309567 the warrant with the balance of the sheriff's service fee to be

324606 office in the county where witness attendance wa s required. Fees

326608 district attorney's maintenance and operating expense account;

328609 4. The fees provided for in subsection C of this section shall
329610 be forwarded to the District Attorneys Council Revolving Fund to
330611 defray the costs of prosecution; and

332612 5. The following amounts of the fees provided for in paragraphs
333613 2, 3, 5 and 6 of subsection A of this section, when collected, shall
334614 be deposited in the Trauma Care Ass istance Revolving Fund, created
335615 pursuant to the provisions of Section 1 -2530.9 of Title 63 of the

378700 SECTION 4. It being immediately necessary for the preservation
379701 of the public peace, health or safety, an emergency is hereby
380702 declared to exist, by reason whereof this act shall take effect and
