50 | 46 | SECTION 1. NEW LAW A ne w section of law to be codified | |
51 | 47 | in the Oklahoma Statutes as Sectio n 6969 of Title 36, unless there | |
52 | 48 | is created a duplication in numbering, reads as follows: | |

54 | 50 | 1. "Pharmacy benefit managers" means individuals or companies | |
55 | 51 | that manage prescription drug benefits on behalf of health insurers, | |
56 | 52 | Medicare Part D drug plans, large employer plans, and other payers; | |

58 | 54 | 2. "White bagged drugs" means the distribution of | |
59 | 55 | patientāspecific medication from a pharmacy, typically a specialty | |
60 | 56 | pharmacy, to the physician 's office, hospital, or clinic for | |
61 | 57 | administration. | |

94 | 89 | controls set forth by the federal Drug Supply Chain and Security | |

96 | 91 | D. Plan providers shall not require a patient to self- | |
97 | 92 | administer an injectable drug agai nst a provider's recommendation. | |
98 | 93 | E. Plans shall not require patients to pay additional fees | |
99 | 94 | beyond cost-sharing obligations as outlined in the individual's | |
100 | 95 | plan. | |
101 | 96 | F. Patients and providers s hall determine a billing pathway | |
102 | 97 | based on patient's best interest. | |
103 | 98 | G. Any payer in violation of this section shall be fined a | |
104 | 99 | minimum of Five Thousand Dollars ($5,000.00) per violation, but not | |
105 | 100 | more than Ten Thousand Dollars ($10,000.00) per violation. Fines | |
106 | 101 | related to this section shall not be used when calculating p ayers, | |
107 | 102 | plans, or members los s ratios and losses shall not be passed on to | |
108 | 103 | the consumer in future rate increases. | |
109 | 104 | H. A health care facility or health care provider shall be | |
110 | 105 | immune from civil liability for any loss or harm to a person due to | |
111 | 106 | their health insurance plan utilizing white bagged drugs caused by | |
112 | 107 | an act or omission by the facility or provider that occurs during | |

109 | + | result of gross negligence or willful or wanton misconduct of the | |
