COMMITTEE SUBSTITUTE 
 
An Act relating to medical marijuana; crea ting the 
Oklahoma Flower and Pre-Packaging Act; directing 
licensed medical marijuana processors and licensed 
medical marijuana commercial growers to sell certain 
medical marijuana products in pre-packaged form; 
providing requirements for packaging; allowing for 
the display and smelling of marijuana ; prohibiting 
deli-style sales; and declaring an emergency . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 431 of Title 63, unless there is 
created a duplication in numbering, reads as follows: 
Section 1 and 2 of this act shall be known and may be cited as 
the "Oklahoma Flower Pre-Packaging Act". 
SECTION 2.     NEW LAW    A new section of law to be codified 
in the Oklahoma Statutes as Section 431.1 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
A.  Upon the effective date of this act, all medical marijuana 
flower, trim, shake, kief, or other flower-based product not defined

as a concentrate shall be sold by licensed medical marijuana 
processors and licensed medical marijuana commercial growers to 
licensed medical marijuana dispensaries only in p re-packaged form in 
package sizes weighi ng from not less than one-eighth (1/8) of one 
(1) ounce to not more than one (1) ounce.  
B.  The packaging of medical marijuana flower may contain non -
opaque materials provided that it meets all other packaging and 
labeling requirements for edible medical marijuana products sold in 
the State of Oklahoma and is placed in an opaque container before 
leaving a licensed medical marijuana dispensary.   
C.  The display and smelling of medical marijuana shall be 
allowed pursuant to current Oklahoma law ; provided, however, deli-
style sales shall no longer be allowed. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effe ct and 
be in full force from and after its passage and approval.
