122189 constitute a misdemeanor offense punishable b y a fine not to exceed
123190 Four Hundred Dollars ($400.00) and shall not be subject t o
124191 imprisonment for the offense. An y law enforcement officer who comes
125192 in contact with a person in violation of this subsection and w ho is
126193 satisfied as to the identity of the p erson, as well as any other

130223 receiving the written pr omise of the alleged violator to answer as
131224 specified in the citation, the law en forcement officer shall release
132225 the person upon personal recognizance unless there has been a
133226 violation of another provision of law.

137227 C. A regulatory office shall be establishe d under the State
138228 Department of Health which shall receive applications for medi cal
139229 marijuana license recipients, d ispensaries, growers, and packagers
140230 within sixty (60) days of the passage of this initiative.

142231 D. The State Department of Health shall, withi n thirty (30)
143232 days of passage of this initiative, make available on its website,
144233 in an easy-to-find location, an ap plication for a medical marijuana
145234 license. The license shall be good for two (2) years. The
146235 application fee shall be One Hundred Dollars ($ 100.00), or Twenty
147236 Dollars ($20.00) for individuals on Medicaid, Medicare or
148237 SoonerCare. The methods of payment sh all be provided on the website
149238 of the Department.

151239 E. A short-term medical marijuana license appli cation shall
152240 also be made available on the website of the State Department of
153241 Health. A short-term medical marijuana licen se shall be granted to
154242 any applicant who can meet the requirements for a two -year medical
155243 marijuana license, but whose physician reco mmendation for medical
156244 marijuana is only va lid for sixty (60) days. Short -term medical
157245 marijuana licenses shall be issued for sixty (60) days. The fee for

158272 a short-term medical marijuana license and the procedure for
159273 extending or renewing the license shal l be determined by the
160274 Department.

162275 F. A temporary license application shall also be made available
163276 on the website of the D epartment. A temporary medical mar ijuana
164277 license shall be granted to any medical marijuana license holder
165278 from other states, provide d that the state has a state -regulated
166279 medical marijuana program, and the applicant can prove he or she is
167280 a member of such program. Temporary licenses shall be issued for
168281 thirty (30) days. The cost for a temporary license shall be One
169282 Hundred Dollars ($100.00). Renewal shall be granted with
170283 resubmission of a new application. No additional criteria shall be
171284 required.

173285 G. Medical marijuana license applicants shall submit his or her
174286 applications to the State Department of Health for approval. The
175287 applicant shall be an Oklahoma state resident and shall prove
176288 residency by a valid driver license, utility bills, or other
177289 accepted methods.

181290 H. The State Department of Health shall review the medical
182291 marijuana application, approve or reject the application, and mail
183292 the approval or rejection letter stati ng any reasons for rejection
184293 to the applicant within fourteen (14) business days of receipt of

186295 marijuana license which shall act as proof of his or h er approved

188323 not meeting stated criteria or improper compl etion of the

191325 I. The State Department of Health shall only keep the following
192326 records for each approved medical marijuan a license:

194327 1. A digital photograph of the license holder;

196328 2. The expiration date of the license;

198329 3. The county where the card was issued; and

200330 4. A unique 24-character identification number assigned to the
201331 license.

203332 J. The State Department of Health sha ll make available, both on
204333 its website and through a telephone verification system, an easy
205334 method to validate the authenti city of the medical marijuana licen se
206335 by the unique 24-character identification number.

208336 K. The State Department of Health shall ensu re that all
209337 application records and informa tion are sealed to protect the
210338 privacy of medical marijuana license applicants.

212339 L. A caregiver license shall be ma de available for qualified
213340 caregivers of a medical marijuana license holder who is homebound.
214341 As provided in Section 11 of Enrolled House Bi ll No. 2612 of the 1st
215342 Session of the 57th Oklahoma Legislature 427.11 of this title, the
216343 caregiver license shall p rovide the caregiver the same rights as the
217344 medical marijuana patient licensee , including the ability to possess
218345 marijuana, marijuana product s and mature and immature plants or

219372 cultivated medical marijuana pursuant to the Oklahoma Medical
220373 Marijuana and Patient Protection Act, but excluding the ability to
221374 use marijuana or marijuana products unless the c aregiver has a
222375 medical marijuana patient li cense. An applicant for a caregiver

225376 license shall submit proof of the license s tatus and homebound
226377 status of the medical marijuana patient and proof that the applicant
227378 is the designee of the medical marijuana pat ient. The applicant
228379 shall also submit proo f that he or she is eighteen (18) years of age
229380 or older and proof of his or her Oklahoma residency. This shall be
230381 the only criteria for a caregiver license. A licensed caregiver
231382 shall not cultivate medical marij uana for more than five medical
232383 marijuana patient licensees and shall not charge a medical marijuana
233384 patient licensee for c ultivating medical marijuana in exc ess of the
234385 actual costs incurred in cultivating the medical marijuana.

236386 M. All applicants shall be eighteen (18) years of age or older.
237387 A special exception shall be granted to an applicant under the age
238388 of eighteen (18); however, these applications shall be signed by two
239389 physicians and the parent or legal guardian of the applica nt.
240-
241390 N. All applications for a medical marijuana license shall be
242391 signed by an Oklahoma physician. There are no qualifying
243392 conditions. A medical marijuana license must be recommen ded
244393 according to the accepted standards a reasonable and prudent
245394 physician would follow when recom mending or approving any
246395 medication. No physician may be unduly stigmatized , penalized,

248423 signing a medical marijuana license application ; provided, the
249424 physician acted in accordance with the provisions of this subsection
250425 and all other rules governing the medical license of the physician
251426 in this state.

253427 O. Counties and cities may enact medical mari juana guidelines
254428 allowing medical marijuana license holders or caregivers t o exceed
255429 the state limits set forth in subsection A of this section.

275443 a person in hiring, termination or imposing any term or c ondition of
276444 employment or otherwise penalize a person based upon the status of
277445 the person as a licensed medica l marijuana patient.

279472 2. Employers may take action against a licensed med ical
280473 marijuana patient if the licensed medical marijuana patient uses or
281474 possesses marijuana while in his or her place of employment or
282475 during the hours of employment. Employers may not take action
283476 against the licensed medical marijuana patient solely bas ed upon the
284477 status of an employee as a licensed medical marijuana patient or the
285478 results of a drug test show ing positive for marijuana or its
286479 components.

288480 C. For the purposes of medic al care, including orga n
289481 transplants, the authorized use of marijuana by a licensed medical
290482 marijuana patient shall be considered the equivalent o f the use of
291483 any other medication u nder the direction of a physician and does not
292484 constitute the use of an ill icit substance or other wise disqualify a
293485 registered qualifying patient fr om medical care.

295486 D. No licensed medical marijuana patient may be denied custody
296487 of or visitation or parenti ng time with a minor child, and there is
297488 no presumption of neglect or child endangerment for condu ct allowed
298489 under this law, unless the behavior of the person creates an
299490 unreasonable danger to the safety of the minor chil d.

301491 E. No licensed medical marijuan a patient may unduly be withheld
302492 from holding a state -issued license by vir tue of their being a

307522 restrict zoning laws to prevent the opening of a medical marijuana

312524 2. For purposes of this sub section, an undue change or
313525 restriction of municip al zoning laws means an act which entirely
314526 prevents medical marijuana dis pensaries from operating within
315527 municipal boundaries as a matter of law. Municipalities may follow
316528 their standard planning and zonin g procedures to determine if
317529 certain zones or dist ricts would be appropriate for locating
318530 marijuana-licensed premises, medi cal marijuana businesses or any
319531 other premises where marijuana or its by -products are cultivated,
320532 grown, processed, stored or manufac tured.

322533 3. For purposes of this section, a medical marijuana dispensary
323534 does not include those other entities licensed by t he Department as
324535 marijuana-licensed premises, medical marijuana businesses or other
325536 facilities or locations wh ere marijuana or any pr oduct containing
326537 marijuana or its by-products are cultivated, grown, processed,
327538 stored or manufactured.

329539 G. The Except as otherwise provided in this subsectio n, the
330540 location of any retail marijuana establishment dispensary is
331541 specifically prohibited within one thousand (1,000) feet of any

339574 1. On and after June 26, 2018, if any school is established
340575 within one thousand (1,000) feet of any retail marijuana di spensary
341576 after a license has been issued by the Au thority for that location,
342577 the setback distance between properties shall not apply as long as
343578 the licensed property is used for its original licensed purpose.
344579 The licensed location s hall be grandfathered i n as to the setback
345580 distance as long as the proper ty is used in accordance with the
346581 original licensed purpose.

348582 2. On and after June 26, 2018, the Authority, due to an error
349583 in measurement of the setback distance or failure to measur e the
350584 setback distance by the Authority prior to issuance of an original
351585 license at a location, shall not:

355586 a. deny any issuance or renewal of a li cense at that

358588 b. deny any transfer of license pursuant to a change in
359589 ownership at that location, or

363592 otherwise provided by law.

365619 The retail marijuana dispensary shall be grand fathered in as to
366620 the setback distance, subject only to the municipal compl iance
367621 provisions of Section 426.1 of this title.

369622 3. For purposes of this subsection:

371623 a. "school" means the same as defined in Section 427.2 of
372624 this title, and
373-
374625 b. "error in measurement" means a mistake made by the
375626 Authority or a municipality in the setback measurement
376627 process where either the distance between a retail
377628 marijuana dispensary and a school is miscalculated due
378629 to mathematical error or th e method used to measure
379630 the setback distance is inconsistent with this
380631 section. The setback measurement process is allowed
381632 an error in measurement up to and including five
382633 hundred (500) feet when remeasured after an original
383634 license has been issued.

385635 H. Research shall be provided for unde r this law. A researcher
386636 may apply to the State Department of Health for a special research
387637 license. The license shall be granted, provided the ap plicant meets
388638 the criteria listed under subsection B of Section 421 of th is title.
389639 Research licensees shall be required to file monthly consumption
390640 reports to the State Department of Health with amounts of marijuana

401673 Section 426.1. A. Except for revo cation hearings concerning
402674 licensed patients, as defined in Section 2 of Enrolled House Bill
403675 No. 2612 of the 1st Session of the 57th Oklahoma Legislature 427.2
404676 of this title, all licensure revocation hearings conducted pursuant
405677 to marijuana licenses establ ished in the Oklahoma Statutes shal l be
406678 recorded. A party may request a copy of the recording of the
407679 proceedings. Copies shall be p rovided to local law enforcement if
408680 the revocation was based on alleged criminal activity.

410681 B. The State Department of Heal th shall assist any law
411682 enforcement officer in the performance of his or her duties upon
412683 such request by the law enforcement officer or the request of other
413684 local officials having jur isdiction. Except for license information
414685 concerning licensed patients, as defined in Section 2 of Enrolled
415686 House Bill No. 2612 of the 1st Session of the 57th Oklahoma
416687 Legislature 427.2 of this title, the Department shall share
417688 information with law enforc ement agencies upon request without a
418689 subpoena or search warrant.

427722 subdivisions a list of marijuana -licensed premises, medical
428723 marijuana businesses or any other premises where marijuana or its
429724 by-products are licensed to be cultivated, grown, processed, stored
430725 or manufactured to aid county and municipal gove rnments in
431726 identifying locations within their jurisdiction and ensure
432727 compliance with local regula tions.

434728 E. 1. All marijuana-licensed premises, me dical marijuana
435729 businesses or any other premises where marijuana or its b y-products
436730 are licensed to be culti vated, grown, processed, stored or
437731 manufactured shall submit with their application, after notifyi ng
438732 the political subdivision of their intent, a ce rtificate of

455771 3. To prevent the granting of the grandfather provisions of
456772 Section 425 of this title as a matter o f law, the municipal
457773 government shall provide the following documentation prior to the
458774 initial renewal or transfer of a license:

460775 a. a municipal resolution finding that the marijuana
461776 dispensary is located within the prohibited setback
462777 distance from a school that was openly in existence in
463778 such a way that the public generally would have known
464779 of the school's existence and operation in tha t
465780 location prior to the original marijuana dispens ary
466781 being licensed. For purposes of this subparagraph,
467782 "openly in existence" means any building, location or
468783 structure on a school site that has visible outward
469784 markings indicating the building, location o r
470785 structure was operating as a school which would serve
471786 as sufficient notice of the existence of the school or

18402951 the licensure program until November 1, 2021 , issue more than ten
18412952 medical marijuana wa ste disposal licenses. Upon the conclusion of
18422953 the first year, the Authority shall assess the need for additional
18432954 licenses and shall, if demonstrated, increase Beginning November 1,
18442955 2021, there shall be no limit to the number of medical marijuana
18452956 waste disposal licenses as deemed necessary issued by the Authority.

18472957 B. Entities applying for a medical marijuana waste disposal

19153054 within one thousand (1,000) feet of any disposal
19163055 facility after such disposal facility has been
19173056 licensed, the provisions of thi s subparagraph shall
19183057 not be a deterrent to the renewal of such license or
19193058 warrant revocation of the li cense, and

19353095 insurance shall be provided by the applicant and shall a pply to
19363096 sudden and nonsudden bodily injury or property damage on, below or
19373097 above the surface, as required by the rules of the Au thority. Such
19383098 insurance shall be maintained for the period of operation of the
19393099 facility and shall provide coverage for damages resulting from
19403100 operation of the facility during operation and after closin g. In
19413101 lieu of liability insurance required by this su bsection, an
19423102 equivalent amount of cash, securiti es, bond or alternate financial
19433103 assurance, of a type and in an amount acceptable to the Authority,
19443104 may be substituted; provided, that such deposit shall b e maintained
19453105 for a period of five (5) years after the date of last operation of
19463106 the facility.
1947-
19483107 D. Submission of an application for a medical marijuana waste
19493108 disposal license shall co nstitute permission for entry to and
19503109 inspection of the facility of the lic ensee during hours of operation
19513110 and other reasonable t imes. Refusal to permit such entry of
19523111 inspection shall constitute grounds for the nonrenewal, suspension
19533112 or revocation of a lic ense. The Authority may perform an annual
19543113 unannounced on-site inspection of the operations and any facility of
19553114 the licensee. If the Authority receives a complaint concerning
19563115 noncompliance by a licensee with the provisions of this act the
19573116 Oklahoma Medical Marijuana Waste Management Act , the Authority may
19583117 conduct additional unan nounced, on-site inspections beyond an annual
19593118 inspection. The Authority shall refer all complaints al leging

19633147 E. The Authority shall issu e a permit for each medical
19643148 marijuana waste disposal f acility operated by a licensee. A permit

19683150 determination by the Au thority that the proposed site and facility
19693151 are physically and technically suitable. Upon a finding that a
19703152 proposed medical mar ijuana waste disposal facility is not physically
19713153 or technically suitable, the Authority shall deny the permit. The
19723154 Authority shall have the authority to revoke a permit upon a finding
19733155 that the site and facility are not physically and technically
19743156 suitable for processing. The Authority may, upon determi ning that
19753157 public health or safety requires emergency action, issue a temporary
19763158 permit for treatment or storage of medical marijuana waste for a
19773159 period not to exceed ninety (90) days.
1978-
19793160 F. The cost of a medical marijuana waste disposal license shall
19803161 be Five Thousand Dollars ($5,000.00) for the initial license. The
19813162 cost of a medical mar ijuana waste disposal facility permit shall be
19823163 Five Hundred Dollars ($500. 00). A medical marijuana waste disposal
19833164 facility permit that has been revoked shall be reinstated upo n
19843165 remittance of a reinstatement fee of Five Hundred Dollars ($500.00)
19853166 to restore the facility permit. All license and permit fees shall
19863167 be deposited into the Public Health Special Oklahoma Medical

20003204 I. The State Commissioner of Health shall promulgate rules for
20013205 the implementation of this act the Oklahoma Medical Marijuana Waste
20023206 Management Act. Promulgated rules shall address dispos al process
20033207 standards, site security and any othe r subject matter deemed
