20	50		school district board of education to adopt certain
21	51		policy for school district employees who are
22	52		lactating; requiring each school district to make a
23	53		reasonable effort to provide ce rtain room or other
24	54		location for an employee to express milk or
25	55		breastfeed a child; providing for codification;
26	56		providing an effective date; and declaring an

35	63		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

37	64		SECTION 1. NEW LAW A new section of law to be codified
38	65		in the Oklahoma Statutes as Section 5 -149.3 of Title 70, unless
39	66		there is created a duplication in numbering, reads as follows:

41	67		A. Each school district board of education in this state shall
42	68		adopt a policy allowing a school district employee who is lactating
43	69		reasonable paid break time each day to use a designated lactation

44	97		room for the purpose of maintaining milk supply and comfort. The
45	98		break time may run concurrently with any break time, paid or unpaid,
46	99		already provided to the employee.

50	100		B. Each school district board of education shall make a
51	101		reasonable effort to provide a private, secure and sanitary room or
52	102		other location, other than a toilet stall, where an employee can
53	103		express her milk or breastfeed he r child.

55	104		SECTION 2. This act shall become effective July 1, 2021.

57	105		SECTION 3. It being immediately necessary for the preservation
58	106		of the public peace, health or safety, an emergency is hereby
59	107		declared to exist, by reason wh ereof this act shall take effect and
60	108		be in full force from and after its passage and approval.
