4097 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1135. 1, as
4198 last amended by Section 3, Chapter 276, O.S.L. 2021, is amended to
4299 read as follows:

44100 Section 1135.1. A. The Oklahoma Tax Commission is hereby
45101 authorized to design and issue ap propriate official sp ecial license
46102 plates to persons as provid ed by this section.

50103 Special license plates shall not be transferred to any other
51104 person but shall be removed from the vehicle upon transfer of
52105 ownership and retained. The special license plate may then be used
53106 on another vehicle but only after such other vehicle has been
54107 registered for the current year.

56108 Except as provided in subsection B of this section, special
57109 license plates shall be renewed each year by the Tax Commission or a
58110 motor license agent. The Tax Commis sion shall annually notify by
59111 mail all persons issued special license plates. The notice shall
60112 contain all necessary information and shall contain instructions for
61113 the renewal procedure upon presentation to a motor license agent or
62114 the Tax Commission. Th e license plates shall be issued on a
63115 staggered system. The motor license agent fees shall be paid out of
64116 the Oklahoma Tax Commission Reimbursement Fund.

66117 On and after January 1, 2022, if a special license plate is
67118 issued pursuant to t his section, except for Legislative License
68119 Plates issued pursuant to paragraph 30 of subsection B of Section

70147 pursuant to this section and the fee required pursuant to Section
71148 1132 of this title shall be remitt ed at the same time and subject to
72149 a single registration period. The Oklahoma Tax Commission shall
73150 determine, by rule, a method for making required fee and
74151 registration period adjustments if a special license plate is
75152 obtained during a twelve-month period for which a registration fee
76153 has already been remitted pursuant to Section 1132 of this title.
77154 The combination of fees in a single remittance shall not alter the
78155 apportionment otherwise provided for in this section.

80156 On and after January 1, 2022, if a phy sically disabled license
81157 plate is issued pursuant to paragraph 3 of subsection B of this
82158 section, any registration fee required for such plate pursuant to
83159 this section and the fee required pursuant to Section 1132 of this

85161 registration period. The Oklahoma Tax Commission shall determine,

98196 1. Political Subdivision Plates - such plates shall be designed
99197 for any vehicle owned by any political subdivision of this state
100198 having obtained a proper Oklahoma certificate of title. Such
101199 political subdivisions shall file an annual report with the Tax
102200 Commission stating the agency where such vehicle is located. Such
103201 license plates shall be permanent in nature and designed in such a
104202 manner as to remain with the vehicle for the duration of the life
105203 span of the vehicle o r until the title is transferred to an own er
106204 who is not a political subdivision.

108205 The registration fee shall be Eight Dollars ($8.00) and shall be
109206 in addition to all other registration fees provided by law, except
110207 the registration fees levied by Section 113 2 of this title;

112208 2. Tax-Exempt or Nonprofit License Plates - such plates shall
113209 be designed for:

115210 a. any motor bus, manufactured home, or mobile chapel and
116211 power unit owned and operated by a religious
117212 corporation or society of this stat e holding a valid
118213 exemption from taxation issued pursuant to Se ction
119214 501(a) of the Internal Revenue Code, 26 U.S.C.,
120215 Section 501(a), and listed as an exempt organization
121216 in Section 501(c)(3) of the Internal Revenue Code, as
122217 amended, 26 U.S.C., Section 501( c)(3), and that is
123218 used by the corporation or society solely fo r the

158296 (3) uses such vehicle exclusively for the
159297 transportation of such surplus foods,

161298 f. any vehicle which:

163299 (1) is owned and operated by a private, n onprofit
164300 organization which is exempt from taxation
165301 pursuant to the provisions of Section 501(c)(3)
166302 of the Internal Revenue Code, 26 U.S.C., Section
167303 501(c)(3), and which is primarily funded by a
168304 fraternal or civic service organization with at
169305 least one hundred local chapters or clubs, and
170-
171306 (2) is designed and used to provide mobile health
172307 screening services to the general public at no
173308 cost to the recipient, and for which no
174309 reimbursement of any kind is received from any
175310 health insurance provider, health main tenance
176311 organization or governmental progr am, or

180312 g. any vehicle owned and operated by the Civil Air
181313 Patrol, a congressionally chartered corporation that
182314 also serves an auxiliary of the United States Air
183315 Force and which is exempt from t axation pursuant to
184316 the provisions of Section 501(c)(3) of the Internal
185317 Revenue Code, 26 U.S.C., Section 501(c)(3), and is
186318 used exclusively for its corporate missions of
187319 aerospace education, cadet programs and emergency

188346 services. Such license plates shall be permanent in
189347 nature and designed in such a manner as to rem ain with
190348 the vehicle for the duration of the life span of the
191349 vehicle or until the title to such vehicle is
192350 transferred to an owner who is not subject to this
193351 exemption. Such vehicles shall be exempt from the
194352 registration fees levied under Section 1132 of this
195353 title, except that an initial registration fee of
196354 Twenty-five Dollars ($25.00) shall apply to each
197355 vehicle.

199356 Any person claiming to be eligible for a tax -exempt or nonprofit
200357 license plate under the provisions of this paragraph must have the
201358 name of the tax-exempt or nonprofit organization prominently
202359 displayed upon the outside of the vehicle, except those vehicles
203360 registered pursuant to the provisions of subparagraph b of this
204361 paragraph, unless such display is prohibited by federal or state law
205362 or by state agency rules. No vehicle shall be licensed as a tax-
206363 exempt or nonprofit vehicle unless the vehicle has affixed on each
207364 side thereof, in letters not less than two (2) inches high and two
208365 (2) inches wide, the n ame of the tax-exempt or nonprofit
209366 organization or the insignia or other symbol of such organization
210367 which shall be of sufficient size, shape and color as to be readily
211368 legible during daylight hours from a distance of fifty (50) feet
212369 while the vehicle is n ot in motion.

214396 Except as provided in subpar agraph g of this paragraph, the
215397 registration fee shall be Eight Dollars ($8.00) and shall be in
216398 addition to all other registration fees provided by law, except the
217399 registration fees levied by S ection 1132 of this t itle;

219400 3. Physically Disabled License Plat es - such plates shall be
220401 designed for persons who are eligible for a physically disabled
221402 placard under the provisions of Section 15-112 of this title. It

224403 shall prominently display the interna tional accessibility symbol,
225404 which is a stylized human figure i n a wheelchair. The Tax
226405 Commission shall also design physically disabled license plates for
227406 motorcycles owned by persons who are eligible for a physically
228407 disabled placard pursuant to the prov isions of Section 15 -112 of
229408 this title. Upon the death of the physically disabled person, the
230409 disabled license plate shall be returned to the Tax Commission.
231410 There shall be no fee for such plate in addition to the rate
232411 provided by the Oklahoma Vehicle Li cense and Registratio n Act for
233412 the registration of the vehicle. For an additional fee of Ten
234413 Dollars ($10.00), a person eligible for a physically disabled
235414 license plate shall have the option of purchasing a duplicate
236415 physically disabled special license pl ate which shall be se curely
237416 attached to the front of the vehicl e. The original physically
238417 disabled special license plate shall be securely attached to the
239418 rear of the vehicle at all times.

241445 Any person who is eligible for a physically disabled license
242446 plate and whose vehicle ha s had modifications because of the
243447 physical disability of the owner or of a family member within the
244448 second degree of consanguinity of the owner, may register the
245449 vehicle for a flat fee of Twenty -five Dollars ($25.00). This fee
246450 shall be in lieu of all oth er registration fees provided by the
247451 Oklahoma Vehicle License and Registration Act;
248-
249452 4. Indian Tribal License Plates - such plates shall be designed
250453 for any vehicle of a native American Indian Tribal Association
251454 exempted in Sections 20 1 through 204 of Publ ic Law 97-473 and used
252455 by the tribal association exclusively for the furtherance of its
253456 tribal functions.

255457 The registration fee shall be Eight Dollars ($8.00) and shall be
256458 in addition to all other registration fees provided by law, exce pt
257459 the registration fees levied by Section 1132 of this title;

259460 5. Hearing Impaired License Plates - such plates shall be
260461 designed for persons who are hearing impaired. Such persons may
261462 apply for a hearing-impaired license plate for each vehicle with a
262463 rated carrying capacity of one (1) ton or less upon the presentme nt
263464 of an application on a form furnished by the Tax Commission and
264465 certified by a physician holding a valid license to practice
265466 pursuant to the licensing provisions of Title 59 of the Oklahoma

268467 Statutes, attesting t hat the person is hearing impaired. The

271496 fee for the plate, but all other registration fees provide d by the
272497 Oklahoma Vehicle License and Registration Act shall ap ply;

274498 6. Antique or Classic Vehicles License Plates – such plates
275499 shall be designed and issued for any vehicle twenty-five (25) years
276500 of age or older, based upon the date of manufacture thereof and
277501 which travels on the highways of this state primarily inci dental to
278502 historical or exhibition purposes only.

280503 The registration fee shall be Eight Dollars ($8.00) and shall be
281504 in addition to all other registration fees provided by law, except
282505 the registration fees levied by Section 1132 of this title. Any
283506 person registering an antique or classic vehicle may elect to have
284507 the vehicle registered for a ten-year period. The registration fee
285508 for the elected ten-year registration shall be Seventy -five Dollars
286509 ($75.00). The motor license agent registering the antique or
287510 classic vehicle for a ten-year period shall receive one hundred
288511 percent (100%) of the fees the motor license agent would have
289512 otherwise received pursuant to subsection A of Section 1141.1 of
290513 this title if the antiq ue or classic vehicle had been registered on
291514 an annual basis; and

293515 7. Honorary Consul License Plates – such plates shall be
294516 designed to include the words "Honorary Consul" and issued to
295517 persons who are honorary consuls authorized by th e United States to

298546 plate shall be Eight Dollars ($8.00) and shall be in addition to all
299547 other registration fees required by the Oklahoma Vehi cle License and
300548 Registration Act. The own er of the vehicle that possesses such
301549 license plates shall return the special license plates to the
302550 Oklahoma Tax Commission if the owner disposes of the vehicle during
303551 the registration year or ceases to be authoriz ed to perform consular
304552 duties.

306553 C. Special license plates provided by this section shall be
307554 designed in such a manner as to identify the use or ownership of the
308555 vehicle. Use of any vehicle possessing a special license plate
309556 provided by this section for an y purpose not specified herein shall

312557 be grounds for revocation of the special license plate and
313558 registration certificate.

315559 D. The fees provided by this section shall be deposited in the
316560 Oklahoma Tax Commission Reimbursement Fund.

334600 Commission or a motor license agent. The Tax Commission shall

336602 The Tax Commission shall send the notifications to the electronic
337603 mail address provided by the person. If a person does not provide
338604 an electronic mail address, the Tax Commission shall notify the
339605 person by mail. The notice shall contain all nec essary information
340606 and shall contain instructions for the renewal procedure upon
341607 presentation to a motor license agent or the Tax Commission. The
342608 license plates shall be issued on a staggered system ex cept for
343609 legislative plates and amateur radio operator license plates.

357646 alter the apportionment otherwise provided for in this section.

359647 The Tax Commission is hereby directed t o develop and implement a
360648 system whereby motor license agents are permitted to accept
361649 applications for special license plates authorized under this
362650 section. The motor license agent shall confirm the ap plicant's
363651 eligibility, if applicable, collect and depo sit any amount
364652 specifically authorized by law, accept and process the necessary
365653 information directly into such system and generate a receipt
366654 accordingly. For performance of these duties, motor license agents
367655 shall retain the fee provided in Section 1141.1 of this title for
368656 registration of a motor vehicle. The motor license agent fees for
369657 acceptance of applications and renewals shall be paid out of the
370658 Oklahoma Tax Commission Reimbursement Fund.

372659 B. The special license plates provided by this section are a s
373660 follows:

375661 1. Prisoner of War License Plates - such plates shall be
376662 designed for honorably discharged or present members of the United
377663 States Armed Forces and civilians who were former prisoners of war
378664 held by a foreign country and who can provide proper certification
379665 of that status. Such persons may apply for a prisoner of war
380666 license plate for no more than two vehicles with each vehicle having
381667 a rated carrying capacity of one (1) ton or less. The su rviving

384696 death, divorce or annulment, may apply for a prisoner of war l icense
385697 plate for one vehicle with a rated carrying capacity of one (1) ton
386698 or less. The fee provided by this section for the special license
387699 plate authorized by this paragraph shall be in addition to all other
388700 registration fees provided by law, except the registration fees
389701 levied by Section 1132 of this t itle;

391702 2. National Guard License Plates - such plates shall be
392703 designed for active or retired members of the Oklahoma National
393704 Guard. Retirees who are eligible for such plates shall provide
394705 proof of eligibility upon initial application, but shall not be
395706 required to provide proof of eligibility annually;

399707 3. Air National Guard License Plates - such plates shall be
400708 designed for active or retired members of the Oklahoma Air National
401709 Guard. Retirees who are e ligible for such plates shall provide
402710 proof of eligibility upon initial application, but shall not be
403711 required to provide proof of eligibility annually;

405712 4. United States Armed Forces - such plates shall be designed
406713 for active, retired, former or reserve m embers of the United States
407714 Armed Forces, and shall identify which branch of service, and carry
408715 the emblem and name of either the Army, Navy, Air Force, Marine s or
409716 Coast Guard, according to the branch of service to which the member

412745 for such license plate must show proof of present or past military
413746 service by presenting a valid Uniformed Services Identity Card or
414747 the United States Department of Defense Form (DD)214 form DD 214.
415748 Retired or former members who are eligible for such plates shall
416749 provide proof of eligibility upon initia l application, but shall not
417750 be required to provide proof of eligibility annually;

419751 5. Congressional Medal of Honor Recipient License Plates - such
420752 plates shall be designed for any resident of this stat e who has been
421753 awarded the Congressional Medal of Hono r. Such persons may apply
422754 for a Congressional Medal of Honor recipient license plate for each
423755 vehicle with a rated carrying capacity of one (1) ton or less.
424756 There shall be no registration fee for the issuance of this plate;

426757 6. Missing In Action License Plates - such plates shall be
427758 designed to honor members of the United States Armed Forces who are
428759 missing in action. The spouse of such missing per son, if the spouse
429760 has not since remarried, or if rema rried, the remarriage is
430761 terminated by death, divorce or annulment, and each parent of the
431762 missing person may apply for a missing in action license plate upon
432763 presenting proper certification that the pe rson is missing in action
433764 and that the person making t he application is the qualifying spouse
434765 or the parent of the missing person. The qualifying spouse and each
