27	57		BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:

29	58		SECTION 1. AMENDATORY 67 O.S. 2021, Section 305, is
30	59		amended to read as follows:

32	60		Section 305. There is hereby re-created until July 1, 2021
33	61		2025, in accordance with the Oklahoma Sunse t Law, the Archives and
34	62		Records Commission, hereinafter referr ed to as the Commission, to be
35	63		composed of one member to be ap pointed by the Governor who shall
36	64		serve as Chairman, the State Librarian as Vice Chairman and
37	65		Secretary, the Lieutenant Governor, th e State Auditor and Inspector
38	66		and the State Treasurer as membe rs. Any member may appoint and

39	94		designate a subofficer or empl oyee as his or her proxy for purposes
40	95		of carrying on the duties of the Commission. The Commission shall
41	96		have sole, entire and exclusive au thority of the disposition for all
42	97		public records and a rchives of state officers, departm ents, boards,
43	98		commissions, agencies and institutions of this state. The authority
44	99		herein granted shall not apply to records and archives of po litical
45	100		subdivisions of the state; provided, howeve r, this act Section 305
46	101		et seq. of this title shall not apply to the confidential records

49	102		and files of the Oklahoma Tax Commission which are exe mpt from all
50	103		provisions of this act.

52	104		SECTION 2. It being immediately necessar y for the preservation
53	105		of the public peace, he alth or safety, an emergency is he reby
54	106		declared to exist, by r eason whereof this act shall take effect and
55	107		be in full force from and after its passage an d approval.
