An Act relating to records; amending 67 O.S . 2021,
Section 305, which relates to the Ar chives and
Records Commission; re-creating the Commission;
modifying termination date; making language gender
neutral; updating statutory reference; and declaring
an emergency.
SUBJECT: Archives and Records Commission
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY 67 O.S. 2021, Section 305, is
amended to read as follows:
Section 305. There is hereby re-created until July 1, 2021
2025, in accordance with the Oklahoma Sunse t Law, the Archives and
Records Commission, hereinafter referr ed to as the Commission, to be
composed of one member to be ap pointed by the Governor who shall
serve as Chairman, the State Librarian as Vice Chairman and
Secretary, the Lieutenant Governor, th e State Auditor and Inspector
and the State Treasurer as membe rs. Any member may appoint and
designate a subofficer or empl oyee as his or her proxy for purposes
of carrying on the duties of the Commission. The Commission shall
have sole, entire and exclusive au thority of the disposition for all
public records and a rchives of state officers, departm ents, boards,
commissions, agencies and institutions of this state. The authority
herein granted shall not apply to records and archives of po litical
subdivisions of the state; provided, however, this act Section 305
et seq. of this title shall not apply to the confidential records

and files of the Oklahoma Tax Commission which are exe mpt from all
provisions of this act.
SECTION 2. It being immediately necessar y for the preservation
of the public peace, he alth or safety, an emergency is he reby
declared to exist, by r eason whereof this act shall take effect and
be in full force from and after its passage an d approval.
