2855 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3056 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3247, is
3157 amended to read as follows:

3358 Section 3247. A. A student shall be eligible for in -state
3459 status regardless of the residency of the stud ent if the student is
3560 a:

3761 1. Dependent child or spouse of a person currently serving as a
3862 member of the active uniformed services of the United States on
3963 full-time active duty status of more than thirty (30) days and for
4064 whom Oklahoma is the home of record ;

4494 thirty (30) days and for whom Oklahoma is the home of record;

4996 serving as a member of the uniformed ser vices of the United States
5097 who is on full-time active duty for a period of more than thirty
5198 (30) days and is stationed or temporarily present in Oklahoma
5299 through military orders;

54100 4. Person, or spouse or dependent child of a person, who was
55101 discharged or released from a period of not fewer than ninet y (90)
56102 days of active uniformed service, less than five (5) years before
57103 the date of enrollment in the course(s) concerned and for whom
58104 Oklahoma is the home of record; or

60105 5. Person who is participating in or ha s received a partial or
61106 full scholarship from the Air Force Reserve Officers' Training
62107 Corps, Army Reserve Officers ' Training Corps or the Navy/Marines
63108 Reserve Officers' Training Corps; or

65109 6. Person who is a current member of the Oklahoma National
66110 Guard.

68111 B. To be eligible for in-state status as provided for in
69112 subsection A of this section and to maintain eligibility, the

72141 1. Satisfy admission and retention standards as determined by
73142 the Oklahoma State Regents for Higher Education for an institution
74143 within The Oklahoma State System of Higher Education; and

76144 2. Have secured admission to and enrolls full -time or part-time
77145 in a program of study at an institution within The Oklahoma State
78146 System of Higher Education.

80147 C. A student who files with the institution within The Oklahoma
81148 State System of Higher Education at which the student intends to
82149 register a letter of intent to establish residence in the state and
83150 who resides in the state while enrolled in th e institution shall be
84151 eligible for in-state status, regardless of the residency of the
85152 student or home of record, if the student:

91154 a. was discharged or released from a period of not fewer
92155 than ninety (90) days of active duty uniformed
93156 service, less than five (5) years before th e date of
94157 enrollment in the course(s) concern ed, and

96158 b. is pursuing a course of education with educational
97159 assistance under Chapter 30 or 33 of Title 38 of the
98160 United States Code while living in this state; or

100161 2. Is a person who:

102162 a. is entitled to assista nce under Section 3311(b)(9) or
103163 3319 of Title 38 of the United States Code by virtue
104164 of a relationship to a person who was discharged or

109195 years of the date the related person was discharged or

111197 days of active duty uniformed services.

113198 D. To be eligible for in -state status as provided for in
114199 subsection C of this section and to maintain eligibility, the
115200 student shall:

117201 1. Satisfy admission and retention standards as determined by
118202 the Oklahoma State Regents for Higher Education for an institution
119203 within The Oklahoma Stat e System of Higher Education; and

121204 2. Have secured admission to and enrolls full -time or part-time
122205 in a program of study at an institution within The Oklahoma State
123206 System of Higher Education.

125207 E. A student who meets the eligibility requirements for in -
126208 state status shall maintain in -state status if the student remains
127209 continuously enrolled at an institution within The Oklahoma State
128210 System of Higher Education after the student:

130211 1. As described in paragraphs paragraph 1, 2, or 3 of
131212 subsection A of this sect ion is discharged or released from active
132213 duty service;

138243 exceeds the five-year period after bei ng discharged or released from
139244 active duty uniformed service;

141245 3. As described in paragraph 1 of subsection C of this sect ion
142246 has exhausted education assistance provided under Chapter 30 or 33
143247 of Title 38 of the United States Code; or

145248 4. As described in p aragraph 2 of subsection C of this section
146249 has exhausted education assistance provided under Section 3311(b)(9)
147250 or 3319 of Title 38 of the United States Code.

149251 F. For purposes of this section, "home of record" means the
150252 place where one was living when the person enlisted or was
151253 commissioned into the military or reenlisted in the mi litary.

153254 G. The Oklahoma State Regents for Hi gher Education shall
154255 develop policies and procedures necessary to implement the
155256 provisions of this section.

157257 SECTION 2. This act shall become effective July 1, 2022.

159258 SECTION 3. It being immediately necessary for the preserv ation
160259 of the public peace, health or safety, an emergency is hereby
161260 declared to exist, by reason whereof this act shall take effect an d
162261 be in full force from and after its passage and approval.
