28	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	56		SECTION 1. AMENDATORY 70 O.S. 2021, Section 3247, is
31	57		amended to read as follows:
32		-
33	58		Section 3247. A. A student shall be eligible for in -state
34	59		status regardless of the residency of the stud ent if the student is
35	60		a:

37	61		1. Dependent child or spouse of a person currently serving as a
38	62		member of the active uniformed services of the United States on
39	63		full-time active duty status of more than thirty (30) days and for
40	64		whom Oklahoma is the home of record ;

43	93		member of the militar y reserve on active duty orders of more than
44	94		thirty (30) days and for whom Oklahoma is the home of record;

48	95		3. Person, or spouse or dependent child of a person, current ly
49	96		serving as a member of the uniformed ser vices of the United States
50	97		who is on full-time active duty for a period of more than thirty
51	98		(30) days and is stationed or temporarily present in Oklahoma
52	99		through military orders;

54	100		4. Person, or spouse or dependent child of a person, who was
55	101		discharged or released from a period of not fewer than ninet y (90)
56	102		days of active uniformed service, less than five (5) years before
57	103		the date of enrollment in the course(s) concerned and for whom
58	104		Oklahoma is the home of record; or
59		-
60	105		5. Person who is participating in or ha s received a partial or
61	106		full scholarship from the Air Force Reserve Officers' Training
62	107		Corps, Army Reserve Officers ' Training Corps or the Navy/Marines
63	108		Reserve Officers' Training Corps; or
64		-
65	109		6. Person who is a current member of the Oklahoma National
66	110		Guard.

68	111		B. To be eligible for in-state status as provided for in
69	112		subsection A of this section and to maintain eligibility, the
70	113		student shall:

72	141		1. Satisfy admission and retention standards as determined by
73	142		the Oklahoma State Regents for Higher Education for an institution
74	143		within The Oklahoma State System of Higher Education; and

76	144		2. Have secured admission to and enrolls full -time or part-time
77	145		in a program of study at an institution within The Oklahoma State
78	146		System of Higher Education.

80	147		C. A student who files with the institution within The Oklahoma
81	148		State System of Higher Education at which the student intends to
82	149		register a letter of intent to establish residence in the state and
83	150		who resides in the state while enrolled in th e institution shall be
84	151		eligible for in-state status, regardless of the residency of the
85	152		student or home of record, if the student:

87	153		1. Is a person who:

91	154		a. was discharged or released from a period of not fewer
92	155		than ninety (90) days of active duty uniformed
93	156		service, less than five (5) years before th e date of
94	157		enrollment in the course(s) concern ed, and
95		-
96	158		b. is pursuing a course of education with educational
97	159		assistance under Chapter 30 or 33 of Title 38 of the
98	160		United States Code while living in this state; or
99		-
100	161		2. Is a person who:
101		-
102	162		a. is entitled to assista nce under Section 3311(b)(9) or
103	163		3319 of Title 38 of the United States Code by virtue
104	164		of a relationship to a person who was discharged or

113	198		D. To be eligible for in -state status as provided for in
114	199		subsection C of this section and to maintain eligibility, the
115	200		student shall:

117	201		1. Satisfy admission and retention standards as determined by
118	202		the Oklahoma State Regents for Higher Education for an institution
119	203		within The Oklahoma Stat e System of Higher Education; and
120		-
121	204		2. Have secured admission to and enrolls full -time or part-time
122	205		in a program of study at an institution within The Oklahoma State
123	206		System of Higher Education.
124		-
125	207		E. A student who meets the eligibility requirements for in -
126	208		state status shall maintain in -state status if the student remains
127	209		continuously enrolled at an institution within The Oklahoma State
128	210		System of Higher Education after the student:

130	211		1. As described in paragraphs paragraph 1, 2, or 3 of
131	212		subsection A of this sect ion is discharged or released from active
132	213		duty service;

136	214		2. As described in paragraph 4 of subsection A of this section
137	215		or paragraph paragraphs 1 and 2 of subsection C of this section

138	243		exceeds the five-year period after bei ng discharged or released from
139	244		active duty uniformed service;

141	245		3. As described in paragraph 1 of subsection C of this sect ion
142	246		has exhausted education assistance provided under Chapter 30 or 33
143	247		of Title 38 of the United States Code; or

145	248		4. As described in p aragraph 2 of subsection C of this section
146	249		has exhausted education assistance provided under Section 3311(b)(9)
147	250		or 3319 of Title 38 of the United States Code.

149	251		F. For purposes of this section, "home of record" means the
150	252		place where one was living when the person enlisted or was
151	253		commissioned into the military or reenlisted in the mi litary.
152		-
153	254		G. The Oklahoma State Regents for Hi gher Education shall
154	255		develop policies and procedures necessary to implement the
155	256		provisions of this section.

157	257		SECTION 2. This act shall become effective July 1, 2022.

159	258		SECTION 3. It being immediately necessary for the preserv ation
160	259		of the public peace, health or safety, an emergency is hereby
161	260		declared to exist, by reason whereof this act shall take effect an d
162	261		be in full force from and after its passage and approval.
