3159 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3360 SECTION 1. AMENDATORY 70 O.S. 2021, Section 6-122.3, is
3461 amended to read as f ollows:

54103 Secretary of the United States Department of
55104 Education. The Oklahoma State Regents f or Higher
56105 Education shall be consulted to verify other terminal

61109 Oklahoma State Regents for Higher Education and has

75148 2. Declares the intention to earn standard certification by
76149 means of an alternative placemen t program in not more than three (3)
77150 years. The State Board of Education shall determine the subject
78151 matter and the number of clock or semester hours required for the
79152 professional education component for each person making application
80153 for an alternative p lacement teaching certificate based on the
81154 criteria of paragraph 1 of this subsection.

83155 The State Board of Education shall establish a core minimum of
84156 six (6) semester hours or ninety (90) clock hours and a maximum of
85157 eighteen (18) semester hours or two hun dred seventy (270) clock
86158 hours for the professional education component.

104197 4. 5. Either presents a document fro m an accredited public
105198 school district in th is state offering employment in the area of
106199 specialization for which certification is sought on condition that
107200 the person enroll in an alternative placement program approved by
108201 the State Board of Education or dec lares the intention to seek
109202 employment as a teacher at an accredited public school distri ct in
110203 this state. The certificate granted pursuant to this s ubsection
111204 shall be considered a "valid certificate of qualification " for the
112205 purposes of Sections 6 -107 and 6-108 of this title, and the holder
113206 of the certificate shall be considered an inductee for the purposes
114207 of Section 6-195 of this title.

116208 B. An alternative placement teaching certificate shall be
117209 renewed for not more than a maximum of three (3) years upon
118210 presentation of a document from an accredit ed public school district
119211 in this state offering renewed employment in the same area of
120212 specialization and a document from a teacher education institution
121213 verifying satisfactory progress in an appropriate alterna tive
122214 placement program.

124215 C. Persons enrolled in an alternative placement program shall:

126216 1. Have never been denied admittance to a teacher education
127217 program approved by the Oklahoma State Regents for Higher Education,
128218 the North Central Association of Colle ges and Schools, and by the
129219 Oklahoma Commission for Teacher Preparation to offer teacher
130220 education programs, nor have enrolled in and subsequently fai led

133248 courses necessary to successfully meet the minimum requirements of
134249 the program, except those persons w ho hold a certificate;

136250 2. Have on file with the director of teacher education at an
137251 Oklahoma institution of higher education a plan for meeting stand ard
138252 certification requirements within three (3) years; and

140253 3. Participate in an induction program as requ ired in Section
141254 6-195 of this title and have the same duties and responsibilities as
142255 other inductees.

144256 D. The State Board of Education may grant an ex ception to the
145257 requirements for certification and, upon demonstration by an
146258 individual of specific compete ncy in the subject area of
147259 specialization, may grant a certificate to the individual. Th e
148260 State Board may establish other requirements necessary to g rant
149261 exceptions.

151262 E. The State Board of Education, in consultation with the
152263 Commission for Educational Qua lity and Accountability, may grant an
153264 exception to the requirement to complete a subject area examination
154265 for initial certification in a field which d oes not require an
155266 advanced degree pursuant to this section if the candidate has an
156267 advanced degree in a s ubject that is substantially comparable to t he
157268 content assessed on a subject area examina tion. The degree shall be
158269 from an institution accredited by a national or regional accrediting
159270 agency which is recognized by the Secretary of the U.S. Department

163300 F. Student teaching and a prestudent tea ching field experience
164301 shall not be required of alternative placement program participants
165302 for standard certification.

167303 G. The State Board of Educatio n shall promulgate rules
168304 authorizing adjunct teachers who shall be persons with distinguished
169305 qualifications in their field. Adjunct teachers shall not be
170306 required to meet standard certification. Adjunct teache rs shall be
171307 limited to two hundred seventy ( 270) clock hours of classroom
172308 teaching per semester.

176309 H. Each teacher education institution shall provide the
177310 Oklahoma Commission for Teacher Preparation an annual report of
178311 information as specified by the Commis sion regarding participation
179312 in the alternative placement programs offered by the institu tion.

181313 I. The Oklahoma Commission for Teacher Preparation sha ll not
182314 accredit, renew the accreditation of, or otherwise approve any
183315 teacher education program of any ins titution of higher education in
184316 this state that has not implemented alternative placement programs
185317 in at least four areas of specialization , including mathematics,
186318 science, and a foreign language. Each institution shall allow
187319 individuals who meet the crit eria of subsections A and C of this
188320 section to be:

193350 2. Offered the opportunity to complete the requirements for
194351 standard certification set forth in subsection A of this sec tion
195352 during the summer preceding and the sum mer following the first year
196353 of teaching with an alternative placement teaching certificate. Any
197354 person seeking standard certification through an alternative
198355 placement program shall be permitted to take necessar y courses
199356 during regular semesters if offere d.

201357 J. The criteria specified in subsection I of this section can
202358 be met through a cooperative arrangement entered into by two or more
203359 institutions of higher education.

205360 SECTION 2. AMENDATORY 70 O.S. 2021, Section 6-187, as
206361 last amended by Section 1, Chapter 319, O.S.L. 2021, is amended to
207362 read as follows:

209363 Section 6-187. A. Prior to July 1, 2014, a competency
210364 examination shall be adopted by the Oklahoma Commission for Teacher
211365 Preparation and beginning July 1, 2014, a competency ex amination
212366 shall be adopted by the Commission for Educational Quality and
213367 Accountability for the general ed ucation, professional education ,
214368 and various subject areas and grade levels for purposes of ensuring
215369 academic achievement and competency of each teach er candidate or
216370 teacher in the subject area t he person is seeking certification to

219398 teach which shall also include certification as an administrator, as
220399 prescribed by the State Board of Education.

222400 The Commission, consistent with the purposes of this section ,
223401 shall promulgate rules and procedures to gu arantee the
224402 confidentiality of examinations.

226403 B. 1. No teacher candidate shall be eligible for certification
227404 until successfully completing the competency examination except
228405 those candidates who make application to the State Board and meet
229406 the criteria for the alternative placement program pursuant to
230407 Section 6-122.3 of this title. Certification shall be limited to
231408 areas of approval in which the certified teacher has s uccessfully
232409 completed the examination. Subj ect to the provisions of subsection
233410 C of this section, testing for certification for subjects in which a
234411 teacher candidate or teacher is seeking a minor teaching assignment
235412 or an endorsement to teach shall be lim ited to the specific subject
236413 area test.

238414 A teacher candidate or teacher may take the gener al education,
239415 professional education, or subject area portion s of the examination
240416 subject to any limit imposed by the Commission.

242417 2. A teacher candidate or teacher shall be exempt from the
243418 requirement to pass the general education portion of the competenc y
244419 examination required by this section if he or she has a master's
245420 degree or a doctorate degree from an institution accredited by a

249450 C. 1. Except as otherwise provided for in this subsection, a
250451 teacher may be certified in as many areas as the teacher meets the
251452 necessary requirements provided by law and has successfully
252453 completed the subject area portion of the examination .

254454 2. Except as otherwi se provided for in this paragraph,
255455 certification in early childhood, elementary, or special education
256456 shall require completion of an appropriate teacher education prog ram
257457 approved by the Commission.

259458 Any teacher who is certified to te ach elementary educatio n may
260459 be certified in early childhood education upo n meeting the
261-

263460 requirements provided in law and successful completion of the
264461 appropriate subject area portion of the examination. Any teacher
265462 who is certified to teach early childhoo d education may be cert ified
266463 in elementary education upon meeting the requ irements provided in
267464 law and successful completion of the appropriate subject a rea
268465 portion of the examination. Any special education teacher who
269466 becomes certified to teach through c ompletion of an accredi ted
270467 teacher preparation program may be certified in early childhood or
271468 elementary education upon meeting the requirements provided in law
272469 and successful completion of the appropriate subject portion of the
273470 examination. Any teacher w ho becomes certified to teach through
274471 completion of an accredited teacher preparation program or becomes

275499 alternatively certified to teach through the Tro ops to Teachers
276500 program may be certif ied in special education upon meeting the
277501 requirements provided in law and successful com pletion of the
278502 appropriate subject area portion of the examination. Any special
279503 education teacher who has not completed a Commiss ion-approved
280504 teacher education progra m in elementary education or early childhood
281505 education but who has successfully completed the subject area
282506 portion of the examination may be certified in elementary education
283507 or early childhood education for the purpose of providing direct
284508 instruction and serving as the teacher of record for grading
285509 purposes in special e ducation settings only.

287510 D. The Commission shall offer the competency exam ination at
288511 least four times per calendar year on dates to be established by the
289512 Commission.

291513 E. If a teacher candida te or teacher is a non -native-English
292514 speaker, the Commission shal l offer the subject are a competency
293515 examination in the native language of the teacher candidate or
294516 teacher only if the teacher candidate or teacher is em ployed or has
295517 been offered employment by a school district as a teacher in a
296518 foreign language immersion program offered by the school district.
297519 If a non-native-English speaker who has received certification in a
298520 subject area after taking the subject area competency examination in
299521 the native language of the speaker seeks to add a certification area
300522 in the future and that person i s no longer employed as a teacher in

302551 additional certification area s hall be taken in English. The State
303552 Board of Education shall issue a restricted license or certificate
304553 to any teacher who has completed a subject area competency

307554 examination in the native language of the teacher as provided for in
308555 this subsection restrict ing the teacher to teaching only in a
309556 foreign language immersion program.

311557 F. The State Board of Educat ion, in consultation wi th the
312558 Commission for Educational Quality and Accou ntability, may grant an
313559 exception to the requirement to complete a subject area examination
314560 for initial certificatio n in a field which does not require an
315561 advanced degree if the cand idate has an advanced d egree in a subject
316562 that is substantially comparable to the content assessed on a
317563 subject area examination. The advanced degree sh all be from an
318564 institution accredited by a national or regional accrediting agency
319565 which is recognized by the Secretary of the United States Department
320566 of Education. The Commis sion shall provide the Board with the
321567 necessary information to determine compar ability.

323568 G. 1. Nothing in the Oklah oma Teacher Preparation Act shall
324569 restrict the right of the State Board of Education to i ssue an
325570 emergency or provisional certificate, as ne eded. Provided, however,
326571 prior to the issuance of an emergency certificate, th e district
327572 shall document substantial efforts to employ a teacher who holds a
328573 provisional or standard c ertificate. In the eve nt a district is

329601 unable to hire an individual meeti ng this criteria, the district
330602 shall document efforts to employ an individual w ith a provisional or
331603 standard certificate in another curricular area with academic
332604 preparation in the f ield of need. Only aft er these alternatives
333605 have been exhausted shall the district be allowed to employ an
334606 individual meeting minimum standards as estab lished by the State
335607 Board of Education for the issuance of emergency certificates.

337608 2. The State Board of Education may renew the emergency or
338609 provisional certificate of an indi vidual who has been employed by a
339610 school district board of education for at lea st two (2) years if the
340611 following criteria are met:

342612 a. the individual has been granted an emergency or
343613 provisional certificate pursuant to paragraph 1 of
344614 this subsection for two (2) years,

346615 b. the individual has not successfully completed the
347616 competency examinations required by this section,

351617 c. the individual submits a portfolio of his or her work
352618 to the State Board of Education, which shall include
353619 evidence of progress toward sta ndard certification,

355620 d. the employing school district board of education
356621 agrees to renew the individual 's contract to teach for
357622 the ensuing fiscal year, and

359623 e. the superintendent of the employing school di strict
360624 submits to the State Board of Education the reason the

363654 hire a teacher who holds a standard certificate.

365655 3. Individuals employed by a school district under an emergency
366656 or provisional certific ate shall not be considered career teachers
367657 and therefore not entitled to the p rotections of the Teacher Due
368658 Process Act of 1990.

370659 SECTION 3. This act shall become ef fective July 1, 2022.

372660 SECTION 4. It being immediately nec essary for the preservation
373661 of the public peace, health or safety, an emergency is hereby
374662 declared to exist, by reas on whereof this act shall take effect and
375663 be in full force from an d after its passage and approval.
