32	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

34	60		SECTION 1. AMENDATORY 59 O.S. 2011, Section 1000.21, as
35	61		amended by Section 2, Chapter 223, O.S.L. 2014 (59 O.S. Supp. 2020,
36	62		Section 1000.21), is amended to read as follows:

38	63		Section 1000.21. A. 1. There is hereby created the Oklahoma
39	64		Uniform Building Code Commission within the Construction Industries
40	65		Board which shall consist of eleven (11) thirteen (13) members, nine
41	66		eleven of whom shall be appointed by the Governor with the advice
42	67		and consent of the Senate as follows:

71	114		Code, 26 U.S.C., Section 170(a), who has represented
72	115		municipalities and had statutory functions for
73	116		municipalities for at least fifteen (15) years prior
74	117		to November 1, 2005,

97	157		2. The members shall be appointed for staggered terms of four
98	158		(4) years, beginning July 1, 2009 . The initial appointment of the
99	159		members added by this act shall be made within ninety (90) days of
100	160		the effective date of this act. A full term of office for purposes
101	161		of determining term limits provided in subsection C of this section
102	162		shall be the completion of a full four -year term of appointment.

104	163		B. The remaining two members of the Commission shall b e the
105	164		State Fire Marshal, or a designee, and an appointee of the
106	165		Construction Industries Board.

108	166		C. Appointed members shall continue in office until a successor
109	167		is appointed by the Governor, notwithstanding the term limitations.
110	168		No appointed member shall serve more than two consecutive full four -
111	169		year terms; provided, such a member shall be eligible to serve until

112	197		a successor is appointed, and such member may be reappointed after a
113	198		two-year absence from the Commission. The Governor shall fill all
114	199		vacancies and unexpired terms in the same manner as the original
115	200		appointment of the member whose position is to be filled. No
116	201		initial appointment to a term of less than four (4) years or any
117	202		partial-term appointment to fill a vacancy or unexpired term of
118	203		another member shall be counted for purposes of determining term
119	204		limits. An appointed member may be removed by the Governor for
120	205		cause.

122	206		D. Whenever a member of the Commission is absent from more than
123	207		one-half (1/2) of all meetings of the governing body, regular an d
124	208		special, held within any period of twelve (12) consecutive months,
125	209		the member shall thereupon cease to hold office by operation of law.

127	210		SECTION 2. This act shall become effective July 1, 2021.

129	211		SECTION 3. It being immediately necessary for the preservation
130	212		of the public peace, health or safety, an emergency is hereby
131	213		declared to exist, by reason whereof this act shall take effect and
132	214		be in full force from and after its passage and approval.
