38	39		An Act relating to fire protection districts;
39	40		amending 18 O.S. 2021, Sections 592 and 594, which
40	41		relate to fire departments for unincorporated areas;
41	42		modifying allowable services to be provided; and
42	43		providing an effective date .

48	49		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	50		SECTION 1. AMENDATORY 18 O.S. 2021, Section 592, is
50	51		amended to read as follows:
51	52		Section 592. The authority of persons associated together to
52	53		become incorporated as a ch aritable corporation for the purpose of
53	54		providing either a volunteer or full -time fire department for an
54	55		unincorporated area or place is hereby ratified and confirmed. Such
55	56		a corporate fire department shall have authority to provide fire
56	57		protective service and all other emergenc y services both to its
57	58		members and to nonmembers, either within or without the
58	59		unincorporated area wherein it is situated .
59	60		SECTION 2. AMENDATORY 18 O.S. 2021, Section 594, is
60	61		amended to read as follows:

87	89		Section 594. Any charitable corporation formed in an
88	90		unincorporated area for the purpose of providing eithe r a volunteer
89	91		or a full-time fire department, suc h as is mentioned in Section 592
90	92		of this title, shall be considered an agency of the State of
91	93		Oklahoma while actually performing the function of providing fire
92	94		protective services and all other emergency ser vices either within
93	95		or without the unincorporated area wherein it is situated, and while
94	96		so engaged such corporation shall not be liable in tort for the acts
95	97		of its members or its firemen.
96	98		SECTION 3. This act shall become effective Novembe r 1, 2022.
