4940 An Act relating to schools; defining terms;

6354 BE IT ENACTED BY THE P EOPLE OF THE STATE OF OKLAHOMA:
6455 SECTION 1. NEW LAW A new section of law to be codified
6556 in the Oklahoma Statutes as Section 24-159 of Title 70, unless there
6657 is created a duplication in numb ering, reads as follows:
6758 A. As used in this section :
6859 1. “Abortion” means the term as de fined in Section 1-730 of
6960 Title 63 of the Oklahoma Statutes; and
61+2. “Transaction” means a formal or informa l agreement,
62+contract, or arrangement o f any kind between a public school, public
63+charter school, or public virtual charter school and a private

97-2. “Transaction” means a formal or informa l agreement,
98-contract, or arrangement o f any kind between a public school, public
99-charter school, or public virtual charter school and a private
10090 entity, regardless of whether the private entity or the school
10191 receives anything of value in return .
10292 B. A public school, public charter school, or public virtual
10393 charter school shall not enter into a transaction with an individual
10494 or entity that performs abortions, induces abortions, or provides
10595 abortions unless the entity is a hospital licensed pursuant to
10696 Section 1-702 of Title 63 which has enacted a policy to only provide
10797 abortions when it is a medical emergency. For the purposes of this
10898 section, "medical emergency" means a condition in w hich an abortion
10999 is necessary to preserve the life of a pregnant woman whose life is
110100 endangered by a physical disorder, physical illness, or physical
111101 injury including a life -endangering physical condition caused by or
112102 arising from the pregnancy itself .
113103 C. The State Board of Educa tion shall promulgate rules to
114104 implement the provisions of this section.
115105 D. Each school district board o f education and governing board
116106 of a public charter school or public virtual charter school shall
117107 adopt a policy for the implementation of the provisio ns of this
118108 section.
119109 E. The State Board of Education shall require the board of
120110 education of a public school and the governing board of a public
111+charter school or public virtual charter school that knowingly
112+violates the provisions of this section to appear before the Board
113+to determine:

148-charter school or public virtual charter school that knowingly
149-violates the provisions of this section to appear before the Board
150-to determine:
151140 1. Why the school violated the pro visions of this section; and
152141 2. How to prevent the violation of provisions of this section
153142 in the future.
154143 SECTION 2. This act shall become effective July 1, 2022.
155144 SECTION 3. It being immediately necessary for the preservation
156145 of the public peace, health or safety, an emergency is hereby
157146 declared to exist, by reason whereof thi s act shall take effect and
158147 be in full force from and after its passage and appro val.
