3599 Section 7-102. As used in this act:

37100 1. "Cocktail" or "mixed drink" means any beverage obtained by
38101 combining ingredients alcoholic in nature, whether brewed,
39102 fermented, or distilled, with ingredients nonalcoholic in nature,
40103 such as fruit juice, lemo nade, cream or a carbona ted beverage;
41-
42104 2. "Single-serve wine" means a bottle or sealed contai ner,
43105 containing seven (7) fluid ounces, or less, of wine;
44-
45106 3. "Original container" means, for the purposes of this act
46107 only, a container that is filled, sealed and secured with a tamper-
47108 evident lid or cap by the original manufacturer of the mixed drink
48-

50109 or by a mixed beverage licensee 's or caterer licensee 's employee at
51110 the mixed beverage licensee 's or caterer licensee 's location with a
52111 tamper-evident lid or cap;

54112 4. "Sealed container" means a rigid container that contains a
55113 mixed drink, is new, has never be en used, has a secured lid or cap
56114 designed to prevent consumption without removal of the lid or cap
57115 and is tamper evident. Sealed container does not include a
58116 container with a lid with s ipping holes or openings for straws or a
59117 container made of plastic, p aper or polystyrene foam; and

61118 5. "Tamper evident" means a lid or cap that has been sealed
62119 with tamper-evident covers, including, but not limited to, wax dip
63120 or heat-shrink wrap.

68149 Section 7-103. A cocktail, mixed drink or single -serve wine
69150 placed in a sealed container by a mixed beverage licensee at the
70151 mixed beverage licensee's or caterer licensee's location in its
71152 original container may be transferred and sold for off -premises
72153 consumption if the following requirements are met:

74154 1. The cocktail, mixed beverage or single -serve wine is
75155 transferred within the li censed premises by a cur bside pickup or by
76156 delivery by an employee of the retail licensee who :
77-
78157 a. is at least twenty-one (21) years of age, and
79-
80158 b. upon delivery, verifies the age of the person to whom
81159 the cocktail is being delivered;
82-
83160 2. If the employee de livering the cocktail, m ixed drink or
84161 single-serve wine is not able to safely verify a person 's age or
85162 level of intoxication upon delivery, the employee shall cancel the
86163 sale of alcohol and return the product to the retail license holder;
87-
88164 3. The sealed container is placed in the trunk of the vehicle
89165 or, if there is no trunk, in the vehicle 's rear compartment that is
90166 not readily accessible to the passenger area; and

94167 4. The In the case of a mixed drink sealed by the mixed
95168 beverage or caterer licensee, the sealed container shall be affixed
96169 with a label or tag that contains the following information:

98170 a. the cocktail, mixed drink or single -serve wine
99171 ingredients, type and name of the alcohol,

101198 b. the name, license number and address of the mixed
102199 beverage licensee or caterer licensee wh o filled the
103200 original container and sold the product,

109204 than seven (7) days before the date of sale; and

278+BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:
279+SECTION 4. AMENDATORY 47 O.S. 2011, Section 1 135.7, as
280+amended by Section 5, C hapter 69, O.S.L. 2018 (47 O.S. Supp. 2020,
281+Section 1135.7), is amended to read as follows:
282+Section 1135.7. A. The Oklahoma Tax Commission or private
283+vendor with whom the Commission has contracted is authorized to
284+design and issue special license plates to any person that applies
285+to the Tax Commission or private vend or for the creation of a
286+special license plate and meets th e minimum standards and
287+qualifications specifi ed in this section.
288+B. If the following standards and guidelines are satisfied, the
289+Tax Commission shall authorize the issu ance of a special license

316+plate to the person making application for the special licen se
317+plate:
318+1. The license plate is to:
319+a. show membership in or affiliation with an
320+organization, or
321+b. demonstrate support for an or ganization, group or
322+cause;
323+2. The license plate does not adver tise or endorse a product,
324+brand, or service that is provid ed for sale;
325+3. The license plate does not pr omote any philosophy based on
326+prejudice or that is con trary to state civil rights laws; and
327+4. Two hundred prepaid applicat ions for the special licens e
328+plate are received by the Tax Commission or private vendo r.
329+C. The fee for special license plates shal l be determined in
330+accordance with Section 1 of this act 1135.9 of this title. If the
331+special license plate does not p rovide financial assistanc e the fee
332+shall be no less than Fifteen Dollars ($15.00) per year of renewal
333+and shall be in addition to all ot her registration fees provided by
334+the Oklahoma Vehicle License and Registra tion Act. Unless otherwise
335+provided in this section, Fifteen Dollars ($15.00) of the fee shall
336+be apportioned as follows: Eight Dolla rs ($8.00) of the special
337+license plate fee sh all be deposited in the Oklahoma Tax Co mmission
338+Reimbursement Fund to be us ed for the administration of the Oklahoma
339+Vehicle License and Registra tion Act and the remaining amounts of

366+the special license plate f ee shall be apportioned as provided in
367+Section 1104 of this title.
368+D. For special license plates that provide financial assistance
369+created pursuant to the provision s of this section, the Tax
370+Commission shall be authorized to enter into a licensing agreement
371+with an organization for any licensing fees that may be required to
372+use the organization's logo or design.
373+E. The fee for special license plates that provide fin ancial
374+assistance shall be deter mined in accordance with Section 1 of this
375+act 1135.9 of this title. Provided, the fee shall be no less than
376+Thirty-five Dollars ($35.00) and shall be in addition t o all other
377+registration fees provided by the Oklahoma Vehicle License and
378+Registration Act. Thirty-five Dollars ($35.00) per year of renewal
379+of the fee shall be apportioned as follows:
380+1. a. Twenty Dollars ($20.00) of the fee shall be
381+apportioned to the License Plate Special Prog ram
382+Assistance Revolving Fund created in Section 1135 .8 of
383+this title to be used in the manner detailed in the
384+application for the special license plate ;, except as
385+provided in subparagraph b of this paragraph.
386+b. If the Tax Commission has entered into a licensing
387+agreement with an organization for the use of its
388+design or logo pursuant to Chapter 74 of Title 47 of
389+the Oklahoma Statutes, an amount to be determined in
390+

416+the licensing agreement, but not to exceed twenty
417+($20) dollars per license plate issued , shall be
418+transferred monthly to that organization as p ayment of
419+licensing fees and no fee shall be apportioned to the
420+License Plate Special Program Assistance Revolving
421+Fund.
422+2. Eight Dollars ($8.00) of the fee shall be depos ited in the
423+Oklahoma Tax Commission Reimbursement Fund to be used for the
424+administration of the Oklahoma Vehicle License and Registration Act;
425+and
426+3. Any remaining amounts of the fee shall be apporti oned as
427+provided in Section 1104 of this title.
428+E. If F. Except as otherwise provided in subsection D and
429+subparagraph b of paragraph 1 of subsection E of this section, if a
430+person applies for a special license plate that provides financial
431+assistance, the application shall des ignate a state agency to be
432+responsible for expe nding the funds generated by the special license
433+plate and the application shal l designate a specific public purpose
434+for which the funds are to be used. The application shall include
435+an acknowledgment from t he designated state agency of their
436+agreement with acceptance of the designated funds.
437+F. G. Special license plates shall not be transferred to any
438+other person but shall be removed from the vehicle upon transfer of
439+ownership and retained. The special lice nse plate may then be used

466+on another vehicle bu t only after such other vehicle has been
467+registered for the current year.
468+Special license plates shall be renewed each year by the Tax
469+Commission or a motor license agent, unless aut horized by the Tax
470+Commission to be renewed for a period greater than one (1) year.
471+The Tax Commission shall notify all persons issued special license
472+plates of the renewal procedures prior to the expiration of the
473+special license plate. The notice shall contain all necessary
474+information and shall contain instructions for the renewal procedure
475+upon presentation to a motor license agent or the Tax Commi ssion.
476+The license plates shall be issued on a staggered system.
477+The Tax Commission is hereby directed t o develop and implement a
478+system whereby motor license agents are permitte d to accept
479+applications for special license plates authorized under this
480+section. The motor license agent shall confirm the applicant's
481+eligibility, if applicable, collect and depo sit any amount
482+specifically authorized by law, accept and process the nece ssary
483+information directly into such system and generate a receipt
484+accordingly. For performance of these duties, motor license agents
485+shall retain the fee provided in Section 1141.1 of this title for
486+registration of a motor vehicle. The motor license age nt fees for
487+acceptance of applications and renewals shall be paid out of the
488+Oklahoma Tax Commission Reimbursement Fund.

515+G. H. All special plates issued by the Tax Commission prior to
516+the effective date of thi s act November 1, 2005, shall not be
517+subject to the require ments and qualifications outlin ed in this
518+section.
519+H. I. As used in this section, "person" includes an individual,
520+group, organization or not-for-profit corporation tha t is recognized
521+as such by the Internal Revenue Service.
522+SECTION 5. AMENDATORY 47 O.S. 2011, Section 113 5.5, as
523+last amended by Section 3, Chapter 434, O.S.L. 2019 (47 O.S. Supp.
524+2020, Section 1135.5), is amended to read as follow s:
525+Section 1135.5. A. The Oklahoma Tax Commission is h ereby
526+authorized to design and issue appropriate official special license
527+plates to persons wis hing to demonstrate support and provide
528+financial assistance as provided by this section.
529+Special license plates shall not be transferred to any other
530+person but shall be removed from t he vehicle upon transfer of
531+ownership and retained . The special licens e plate may then be used
532+on another vehicle but only after such other vehicle has been
533+registered for the current year with a motor license agent.
534+Special license plates shall be renewe d each year by the Tax

566+presentation to a motor license ag ent or the Tax Commission. The
567+license plates shall be issued on a staggered system.
568+The Tax Commission is hereby directed to develop and implement a

571+section. The motor license a gent shall confirm the applicant 's
572+eligibility, if appli cable, collect and depos it any amount
573+specifically authorized by law, acce pt and process the ne cessary

575+accordingly. For performance of the se duties, motor license agents
576+shall retain the fee pro vided in Section 1141.1 of this title for
577+registration of a motor vehicle. The motor license agent fees for

580+If fewer than one hundred of any type of special license plate s
581+authorized prior to January 1, 2004, are issued prior to January 1,
582+2006, the Tax Commission shall discontinue issuance and rene wal of
583+that type of special license plate. An y such authorized special
584+license plate registrant shall be allowed to display t he license
585+plate upon the designated vehicle until the registration exp iration
586+date. After such time the expired special license plate shall be
587+removed from the vehicle.

614+For special license plates authorized on or after July 1, 200 4,
615+no special license pl ates shall be developed or issued by the Tax
616+Commission until the Commi ssion receives one hundred prepaid
617+applications therefor. The prepaid applications must be received by
618+the Tax Commission within one hundred eighty (180) days o f the
619+effective date of the authorization or the authority to issue shall
620+be null and void. In the event one hundred prepaid applications are
621+not received by the Tax Commission within such prescribed time
622+period any payment so received shall be refunded a ccordingly.
623+B. The special license plates provided by this section are as
624+follows:
625+1. University or College Supporter License Plate - such plates
626+shall be designed and issued to any person wishing t o demonstrate
627+support to any state -supported or private university or college. As
628+provided in this section, an amount of the fee collected shall be
629+apportioned as provided in Section 1104.1 of this title;
630+2. Environmental Awareness License Plate - such plates shall be
631+designed, subject to the criteria to be p resented to the Tax
632+Commission by the Department of Environmental Quality in
633+consultation with the Oklahoma Arts Council, and issued to any
634+person wishing to demonstrate support to implement the state wide
635+general public environmental education program crea ted pursuant to
636+the provisions of the Oklahoma Environmental Quality Code. Such
637+plates shall be designed and issued to any person in any combination
638+

664+of numbers and letters from one to a maximum of se ven, as for
665+personalized license plates. A dealer 's license plate issued
666+pursuant to Section 1116.1 or 1128 of this title may be designated
667+an Environmental Awareness License Plate upon payment of the fee
668+imposed by this section and any other registration fees required by
669+the Oklahoma Vehicle License and Regis tration Act. As provide d in
670+this section, an amount of the fee collected shall be apportioned
671+pursuant to Section 1104.2 of this title;
672+3. Firefighter License Plate - such plates shall be designed
673+for any career or retired firefighter, volunteer or paid.
674+Firefighters may apply for firefighter plates for up to four
675+vehicles with a rated capacity o f one (1) ton or less or for a
676+motorcycle upon proof of a f ire department membership by either an
677+identification card or letter from the chief of the fire depart ment.
678+Retirees who are eligible for such plates shall provide proof of
679+eligibility upon initia l application, but shall not be required to
680+provide proof of eligibility annually. The surviving spouse of any
681+deceased firefighter, if the spouse has not since remarried, may
682+apply for a firefighter license plate for one vehicle with a rated
683+carrying capacity of one (1) ton or less or for a motorcycle upon
684+proof that the deceased firefighter was a member of a fire
685+department by either an identification card or l etter from the chief
686+of the fire department. The license plate shall be d esigned in
687+consultation with the Oklahoma Firefighters Association.

714+As provided in this section, an amount of the fee collecte d
715+shall be deposited to the Oklahoma State Firemen 's Museum Building &
716+Memorial Fund for support of the Oklahoma Firefighters Muse um and
717+the Oklahoma Fallen and Living Firefighters Memorial;
718+4. Wildlife Conservation License Plate - such plates shall be
719+designed, subject to the criteria to be presented to the T ax
720+Commission by the Okl ahoma Department of Wildlife Conservation in
721+consultation with the Okla homa Arts Council, and issued to any
722+person wishing to demo nstrate support for wildlife conservation in
723+this state through the Wildlife Diversity Fund, provided for in
724+Section 3-310 of Title 29 of the Oklahoma Statutes. Such plates ma y
725+be designed and issued to any person as for personalized license
726+plates.
727+As provided in this section, an amount of the fee c ollected
728+shall be apportioned pursuant to subsection D o f Section 3-310 of
729+Title 29 of the Oklahoma Statutes;
730+5. Child Abuse Prev ention License Plate - such plates shall be
731+designed, subject to the criteria to be presented to the Tax
732+Commission by the Off ice of Child Abuse Prevention in the State
733+Department of Health and the Oklahoma Committee to Prevent Child
734+Abuse, and issued to a ny person wishing to demonstrate support for
735+the prevention of child abuse.
736+As provided in this section, an amount of the fee collected
737+shall be deposited in the Child Abuse Preventi on Fund;

764+6. United States Olympic Committee Supporter License Plate -
765+such plates shall be des igned and issued to any person wishing to
766+demonstrate support for the United States Olympic Committee. T he
767+plates shall be issued to any person in any combinati on of numbers
768+and letters from one to a maximum of seven, as for personali zed
769+license plates. The plate shall contain the official United States
770+Olympic Committee logo. The Tax Commission shall be a uthorized, if
771+necessary, to enter into a licensing agree ment with the United
772+States Olympic Committee for any licensing fees which may be
773+required in order to use the United States Olympic Committee logo or
774+design. The licensing agreement shall provide fo r a payment of not
775+more than Twenty-five Dollars ($25.00 ) for each license plate
776+issued;
777+7. Oklahoma History License Plate - such plates shall be
778+designed and issued to any person wishing to demonstrate intere st in
779+Oklahoma history. As provided in this s ection, an amount of the fee
780+collected shall be deposite d to the Oklahoma Histor ical Society
781+Revolving Fund to be used for educati onal purposes;
782+8. Historic Route 66 License Plate - such:
783+a. vehicle plates shall be designed to honor historic
784+Route 66, also known as the "Mother Road". As
785+provided in this secti on, an amount of the fee
786+collected for each vehicle license plate shall be
787+apportioned to the O klahoma Historical Society
788+

1027+combination with three numbers on eith er side of the insignia or
1028+emblem. The color of t he letters and number s shall be brown.
1029+Retirees who are eligible for such plate s shall provide proof of
1030+eligibility upon init ial application, but shall not be required to
1031+provide proof of eligibility annua lly. The surviving spouse of any
1032+deceased retired officer of the Oklah oma Highway Patrol, if the
1033+spouse has not since remarried, or if remarried, the remarriage is
1034+terminated by death, divorce, or annulment, may apply for a Retired
1035+Oklahoma Highway Patrol Officers license plate. As provided in this

1076+20. Urban Forestry and Beauti fication License Plate – such
1077+plates shall be designed, subject to criteria to b e presented to the
1078+Tax Commission, by the Oklahoma Department of Agricu lture, Food, and
1079+Forestry in consultation with nonprofit or ganizations in this state
1080+that develop and ope rate programs to encourage urban forestry and
1081+beautification, and issued to any person wishing to demonstrate
1082+support of such prog rams. As provided in this section, an amount of
1083+the fee collected shall be appo rtioned as provided in Section 1104.5

1119+22. Adoption Creates Families Licens e Plate – such plates shall
1120+be issued to any person wishing to demonstrate support of pregnant
1121+women who are committed to placing their children for adopt ion and
1122+wishing to provide assistance to guard ians, adoptive parents and
1123+other created families to ass ist in the adoption and placement of
1124+children in permanent, safe homes. T he license plates sha ll be
1125+designed and final terminology delivered in consultat ion with the
1126+Oklahoma Adoption Coalition and t he Department of Human Services.
1127+Twenty-five Dollars ($25.00) of the fee collec ted shall be deposited
1128+in a revolving fund establi shed in the State Tre asury for and to be
1129+used by the Department of Human Service s for the implementation of

1173+25. Lions Club License Plate – such plates shall be designed
1174+and issued to persons wishing to demonstrate support for the Lions
1175+Club of Oklahoma. The plates shall be issued to any person in any
1176+combination of numbers and letters from one to a maximum of seven ,
1177+as for personalized license plates. The lic ense plates shall be
1178+designed in consultation with the O klahoma Lions Service Fo undation
1179+and shall contain the official logo of th e International Assoc iation
1180+of Lions Clubs. The Tax Commission shall be authori zed to enter

1520+Folds of Honor Incorporated of Twenty-five Dollars ($25.00) for each
1521+license plate issued. Subject to the provisions of subsection A of
1522+this section, the Fo lds of Honor Supporter License Plate is hereby
1523+reauthorized effective N ovember 1, 2019;
1524+41. Downed Bikers Association License Pla te - such plates shall
1525+be designed and issued to any person wishing to demonstrate support
1526+for the Downed Bikers Association, a nonprofit charitable
1527+organization exempt from ta xation pursuant to th e provisions of the
1528+Internal Revenue Code, 26 U.S.C., Secti on 501(c)(3), which provides
1529+emotional and financial support for downed bikers. The license
1530+plate shall be designed in consul tation with the Central Oklahoma
1531+Chapter of the Downed Bikers Associati on and shall contain any

1568+(ABATE), and issued to any honorably discharged former member of the
1569+United States Armed Forces wishing to demonstrate support for the
1570+45th Infantry Division M useum. Persons applying for such license
1571+plate must show proof of past military service. As provided in this
1572+section, a portion of the fee collected shall be d eposited in the
1573+45th Infantry Division Museum Fund created in Section 235. 1 of Title
1574+44 of the Oklahoma Statutes;
1575+43. Buffalo Soldier License Plate - such plates shall be issued
1576+to any person wishing to honor and celebrate the history and
1577+contribution of the Buffalo Soldiers. T he license plates shall be
1578+designed in consultatio n with the Lawton-Fort Sill Chapter of the
1579+Buffalo Soldiers 9th and 10th (Horse) Cavalry Association. As

1617+45. Oklahoma State Capitol Restor ation License Plate - such
1618+plates shall be designed and issued to any person wis hing to
1619+demonstrate support for restoration of the Oklahoma State Capitol
1620+building. The license plate s shall be designed in c onsultation with
1621+the Friends of the Capitol corpor ation, created pursua nt to Section
1622+15.4 of Title 73 of the Oklahoma Statutes and the State Capitol
1623+Preservation Commission cre ated pursuant to Section 4102 of Title 74
